2 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024"(छ) "ऊजा(cid:330) लेखा" का ता(cid:797)पय(cid:330) रा(cid:475) भार पारे षण क(cid:336) (cid:363) (cid:554)ारा सभी अंत(िcid:354)(cid:330) याबिंदुओं (अथा(cid:330)त उ(cid:523)ादन - संचरण / वितरण, संचरण - वितरण और संचरण / वितरण - निबा(cid:330)ध उपगम उपभो(cid:389)ा) पर तैयार किया गया ऊजा(cid:330) लेखा(एं ) है और इसम(cid:336) वितरण (cid:366)णालि(यों) के साथ या उसके बिना संचरण (cid:366)णालि(यों) के उपयोग के मामले म(cid:336) डीएसएम लेखा(ओं), (cid:366)ति(िcid:354)याशील ऊजा(cid:330) (cid:366)भार लेखा(ओं) और आयोग (cid:554)ारा अधिसूचित कोई अ(cid:586) लेखाओं, जैसा भी लागू हो,शामिल होगा:
पर(cid:802)तु यह कि वितरण लाइस(cid:336)सधारी को ऐसा लेखा(एं ) तैयार करने होंगे, यदि अत:(cid:407)ेपण और निकासी दोनों बिंदु संचरण (cid:366)णाली के उपयोग के बिना के वल उसकी वितरण (cid:366)णाली के भीतर (cid:304)(cid:830)थत हों;"
2.6 तीन नए उप-खंडों, अथा(cid:330)त्, खंड (छ-i), खंड (छ-ii) और खंड (छ-iii) को मूल विनियमावली के विनियम 2.4 के खंड (छ) के बाद नीचे बताए अनुसार जोड़ा जाएगा:
"(छ-i) "ह(cid:303)रत ऊजा(cid:330)" / "नवीकरणीय ऊजा(cid:330)" का ता(cid:797)पय(cid:330) है जलविद् युत और भंडारण (यदि भंडारण नवीकरणीय ऊजा(cid:330) का उपयोग करता है) या किसी अ(cid:586) (cid:366)ौ(cid:552)ोगिकी/(cid:375)ोत सहित ऊजा(cid:330) के नवीकरणीय (cid:375)ोतों से विद् युत ऊजा(cid:330), जिसे भारत सरकार (cid:554)ारा समय-समय पर अधिसूचित किया जाता है और इसम(cid:336) ह(cid:303)रत हाइड(cid:332) ोजन या ह(cid:303)रत अमोनिया के उ(cid:523)ादन सहित जीवा(cid:691) ईंधन को बदलने के लिए ह(cid:303)रत ऊजा(cid:330) का उपयोग करने वाला कोई भी तं(cid:361) भी शामिल होगा;"
"(छ-ii) "ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम" या "जीईओए" का ता(cid:797)पय(cid:330) है सौ (100) किलोवाट और उससे अधिक के अनुबंधित भार/(cid:738)ीकृ त भार वाले ह(cid:303)रत ऊजा(cid:330) उपभो(cid:389)ा(ओं) के लिए एकल कने(cid:405)न के मा(cid:559)म से निबा(cid:330)ध उपगम या सौ (100) किलोवाट और उससे अधिक के समेकित अनुबंधित भार/(cid:738)ीकृ त भार वाले ह(cid:303)रत ऊजा(cid:330) उपभो(cid:389)ा(ओं) के लिए किसी वितरण लाइस(cid:336)सधारी के एक ही विद् युत खंड म(cid:336) (cid:304)(cid:830)थत एक ही नाम म(cid:336) एक ही खुदरा (cid:373)ेणी वाले एक (cid:366)मुख जीईओए उपभो(cid:389)ा के मा(cid:559)म से निबा(cid:330)ध उपगम, इन विनियमावली म(cid:336) निदि(cid:330)(cid:700) तकनीकी/प(cid:303)रचालन अपे(cid:407)ा की पूति(cid:330) और यूपीईजीसी/आईईजीसी के अनुसार वियोजनवाली अधियाचनाओं और अनुसूचियों के अधीन और अभि(cid:681)(cid:304)(cid:389) "ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम वाले उपभो(cid:389)ा(ओं)" या "जीईओए उपभो(cid:389)ा(ओं)" का तदनुसार ता(cid:797)पय(cid:330) लगाया जाएगा:
पर(cid:802)तु यह कि किसी वितरण लाइस(cid:336)सधारी के एक ही विद् युत खंड म(cid:336) (cid:304)(cid:830)थत सौ (100) किलोवाट से कम अनुबंधित भार/(cid:738)ीकृ त भार वाले कई कने(cid:405)नों के मामले म(cid:336), जिनका कु ल अनुबंधित भार/(cid:738)ीकृ त भार सौ (100) किलोवाट और उससे अधिक लेकिन दो सौ (200) किलोवाट से अधिक नहीं है, लीड जीईओए उपभो(cid:389)ा के मा(cid:559)म से ऐसे ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम का लाभ उठाने के लिए एक ही नाम के तहत एक ही खुदरा (cid:373)ेणी का कोई (cid:366)तिबंध नहीं होगा:
पर(cid:802)तु यह भी कि ह(cid:303)रत ऊजा(cid:330) का लाभ उठाने वाले वशवत(cid:334) (cid:366)यो(cid:779)ता के मामले म(cid:336), ऐसी कोई भार सीमा नहीं होगी और यह यूपीईजीसी/आईईजीसी के अनुसार वियोजनवाली अधियाचनाओं और अनुसूचियों की पूति(cid:330) के अधीन होगी और ऐसा निबा(cid:330)ध उपगम इन विनियमावली म(cid:336) निदि(cid:330)(cid:700) तकनीकी/प(cid:303)रचालन अपे(cid:407)ाओं की पूति(cid:330) के अधीन होगा:
पर(cid:802)तु यह भी कि विद् युत खंड के आधार पर उपयु (cid:330)(cid:779)त लाइस(cid:336)स (cid:407)े(cid:361) (cid:366)तिबंध प(िcid:686)मांचल विद् युत वितरण निगम लिमिटेड, द(िcid:407)णांचल विद् युत वितरण निगम लिमिटेड, म(cid:559)ांचल विद् युत वितरण निगम लिमिटेड, पूवा(cid:333)चल विद् युत वितरण निगम लिमिटेड एवं कानपुर विद् युत आपूति(cid:330) कं पनी लिमिटेड तथा उनकी उ(cid:517)रवत(cid:334) सं(cid:830)थाओं पर ही लागू होगा तथा अ(cid:586) सभी वितरण लाइस(cid:336)सधा(cid:303)रयों के लिए सुविवेचित वाला (cid:407)े(cid:361) स(cid:636)ूण(cid:330) लाइस(cid:336)स (cid:407)े(cid:361) होगा;"
"(छ-iii) "जीईओए नियम" का ता(cid:797)पय(cid:330) है विद् युत (ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम के मा(cid:559)म से नवीकरणीय ऊजा(cid:330) को बढ़ावा देना) नियमावली, 2022 और उसके संशोधन;"
2.7 मूल विनियमावली के विनियम 2.4 का खंड (ज) हटा दिया जाएगा। 2.8 एक नया खंड, अथा(cid:330)त्, खंड (ज-i) मूल विनियमावली के विनियम 2.4 के खंड (ज) के बाद नि(cid:635)ानुसार जोड़ा जाएगा:
"(ज-i) "अ(cid:356)णी जीईओए उपभो(cid:389)ा" का ता(cid:523)य(cid:330) जीईओए उपभो(cid:389)ाओं के बीच नामित अधिकृ त (cid:366)तिनिधि से है जो इन विनियमावली के अनुसार वितरण लाइस(cid:336)सधारी के एक ही विद् युत खंड म(cid:336) (cid:304)(cid:830)थत कई कने(cid:405)नों के मा(cid:559)म से सौ (100) किलोवाट और उससे अधिक के अनुबंधित भार / (cid:738)ीकृ त सम(cid:356)भार को ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम (cid:366)ा(cid:593) करने के मामले म(cid:336) उनकी ओर से सम(cid:587)य अभिकरण के (cid:349)प म(cid:336) काय(cid:330) करे गा।;"
2.9 मूल विनियमावली के विनियम 2.4 के खंड(झ) के अंत म(cid:336) श(cid:616) "कि(cid:566)ु 25 वष(cid:330) से अधिक नहीं" जोड़े जाएं गे।
2.10 मूल विनियमावली के विनियम 2.4 के खंड (ञ) म(cid:336) "3 महीने से अधिक लेकिन 5 वष(cid:330) से अधिक नहीं" श(cid:616)ों को "11 महीने से अधिक लेकिन 3 वष(cid:330) से अधिक नहीं" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
2.11 मूल विनियमावली के विनियम 2.4 के खंड (ड), खंड (त) और खंड (थ) हटा दिए जाएं गे। 2.12 मूल विनियमावली के विनियम 2.4 के खंड (ढ) के उप-खंड (iii) म(cid:336) चार नए (cid:366)ावधानों को नि(cid:635)ानुसार जोड़ा जाएगा:
"पर(cid:802)तु यह कि जिनजीईओए उपभो(cid:389)ा(ओं) ने इन विनियमावली म(cid:336) निदि(cid:330)(cid:700) तकनीकी / प(cid:303)रचालन अपे(cid:407)ाओं की पूति(cid:330) और यूपीईजीसी / आईईजीसी के अनुसार वियोजनवाली अधियाचनाओं और अनुसूचियों के अधीन एकल कने(cid:405)न के mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 3 मा(cid:559)म से वितरण लाइस(cid:336)सधारी के एक ही बिजली खंड म(cid:336) (cid:304)(cid:830)थत एक ही नाम म(cid:336) एक ही खुदरा (cid:373)ेणी वाले कई कने(cid:405)नों के मा(cid:559)म से सौ (100) किलोवाट और उससे अधिक का समेकित अनुबंधित भार/(cid:738)ीकृ त भार (cid:366)ा(cid:593) किया हो:

पर(cid:802)तु यह भी कि विद् युत खंड के आधार पर उपयु (cid:330)(cid:779)त लाइस(cid:336)स (cid:407)े(cid:361) (cid:366)तिबंध प(िcid:686)मांचल विद् युत वितरण निगम लिमिटेड, द(िcid:407)णांचल विद् युत वितरण निगम लिमिटेड, म(cid:559)ांचल विद् युत वितरण निगम लिमिटेड, पूवा(cid:333)चल विद् युत वितरण निगम लिमिटेड एवं कानपुर विद् युत आपूति(cid:330) कं पनी लिमिटेड तथा उनकी उ(cid:517)रवत(cid:334) सं(cid:830)थाओं पर ही लागू होगा तथा अ(cid:586) सभी वितरण लाइस(cid:336)सधा(cid:303)रयों के लिए विवेचित (cid:407)े(cid:361) स(cid:636)ूण(cid:330) लाइस(cid:336)स (cid:407)े(cid:361) होगा।"
2.13 मूल विनियमावली के विनियम 2.4 के खंड (ण) म(cid:336) श(cid:616)ों "(ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम सहित)" को "वह (cid:681)(cid:304)(cid:389) जो निबा(cid:330)ध उपगम के मा(cid:559)म से बिजली का उपभोग करता है" के बाद और "किसी (cid:681)(cid:304)(cid:389) से" श(cid:616)ों से पहले जोड़ा जाएगा।
2.14 "3 महीने" श(cid:813)दों को मूल विनियमावली के विनियम 2.4 के खंड (द) म(cid:336) "11 महीने" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
2.15 दो नए खंडों, अथा(cid:330)त्, खंड (फ) और खंड (ब) को मूल विनियमावली के विनियम 2.4 के खंड (प) के बाद नि(cid:635)ानुसार जोड़ा जाएगा:
"(फ) "यूपीएसएलडीसी रजि(cid:720)(cid:332) ी" या "यूपीएसएलडीसी-आर" का ता(cid:523)य(cid:330) इन विनियमावली की अनुसूची-ख के विनियम 1क के अंतग(cid:330)त निदि(cid:330)(cid:700) रजि(cid:720)(cid:332) ी से है;
"(ब) "यूपीएसटीयू रजि(cid:720)(cid:332) ी" या "यूपीएसटीयू-आर" का ता(cid:523)य(cid:330) इन विनियमावली की अनुसूची-क के विनियम 1क के अंतग(cid:330)त निदि(cid:330)(cid:700) रजि(cid:720)(cid:332) ी से है;
2.16 श(cid:616) "नियमावली" को मूल विनियमावली के विनियम 2.5 म(cid:336) दो (cid:830)थानों पर "विनियमावली" श(cid:616) से (cid:366)ति(cid:830)थापित किया जाएगा।
3. मूल िविनयमावली के िविनयम 4 म(cid:336) संशोधन:
3.1 मूल विनियमावली के विनियम 4.2 म(cid:336) "5 वष(cid:330) से अधिक" श(cid:616)ों को "5 वष(cid:330) से अधिक कि(cid:566)ु 25 वष(cid:330) से अधिक नहीं" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
3.2 मूल विनियमावली के विनियम 4.3 म(cid:336) "3 महीने से अधिक तथा 5 वष(cid:330) तक" श(cid:616)ों को "11 महीने से अधिक तथा 3 वष(cid:330) तक" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
3.3 मूल विनियमावली के विनियम 4.4 म(cid:336) "3 महीने" श(cid:616)ों को "11 महीने" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
4. मूल िविनयमावली के िविनयम 7 म(cid:336) संशोधन:
4.1 मूल विनियमावली के विनियम 7.1 म(cid:336) तथा विनियम 7.3 के खंड (ग) म(cid:336) चार नए (cid:366)ावधानों को नि(cid:635)ानुसार जोड़ा जाएगा:
"पर(cid:802)तु यह कि जीईओए उपभो(cid:389)ा (उपभो(cid:389)ाओं) ने इन विनियमावली म(cid:336) निदि(cid:330)(cid:700) तकनीकी / प(cid:303)रचालन अपे(cid:407)ाओं की पूति(cid:330) और यूपीईजीसी / आईईजीसी के अनुसार वियोजनवाली अधियाचनाओं और अनुसूचियों के अधीन एकल कने(cid:405)न के मा(cid:559)म से सौ (100) किलोवाट और उससे अधिक का अनुबंधित भार / (cid:738)ीकृ त भार या एक (cid:366)मुख जीईओए उपभो(cid:389)ा के मा(cid:559)म से वितरण लाइस(cid:336)सधारी के एक ही बिजली डिवीज़न म(cid:336) (cid:304)(cid:830)थत एक ही नाम म(cid:336) एक ही खुदरा (cid:373)ेणी वाले कई कने(cid:405)नों के मा(cid:559)म से सौ (100) किलोवाट और उससे अधिक का समेकित अनुबंधित भार/(cid:738)ीकृ त भार (cid:366)ा(cid:593) किया हो:

पर(cid:802)तु यह भी कि विद् युत खंड के आधार पर उपयु (cid:330)(cid:779)त लाइस(cid:336)स (cid:407)े(cid:361) (cid:366)तिबंध प(िcid:686)मांचल विद् युत वितरण निगम लिमिटेड, द(िcid:407)णांचल विद् युत वितरण निगम लिमिटेड, म(cid:559)ांचल विद् युत वितरण निगम लिमिटेड, पूवा(cid:333)चल विद् युत वितरण निगम लिमिटेड एवं कानपुर विद् युत आपूति(cid:330) कं पनी लिमिटेड तथा उनकी उ(cid:517)रवत(cid:334) सं(cid:830)थाओं पर ही लागू होगा तथा अ(cid:586) 4 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 4.2 मूल विनियमावली के विनियम 7.3 के (cid:366)थमपरं तुक म(cid:336) दो (cid:830)थानों पर "अ(cid:586) (cid:366)भार" श(cid:616)ों को "अ(cid:586) शु(cid:821)क और (cid:366)भार" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
