IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 1925/XXIX-6–2024-135 Sa-2015, dated November 26, 2024:

WHEREAS the Government of India, Ministry of Consumer Affairs, Food and Public Distribution (Department of Food and Public Distribution) in exercise of powers conferred by section 3 of the Essential Commodities Act, 1955 (Act no. 10 of 1955) has issued Targeted Public Distribution System (Control) Order, 2015, vide GSR 213(E) dated 20th March, 2015;
AND WHEREAS in pursuance of clauses 4, 9, 10, 11 and 12 of the Targeted Public Distribution System (Control) Order, 2015, the State Government is empowered to issue Order under section 3 of the aforesaid Act for regulating Ration Cards, licensing and regulation of fair price shops, operation and monitoring of fair price shops, ensuring transparency and accountability and for matters connected therewith and incidental thereto;

GSR-213(E) dated 20th March, 2015 of the Government of India, Ministry of Consumer Affairs, Food and Public Distribution (Department of Food and Public Distribution) and Section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor is pleased to make the following Order with a view to amend the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016, namely :-
THE UTTAR PRADESH ESSENTIAL COMMODITIES (REGULATION OF SALE AND
DISTRIBUTION CONTROL) (THIRD AMENDMENT) ORDER, 2024
Short title,
1.(1) This Order may be called the Uttar Pradesh Essential Commodities
(Regulation of Sale and Distribution Control) (Third Amendment) Order, 2024.
extent and commencement (2) It shall extend to the whole of the State of Uttar Pradesh.
(3) It shall come into force with effect from the date of its publication in the
official Gazette.
Amendment of
clause 8
2. In the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016 for the existing sub-clause (4) (iii) of clause 8 set out in Column-I below, the sub-clause as set out in Column-II shall be substituted, namely:-

| 8 (4) (iii) maintenance of the records of ration card holders, e.g. stock register, issue or sale register shall be in the form prescribed by the State Government including in the electronic format in a progressive manner; | 8 (4) (iii) fair price shop owner shall ensure the maintenance of stock register. Apart from the above, in exceptional and unavoidable situations, after the approval of the District Magistrate, the maintenance of issue or sales register prepared in support of manual distribution (without e-POS machine) shall be ensured on the format prescribed by the Food Officer (which also includes electronic format in progressive manner); |
