1--सं(cid:468)(cid:162)(cid:431) नाम और (cid:292)ार(cid:224)भ--1. (1) यह िनयमावली उ(cid:419)र (cid:292)देश आबकार(cid:547) (बीयर के फु टकर (cid:466)व(cid:272)य के अनु(cid:163)ापन(cid:585) का (cid:229)यव(cid:232)थापन) (बाइसवाँ संशोधन) िनयमावली, 2024 कह(cid:547) जायेगी।

(2) यह 1 अ(cid:292)ैल, 2024 से (cid:292)वृ(cid:419) हुई समझी जायेगी ।

2- िनयम-8 का संशोधन--उ(cid:419)र (cid:292)देश आबकार(cid:547) (बीयर के फु टकर (cid:466)व(cid:272)य के अनु(cid:163)ापन(cid:585) का (cid:229)यव(cid:232)थापन) िनयमावली, 2001 ((cid:468)जसे आगे "उ(cid:416) िनयमावली" कहा गया है) म(cid:581), नीचे (cid:232)त(cid:224)भ-1 म(cid:581) (cid:465)दये गये (cid:466)व(cid:429)मान िनयम-8 के (cid:232)थान पर (cid:232)त(cid:224)भ-2 म(cid:581) (cid:465)दया गया िनयम रख (cid:465)दया जायेगा, अथा(cid:91)त ्ः-

फु टकर बीयर क(cid:551) (cid:466)ब(cid:272)(cid:551) क(cid:551) दुकान(cid:585) के लाइस(cid:581)स फु टकर बीयर क(cid:551) (cid:466)ब(cid:272)(cid:551) क(cid:551) दुकान(cid:585) के लाइस(cid:581)स के िलए पा(cid:287) आवेदक(cid:585) को िन(cid:224)निल(cid:468)खत शत(cid:591) पूर(cid:547) के िलए पा(cid:287) आवेदक(cid:585) को िन(cid:224)निल(cid:468)खत शत(cid:591) पूर(cid:547) करनी होगी- अथा(cid:91)त ्-

दुकान का नवीकरण (cid:465)कया जाना अनुमन ्य होगा।

(cid:466)वत ्तीय वष(cid:91) क(cid:551) समाि(cid:431) पर उस वष(cid:91) क(cid:551) जमा

(cid:292)ितभूित िनयमानुसार वापस क(cid:551) जायेगी।

पर(cid:219)तु यह और भी (cid:465)क य(cid:465)द पूव(cid:91)वत(cid:568) वष(cid:574) से

नवीकृ त होती आ रह(cid:547)ं दो जी(cid:466)वत लाइस(cid:581)धार(cid:547) वाली

दुकान(cid:585) का नवीकरण के वल दोन(cid:585) ह(cid:547) लाइस(cid:581)धा(cid:464)रय(cid:585)

के मध ्य नवीकरण हेतु सहमित क(cid:551) दशा म(cid:581) ह(cid:547)

(cid:465)कया जायेगा। सहमित के अभाव म(cid:581) नवीकरण

(क) इस िनयमावली के अधीन लाइस(cid:581)सधार(cid:547) कम ती(cid:301)ता (क) इस िनयमावली के अधीन लाइस(cid:581)सधार(cid:547) कम ती(cid:301)ता के मादक पेय स(cid:465)हत बीयर एवं वाइन के लागत मू(cid:227)य का पूण(cid:91) भुगतान, (cid:468)जसके अ(cid:219)तग(cid:91)त सभी कर, (cid:292)ितफल शु(cid:227)क (अित(cid:464)र(cid:416) (cid:292)ितफल शु(cid:227)क स(cid:465)हत) जो समय-समय पर उद(cid:274)ह(cid:547)त (cid:465)कये जांय, अिधमानतः ई-पेमे(cid:219)ट (cid:220)लेटफाम(cid:91) के मा(cid:218)यम से जमा करने के प(cid:433)ात ् (cid:468)जला के (cid:465)कसी थोक लाइस(cid:581)सधार(cid:547) (cid:466)व0म0-2/(cid:466)व0म0 2(ख) लाइस(cid:581)सधार(cid:547) से आपूित(cid:91) (cid:292)ा(cid:431) करेगा। य(cid:465)द स(cid:224)ब(cid:468)(cid:219)धत (cid:468)जला म(cid:581) (cid:466)व0म0- 2/(cid:466)व0 म0 2(ख) लाइस(cid:581)स (cid:232)वीकृ त नह(cid:547)ं है, तो लाइस(cid:581)सधार(cid:547) आबकार(cid:547) आयु(cid:416) क(cid:551) पूवा(cid:91)नुमित से अ(cid:219)य (cid:468)जला/(cid:468)जल(cid:585) के थोक (cid:466)ब(cid:272)(cid:551) लाइस(cid:581)सधार(cid:547) से आपूित(cid:91) (cid:292)ा(cid:431) करेगा।