4.3 विनियम 7.3 के (cid:366)थम परं तुक के बाद नि(cid:635)ानुसार दो नए (cid:366)ावधान जोड़े जाएं गे: "परं तु यह भी कि गैर-जीवा(cid:691) ईंधन आधा(cid:303)रत अपशि(cid:700)-से-ऊजा(cid:330) संयं(cid:361) से उ(cid:523)ादित बिजली की आपूति(cid:330) जीईओए उपभो(cid:389)ा को किए जाने की (cid:304)(cid:830)थति म(cid:336) (cid:366)ति-राजसहायता अधिभार और अति(cid:303)र(cid:389) अधिभार लागू नहीं होगा:
परं तु यह भी कि यदि ह(cid:303)रत ऊजा(cid:330) का उपयोग ह(cid:303)रत हाइड(cid:332) ोजन और ह(cid:303)रत अमोनिया के उ(cid:523)ादन के लिए किया जाता है तो (cid:366)ति-राजसहायता अधिभार और अति(cid:303)र(cid:389) अधिभार लागू नहीं होगा:"
4.4 मूल विनियमावली के विनियम 7.3 के चतुथ(cid:330) परं तुक म(cid:336) "1 मेगावाट या उससे अधिक की अनुबंधित मांग वाले उपभो(cid:389)ा" श(cid:616)ों को "निबा(cid:330)ध उपगम उपभो(cid:389)ा" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
4.5 मूल विनियमावली के विनियम 7.3 का स(cid:593)म परं तुक नीचे बताए अनुसार (cid:366)ति(cid:830)थापित किया जाएगा: "पर(cid:802)तु यह कि निबा(cid:330)ध उपगम (cid:366)दान करने से पहले, उपभो(cid:389)ा को यूपीईआरसी (अंतर-रा(cid:475)ीय पारे षण (cid:366)णाली को संयोजकता (cid:366)दान करना) विनियम, 2010 के अनुसार संयोजन समझौता करना होगा, जबकि ऐसे उपभो(cid:389)ा के मामले म(cid:336) जो वितरण लाइस(cid:336)सधारी की (cid:366)णाली से जुड़ा है, संयोजन समझौता, वितरण लाइस(cid:336)सधारी के परामश(cid:330) से उपयु(cid:389) संशोधन को शामिल करते (cid:352)ए, अंतर-रा(cid:475)ीय पारे षण (cid:366)णाली के साथ वत(cid:330)मान (cid:366)तिमान संयोजन समझौते के अनु(cid:349)प, जैसा भी मामला हो, होना चाहिए:"
4.6 मूल विनियमावली का विनियम 7.2 नीचे बताए अनुसार (cid:366)ति(cid:830)थापित किया जाएगा: "(cid:738)तं(cid:361) फीडर के मा(cid:559)म से आपूति(cid:330) किए जाने वाले निबा(cid:330)ध उपगम उपभो(cid:389)ा के मामले म(cid:336), निबा(cid:330)ध उपगम और वितरण लाइस(cid:336)सधारी से कु ल निकासी आपूति(cid:330) संहिता के तहत निदि(cid:330)(cid:700) वो(cid:656)ेज (cid:721)र के लिए लागू निकासी की अधिकतम सीमा तक सीमित होगी, जिससे निबा(cid:330)ध उपगम उपभो(cid:389)ा जुड़ा (cid:352)आ है। ऐसी अधिकतम सीमा के किसी भी उ(cid:671)ंघन के मामले म(cid:336) नोडल अभिकरण (cid:554)ारा उचित समझी जाने वाली दंडा(cid:527)क कार(cid:330) वाई की जाएगी, जिसम(cid:336) (cid:366)(cid:529)ेक उ(cid:671)ंघन के लिए तीन महीने के लिए निबा(cid:330)ध उपगम को निलंबित करना भी शामिल होगा। तीन बार से अधिक बार उ(cid:671)ंघन दोहराए जाने की (cid:304)(cid:830)थति म(cid:336) निबा(cid:330)ध उपगम को तब तक के लिए निलंबित कर दिया जाएगा जब तक कि निबा(cid:330)ध उपगम उपभो(cid:389)ा आपूति(cid:330) कोड के अनुसार अगले उपयु(cid:389) वो(cid:656)ेज (cid:721)र पर (cid:830)थानांत(cid:303)रत नही ं हो जाता।
जबकि निबा(cid:330)ध उपगम उपभो(cid:389)ा के मामले म(cid:336), यदि उसे मि(िcid:373)त फीडर के मा(cid:559)म से बिजली दी जाती है, तो निबा(cid:330)ध उपगम उपभो(cid:389)ा को निबा(cid:330)ध उपगम और वितरण लाइस(cid:336)सधारी से अपनी कु ल निकासी की राशि को वितरण लाइस(cid:336)सधारी के साथ अनुबंधित (cid:407)मता तक ही सीमित रखना होगा। ऐसी अधिकतम सीमा के किसी भी उ(cid:671)ंघन की (cid:304)(cid:830)थति म(cid:336) वितरण लाइस(cid:336)सधारी (cid:554)ारा उचित समझी जाने वाली दंडा(cid:527)क कार(cid:330) वाई की जाएगी, जिसम(cid:336) नोडल अभिकरण (cid:554)ारा (cid:366)(cid:529)ेक उ(cid:671)ंघन के लिए तीन महीने के लिए निबा(cid:330)ध उपगम को निलंबित करना भी शामिल है। तीन बार से अधिक बार उ(cid:671)ंघन दोहराए जाने की (cid:304)(cid:830)थति म(cid:336) निबा(cid:330)ध उपगम को तब तकके लिए निलंबित कर दिया जाएगा जब तक कि निबा(cid:330)ध उपगम उपभो(cid:389)ा आपूति(cid:330) संहिता के अनुसार वितरण लाइस(cid:336)सधारी के साथ अनुबंधित (cid:407)मता नहीं बढ़ा लेता।
5. मूल िविनयमावली के िविनयम 14 म(cid:336) संशोधन:
5.1 मूल विनियमावली के विनियम 14 का (िcid:554)तीय परं तुक नि(cid:635)ानुसार (cid:366)ति(cid:830)थापित किया जाएगा: "परं तु यह भी कि अ(cid:665)कालिक निबा(cid:330)ध उपगम वाले (cid:356)ाहकों के लिए, इन विनियमावली के अंतग(cid:330)त की गई या की जाने वाली या किए जाने का दावा की गई कोई भी बात, (cid:356)ाहक (cid:554)ारा एसएलडीसी, एसटीयू या किसी अ(cid:586) संचरण लाइस(cid:336)सधारी, वितरण लाइस(cid:336)सधारी या निबा(cid:330)ध उपगम वाले सं(cid:826)यवहार से संबंधित किसी अ(cid:586) (cid:681)(cid:304)(cid:389) के साथ किया गया समझौता (लि(cid:304)खत या निहित) माना जाएगा।"
6. मूल िविनयमावली के िविनयम 15 म(cid:336) संशोधन:
6.1 मूल विनियमावली के विनियम 15.3 का (िcid:554)तीय परं तुक हटा दिया जाएगा। 6.2 श(cid:616) "उपांत" को मूल विनियमावली के विनियम 15.4 म(cid:336) पांच (cid:830)थानों पर "निबा(cid:330)ध उपगम" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
6.3 मूल विनियमावली के विनियम 15.4 म(cid:336) एक नया खंड (ix) नि(cid:635)ानुसार जोड़ा जाएगा: "(ix) विनियम 15.4 के तहत निबा(cid:330)ध उपगम (cid:407)मता के कम उपयोग के कारण कटौती या निर(cid:721)ीकरण के मामले म(cid:336), निबा(cid:330)ध उपगम वाले (cid:356)ाहक को सं(cid:826)यवहार की शेष अवधि के दौरान संशोधित (cid:407)मता पर पूण(cid:330) निबा(cid:330)ध उपगम (cid:366)भार के अलावा कटौती या निर(cid:721)ीकरण की ऐसी अवधि के लिए लागू निबा(cid:330)ध उपगम (cid:366)भार का 50% भुगतान करना होगा।"
6.4 मूल विनियमावली का विनियम 15.7 नीचे बताए अनुसार (cid:366)ति(cid:830)थापित किया जाएगा: "दीघा(cid:330)वधि एवं म(cid:559)म अवधि दोनों (cid:366)कार की निबा(cid:330)ध उपगम के मामले म(cid:336) शु(cid:544) वत(cid:330)मान मू(cid:670) की गणना के लिए लागू छू ट दर, सीईआरसी (cid:554)ारा समय-समय पर निदि(cid:330)(cid:700) पुराने मानक बोली द(cid:721)ावेजों (एसबीडी) और दिशानिद(cid:337)शों के आधार पर प(cid:303)रयोजनाओं के लिए बोली मू(cid:670)ांकन के उ(cid:542)े(cid:692) से (cid:721)रीकृ त संचरण (cid:366)भार की गणना के लिए छू ट दर होगी।"
6.5 श(cid:616) "संचरण" को मूल विनियमावली के विनियम 15.9 म(cid:336) दो (cid:830)थानों पर "संचरण/(cid:826)हीलिंग" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
6.6 मूल विनियमावली का विनियम 15.10 हटा दिया जाएगा।

7.1 मूल विनियमावली के विनियम 18.1 म(cid:336) दो नए परं तुक नि(cid:635)ानुसार जोड़े जाएं गे: "पर(cid:802)तु यह कि जीईओए उपभो(cid:389)ा के लिए अति(cid:303)र(cid:389) अधिभार लागू नही ं होगा, यदि ऐसे उपभो(cid:389)ा (cid:554)ारा निधा(cid:330)(cid:303)रत (cid:366)भार का भुगतान किया जा रहा है:
परं तु यह भी कि अपतटीय पवन प(cid:303)रयोजनाओं से उ(cid:523)ादित बिजली के मामले म(cid:336) अति(cid:303)र(cid:389) अधिभार लागू नही ं होगा, जो दिसंबर, 2032 तक चालू हो जाती है और जीईओए उपभो(cid:389)ा को आपूति(cid:330) की जाती है।
8. मूल िविनयमावली के िविनयम 20 म(cid:336) संशोधन:
8.1 मूल विनियमावली के विनियम 20.1 का (िcid:554)तीय परं तुक नि(cid:635)ानुसार (cid:366)ति(cid:830)थापित किया जाएगा: "परं तु यह भी कि किसी अ(cid:586) (cid:375)ोत से अति(cid:303)र(cid:389) बिजली की (cid:681)व(cid:830)था (cid:366)ासंगिक (िcid:356)ड संहिता/विनियमावली के (cid:366)ावधानों के अनुसार की जाएगी।"
8.2 मूल विनियमावली के विनियम 20.2 के खंड (ii) म(cid:336) "एक वष(cid:330) म(cid:336) 60 दिन" श(cid:616)ों को "एक वि(cid:517)ीय वष(cid:330) म(cid:336) 60 दिन" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
8.3 "1.5 गुना" श(cid:813)दों को मूल विनियमावली के विनियम 20.2 के खंड (ii) म(cid:336) "1.25 गुना" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
8.4 मूल विनियमावली के विनियम 20.2 के बाद एक नया विनियम, अथा(cid:330)त्, विनियम 20.3 नि(cid:635)ानुसार जोड़ा जाएगा।
"20.3 इस विनियमावली के (cid:366)योजनों के लिए, "वैक(cid:304)(cid:665)क (cid:366)भार" से ता(cid:523)य(cid:330) आपूति(cid:330) (cid:407)े(cid:361) के वितरण लाइस(cid:336)सधारी (cid:554)ारा (cid:366)दान की गई वैक(cid:304)(cid:665)क (cid:681)व(cid:830)था के लिए पूण(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ाओं पर लागू (cid:366)भार से है, यदि निबा(cid:330)ध उपगम उपभो(cid:389)ा जनरे टर, संचरण प(cid:303)रसंप(िcid:517)यों और इसी तरह के अ(cid:586) मामलों म(cid:336) (cid:681)वधान के कारण उन उ(cid:523)ादक (cid:375)ोतों से विद् युत (cid:366)ा(cid:593) करने/निधा(cid:330)(cid:303)रत करने म(cid:336) असमथ(cid:330) है जिनके साथ उनका विद् युत (cid:366)ा(cid:593) करने का अनुबंध है। ऐसे उपभो(cid:389)ाओं के लिए वैक(cid:304)(cid:665)क (cid:681)व(cid:830)था बनाए रखने के लिए ऐसे वैक(cid:304)(cid:665)क (cid:366)भार, इन सहायक सेवाओं को (cid:366)दान करने के लिए वितरण लाइस(cid:336)सधारी (cid:554)ारा किए गए खच(cid:330) को (cid:366)तिबिंबित करने चाहिए।"
9. मूल िविनयमावली के िविनयम 21 म(cid:336) संशोधन:
9.1 मूल विनियमावली के विनियम 21 के शीष(cid:330)क म(cid:336), श(cid:616) "असंतुलन (cid:366)भार" श(cid:616)ों को "विचलन (cid:366)भार" श(cid:813)दों से (cid:366)ति(cid:830)थापित किया जाएगा।
9.2 मूल विनियमावली का विनियम 21.2 नि(cid:635)ानुसार (cid:366)ति(cid:830)थापित किया जाएगा: "21.2अंतर-रा(cid:475)ीय निबा(cid:330)ध उपगम सं(cid:826)यवहार के संबंध म(cid:336) एसटीयू/डि(cid:715)ॉम से जुड़े जनरे टर (सौर और पवन उ(cid:523)ादन संयं(cid:361) को छोड़कर), वितरण लाइस(cid:336)सधारी और पूण(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ा के अनुसूचित अत:(cid:407)ेपण/निकासी और वा(cid:721)विक अत:(cid:407)ेपण/निकासी के बीच (cid:681)ति(cid:354)म का निपटान क(cid:336) (cid:363)ीय आयोग (cid:554)ारा निदि(cid:330)(cid:700) डीएसएम विनियमावली के अनुसार किया जाएगा।
जबकि, अंतर-रा(cid:475)ीय निबा(cid:330)ध उपगम सं(cid:826)यवहार के संबंध म(cid:336) एसटीयू/डि(cid:715)ॉम से जुड़े ((cid:830)थापित (cid:407)मता सेनिरपे(cid:407)) सौर और पवन उ(cid:523)ादन संयं(cid:361) के अनुसूचित अत:(cid:407)ेपण और वा(cid:721)विक अत:(cid:407)ेपण के बीच (cid:681)ति(cid:354)म का निपटान यूपीईआरसी (सौर और पवन उ(cid:523)ादन (cid:375)ोतों के पूवा(cid:330)नुमान, समय-निधा(cid:330)रण, (cid:681)ति(cid:354)म निपटान और संबंधित मामले) विनियमावली, 2018 और उसके संशोधनों के अनुसार किया जाएगा।
10. मूल िविनयमावली के िविनयम 27 म(cid:336) संशोधन:
10.1 मूल विनियमावली के विनियम 27.1 म(cid:336) एक नया परं तुक नि(cid:635)ानुसार जोड़ा जाएगा: "पर(cid:802)तु यह कि यदि अत:(cid:407)ेपण और निकासी दोनों बिंदु, संचरण (cid:366)णाली के उपयोग के बिना वितरण (cid:366)णाली के भीतर (cid:304)(cid:830)थत ह(cid:339), तो वितरण लाइस(cid:336)सधारी, यूपीईजीसी/आईईजीसी या लागू विनियमावली के (cid:366)ावधानों के अनु(cid:349)प, यदि लागू हो, अत:(cid:407)ेपण और निकासी बिंदु पर ऐसी बिजली के अनुसूचीयन और पारे षण के लिए उ(cid:517)रदायी होगा।
