IN exercise of powers conferred under Section- 31(2) of Uttar Pradesh Avas Evam Vikas Parishad Adhiniyam, 1965 (Uttar Pradesh Act no. 1 of 1966), the State Government had approved the implementation of Izzatnagar Bhoomi Vikas and Grihsthan Yojana no.-6, Bareilly by Government Order no. 5030/37-2-86-163HB/82, dated December 20, 1985. Accordingly, Uttar Pradesh Housing and Development Board published the notification dated March 12, 1986 in Part-8 of Uttar Pradesh Gazette dated September 20, 1986 under Section-32(1) of the said Act.

It was not found feasible for the Uttar Pradesh Housing and Development Board to run the scheme on the land to be acquired for the implementation of Izzatnagar Land Development and Housing Scheme no. 6, Bareilly notified by the above-mentioned notification. Therefore, after due consideration of the proposal provided by the Board, exercising the powers under sub-section (1) of Section 49 of the Uttar Pradesh Avas Evam Vikas Parishad Adhiniyam, 1965, approval was granted to abandon the said scheme vide Housing Section 2 of Uttar Pradesh Government's notification no. 1919/9-A-2-2001, dated September 14, 2001.

3. Uttar Pradesh Avas Evam Vikas Parishad filed Special Leave Petition no. 22934/2016 in the Hon'ble Supreme Court. The operative part of the order passed on August 26, 2021 in the hearing is as follows:-

......We only wish to make legal position clear that while the High court may be right in finding that upon exercise of power under Section 49 of the 1965 Act, it will only unsettle or modify the scheme and it would not have the effect of withdrawal of the Government from the acquisition, the said power is available to the Government under Section 55 of the 1965 Act read with Section 48 of the Land Acquisition Act, 1894, as per law.

4. Therefore, after due consideration of the proposal of Uttar Pradesh Avas Evam Vikas Parishad made available by the letter number 97/LAC/HQ/125, dated November 2, 2023, the earlier notification dated September 14, 2001 issued under Section 49 of the Uttar Pradesh Avas Evam Vikas Parishad Adhiniyam, 1965 (Uttar Pradesh Act no. 1 of 1966) for Uttar Pradesh Avas Evam Vikas Parishad, Izzatnagar Bhoomi Vikas and Grihasthan Yojana no. 6, Bareilly, in exercise of power under Section 55 of the same Adhiniyam, read with sub-section (1) of Section-48 of the Land Acquisition Act, 1894 (as amended) in the light of judicial point, partially amending it. The Governor grants approval for withdrawal from acquisition of the land involved in the above scheme.
