NOTIFICATION

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the "Uttar Pradesh Niji Vishvavidyalaya (Paanchva Sanshodhan) Vidheyak, 2024" introduced in the Uttar Pradesh Legislative Assembly on December 16, 2024.

THE UTTAR PRADESH PRIVATE UNIVERSITIES (FIFTH AMENDMENT) BILL, 2024

further to amend the Uttar Pradesh Private Universities Act, 2019.

IT IS HEREBY enacted in the Seventy-fifth Year of the Republic of India as

follows:-

1. (1) This Act may be called the Uttar Pradesh Private Universities (Fifth Short title and commencement Amendment) Act, 2024.

(2) It shall be deemed to have come into force with effect from the 19th day of

September, 2024.

Amendment 2. In Schedule 2 of the Uttar Pradesh Private Universities Act, 2019 (hereinafter

of Schedule 2 referred to as the "principal Act") after serial no. 44, the Columns of the said Schedule

of U.P. Act shall be amended as below and after serial no. 44 for the newly established Universities

no. 12 of 2019

relation to the establishment of Chandigarh University, Unnao, Uttar Pradesh, by order remove difficulties published in the Gazette direct that the provisions of the principal Act shall during such

period, as may be specified in the order, have effect subject to such adaptations, whether

by way of modification, addition or omission, as it may deem necessary or expedient:

Provided that no such order shall be made after two years from the date of

commencement of this Act.

(2) Every order made under sub-section (1) shall be laid before both Houses of

the State Legislature, as soon as may be, after it is made.

4. (1) The Uttar Pradesh Private University (Seventh

Ordinance Repeal and saving

Amendment) Ordinance, 2024 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action

no. 13 of 2024

taken under the provisions of the principal Act as amended by the

Ordinance referred to in sub-section (1) shall be deemed to have been done

or taken under the corresponding provisions of the principal Act as

amended by this Act as if the provisions of this Act were in force at all

material times.

The Uttar Pradesh Private Universities Act, 2019 (U.P. Act no. 12 of 2019) has been enacted to provide for the establishment of new Private Universities and incorporation of existing Private Universities in the State of Uttar Pradesh for imparting higher education and to regulate their functions and for matters connected therewith or incidental thereto.

In order to provide for the establishment of a new Private University namely, Chandigarh University, Unnao, Uttar Pradesh, it was decided to amend Schedule 2 of the aforesaid Act.

Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Private Universities (Seventh Amendment) Ordinance, 2024 (U.P. Ordinance no. 13 of 2024) was promulgated by the Governor on September 17, 2024.

This Bill is introduced to replace the aforesaid Ordinance.