10.2 मूल विनियमावली का विनियम 27.2 नीचे बताए अनुसार (cid:366)ति(cid:830)थापित किया जाएगा: "27.2 निबा(cid:330)ध उपगम सं(cid:826)यवहार इन विनियमावली के (cid:366)ावधानों के अनुसार और अनुसूचीयन, पारे षण, ऊजा(cid:330) लेखांकन, डीएसएम और निबा(cid:330)ध उपगम सं(cid:826)यवहार के निपटान की (cid:366)(िcid:354)याओं के अनुसार यूपीईजीसी/आईईजीसी या लागू विनियमावली के अनुसार किया जाएगा।"
11. मूल िविनयमावली के िविनयम 28 म(cid:336) संशोधन:
11.1 मूल विनियमावली के विनियम 28 के शीष(cid:330)क म(cid:336), "िनबा(cid:330)ध उपगम के मामले म(cid:336) लेखांकन" श(cid:616)ों को "आंिशक िनबा(cid:330)ध उपगम के मामले म(cid:336) लेखांकन" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
12. मूल िविनयमावली के िविनयम 29 म(cid:336) संशोधन:
12.1 मूल विनियमावली का विनियम 29 नि(cid:635)ानुसार (cid:366)ति(cid:830)थापित किया जाएगा: "29. मीट(cid:303)रंग–
29.1 एएमआर सुविधा के (cid:366)योजन के लिए आव(cid:692)क अति(cid:303)र(cid:389) संचार लिंक, यदि कोई हो, सहित (cid:738)चालित (cid:303)रमोट मीटर रीडिंग (एएमआर) सुविधा के साथ अंत(िcid:354)(cid:330) या ऊजा(cid:330) मीटर (आईईएम) की (cid:830)थापना, संचालन, अंशांकन और रखरखाव सीईए मीट(cid:303)रं ग विनियमावली और सीईए संचार विनियमावली के अनुसार होगा:

29.2 निबा(cid:330)ध उपगम सं(cid:826)यवहार को सुविधाजनक बनाने के लिए उपयु(cid:389) अंतर-संयोजन/अंत(िcid:354)(cid:330) या(cid:527)क बिंदुओं (अत:(cid:407)ेपण और निकासी बिंदु) पर (cid:830)थापित किए जाने वाले मीटरों के लिए विनिद(cid:337)श (cid:366)दान करना एसटीयू का उ(cid:517)रदायि(cid:533) होगा।
29.3 निबा(cid:330)ध उपगम (cid:356)ाहक एसएलडीसी के साथ संचार सुविधाएं (cid:830)थापित करे गा तथा एसएलडीसी (cid:554)ारा निदि(cid:330)(cid:700) (cid:366)ा(cid:349)प म(cid:336) वा(cid:721)विक समय के आधार पर तथा आवधिक आधार पर सूचना उपल(cid:617) कराएगा।
29.4 अंतरा-पृ(cid:829)ठ ऊजा(cid:330) मीटर एसएलडीसी के ऊजा(cid:330) लेखांकन सॉ(cid:605)वेयर के साथ संगत होंगे।
29.5 उ(cid:523)ादन कं पनी या लाइस(cid:336)सधारी, जिसके प(cid:303)रसर म(cid:336) मीटर (cid:830)थापित किया गया है, का यह उ(cid:517)रदायि(cid:533) होगा कि वह मीटर डेटा डाउनलोड करे , मीटर किए गए डेटा को (cid:303)रकॉड(cid:330) करे तथा अपे(cid:407)ानुसार ऐसे डेटा को एसएलडीसी और अ(cid:586) अभिकरणों को उपल(cid:617) कराए। निबा(cid:330)ध उपगम उपभो(cid:389)ा के (cid:721)र पर मीटरों की रीडिंग और (cid:303)रकॉडि(cid:333)ग वितरण लाइस(cid:336)सधारी (cid:554)ारा की जाएगी, जिसके लिए निबा(cid:330)ध उपगम उपभो(cid:389)ा को आव(cid:692)कता पड़ने पर लाइस(cid:336)सधारी के अधिकृ त (cid:366)तिनिधियों को उपगम (cid:366)दान करना होगा:
पर(cid:802)तु यह कि यदि किसी कारणवश एएमआर सुविधा के मा(cid:559)म से रीडिंग (cid:366)ेषित नहीं की गई हो तो मीटर की ह(cid:721)चालित रीडिंग की जाएगी, तथापि, ऐसी (cid:738)चालित (cid:303)रमोट मीटर रीडिंग को उ(cid:523)ादन कं पनी या लाइस(cid:336)सधारी या निबा(cid:330)ध उपगम उपभो(cid:389)ा (cid:554)ारा तुरं त पुन(cid:830)था(cid:330)पित किया जाएगा।
29.6 33 के वी और उससे अधिक वो(cid:656)ेज पर संचरण सि(cid:720)म से सीधे जुड़े निबा(cid:330)ध उपगम उपभो(cid:389)ा की मीट(cid:303)रं ग और लेखा के (cid:366)योजन के लिए, अंतरा-पृ(cid:829)ठ मीटर (मु(cid:421) मीटर, चेक मीटर और वैक(cid:304)(cid:665)क मीटर) का (cid:830)थान यूपीईआरसी (अंतर-रा(cid:475)ीय संचरण सि(cid:720)म को संयोजकता (cid:366)दान करना) विनियम, और उसके संशोधन के अनुसार होगा।
वो(cid:656)ेज 33 किलोवो(cid:821)ट पर अंतरा(cid:475)ीय पारे षण (cid:366)णाली से सीधे जुड़े निबा(cid:330)ध उपगम उपभो(cid:389)ा या वशवत(cid:334) (cid:366)यो(cid:779)ता (cid:554)ारा अंतरा-पृ(cid:829)ठ मीटर (मु(cid:421) मीटर और चेक मीटर) वितरण लाइस(cid:336)सधारी (cid:554)ारा निबा(cid:330)ध उपगम उपभो(cid:389)ा के सिरे या वशवत(cid:334) (cid:366)यो(cid:779)ता के सिरे पर, जैसा भी मामला हो, (cid:830)थापित किए जाएं गे जबकि अंतरा- पृ(cid:829)ठ मीटर (वैक(cid:304)(cid:665)क मीटर) (cid:738)तं(cid:361) फीडर के मामले म(cid:336) पारे षण लाइस(cid:336)सधारी (cid:554)ारा अपने प(cid:303)रसर म(cid:336) या मि(िcid:373)त फीडर के मामले म(cid:336) उपभो(cid:389)ा या वशवत(cid:334) (cid:366)यो(cid:779)ता वितरण लाइस(cid:336)सधारी (cid:554)ारा निबा(cid:330)ध उपगम पर (cid:830)थापित किया जाएगा। इन अंतरा-पृ(cid:829)ठ मीटरों की लागत निबा(cid:330)ध उपगम उपभो(cid:389)ा (cid:554)ारा वहन की जाएगी।
29.7 निबा(cid:330)ध उपगम वाले उपभो(cid:389)ा के पास लाइस(cid:336)सधारी (cid:554)ारा (cid:366)ति(cid:703)ापन के लिए अपने खच(cid:330) पर मीटर (cid:738)यं उपल(cid:617) कराने का विक(cid:665) होगा। एसटीयू अपनी वेबसाइट पर मीटरों और संबंधित उपकरणों के निमा(cid:330)ताओं और विनिद(cid:337)शों की अ(cid:552)तन सूची उपल(cid:617) कराएगा, जैसा कि निबा(cid:330)ध उपगम वाले उपभो(cid:389)ाओं (cid:554)ारा मीटरों की खरीद के लिए एसटीयू (cid:554)ारा अनुमोदित किया गया है।
29.8 एसटीयू और वितरण लाइस(cid:336)सधारी संचरण ज़ोन (cid:721)र और डि(cid:715)ॉम (cid:721)र पर अधिकारी को "नोडल अधिकारी" के (cid:349)प म(cid:336) नामित कर(cid:336) गे, जो अंतरा-पृ(cid:829)ठ मीटरों के आवधिक परी(cid:407)ण, अंशांकन और रखरखाव, एसएलडीसी को मीटड(cid:330) डेटा की समय पर डिलीवरी, एसएलडीसी/अभिकरणों के साथ आव(cid:692)क सम(cid:587)य और अ(cid:586) संबंधित मामलों के लिए जि(cid:643)ेदार होंगे।"
13. मूल िविनयमावली के खंड 31 म(cid:336) संशोधन:
13.1 मूल विनियमावली के विनियम 31.1 म(cid:336), वा(cid:400) "एसएलडीसी को इस विनियमावली की अधिसूचना के 60 दिनों के भीतर उपयु (cid:330)(cid:389) (cid:366)(िcid:354)या (cid:366)(cid:721)ुत करने का निद(cid:337)श दिया जाता है" हटा दिया जाएगा।
13.2 मूल विनियमावली का विनियम 31.2 नि(cid:635)ानुसार (cid:366)ति(cid:830)थापित किया जाएगा: "31.2 एसएलडीसी (cid:554)ारा तैयार ऊजा(cid:330) लेखा(ओं) का उपयोग बिलिंग (cid:366)योजनों के लिए किया जाएगा:
पर(cid:802)तु यह कि एसएलडीसी बिजली के लिए ऊजा(cid:330) लेखा जारी करे गा तथा वितरण लाइस(cid:336)सधारी (cid:554)ारा आपूति(cid:330) की गई ऊजा(cid:330) और मांग का प(cid:303)रमाणन करेगा, यदि निबा(cid:330)ध उपगम उपभो(cid:389)ा को निबा(cid:330)ध उपगम के साथ-साथ वितरण लाइस(cid:336)सधारी से भी बिजली (cid:366)ा(cid:593) होती है। एसएलडीसी (cid:554)ारा (cid:366)ासंगिक माह के लिए तैयार और जारी किए गए ऊजा(cid:330) लेखा के आधार पर, वितरण लाइस(cid:336)सधारी तदनुसार खुदरा टै(cid:303)रफ के नियमों और शत(cid:344) तथा ऐसे निबा(cid:330)ध उपगम उपभो(cid:389)ा पर लागू खुदरा टै(cid:303)रफ आदेश म(cid:336) आयोग (cid:554)ारा निदि(cid:330)(cid:700) दरों के अनुसार निबा(cid:330)ध उपगम उपभो(cid:389)ा को मांग (cid:366)भार और सुर(cid:407)ा(cid:527)क भार (cid:366)भार (जहां भी लागू हो) सहित आपूति(cid:330) की गई बिजली के लिए बिल तैयार करे गा और जारी करे गा।
13.3 मूल विनियमावली के विनियम 31.4 का खंड (iv) हटा दिया जाएगा। 13.4 मूल विनियमावली के विनियम 31.4 के खंड (vii) म(cid:336) "असंतुलन (cid:366)भार" श(cid:813)दों को "विचलन (cid:366)भार" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।

31क-1 लीड जीईओए उपभो(cid:389)ा को जीईओए उपभो(cid:389)ा(ओं) के बीच पार(cid:729)(cid:303)रक (cid:349)प से सहमत नियमों और शत(cid:344) के आधार पर अधिकृ त किया जाएगा। लीड जीईओए उपभो(cid:389)ा संबंधित नोडल अभिकरण के साथ खुद को पंजीकृ त कर(cid:336) गे। लीड जीईओए उपभो(cid:389)ा अपने जीईओए उपभो(cid:389)ा(ओं) की ओर से एसटीयू, एसएलडीसी, किसी अ(cid:586) संचरण लाइस(cid:336)सधारी/वितरण लाइस(cid:336)सधारी और अ(cid:586) अभिकरणों के साथ नि(cid:635)लि(cid:304)खत उ(cid:542)े(cid:692)ों के लिए एकल बिंदु संपक(cid:330) होगा: (i) संबंधित नोडल अभिकरण को अपने जीईओए उपभो(cid:389)ा(ओं) की ओर से लीड जीईओए उपभो(cid:389)ा के (cid:349)प म(cid:336) अपना (cid:366)ाधिकरण (cid:366)(cid:721)ुत करना;
(ii) ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम आवेदन (cid:366)(cid:721)ुत करना; (iii) निकासी अनुसूचियों के लिए एसएलडीसी / वितरण लाइस(cid:336)सधारी के साथ सम(cid:587)य करना; (iv) मीट(cid:303)रं ग, डेटा सं(cid:356)हण/संचरण और वा(cid:721)विक समय डेटा संचार, ऊजा(cid:330) लेखांकन, बिलिंग, भुगतान सुर(cid:407)ा और ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम सं(cid:826)यवहार के निपटान के लिए एसटीयू/एसएलडीसी/ वितरण लाइस(cid:336)सधारी और अ(cid:586) अभिकरणों के साथ सम(cid:587)य करना;
(v) जीईओए उपभो(cid:779)ता(ओं) की ओर से, निबा(cid:330)ध उपगम (cid:366)भारों का वाणि(cid:304)(cid:475)क समझौता करना; (vi) निबा(cid:330)ध उपगम (cid:366)भार / लागू (cid:366)भार भुगतानों के भुगतानों का अ-सं(cid:356)हीकरण करना।
टि(cid:596)णी: "अ-सं(cid:356)हीकरण" का ता(cid:797)पय(cid:330) है जीईओए उपभो(cid:389)ा(ओं) के बीच लागू शु(cid:651)ों का पृथ(cid:383)रण और विभाजन, जो उनके आपसी समझौतों (cid:554)ारा शासित होगा।
(vii) समय-समय पर अनिवाय(cid:330) किए गए अनुसार जीईओए उपभो(cid:389)ा(ओं) की ओर से किसी भी अ(cid:586) (cid:366)भार का वाणि(cid:304)(cid:475)क निपटान करना:
पर(cid:802)तु यह कि (cid:681)(cid:304)(cid:389)गत ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ा(ओं) की समय-निधा(cid:330)रण, मीट(cid:303)रं ग, लेखा, बिलिंग और भुगतान सहित सभी (cid:681)ावहा(cid:303)रक (cid:366)योजनों के लिए, वितरण लाइस(cid:336)सधारी ऐसे ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ाओं के समूह के लिए वेब आधा(cid:303)रत लेखा और बिलिंग/भुगतान (cid:366)णाली (cid:554)ारा समथि(cid:330)त खंड के अंतग(cid:330)त अनेक संयोजनों के अनुबंधित भार/(cid:738)ीकृ त भार के सम(cid:356)ीकरण के लिए एक (cid:366)(िcid:354)या विकसित करे गा।
31क-2 (cid:366)मुख जीईओए उपभो(cid:389)ा के (cid:366)ाधिकरण के बावजूद, उस समूह के (cid:366)(cid:529)ेक जीईओए उपभो(cid:389)ा को प(cid:303)रचालन, वाणि(cid:304)(cid:475)क और निपटान उ(cid:542)े(cid:692)ों के लिए एकल संयोजन के (cid:349)प म(cid:336) माना जाएगा। इन विनियमावली के (cid:366)ासंगिक (cid:366)ावधानों का अनुपालन करने का दायि(cid:533) (cid:366)(cid:529)ेक जीईओए उपभो(cid:389)ा पर होगा, जबकि उनके और उनके (cid:366)मुख जीईओए उपभो(cid:389)ा के बीच वाणि(cid:304)(cid:475)क और अ(cid:586) (cid:681)व(cid:830)थाएं उनके आपसी समझौतों (cid:554)ारा शासित होंगी।"
15. मूल िविनयमावली की अनुसूची-क (दीघ(cid:330)कािलक और म(cid:559)म-कािलक िनबा(cid:330)ध उपगम के िलए (cid:366)ि(cid:354)या) म(cid:336) संशोधन:
15.1 नया िविनयम 1क: यूपीएसटीयू रिज(cid:830)ट(cid:332) ी: एक नया खंड, अथा(cid:330)त् विनियम 1क मूल विनियमावली की अनुसूची-क के विनियम 1 के बाद नि(cid:635)ानुसार जोड़ा जाएगा:
