IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Niji Vishwavidyalay (Nauvaan Sanshodhan) Adhyadesh, 2024 (Uttar Pradesh Adhyadesh Sankhya 18 of 2024) promulgated by the Governor. Uchcha Shiksha Anubhag-1 is administratively concerned with the said Ordinance.
THE UTTAR PRADESH PRIVATE UNIVERSITIES (NINTH AMENDMENT)
ORDINANCE, 2024

[Promulgated by the Governor in the Seventy-fifth Year of the Republic of India]
AN
ORDINANCE
further to amend the Uttar Pradesh Private Universities Act, 2019.
WHEREAS the State Legislature is not in session and the Governor is satisfied
that circumstances exist which render it necessary for him to take immediate action;
NOW, THEREFORE, in exercise of the powers conferred by clause (1) of
Article 213 of the Constitution of India, the Governor is pleased to promulgate the
following Ordinance:–
1. (1) This Ordinance may be called the Uttar Pradesh Private Universities Short title and Commencement (Ninth Amendment) Ordinance, 2024.
(2) It shall come into force on the date of its publication in the Gazette.
Amendment of 2. In the Uttar Pradesh Private Universities Act, 2019, hereinafter referred to
section 2 of
as the principal Act, in clause (aa) of section 2, after sub-clause (iii), the
U.P. Act no. 12 following sub-clause shall be inserted, namely:-

"(iv) a society or public trust or company registered under an Act of other
states."
Amendment of 3. In the principal Act, in section 7(A), the following proviso shall be
section 7(A) inserted at the end, namely :
"Provided that, acting under the provisions of the University Grants
Commission (Establishment and Operation of Campuses of Foreign Higher
Educational Institutions in India) Regulations, 2023, the foreign higher educational
institution may establish 'campus' in the State. The provisions of the above
mentioned regulation shall be complied with by the foreign higher education

4. (1) The State Government may, for the purpose of removing any

difficulty in respect of the provisions made by this Ordinance, by order published in
the Gazette, direct that the provisions of the principal Act shall during such period, as difficulties
may be specified in the order, have effect subject to such adaptations, whether by
way of modification, addition or omission, as it may deem necessary or expedient:
Provided that no such order shall be made after two years from the date of
commencement of this Ordinance.
(2) Every order made under sub-section (1) shall be laid before both Houses
of the State Legislature as soon as may be after it is made.