"1क. यूपीएसटीयू रिज(cid:830)ट(cid:332) ी–
1क-1 संयोजन, म(cid:559)म अवधि और दीघ(cid:330)कालिक निबा(cid:330)ध उपगम आवेदनों को एकल गवा(cid:407) एकीकृ त इले(cid:387)(cid:332) ॉनिक (cid:600)ेटफॉम(cid:330), अथा(cid:330)त्, यूपीएसटीयू रजि(cid:720)(cid:332) ी (यूपीएसटीयू-आर) के मा(cid:559)म से लागू और संसाधित किया जाएगा, जो:
(i) संयोजन आवेदनों का अंके (cid:407)णअनुचि(cid:741) (cid:366)दान करे गा;
(ii) म(cid:559)म अवधि और दीघ(cid:330)कालिक निबा(cid:330)ध उपगम आवेदनों का अंके (cid:407)णअनुचि(cid:741) (cid:366)दान करे गा;
(iii) आवेदनों के (cid:366)सं(cid:715)रण/(cid:681)वहाय(cid:330)ता (cid:303)रपोट(cid:330) आदि के स(cid:529)ापन के लिए एसएलडीसी/किसी अ(cid:586) संचरण लाइस(cid:336)सी और वितरण लाइस(cid:336)सधा(cid:303)रयों के सॉ(cid:605)वेयर के साथ एक अंतरा-पृ(cid:829)ठ (cid:366)दान करे गा;
(iv) संयोजन, म(cid:559)म अवधि और दीघ(cid:330)कालिक निबा(cid:330)ध उपगम से संबंधित भुगतान करने के लिए एक भुगतान गेटवे (cid:366)दान करे गा;
(v) एसएलडीसी/किसी अ(cid:586) संचरण लाइस(cid:336)सी और वितरण लाइस(cid:336)सी को वा(cid:721)विक समय की जानकारी के साथ डैश बोड(cid:330) सुविधा (cid:366)दान करे गा और संयोजन, म(cid:559)म अवधि और दीघ(cid:330)कालिक निबा(cid:330)ध उपगम से संबंधित जानकारी के भंडार के (cid:349)प म(cid:336) काय(cid:330) करे गा, जिसम(cid:336) संबंधित लाइस(cid:336)सी (cid:554)ारा जारी (cid:681)वहाय(cid:330)ता (cid:303)रपोट(cid:330), संचरण (cid:366)क(cid:636)ा की उपल(cid:617)ता, लंबित आवेदन और संयोजन, म(cid:559)म अवधि और दीघ(cid:330)कालिक निबा(cid:330)ध उपगम (cid:366)दान की गई और अ(cid:738)ीकृ त की गई जानकारी शामिल है;
(vi) बाज़ार निगरानी और अवे(cid:407)ण के लिए आवधिक (cid:303)रपोट(cid:330) तैयार करने की (cid:826)यव(cid:830)था करे गा;
8 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 (vii) इन विनियमावली के तहत एसटीयू (cid:554)ारा अपे(िcid:407)त संयोजन, म(cid:559)म अवधि और दीघ(cid:330)कालिक निबा(cid:330)धउपगम से संबंधित कि(cid:802)हीं भी अ(cid:586) काय(cid:344) का सुगमीकरण करे गा, और
(viii) आयोग (cid:554)ारा समय-समय पर निद(cid:337)शित कि(cid:802)हीं भी अ(cid:586) काय(cid:344) की (cid:826)यव(cid:830)था करे गा।
1क-2 एसटीयू, यूपीएसटीयू-आर के विकास और रखरखाव के लिए उ(cid:517)रदायी होगा।
15.2 मूल विनियमावली के विनियम 2.1 म(cid:336) दो नए परं तुक नि(cid:635)ानुसार जोड़े जाएं गे: "पर(cid:802)तु यह कि सभी (cid:366)कार से पूण(cid:330) म(cid:559)म अवधि ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम के लिए आवेदन जीओएआर पोट(cid:330)ल पर (cid:366)(cid:721)ुत किया जाएगा और उसे म(cid:559)म अवधि ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम (cid:366)दान करने के लिए एसटीयू को भेजा जाएगा:
पर(cid:802)तु यह कि म(cid:559)म अवधि ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम (cid:366)दान करने के लिए ऐसे आवेदन म(cid:336) (cid:356)ाहक (cid:554)ारा यह घोषणा शामिल होगी कि यूपीईजीसी/आईईजीसी के (cid:366)ावधानों के अनुसार समय-(cid:624)ॉकवार मीट(cid:303)रं ग और लेखा के लिए आव(cid:692)क बुनियादी ढांचा और सीईए संचार विनियमावली के (cid:366)ावधानों के अनुसार उपयु(cid:389) संचार (cid:366)णाली अत:(cid:407)ेपण बिंदु और निकासी बिंदु के लिए अव(cid:304)(cid:830)थत ह(cid:339) और (cid:366)(cid:721)ावित समय-निधा(cid:330)रण के लिए एक वैध अनुबंध (cid:304)(cid:830)थत है।
15.3 मूल विनियमावली के विनियम 2.1 के बाद एक नया विनियम, अथा(cid:330)त्, विनियम 2.1क नि(cid:635)ानुसार जोड़ा जाएगा:
"2.1क एसटीयू यह सुनि(िcid:686)त करने के लिए (cid:366)ारं भिक जांच करे गा कि आवेदन सभी (cid:366)कार से पूण(cid:330) है। किसी भी विसंगति / कमी / किसी भी अति(cid:303)र(cid:389) जानकारी की आव(cid:692)कता की (cid:304)(cid:830)थति म(cid:336), एसटीयू आवेदन (cid:366)ा(cid:593) होने की तारीख से सात (7) काय(cid:330) दिवसों की अवधि के भीतर कमी को सुधारने के लिए (cid:356)ाहक को सूचित करे गा।
15.4 मूल विनियमावली की अनुसूची-क के विनियम 2.2 के खंड (ii) म(cid:336) एक नया परं तुक नि(cid:635)ानुसार जोड़ा जाएगा:
"पर(cid:802)तु यह कि म(cid:559)म अवधि ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम के लिए आवेदन कम से कम प(cid:339)तालीस (45) दिन पहले (cid:366)(cid:721)ुत किया जाएगा।"
15.5 मूल विनियमावली की अनुसूची-क के विनियम 2.3 का परं तुक नि(cid:635)ानुसार (cid:366)ति(cid:830)थापित किया जाएगा;
"आवेदन के साथ गैर-वापसी यो(cid:438) आवेदन शु(cid:821)क आरटीजीएस/एनईएफटी/आईएमपीएस या किसी अ(cid:586) डिजिटल भुगतान विधि के मा(cid:559)म से एसटीयू (cid:554)ारा अधिसूचित अधिकारी के प(cid:407) म(cid:336) लखनऊ म(cid:336) देय होना चाहिए।"
15.6 मूल विनियमावली की अनुसूची-क के विनियम 2.3 के अंत म(cid:336) एक नया परं तुक नि(cid:635)ानुसार जोड़ा जाएगा:
"परं तु यह कि लीड जीईओए उपभो(cid:389)ा के मा(cid:559)म से निबा(cid:330)ध उपगम का लाभ उठाने के इ(cid:453)ु क ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ाओं के मामले म(cid:336), गैर-वापसी यो(cid:438) आवेदन शु(cid:651) का भुगतान सभी (cid:681)(cid:304)(cid:389)गत जीईओए उपभो(cid:389)ाओं (cid:554)ारा संचयी (cid:349)प से करना होगा।"
15.7 विनियमावली 2.3 के अंतग(cid:330)त अंत म(cid:336) नि(cid:635)ानुसार एक "टि(cid:810)पणी" जोड़ी जाएगी: "टि(cid:596)णी: आवेदन शु(cid:821)क का भुगतान लागू करों के साथ,यदि कोई हों, किया जाएगा।"
15.8 मूल विनियमावली की अनुसूची-क के विनियम 3.1 म(cid:336), वा(cid:400) "और सात दिनों के बाद नहीं" हटा दिया जाएगा।
15.9 मूल विनियमावली की अनुसूची-क के विनियम 3.1 म(cid:336) एक नया परं तुक नि(cid:635)ानुसार जोड़ा जाएगा:
"पर(cid:802)तु यह कि म(cid:559)म अवधि ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम के लिए, ऐसी (cid:681)वहाय(cid:330)ता (cid:303)रपोट(cid:330) संचरण लाइस(cid:336)सधारी और/या वितरण लाइस(cid:336)सधारी (cid:554)ारा पं(cid:363)ह (15) दिनों के भीतर एसटीयू को (cid:366)(cid:721)ुत की जाएगी।"
15.10 मूल विनियमावली की अनुसूची-क के विनियम 4.1 के खंड (iii) म(cid:336) एक नया परं तुक नि(cid:635)ानुसार जोड़ा जाएगा:
"पर(cid:802)तु यह कि म(cid:559)म अवधि के ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम के मामले म(cid:336), एसटीयू आवेदन (cid:366)ा(cid:593) होने की तारीख से तीस (30) दिनों के भीतर निबा(cid:330)ध उपगम के अनुदान की पु(िcid:700) करेगा और (cid:356)ाहक को पं(cid:363)ह (15) दिनों के भीतर संबंधित संचरण लाइस(cid:336)सधारी और/या वितरण लाइस(cid:336)सधारी के साथ बीपीटीए और/या बीपीड(cid:626)ूए म(cid:336) (cid:366)वेश करने का निद(cid:337)श देगा।" 16. मूल िविनयमावली की अनुसूची-क (दीघ(cid:330)कािलक और म(cid:559)म-कािलक िनबा(cid:330)ध उपगम के िलए (cid:366)ि(cid:354)या) और अनुसूची-ख (अ(cid:665)कािलक िनबा(cid:330)ध उपगम के िलए (cid:366)ि(cid:354)या) म(cid:336) संशोधन:
16.1 मूल विनियमावली की अनुसूची-क के विनियम 6.2 और अनुसूची-ख के विनियम 7.7 म(cid:336) "1 मेगावाट से अधिक अनुबंधित मांग वाले उपभो(cid:389)ा" श(cid:616)ों को "निबा(cid:330)ध उपगम उपभो(cid:389)ा" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।
17. मूल िविनयमावली की अनुसूची-ख (अ(cid:665)कािलक िनबा(cid:330)ध उपगम के िलए (cid:366)ि(cid:354)या) म(cid:336) संशोधन:
17.1 नया िविनयम 1क: यूपीएसएलडीसी रिज(cid:720)(cid:332)ी:
मूल विनियमावली की अनुसूची-ख के विनियम 1 के बाद एक नया विनियम, अथा(cid:330)त् विनियम 1क नि(cid:635)ानुसार जोड़ा जाएगा:

(ii) अ(cid:821)पकालिक निबा(cid:330)ध उपगम आवेदनों का अंके (cid:407)णअनुचि(cid:741) (cid:366)दान करे गा;
(iii) सहमति के (cid:366)सं(cid:715)रण/स(cid:529)ापन के लिए एसटीयू/किसी अ(cid:586) संचरण लाइस(cid:336)सी और वितरण लाइस(cid:336)सियों के सॉ(cid:605)वेयर के साथ एक अंतरा-पृ(cid:829)ठ (cid:366)दान करे गा;
(iv) अ(cid:821)पकालिक निबा(cid:330)ध उपगम से संबंधित भुगतान करने के लिए एक भुगतान गेटवे (cid:366)दान करे गा;
(v) एसटीयू/किसी अ(cid:586) संचरण लाइस(cid:336)सी और वितरण लाइस(cid:336)सियों को वा(cid:721)विक समय की जानकारी के साथ डैश बोड(cid:330) सुविधा (cid:366)दान करे गा और एसटीयू/किसी अ(cid:586) संचरण लाइस(cid:336)सी और/या वितरण लाइस(cid:336)सियों (cid:554)ारा जारी सहमति, संचरण (cid:366)क(cid:636)ा की उपल(cid:617)ता, लंबित आवेदन और (cid:738)ीकृ त और अ(cid:738)ीकृ त अ(cid:821)पकालिक निबा(cid:330)ध उपगम सहित अ(cid:821)पकालिक निबा(cid:330)ध उपगम से संबंधित जानकारी के नि(cid:407)ेपागार के (cid:349)प म(cid:336) काय(cid:330) करेगा;
(vi) बाज़ार निगरानी और अवे(cid:407)ण के लिए आवधिक (cid:303)रपोट(cid:330) तैयार करने की (cid:826)यव(cid:830)था करे गा;
(vii) एसएलडीसी (cid:554)ारा अपे(िcid:407)त अ(cid:665)कालिक निबा(cid:330)ध उपगम से संबंधित कि(cid:802)हीं भी अ(cid:586) काय(cid:344) की (cid:826)यव(cid:830)था करे गा, तथा
(viii) आयोग (cid:554)ारा समय-समय पर निद(cid:337)शित कि(cid:802)हीं भी अ(cid:586) काय(cid:344) का सुगमीकरण करे गा। 1क-2एसएलडीसी यूपीएसएलडीसी-आर के विकास और रखरखाव के लिए उ(cid:517)रदायी होगा।
17.2 मूल विनियमावली की अनुसूची-ख के विनियम 2, विनियम 3, विनियम 4 और विनियम 5 नि(cid:635)ानुसार (cid:366)ति(cid:830)थापित किए जाएं गे:
2. एसएलडीसी के साथ पंजीकरण–
2.1 अत:(cid:407)ेपण देने वाली इकाई / आहता(cid:330) इकाई को एसएलडीसी के साथ (cid:366)ा(cid:349)प [FORMAT-ST11] पर 'पंजीकरण' के लिए आवेदन करना होगा। एसटी-11 का (cid:366)ा(cid:349)प अधिमानतः रा(cid:700)(cid:332) ीय भार पारे षण क(cid:336) (cid:363) के रा(cid:700)(cid:332) ीय निबा(cid:330)ध उपगम रजि(cid:720)(cid:332) ी (एनओएआर) पोट(cid:330)ल के तहत अधिमानतः वत(cid:330)मान इकाई पंजीकरण के अनु(cid:349)प होने चाहिए। पंजीकरण (cid:366)भार यूपीईआरसी (रा(cid:475) भार पारे षण क(cid:336) (cid:363) और अ(cid:586) संबंधित मामलों के (cid:366)भार और (cid:366)भार) विनियम, 2020 म(cid:336) समय-समय पर संशोधित या आयोग के किसी आदेश म(cid:336) निदि(cid:330)(cid:700) अनुसार होंगे। ऐसी अत:(cid:407)ेपण लगाने वाली इकाई/आहता(cid:330) इकाई यह घोषित करे गी कि यूपीईजीसी/आईईजीसी के (cid:366)ावधानों के अनुसार समय-(cid:624)ॉक-वार मीट(cid:303)रं ग और लेखांकन के लिए आव(cid:692)क बुनियादी ढांचा और सीईए संचार विनियमावली के (cid:366)ावधानों के अनुसार उपयु(cid:389) संचार (cid:366)णाली अत:(cid:407)ेपण के बिंदु / निकासी के बिंदु के लिए, जैसा भी मामला हो, अव(cid:304)(cid:830)थत है। किसी भी नई इकाई को पंजीकरण के लिए आवेदन करने से पहले लागू यूपीईआरसी विनियमावली के अनुसार अंतर-रा(cid:475)ीय पारे षण (cid:366)णाली और/या वितरण (cid:366)णाली से संयोजना (cid:366)ा(cid:593) करनी होगी:
पर(cid:802)तु यह कि लीड जीईओए उपभो(cid:389)ा के मा(cid:559)म से पंजीकरण की इ(cid:453)ा रखने वाले ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ाओं के मामले म(cid:336), पंजीकरण (cid:366)भार का भुगतान सभी (cid:681)(cid:304)(cid:389)गत ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ाओं (cid:554)ारा संचयी (cid:349)प से करना होगा।
2.2 एसटीयू/किसी अ(cid:586) संचरण लाइस(cid:336)सी और/या संबंधित वितरण लाइस(cid:336)सी से अत:(cid:407)ेपण बिंदु/निकासी बिंदु के लिए सहमति के लिए एक (cid:738)चालित अनुरोध, जैसी भी (cid:304)(cid:830)थति हो, यूपीएसएलडीसी-आर के मा(cid:559)म से (cid:366)ा(cid:349)प [FORMAT-ST12(A)/(B)] पर अ(cid:356)ेषित किया जाएगा। एसटीयू/किसी अ(cid:586) संचरण लाइस(cid:336)सी और/या वितरण लाइस(cid:336)सी को उ(cid:389) अवधि के दौरान ऐसे अत:(cid:407)ेपण/निकासी मा(cid:361)ा के लिए सात (7) काय(cid:330) दिवसों के भीतर यूपीएसएलडीसी-आर के मा(cid:559)म से एसएलडीसी को (cid:366)ा(cid:349)प [FORMAT-ST13(A)/(B)] पर अपनी सहमति या अ(cid:586)था सूचित करना होगा:
पर(cid:802)तु यह कि सहमति के अनुरोध को अ(cid:738)ीकार किए जाने की (cid:304)(cid:830)थति म(cid:336), एसटीयू/कोई अ(cid:586) संचरण लाइस(cid:336)सधारी या वितरण लाइस(cid:336)सधारी यूपीएसएलडीसी-आर. को कारण बताएं गे। एसएलडीसी संबंधित लाइस(cid:336)सधारी से (cid:729)(cid:700)ीकरण मांग सकता है तथा उचित समझे जाने पर यु(cid:304)(cid:389)यु(cid:389) निण(cid:330)य ले सकता है।
2.3 एसएलडीसी यह सुनि(िcid:686)त करने के लिए (cid:366)ारं भिक जांच करे गा कि आवेदन सभी (cid:366)कार से पूण(cid:330) है। किसी विसंगति/कमी/किसी अति(cid:303)र(cid:389) सूचना की आव(cid:692)कता की (cid:304)(cid:830)थति म(cid:336), एसएलडीसी यूपीएसएलडीसी-आर के मा(cid:559)म से FORMAT-ST11 की (cid:366)ा(cid:304)(cid:593) की तारीख से दो (2) काय(cid:330) दिवसों के भीतर कमी को सुधारने के लिए संबंधित इकाई को सूचित करे गा। जैसी भी (cid:304)(cid:830)थति हो, अत:(cid:407)ेपण लगाने वाली इकाई/आहता(cid:330) इकाई को उसके बाद पांच (5) काय(cid:330) दिवसों के भीतर कमी को सुधारना होगा, जिसे न करने पर पंजीकरण आवेदन बंद कर दिया जाएगा और पंजीकरण (cid:366)भार ज(cid:615) कर लिया जाएगा। एसएलडीसी, अपे(िcid:407)त सहमति की (cid:366)ा(cid:304)(cid:593) सहित सभी (cid:366)कार से पूण(cid:330) आवेदन की (cid:366)ा(cid:304)(cid:593) की तारीख से पं(cid:363)ह (15) काय(cid:330) दिवसों के भीतर, जैसी भी (cid:304)(cid:830)थति हो, आवेदनकता(cid:330) इकाई/आहता(cid:330) इकाई को FORMAT-ST12 म(cid:336) पंजीकरण या अ(cid:586)था की (cid:738)ीकृ ति की सूचना देगा। पंजीकरण एक (1) वष(cid:330) की अवधि के लिए वैध होगा और उसके बाद एसटीयू / 10 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 अत:(cid:407)ेपण इकाई / आहता(cid:330) इकाई (cid:554)ारा एक (1) वष(cid:330) की अवधि के लिए नवीकृ त किया जा सकता है। संबंधित सं(cid:830)था को किसी भी सांतरता से बचने के लिए कम से कम तीन (3) महीने पहले नवीकरण की (cid:366)(िcid:354)या शु(cid:349) करनी होगी:
पर(cid:802)तु यह कि यदि अंतर-रा(cid:475)ीय पारे षण और/या वितरण (cid:366)णाली का उपयोग करके अंतवि(cid:330)नियम की जाने वाली बिजली की मा(cid:361)ा के संबंध म(cid:336) कोई भौतिक प(cid:303)रवत(cid:330)न [पांच (5) (cid:366)तिशत से अधिक] होता है, तो इन विनियमावली के तहत एक नया पंजीकरण (cid:366)ा(cid:593) करनाहोगा।
2.4 अत:(cid:407)ेपण देने वाली इकाई/आहता(cid:330) इकाई के पंजीकरण का उ(cid:542)े(cid:692) मूल इनपुट (cid:303)रकॉड(cid:330) करना है, जिसके आधार पर संचरण और/या वितरण (cid:366)णाली म(cid:336) तकनीकी/प(cid:303)रचालन बाधाओं का मू(cid:670)ांकन एसएलडीसी (cid:554)ारा निबा(cid:330)ध उपगम की अनुमति देने से पहले किया जाएगा। इसे अ(cid:821)पकालिक निबा(cid:330)ध उपगम का अनुदान/गारं टी नहीं समझना चाहिए।
2.5 "सहमति" का ता(cid:797)पय(cid:330) होगा अति(cid:303)र(cid:389) (cid:407)मता, किसी तकनीकी/प(cid:303)रचालन बाधा तथा समय-(cid:624)ॉक-वार मीट(cid:303)रं ग और लेखाकरण तथा उपयु(cid:389) संचार (cid:366)णाली के लिए आव(cid:692)क अवसंरचना की उपल(cid:617)ता के समुचित स(cid:529)ापन के प(cid:686)ात निदि(cid:330)(cid:700) अवधि के दौरान पारे षण और/या वितरण (cid:366)णाली के उपयोग की अनुमति देने के लिए सै(cid:544)ांतिक सहमति। सहमति, निदि(cid:330)(cid:700) अवधि के दौरान, निदि(cid:330)(cid:700) अत:(cid:407)ेपण मा(cid:361)ा या निकासी मा(cid:361)ा, जैसी भी (cid:304)(cid:830)थति हो, के लिए लागू होगी।
2.6 अत:(cid:407)ेपण देने वाली इकाई/आहता(cid:330) इकाई को यह सुनि(िcid:686)त करना होगा कि सभी विवरण सही ह(cid:339), अ(cid:586)था एसएलडीसी (cid:554)ारा पंजीकरण र(cid:542)/अ(cid:738)ीकृ त किया जा सकता है:
परं तु यह भी कि इकाई (cid:554)ारा (cid:366)दान की गई सूचना म(cid:336) किसी भी प(cid:303)रवत(cid:330)न की (cid:304)(cid:830)थति म(cid:336), इकाई के लिए यह आव(cid:692)क होगा कि वह एसएलडीसी के साथ सूचना को अ(cid:552)तन करे ।
3. ह(cid:303)रतऊजा(cid:330) िनबा(cid:330)ध उपगम के मामले म(cid:336) जीओएआर पोट(cid:330)ल पर पंजीकरण-
3.1 इकाई को सीईआरसी विनियमावली / सीएनए (cid:366)(िcid:354)या के अनुसार, जीओएआर पोट(cid:330)ल म(cid:336) पंजीकरण के लिए आवेदन करने से पहले यूपीएसएलडीसी-आर के मा(cid:559)म से अनुसूची-ख के विनियमावली 2 के तहत एसएलडीसी के साथ पंजीकरण (cid:366)ा(cid:593) करना होगा।
4. अ(cid:665)कािलक िनबा(cid:330)ध उपगम की (cid:738)ीकृ ित के िलए आवेदन–
4.1 अ(cid:665)कालिक निबा(cid:330)ध उपगम (cid:366)ा(cid:593) करने का इ(cid:453)ु क अ(cid:665)कालिक निबा(cid:330)ध उपगम (cid:356)ाहक (जिसे आगे "(cid:356)ाहक" कहा जाएगा) एसएलडीसी के पास (cid:366)ा(cid:349)प [FORMAT-ST1] पर निदि(cid:330)(cid:700) मा(cid:361)ा और निदि(cid:330)(cid:700) समय अवधि के लिए आवेदन करे गा:
पर(cid:802)तु यह कि ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम के लिए सभी तरह से पूण(cid:330) आवेदन जीओएआर पोट(cid:330)ल पर (cid:366)(cid:721)ुत किया जाएगा और उसे अ(cid:665)कालिक ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम (cid:366)दान करने के लिए यूपीएसएलडीसी-आर पर एसएलडीसी को भेजा जाएगा।
4.2 अ(cid:665)कालिक निबा(cid:330)ध उपगम चाहने वाला (cid:356)ाहक एक वचनब(cid:544)ता (cid:366)(cid:721)ुत करे गा कि उ(cid:389) निबा(cid:330)ध उपगम/(cid:366)(cid:721)ावित अनुसूचीयन के लिए एक वैध अनुबंध है और जिस (cid:407)मता (बिजली की मा(cid:361)ा) के लिए अ(cid:665)कालिक निबा(cid:330)ध उपगम वांछित है, उसके लिए एक से अधिक (cid:681)(cid:304)(cid:389)यों के साथ बिजली खरीद समझौता या कोई अ(cid:586) (िcid:554)प(cid:407)ीय समझौता नहीं किया गया है:
पर(cid:802)तु यह कि समेकित गैर-मांग वाली (cid:407)मता और गैर-समेकित (cid:407)मता (cid:366)(cid:721)ावित अनुसूचीयन के लिए पा(cid:361) होगी और तदनुसार अ(cid:665)कालिक निबा(cid:330)ध उपगम (cid:366)दान करते समय उस पर विचार किया जाएगा।
4.3 आवेदन के साथ 500 (cid:348)पये का अ(cid:366)तिदेय आवेदन शु(cid:821)क संल(cid:432) करना होगा। 5,000/- (या आयोग (cid:554)ारा समय-समय पर आदेश (cid:554)ारा निधा(cid:330)(cid:303)रत) लागू करों सहितआरटीजीएस/एनईएफटी/आईएमपीएस (cid:554)ारा या डिजिटल भुगतान के किसी अ(cid:586) मा(cid:559)म से एसएलडीसी (cid:554)ारा अधिसूचित अधिकारी के प(cid:407) म(cid:336) लखनऊ म(cid:336) देय होगा। आवेदन शु(cid:821)क के भुगतान म(cid:336) चूक होने पर, एसएलडीसी आवेदन को अ(cid:738)ीकार कर देगा;
पर(cid:802)तु यह कि लीड जीईओए उपभो(cid:389)ा के मा(cid:559)म से निबा(cid:330)ध उपगम का लाभ उठाने के इ(cid:453)ु क ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ाओं के मामले म(cid:336), आवेदन शु(cid:821)क का भुगतान सभी (cid:681)(cid:304)(cid:389)गत ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम उपभो(cid:389)ाओं (cid:554)ारा संचयी (cid:349)प से करना होगा।
4.4 अ(cid:821)पकालिक निबा(cid:330)ध उपगम (cid:366)दान करने के लिए आवेदन नि(cid:635)लि(cid:304)खत म(cid:336) से किसी भी (cid:373)ेणी के अंतग(cid:330)त किया जा सकता है:
4.4.1 अ(िcid:356)म आवेदन:
(क) (डी+3) दिन या उसके बाद आरं भ होने वाले निबा(cid:330)ध उपगम (cid:366)दान करने के लिए (डी) दिन पर किया गया आवेदन, जो (डी) दिन के उसी महीने म(cid:336) या उसके बाद के महीने म(cid:336) पड़ सकता है।
(ख) अ(िcid:356)म आवेदन (cid:373)ेणी के तहत अनुसूचीयन अनुरोध एक दिन पहले के आधार पर किया जाएगा।
अनुसूची म(cid:336) संशोधन यूपीईजीसी/आईईजीसी के अनुसार होगा।
4.4.2 ता(cid:509)ालिक आवेदन:
(क) ऐसी (cid:407)मता के लिए अनुसूचीयन के साथ निबा(cid:330)ध उपगम (cid:366)दान करने के लिए आवेदन एसएलडीसी (cid:554)ारा अनुसूचीयन की तिथि से दो दिन पूव(cid:330) (cid:366)ा(cid:593) किया जाएगा, लेकिन एक दिन पहले के सं(cid:826)यवहार के लिए अनुसूचीयन के दिन से ठीक पहले के दिन के 13:00 बजे के बाद नहीं।
mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 11उदाहरण के लिए, 25 जुलाई के लिए निधा(cid:330)(cid:303)रत निबा(cid:330)ध उपगम आवेदन उस माह की 23 तारीख को या 24 तारीख को 13:00 बजे तक (cid:366)ा(cid:593) किए जाएं गे।
(ख) (एस-1) दिन के 13:00 बजे के बाद या (एस) दिन म(cid:336) (cid:366)ा(cid:593) अनुसूचीयन वाले आवेदन को 8 समय उप-खंडों के भीतर संसाधित किया जाएगा।
(ग) ता(cid:509)ालिक आवेदन (cid:373)ेणी के अंतग(cid:330)त दी गई अ(cid:665)कालिक निबा(cid:330)ध उपगम को अनुसूचित माना जाएगा, जिसे संशोधित नहीं किया जा सके गा।
5. नोडल अिभकरण (cid:554)ारा अ(cid:665)कािलक िनबा(cid:330)ध उपगम की मंजूरी–
5.1 एसएलडीसी लेन-देन म(cid:336) शामिल संचरण और/या वितरण (cid:366)णाली के किसी भी घटक (लाइन और ट(cid:332) ांसफाम(cid:330)र) के संकलन की (cid:304)(cid:830)थति म(cid:336) निबा(cid:330)ध उपगम लेन-देन की जांच करे गा और तदनुसार निबा(cid:330)ध उपगम की अनुमति देगा, यदि संचरण और/या वितरण (cid:366)णाली म(cid:336) किसी भी सि(cid:720)म सु(cid:778)ढ़ीकरण के बिना पया(cid:330)(cid:593) अति(cid:303)र(cid:389) (cid:407)मता उपल(cid:617) है।
5.2 एसएलडीसी नीचे निधा(cid:330)(cid:303)रत समयसीमा के अनुसार (cid:356)ाहक को (cid:366)ा(cid:349)प [FORMAT-ST2] पर निबा(cid:330)ध उपगम या अ(cid:586)था की अनुमति देगा।
5.2.1 अ(िcid:356)म आवेदन:
अ(cid:665)कालिक निबा(cid:330)ध उपगम के लिए अ(िcid:356)म आवेदन पर पहले आओ-पहले पाओ के आधार पर विचार किया जाएगा और इसे (डी+1) दिन के 23:59 बजे तक संसाधित किया जाएगा, 'डी' आवेदन करने की तिथि है:
पर(cid:802)तु यह कि यदि नोडल अभिकरण उपयु (cid:330)(cid:779)त निदि(cid:330)(cid:700) समयसीमा के भीतर ह(cid:303)रत ऊजा(cid:330) निबा(cid:330)ध उपगम के अनुदान के लिए अ(िcid:356)म आवेदन को संसाधित करने म(cid:336) विफल रहती है, तो इसे इन विनियमावली के तहत निदि(cid:330)(cid:700) तकनीकी/प(cid:303)रचालन अपे(cid:407)ाओं और शत(cid:344) की पूति(cid:330) के अधीन (cid:366)दान किया गया माना जाएगा।
5.2.2 ता(cid:509)ालिक आवेदन:
(एस) दिन के लिए निधा(cid:330)(cid:303)रत समय के साथ अ(cid:665)कालिक निबा(cid:330)ध उपगम के लिए ता(cid:509)ालिक आवेदन नि(cid:635)ानुसार संसाधित किया जाएगा:
(क) (एस-1) दिन के 13:00 बजे तक (cid:366)ा(cid:593) आवेदन को (एस-1) दिन को 13:00 बजे के बाद पहले आओ- पहले पाओ के आधार पर संसाधित किया जाएगा, और (एस-1) दिन के 15:00 बजे तक निण(cid:334)त किया जाएगा।
(ख) (एस-1) दिन के 13:00 बजे के बाद या (एस) दिन म(cid:336) (cid:366)ा(cid:593) आवेदन को पहले आओ-पहले पाओ के आधार पर 8-समय उप-खंडों के भीतर संसाधित किया जाएगा।
5.3 निबा(cid:330)ध उपगम (cid:366)दान करने के लिए आवेदन को अ(cid:738)ीकार किए जाने की (cid:304)(cid:830)थति म(cid:336), एसएलडीसी लि(cid:304)खत (cid:349)प म(cid:336) (cid:356)ाहक को ऐसी अ(cid:738)ीकृ ति के कारण बताएगा:
5.4 यदि आवेदन के अनुसार अ(cid:665)कालिक निबा(cid:330)ध उपगम, आवेदन म(cid:336) मांगी गई पूरी मा(cid:361)ा और पूरी अवधि के लिए (cid:366)दान नहीं की जा सकती है, तो पारे षण (cid:366)णाली और/या वितरण (cid:366)णाली म(cid:336) (cid:681)वरोध को n`f"Vxr रखते (cid:352)ए, आवेदन को अ(cid:738)ीकार कर दिया जाएगा:
पर(cid:802)तु यह कि यदि (cid:356)ाहक ने अपने आवेदन म(cid:336) सहमति दी है कि उसे आंशिक मा(cid:361)ा या आंशिक अवधि या दोनों के लिए निबा(cid:330)ध उपगम (cid:366)दान की जा सकती है, तो ऐसी आंशिक मा(cid:361)ा और आंशिक अवधि या दोनों के लिए अ(cid:665)कालिक निबा(cid:330)ध उपगम उपल(cid:617) पारे षण और/या वितरण (cid:407)मता के अनुसार (cid:366)दान किया जाएगा।
17.3 श(cid:616) "(cid:366)चालनीय" को मूल विनियमावली की अनुसूची-ख के विनियम 7.8 म(cid:336) दो (cid:830)थानों पर "तकनीकी/(cid:366)चालनीय" श(cid:616)ों से (cid:366)ति(cid:830)थापित किया जाएगा।

NOTIFICATION
In exercise of powers conferred under Section 181 of the Electricity Act, 2003 (Act no. 36 of 2003) (hereinafter referred to as 'the Act') and all other powers enabling it in this behalf, and after previous publication, the Uttar Pradesh Electricity Regulatory Commission hereby makes the following regulations to amend the Uttar Pradesh Electricity Regulatory Commission (Terms and Conditions for Open Access) Regulations, 2019, (hereinafter referred to as "the Principal Regulations"), namely:-
1. Short Title and Commencement:
1.1 These regulations may be called the Uttar Pradesh Electricity Regulatory Commission (Terms and Conditions for Open Access) (First Amendment) Regulations, 2024.
1.2 These regulations shall come into force from the date of their publication in the Official Gazette.
2. Amendment to Regulation 2 of the Principal Regulations: 2.1 The word "Rules" shall be substituted with the word "Regulations"at two places in Regulation 2.1 of the Principal Regulations.
2.2 The words ""Bilateral transaction" means" shall be substituted with the words ""Bilateral transaction" in terms of short-term open access means" in clause (b) of Regulation 2.4 of the Principal Regulations.
2.3 A new clause, namely, clause (c-i) shall be added after clause (c) of Regulation 2.4 of the Principal Regulations as under:
"(c-i) "Central Nodal Agency" or "CNA" for green energy open access means a Central Nodal Agency as notified by the Central Government to set up and operate a single window green energy open access system for renewable energy;"
2.4 A new clause, namely, clause (e-i) shall be added after clause (e) of Regulation 2.4 of the Principal Regulations as under:
"(e-i) "Deviation" in a time block shall have the same meaning as defined under CERC (Deviation Settlement Mechanism and Related Matters) Regulations, 2022 ("CERC DSM Regulations");
2.5 Clause (g) of Regulation 2.4 of the Principal Regulations shall be substituted as under:
"(g) "Energy Account" means energy account(s) prepared by State Load Despatch Centre at all the interface points (i.e. generation–transmission/distribution, transmission– distributionand transmission/distribution–open access consumer) and shall include the DSM account(s), Reactive Energy Charges Account(s) and any other accounts as may be notified by the Commission, as applicable, in case of use of transmission system(s) with or without distribution system(s):
Provided that distribution licensee shall have to prepare such account (s) in case both point of injection and drawal are located within his distribution system only without the use of transmission system;"
2.6 Three new clauses, namely, clause (g-i),clause (g-ii) and (g-iii) shall be added after clause (g) of Regulation 2.4 of the Principal Regulations as under:
"(g-i) "Green Energy" / "Renewable Energy" means the electrical energy from renewable sources of energy including hydro and storage (if the storage uses renewable energy) or any other technology / sources as may be notified by the Government of India from time to time and shall also include any mechanism that utilises green energy to replace fossil fuels including production of green hydrogen or green ammonia;" mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 13 a Lead GEOA Consumer, subject to the fulfilment of the technical/ operational requirement as specified in these Regulations and of requisitions and schedules having resolution in accordance with UPEGC / IEGC and the expression "Green Energy Open Access Consumer (s)" or "GEOA Consumer (s)" shall be construed accordingly:
Provided that in case of multiple connections with contracted load / sanctioned load of less than hundred (100) kW each located in same electricity division of a distribution licensee with aggregated contracted load / sanctioned load of hundred (100) kW & above but not exceeding two hundred (200) kW, there shall be no such restrictions of same retail category under the same name for availing such green energy open access through a Lead GEOA Consumer:
Provided further that in case of captive user availing green energy, there shall not be such load limitation and the same shall be subject to the fulfilment of requisitions and schedules having resolution in accordance with UPEGC/IEGC and such open access shall be subject to the fulfilment of the technical/ operational requirement as specified in these Regulations:
Provided also that the above licence area restriction on the basis of electricity division shall be applicable to Paschimanchal Vidyut Vitran Nigam Limited, Dakshinanchal Vidyut Vitran Nigam Limited, Madhyanchal Vidyut Vitran Nigam Limited, Purvanchal Vidyut Vitran Nigam Limited & Kanpur Electricity Supply Company Limited and their successor entities only and for all other distribution licensees, the area to be considered shall be equal to the entire licence area;"
"(g-iii) "GEOA Rules" means the Electricity (Promoting Renewable Energy Through Green Energy Open Access) Rules, 2022 and amendments thereof;"
2.7 Clause (h) of Regulation 2.4 of the Principal Regulations shall be deleted. 2.8 A new clause, namely, clause (h-i) shall be added after clause (h) of Regulation 2.4 of the Principal Regulations as under.
"(h-i) "Lead GEOA Consumer" means authorized representative designated among GEOA Consumers who will act as a coordinating agency on their behalf in case of green energy open access availing by aggregating contracted load / sanctioned load of hundred (100) kW & above through multiple connections located in same electricity division of a distribution licensee as per these Regulations;"
2.9 The words "but not exceeding 25 years" shall be added at the end in clause (i) of Regulation 2.4 of the Principal Regulations.
2.10 The words "exceeding 3 months but not exceeding 5 years" shall be substituted with the words "exceeding 11 months but not exceeding 3 years" in clause (j) of Regulation 2.4 of the Principal Regulations.
2.11 Clause (m), clause (p)and clause (q) of Regulation 2.4 of the Principal Regulations shall be deleted.
2.12 Four new provisos shall be added to sub-cause (iii) of clause (n) of Regulation 2.4 of the Principal Regulations as under:
"Provided that GEOA Consumer (s) who has contracted load/sanctioned load of hundred (100) kW & above through single connection or with aggregated contracted load / sanctioned load of hundred (100) kW & above through multiple connections having same retail category in the same name located in same electricity division of a distribution licensee through a Lead GEOA Consumer, subject to the fulfilment of the technical / operational requirement as specified in these Regulations and of requisitions and schedules having resolution in accordance with UPEGC / IEGC:
Provided that in case of multiple connections with contracted load / sanctioned load of less than hundred (100) kW each located in same electricity division of a distribution licensee with aggregated contracted load / sanctioned load of hundred (100) kW & above but not exceeding two hundred (200) kW, there shall be no such restrictions of same retail category under the same name for availing such green energy open access through a Lead GEOA Consumer:
Provided further that in case of captive user availing green energy, there shall not be such load limitation and the same shall be subject to the fulfilment of requisitions and schedules having resolution in accordance with UPEGC / IEGC and such open access shall be subject to the fulfilment of the technical / operational requirement as specified in these Regulations:
Provided also that the above licence area restriction on the basis of electricity division shall be applicable to Paschimanchal Vidyut Vitran Nigam Limited, Dakshinanchal Vidyut Vitran Nigam Limited, Madhyanchal Vidyut Vitran Nigam Limited, Purvanchal Vidyut Vitran Nigam Limited & Kanpur 14 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 Electricity Supply Company Limited and their successor entities only and for all other distribution licensees, the area to be considered shall be equal to the entire licence area."
2.13 The words "(including green energy open access)" shall be added after the words "one who consumes electricity through open access"and before the words "from a person" in clause (o) of Regulation 2.4 of the Principal Regulations.
2.14 The words "3 months" shall be substituted with the words "11 months" in clause (r) of Regulation 2.4 of the Principal Regulations.
2.15 Two new clauses, namely, clause (v) and clause (w) shall be added after clause (u) of Regulation 2.4 of the Principal Regulations as under:
"(v) "UPSLDC Registry" or "UPSLDC-R" means the Registry as specified under Regulation 1A of Schedule-B of these regulations;
"(w) "UPSTU Registry" or "UPSTU-R" means the Registry as specified under Regulation 1A of Schedule-A of these regulations;
2.16 The word "Rules" shall be substituted with the word "Regulations" at two places in Regulation 2.5 of the Principal Regulations.
3. Amendment to Regulation 4 of the Principal Regulations:
3.1 The words "exceeding 5 years" shall be substituted with the words "exceeding 5 years but not exceeding 25 years" in Regulation 4.2 of the Principal Regulations.
3.2 The words "more than 3 months and up to 5 years" shall be substituted with the words "more than 11 months and up to 3 years" in Regulation 4.3 of the Principal Regulations.
3.3 The words "3 months" shall be substituted with the words "11 months" in Regulation 4.4 of the Principal Regulations.
4. Amendment to Regulation 7 of the Principal Regulations:
4.1 Four new provisos shall be added to Regulation 7.1 and to clause (c) of Regulation 7.3 of the Principal Regulations as under:
"Provided that GEOA Consumer (s) who has contracted load/sanctioned load of hundred (100) kW & above through single connection or with aggregated contracted load/sanctioned load of hundred (100) kW & above through multiple connections having same retail category in the same name located in same electricity division of a distribution licensee through a Lead GEOA Consumer, subject to the fulfilment of the technical / operational requirement as specified in these Regulations and of requisitions and schedules having resolution in accordance with UPEGC / IEGC:
Provided that in case of multiple connections with contracted load / sanctioned load of less than hundred (100) kW each located in same electricity division of a distribution licensee with aggregated contracted load /sanctioned load of hundred (100) kW & above but not exceeding two hundred (200) kW, there shall be no such restrictions of same retail category under the same name for availing such green energy open access through a Lead GEOA Consumer:
Provided further that in case of captive user availing green energy, there shall not be such load limitation and the same shall be subject to the fulfilment of requisitions and schedules having resolution in accordance with UPEGC / IEGC and such open access shall be subject to the fulfilment of the technical / operational requirement as specified in these Regulations:
Provided also that the above licence area restriction on the basis of electricity division shall be applicable to Paschimanchal Vidyut Vitran Nigam Limited, Dakshinanchal Vidyut Vitran Nigam Limited, Madhyanchal Vidyut Vitran Nigam Limited, Purvanchal Vidyut Vitran Nigam Limited & Kanpur Electricity Supply Company Limited and their successor entities only and for all other distribution licensees, the area to be considered shall be equal to the entire licence area."
4.2 The words "other charges" shall be substituted with the words "other fees and charges" at two places in first proviso of Regulation 7.3 of the Principal Regulations.
4.3 Two new provisos shall be added after first proviso to Regulation 7.3 as under: "Provided further that cross subsidy surcharge and additional surcharge shall not be applicable in case power produced from a non-fossil fuel based Waste-to-Energy plant is supplied to GEOA Consumer:
Provided also that cross subsidy surcharge and additional surcharge shall not be applicable if green energy is utilized for production of green hydrogen and green ammonia:" mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 15 4.4 The words "Consumers with Contracted demand of 1 MW or above" shall be substituted with the words "Open Access Consumers"in fourth proviso of Regulation 7.3 of the Principal Regulations.
4.5 Seventh proviso to Regulation 7.3 of the Principal Regulations shall be substituted as under: "Provided that prior to grant of open access, consumer shall enter into connection agreement in accordance with UPERC (Grant of Connectivity to intra-State Transmission System) Regulations, 2010 whereas in case of consumer who is connected with the system of distribution licensee, the connection agreement should be in line with the existing model connection agreement with intra-State transmission system incorporating suitable modification in consultation with distribution licensee, as the case may be:"
4.6 Regulation 7.2 of the Principal Regulations shall be substituted as under: "In case of open access consumer if fed through independent feeder, the total drawal from open access and from the Distribution Licensee shall be restricted upto the ceiling of drawl applicable for the voltage level, as specified under the Supply Code, to which the open access consumer is connected. In case of any breach of such ceiling penal action be taken by the Nodal Agency as deemed appropriate including suspension of open access for three months for each breach. In case of repeated breach for more than three times open access shall be suspended till open access consumer shift to the next appropriate voltage level as per Supply Code.
Whereas in case of open access consumer if fed through mixed feeder the open access consumer shall restrict the sum of his total drawl from open access and from the distribution licensee upto the contracted capacity with the Distribution Licensee. In case of any breach of such ceiling penal action be taken by the Distribution Licensee as deemed appropriate including suspension of open access for three months for each breach by the Nodal Agency. In case of repeated breach for more than three times open access shall be suspended till open access consumer enhances the contracted capacity with the Distribution Licensee as per Supply Code."
5. Amendment to Regulation 14 of the Principal Regulations:
5.1 Second proviso to Regulation 14 of the Principal Regulations shall be substituted as under: "Provided further that for short-term open access customer, anything done or to be done or purported to be done under these Regulations, shall constitute an Agreement (written or implied) entered into by the customer with SLDC, STU or any other transmission licensee, distribution licensee or any other person concerned with the open access transaction."
6. Amendment to Regulation 15 of the Principal Regulations:
6.1 Second proviso to Regulation 15.3 of the Principal Regulations shall be deleted. 6.2 The word "marginal" shall be substituted with the words "open access" at five places in Regulation 15.4 of the Principal Regulations.
6.3 A new clause (ix) shall be added to Regulation 15.4 of the Principal Regulations as under:
"(ix) In case of reduction or cancellation due to under-utilisation of the open access capacity under Regulation 15.4, open access customer shall be liable to pay 50% of applicable open access charges for such period of reduction or cancellation in addition to full open access charges on revised capacity during remaining period of transaction."
6.4 Regulation 15.7 of the Principal Regulations shall be substituted as under:
"The discount rate that shall be applicable for computing the net present value in case of both long term & medium term open access shall be the discount rate for computation of levelized transmission charges for the purpose of bid evaluation for projects based on the old Standard Bidding Documents (SBDs) and Guidelines as specified by CERC from time to time."
6.5 The word "transmission" shall be substituted with the words ""transmission/wheeling" at two places in Regulation 15.9 of the Principal Regulations.
6.6 Regulation 15.10 of the Principal Regulations shall be deleted.
7. Amendment to Regulation 18 of the Principal Regulations:
7.1 Two new provisos shall be added to Regulation 18.1 of the Principal Regulations as under: "Provided that additional surcharge shall not be applicable for GEOA Consumer, if fixed charges are being paid by such a consumer:
16 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024Provided also that additional surcharge shall not be applicable in case electricity produced from offshore wind projects, which are commissioned upto December, 2032 and supplied to GEOA Consumer." 8. Amendment to Regulation 20 of the Principal Regulations:
8.1 Second proviso to Regulation 20.1 of the Principal Regulations shall be substituted as under:
"Provided further that standby power from any other source shall be scheduled in accordance with the provisions of the relevant Grid Code/ Regulations."
8.2 The words "60 days in a year" shall be substituted with the words "60 number of days in a financial year" in clause (ii) of Regulation 20.2 of the Principal Regulations.
8.3 The words "1.5 times" shall be substituted with the words "1.25 times" in clause (ii) of Regulation 20.2 of the Principal Regulations.
8.4 A new Regulation, namely, Regulation 20.3 shall be added after Regulation 20.2 of the Principal Regulations as under;
"20.3 For the purposes of these Regulation, "Standby Charges" means the charges applicable to full open access consumers towards the standby arrangement provided by the distribution licensee of the area of supply, in case the open access consumer is unable to procure/ schedule power from the generating sources with whom they have the agreements to procure power due to outages of generator, transmission assetsand the like. Such standby charges for maintaining standby arrangements for such consumers should be reflective of the costs incurred by distribution licensee for providing these support services."
9. Amendment to Regulation 21 of the Principal Regulations:
9.1 In the heading in Regulation 21 of the Principal Regulations, the words "Imbalance Charges" shall be substituted with the words "Deviation Charges".
9.2 Regulation 21.2 of the Principal Regulations shall be substituted as under: "21.2 Deviation between scheduled injection / drawal and actual injection/drawal of STU/ Discom connected generator (except for solar and wind generating plant),distribution licensee and full open access consumer in respect of intra-State open access transaction will be settled as per DSM Regulations specified by Central Commission.
Whereas, Deviation between scheduled injection and actual injection of STU/ Discom connected (irrespective of installed capacity) solar and wind generating plant in respect of intra-State open access transaction will be settled as per UPERC (Forecasting, Scheduling, Deviation Settlement and Related Matters of Solar and Wind Generation Sources) Regulation, 2018 and amendments thereof.
10. Amendment to Regulation 27 of the Principal Regulations:
10.1 A new proviso shall be added to Regulation 27.1 of the Principal Regulations as under: "Provided that in case both point of injection and drawal are located within distribution system (s) without the use of transmission system, distribution licensee shall be responsible for scheduling and despatch of such electricity at point of injection and drawal, if applicable, in line with the provisions of UPEGC/IEGC or applicable Regulations.
10.2 Regulation 27.2 of the Principal Regulations shall be substituted as under: "27.2 Open access transaction shall be carried out in accordance with the provisions of these Regulations and as per the procedures for scheduling, despatch, energy accounting, DSM and settlement of open access transactions in accordance with UPEGC/ IEGC or applicable Regulations."
11. Amendment to Regulation 28 of the Principal Regulations:
11.1 In the heading in Regulation 28 of the Principal Regulations, the words "Accounting in case of Open Access" shall be substituted with the words "Accounting in case of Part Open Access".
12. Amendment to Regulation 29 of the Principal Regulations:
12.1 Regulation 29 of the Principal Regulations shall be substituted as under: "29. Metering–
29.1 The installation, operation, calibration and maintenance of Interface Energy Meters (IEMs) with automatic remote meter reading (AMR) facility including additional communication mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 17 links, if any, required for the purpose of AMR facility shall be in accordance with CEA Metering Regulations and CEA Communications Regulations:
Provided that part green energy open access consumer connected at voltage below 11 kV shall have the option to use Smart Meteras per CEA Metering Regulations.
29.2 It shall be the responsibility of STU to provide specifications for meters to be installed at appropriate inter-connection/interface points (injection and drawal points) for facilitating the open access transactions.
29.3 Open access customer shall establish communication facilities with SLDC and provide such information and in such format as may be specified by SLDC, on real time basis as well as periodically.
29.4 Interface Energy Meters shall be compatible with energy accounting software of SLDC.
29.5 It shall be the responsibility of the generating company or the licensee, in whose premises the meter has been installed, to download the meter data, record the metered data and furnish such data to SLDC and other agencies as required. The reading and recording of meters at open access consumer end shall be done by the distribution licensee for which open access consumer shall provide access to the authorized representative (s) of the licensee if required:
Provided that manual reading of meter shall be done in case readings have not been transmitted through AMR facility due to any reason however, such automatic remote meter reading shall be restored immediately by the generating company or the licensee or the open access consumer as the case may be.
29.6 For the purpose of metering and accounting of open access consumer directly connected to transmission system at voltage 33 kV and above, location of interface meters (mainmeter, check meter and standby meter) shall be as per UPERC (Grant of Connectivity to intra- State Transmission System) Regulations, 2010 and amendment thereof.
For the purpose of metering and accounting of open access consumer directly connected to distribution system at voltage 33 kV and below, the interface meters (main meter and check meter) shall be installed by the distribution licensee at open access consumer end,whereas interface meter (standby meter) shall be installed by the distribution licensee in its premises in case of independent feeder or at open access consumer end in case of mixed feeder. The cost of these interface meters shall be borne by open access consumer.
29.7 Open access consumer shall have the option to make available meters himself at his cost for installation by the licensee. STU shall make available on its website, an updated list of makes and specifications of meters and associated equipment, as approved by STU for purchase of meters by open access consumer.
29.8 STU and distribution licensee (s) shall designate Officer (s) as "Nodal Officer" at transmission zone level (s) and Discom level (s) who shall be responsible for periodical testing, calibration and maintenance of interface meters, timely delivery of metered data to SLDC, necessary coordination with SLDC/agencies and other related matters."
13. Amendment to Clause 31 of the Principal Regulations:
13.1 In Regulation 31.1 of the Principal Regulations, the sentence "The SLDC is directed to submit the above-mentioned procedure within 60 days of notification of this Regulation" shall be deleted.
13.2 Regulation 31.2 of the Principal Regulations shall be substituted as under: "31.2 Energy account prepared by SLDC shall be used for billing purposes:
Provided that SLDC shall issue energy account for electricity and quantify the demand and energy supplied by the distribution licensee in case where open access consumer receives electricity through both open access as well as from distribution licensee. On the basis of energy account prepared and issued for the relevant month by SLDC, distribution licensee shall accordingly prepare and raise bill for electricity supplied including demand charge and protective load charge (wherever applicable) on open access consumerin accordance with terms and conditions of retail tariff and rates specified by the Commission in the retail tariff order as applicable to such open access consumer."
13.3 Clause (iv) of Regulation 31.4 of the Principal Regulations shall be deleted.
18 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 13.4 The words "imbalance charges" shall be substituted with the words "deviation charges" inclause (vii) of Regulation 31.4 of the Principal Regulations.
13.5 The words "Imbalance charges" shall be substituted with the words "deviation charges" in clause (viii) of Regulation 31.5 of the Principal Regulations.
14. New Regulation 31A: Role of Lead GEOA Consumer:
14.1 A new Regulation, namely, Regulation 31A shall be added after Regulation 31 of the Principal Regulations as under:
"31A. Role of Lead GEOA Consumer–
31A-1 Lead GEOA Consumer shall be authorized based on mutually agreed terms and conditions from amongst GEOA Consumer(s). Lead GEOA Consumer shall register themselves with the concerned Nodal Agency. Lead GEOA Consumer shall be the single point contact with STU, SLDC, any other transmission licensee/ distribution licensee and other agencies on behalf of its GEOA Consumer(s)inter alia for the following purposes:
(i) Submit its authorization as Lead GEOA Consumer on behalf of its GEOA Consumer(s) to the concerned Nodal Agency;
(ii) Submit green energy open access application; (iii) Coordination with SLDC / distribution licensee for drawal schedules; (iv) Coordination with STU/SLDC / distribution licensee and other agencies for metering, data collection/ transmission and real time data communication, energy accounting, billing, payment security and settlement of green energy open access transaction(s);
(v) Undertake commercial settlements on behalf of GEOA Consumer(s), of open access charges.
(vi) Undertake de-pooling of payments of open access charges / applicable charges payments.
Note: "De-Pooling" means the disaggregation and apportionment of the applicable charges among GEOA Consumer(s)which shall be governed by their inter-se agreements.
(vii) Undertake commercial settlement of any other charges on behalf of GEOA Consumer(s) as mandated from time to time;
Provided that for all practical purposes including scheduling, metering, accounting, billing and payment of individual green energy open access consumer(s),the distribution licensee shall develop a procedure for aggregation of contracted load / sanctioned load of multiple connections under a division supported by web based accounting and billing / payment system for such group of green energy open access consumers.
31A-2 Notwithstanding the authorization of Lead GEOA Consumer,each GEOA Consumer of that group shall be treated as single connection (s) for the operational, commercial and settlement purposes. Onus of complying with the relevant provisions of these Regulations shall lie with each GEOA Consumer whereas the commercial & other arrangements between them and their Lead GEOA Consumer shall be governed by their inter-se agreements."
15. Amendment to Schedule-A (Procedure for Long-Term and Medium-Term Open Access) of the Principal Regulations:
15.1 New Regulation 1A: UPSTU Registry: A new Regulation, namely Regulation 1A shall be added after Regulation 1 of Schedule-A of the Principal Regulations as under:
"1A. UPSTU Registry–
1A-1 The connectivity,medium term and long term open access applications shall be applied and processed through single window unified electronic platform, namely, UPSTU Registry (UPSTU-R) which shall:
(i) Provide the audit trail of connectivity applications;
(ii) Provide the audit trail of medium term and long term open access applications;
(iii) Provide an interface with the software of SLDC / any other transmission licensee and distribution licensees for processing of applications/validation of feasibility reports etc.;
mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 19(iv) Provide a payment gateway for making payments related to connectivity, medium term and long term open access;
(v) Provide Dash Board facility with real time information to SLDC / any other transmission licensee and distribution licensees and act as a repository of information related to connectivity, medium term and long term open access including feasibility reports issued by concerned licensees, availability of transmission corridor, pending applications, and connectivity, medium term and long term open access granted and rejected;
(vi) Facilitate generation of periodic reports for market monitoring and surveillance;
(vii) Facilitate any other functions incidental to connectivity, medium term and long term open access as required by STU under these regulations, and
(viii) Facilitate any other functions, as directed by the Commission from time to time. 1A-2 STU shall be responsible for developing and maintaining UPSTU-R.
15.2 Two new provisos shall be added to Regulation 2.1 of Schedule-A of the Principal Regulations as under:
"Provided that an application for medium term green energy open access complete in all respect shall be submitted on the GOAR Portal and the same shall get routed to STU for grant of medium term green energy open access:
Provided further that such application for grant of medium term green energy open access shall contain the declarations by the customer that necessary infrastructure for time-block wise metering and accounting in accordance with the provisions of UPEGC / IEGC and appropriate communication system in accordance with the provisions of CEA Communication Regulations are in place for the point of injection & point of drawal and that there is a valid contract for the proposed scheduling."
15.3 A new Regulation, namely, Regulation 2.1A shall be added after Regulation 2.1 of Schedule-A of the Principal Regulations as under:
"2.1A STU shall conduct a preliminary scrutiny to ensure application is complete in all respects. In case of any discrepancy / shortcoming / requirement of any further information, STU shall intimate the customer for rectification of the deficiency within a period of seven (7) working days from the date of receipt of application."
15.4 A new proviso shall be added to clause (ii) of Regulation 2.2 of Schedule-A of the Principal Regulations as under:
"Provided that an application for medium term green energy open access shall be submitted at least forty five (45) days in advance."
15.5 Proviso to Regulation 2.3 of Schedule-A of the Principal Regulations shall be substituted as under:
"Application shall be accompanied by non-refundable application fee by RTGS/NEFT/IMPS or through any other mode of digital payment in favour of the Officer as notified by STU payable at Lucknow."
15.6 A new proviso shall be added at the end of Regulation 2.3 of Schedule-A of the Principal Regulations as under:
"Provided that in case of green energy open access consumers intending to avail open access through Lead GEOA Consumer, the non-refundable application fee shall have to be paid by all the individual GEOA Consumers cumulatively."
15.7 A "Note" shall be added in last under Regulation 2.3 as under: "Note: Application fee shall be paid along with applicable taxes, if any."
15.8 In Regulation 3.1 of Schedule-A of the Principal Regulations, the sentence "and not later than seven days" shall be deleted.
15.9 A new proviso shall be added to Regulation 3.1 of Schedule-A of the Principal Regulations as under:
"Provided that for medium term green energy open access, such feasibility reports shall be submitted by the transmission licensee and/or distribution licensee to STU within fifteen (15) days."
15.10 A new proviso shall be added to clause (iii) of Regulation 4.1 of Schedule-A of the 20 mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 "Provided that in case of medium term green energy open access, STU shall confirm grant of open access within thirty (30) days from the date of receipt of the application with direction to the customer to enter into BPTA and/or BPWA with concerned transmission licensee and/or distribution licensee within fifteen (15) days."
16. Amendment to Schedule-A (Procedure for Long-Term and Medium-Term Open Access) and Schedule-B (Procedure for Short-Term Open Access) of the Principal Regulations:
16.1 The words "consumers with contracted demand of more than 1 MW" shall be substituted with the words "Open Access Consumers" in Regulation 6.2 of Schedule-A and Regulation 7.7 of Schedule-B of the Principal Regulations.
17. Amendment to Schedule-B (Procedure for Short-Term Open Access) of the Principal Regulations:
17.1 New Regulation 1A: UPSLDC Registry: A new Regulation, namely Regulation 1A shall be added after Regulation 1 of Schedule-B of the Principal Regulations as under:
"1A. UPSLDC Registry–
1A-1 The registration and short term open access applications shall be applied and processed through single window unified electronic platform, namely, UPSLDC Registry (UPSLDC- R)which shall:
(i) Provide the audit trail of registration applications;
(ii) Provide the audit trail of short term open access applications;
(iii) Provide an interface with the software of STU / any other transmission licensee and distribution licensees for processing/validation of concurrence;
(iv) Provide a payment gateway for making payments related to short term open access;
(v) Provide Dash Board facility with real time information to STU / any other transmission licensee and distribution licensees and act as a repository of information related to short term open access including concurrence issued by STU / any other transmission licensee and/or distribution licensees, availability of transmission corridor, pending applications, and short term open access granted and rejected;
(vi) Facilitate generation of periodic reports for market monitoring and surveillance;
(vii) Facilitate any other functions incidental to short term open access as required by SLDC, and (viii) Facilitate any other functions, as directed by the Commission from time to time.
1A-2 SLDC shall be responsible for developing and maintaining UPSLDC-R.
17.2 Regulation 2, Regulation 3, Regulation 4 and Regulation 5 of Schedule-B of the Principal Regulations shall be substituted as under:
"2. Registration with SLDC–
2.1 The injecting entity/ drawee entity shall apply for 'Registration' on format [FORMAT-ST11] with SLDC. The format of ST-11 may preferably be in line with the existing entity registration under National Open Access Registry (NOAR) Portal of National Load Despatch Centre. The registration charges will be as specified in UPERC (Fees & Charges of State Load Despatch Centre and other related matters) Regulations, 2020 as amended from time to time or as specified in any order of the Commission. Such injecting entity/ drawee entity shall declare that necessary infrastructure for time-block wise metering and accounting in accordance with the provisions of UPEGC / IEGC and appropriate communication system in accordance with the provisions of CEA Communication Regulations are in place for the point of injection/ point of drawal, as the case may be.Any new entity shall obtain connectivity to the intra-State transmission system and/or distribution system as per the applicable UPERC Regulations prior to making an application for registration:
mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 21Provided that in case of green energy open access consumers intending registration through Lead GEOA Consumer, the registration charges shall have to be paid by all the individual green energy open access consumers cumulatively.
2.2 An automatic request for concurrence from STU / any other transmission licensee and/or distribution licensee concerned for the point of injection / point of drawal, as the case may be, shall be forwarded on formats [FORMAT-ST12(A)/ (B)] through UPSLDC-R.STU / any other transmission licensee and/or distribution licensee shall convey his concurrence or otherwise on formats [FORMAT-ST13(A)/ (B)] through UPSLDC-R to SLDC within seven (7) working days for such injection/ drawal quantum during the stated period:
Provided that in case of rejection of request for concurrence, STU / any other transmission licensee or distribution licensee shall convey reasons on UPSLDC-R. SLDC may seek clarification from the concerned licensee and take appropriate decision as deemed appropriate.
2.3 SLDC shall conduct a preliminary scrutiny to ensure application is complete in all respects.
In case of any discrepancy/ short coming/ requirement of any further information, SLDC shall intimate concerned entity for rectification of the deficiency within a period of two (2) working days from the date of receipt of FORMAT-ST11 through UPSLDC-R. The injecting entity / drawee entity, as the case may be, shall rectify the deficiency within five (5) working days thereafter, failing which the registration application shall be closed and the registration charges shall be forfeited. SLDC shall convey acceptance of registration or otherwise in FORMAT-ST12 to the injecting entity/ drawee entity, as the case may be,within fifteen (15) working days from the date of receipt of application complete in all respect including receipt of required concurrences. The registration will be valid for a period ofone(1) year and may be renewed there after for a period of one (1) year after obtaining concurrence of STU/ any other transmission licensee and/or distribution licensee by such injecting entity/ drawee entity.The concerned entity shall initiate the process of renewal at least three (3) months in advance, to avoid any discontinuity:
Provided that in case there is any material change with regard to the quantum of power to be inter changed (by more than five (5) percent) using the intra-State transmission and/or distribution system, a fresh registration shall be obtained under these regulations.
2.4 The registration of injecting entity/ drawee entity is aimed at recording basic inputs on the basis of which technical/ operational constraints in transmission and/or distribution system shall be assessed by SLDC be for epermitting open access. It should not be mistaken as agrant/guarantee of short term open access.
2.5 "Concurrence" shall mean in principle consent for allowing use of transmission and/or distribution system during a stated period after due verification of spare capacity, any technical/ operational constraint and availability of necessary infrastructure for time-block wise metering and accounting and appropriate communication system. The concurrence shall be applicable for stated injection quantum or drawal quantum, as the case may be,during the stated period.
2.6 The injecting entity/ drawee entity shall ensure that all details are correct, failing which the registration may be cancelled/ denied by SLDC:
Provided further that in case of any change in the information provided by the entity, it shall be incumbent upon the entity to update the information with SLDC.
3. Registration with GOAR Portal in case of Green Energy Open Access-
3.1 The entity shall obtain registration with SLDC under Regulation 2 of Schedule-B through UPSLDC-R prior to making an application for registration in GOAR Portal as per CERC Regulations/ CNA procedure as applicable.

Application for Grant of Short-Term Open Access–4.1 The short-term open access customer (hereinafter referred to as "customer") intending to avail short term open access shall make an application for a specified quantum and specified time period on format [FORMAT-ST1] with SLDC:
Provided that an application for green energy open access complete in all respect shall be submitted on the GOAR Portal and the same shall get routed to SLDC on UPSLDC-R for grant of short- term green energy open access.
4.2 The customer seeking short term open access shall submit an undertaking that there is a valid contract for the said open access / proposed scheduling and not having entered into power purchase agreement or any other bilateral agreement with more than one person for the capacity (quantum of power) for which short term open access is sought:
Provided that tied up un-requisitioned capacity and untied capacity shall be eligible for proposed scheduling and accordingly shall be considered while granting short term open access.
4.3 Application shall be accompanied by non-refundable application fee of Rs. 5,000/- (or as determined by the Commission from time to time by an order) along with applicable taxes by RTGS/NEFT/IMPS or through any other mode of digital payment in favour of the Officer as notified by SLDC payable at Lucknow. In case of default in payment application fee, SLDC shall reject the application.;
Provided that in case of green energy open access consumers intending to avail open access through Lead GEOA Consumer, the application fee shall have to be paid by all the individual green energy open access consumers cumulatively.
4.4 Application for grant of short term open access may be made under any of the following categories:
4.4.1 Advance application:
(a) Application made on the (D) day for grant of open access starting on or after the (D+3) day, which may fall either in the same month as the (D) day or in the subsequent month.
(b) Scheduling request under Advance application category shall be made on day ahead basis. The revision in schedule shall be as per UPEGC / IEGC.
4.4.2 Exigency application:
(a) An application for grant of open access with scheduling for such capacity shall be received by SLDC within two days prior to the date of scheduling but not later than 1300 Hours of the day immediately preceding the day of scheduling for day-ahead transaction.
For example, open access application with scheduling for 25th day of July shall be received on 23rd day or up to 1300 hours on 24th day of that month.
(b) Application with scheduling received after 1300 Hours of (S-1) day or in the (S) day shall be processed within 8-time blocks.
(c) Short term open access granted under Exigency application category shall be considered as scheduled, which cannot be revised.
5. Grant of Short-Term Open Access by Nodal Agency–
5.1 SLDC shall check open access transaction for congestion of any element (line and transformer) of transmission and/or distribution system involved in transaction and accordingly permit open access, if there is sufficient spare capacity available in transmission and/or distribution system without any system strengthening.
5.2 SLDC shall convey grant of open access or otherwise on format [FORMAT-ST2] to the customer as per timelines stipulated below.
5.2.1 Advance application:
Advance application for short-term open access shall be considered on first-come-first served basis and shall be processed latest by 23:59 hrs of the (D+1) day, 'D' being the date of making the application:
mRrj izns'k vlk/kkj.k xtV] 16 fnlEcj] 2024 23Provided that in case the Nodal Agency fails to process the advance application for grant of green energy open access within the above specified timeline, the same shall be deemed to have been granted subject to the fulfilment of the technical / operational requirements and conditions as specified under these Regulations.
5.2.2 Exigency application:
Exigency application for short term open access with the schedule for (S) day shall be processed as under:
(a) Application received till 1300 hrs of (S-1) day shall be processed after 1300 hrs on (S-1) day on first-come-first-served basis, and shall be finalised by 1500 hrs of (S-1) day.
(b) Application received after 1300 hrs of (S-1) day or in the (S) day shall be processed within 8- time blocks, on first-come-first-served basis.
5.3 In the event of rejection of application for grant of open access, SLDC shall give reasons for such rejection to the customer in writing:
5.4 In the event short term open access as applied for, cannot be granted for full quantum and full period as sought in the application, in view of constraints in transmission system and/or distribution system, the application shall be rejected:
Provided that in case the customer has given consent in its application that open access for part quantum or part period or both may be granted to it, short-term open access for such part quantum and part period or both shall be granted as per available transmission and/or distribution capacity."
17.3 The word "operational" shall be substituted with the words "technical / operational" at two places in Regulation 7.8 of Schedule-B of the Principal Regulations.