य(cid:465)द स(cid:224)ब(cid:468)(cid:219)धत (cid:468)जला म(cid:581) (cid:466)व0म0-2/(cid:466)व0 म0 2(ख) लाइस(cid:581)स (cid:232)वीकृ त नह(cid:547)ं है, तो लाइस(cid:581)सधार(cid:547) आबकार(cid:547) आयु(cid:416) क(cid:551) पूवा(cid:91)नुमित से अ(cid:219)य (cid:468)जला/(cid:468)जल(cid:585) के थोक (cid:466)ब(cid:272)(cid:551) लाइस(cid:581)सधार(cid:547) से आपूित(cid:91) (cid:292)ा(cid:431) करेगा।

अपया(cid:91)(cid:431) आपूित(cid:91) क(cid:551) (cid:468)(cid:232)थित म(cid:581) (cid:468)जला आबकार(cid:547) अपया(cid:91)(cid:431) आपूित(cid:91) क(cid:551) (cid:468)(cid:232)थित म(cid:581) (cid:468)जला आबकार(cid:547) अिधकार(cid:547) आबकार(cid:547) आयु(cid:416) से आदेश (cid:292)ा(cid:431) करेगा।

लाइस(cid:581)सधार(cid:547) बोतल(cid:585) के लेबुल(cid:585) पर अं(cid:465)कत फु टकर मू(cid:227)य से अिधक मू(cid:227)य उपभो(cid:416)ाओं से नह(cid:547)ं लेगा और य(cid:465)द ऐसा करता पाया जायेगा तो उसे िनयमानुसार द(cid:468)(cid:214)डत (cid:465)कया जायेगा।

ती(cid:301)ता के मादक पेय क(cid:551) बोतल(cid:585) के लेबुल(cid:585) पर रा(cid:207)य सरकार क(cid:551) अनुमित से आबकार(cid:547) आयु(cid:416) (cid:430)ारा यथा िनधा(cid:91)(cid:464)रत अिधकतम (cid:466)ब(cid:272)(cid:551) मू(cid:227)य अं(cid:465)कत होगा।

      का  उठान  करने  म(cid:581)  (cid:466)वफल  रहता  है  तो  वह
      सम ्ब(cid:468)(cid:219)धत  माह  के   बकाया  राजस ्व  के   समतुल ्य
      10 (cid:465)दवस के  अंदर अित(cid:464)रक्त (cid:292)ितभूित जमा करने
      क(cid:551)  अपे(cid:162)ा  क(cid:551)  जायेगी  (cid:468)जसम(cid:581)  (cid:466)वफल  रहने  पर
      लाइस(cid:581)स  (cid:232)वत:  िनर(cid:232)त  हो  जायेगा  और  बकाया
      राज(cid:232)व क(cid:551) िनयमानुसार वसूली क(cid:551) (cid:292)(cid:465)कया आर(cid:224)भ
      क(cid:551)  जायेगी।  दुकान  पर  अ(cid:466)व(cid:272)(cid:551)त  (cid:232)टाक  ज(cid:222)त  कर

िलया जायेगा।

अपने  िनधा(cid:91)(cid:464)रत  मािसक  (cid:219)यूनतम  (cid:292)(cid:215)याभूत  राज(cid:232)व
के   समतु(cid:227)य  म(cid:465)दरा  (बीयर,  वाइन  तथा  एल.ए.बी.)
का उठान करने म(cid:581) (cid:466)वफल रहता है तो वह सम ्ब(cid:468)(cid:219)धत
माह  के   बकाया  राजस ्व  के   समतुल ्य    10  (cid:465)दवस  के
अंदर अित(cid:464)रक्त (cid:292)ितभूित जमा करने क(cid:551) अपे(cid:162)ा क(cid:551)
जायेगी  (cid:468)जसम(cid:581)  (cid:466)वफल  रहने  पर  लाइस(cid:581)स  (cid:232)वत:
िनर(cid:232)त  हो  जायेगा  और  बकाया  राज(cid:232)व  क(cid:551)
िनयमानुसार वसूली क(cid:551) (cid:292)(cid:465)कया आर(cid:224)भ क(cid:551) जायेगी।
दुकान पर अ(cid:466)व(cid:272)(cid:551)त (cid:232)टाक ज(cid:222)त कर िलया जायेगा।

(cid:292)थम एवं पश ्चात ्वत(cid:568) (cid:287)ैमािसक म(cid:581) (cid:219)यूनतम (cid:287)ैमािसक राजस ्व के उठान म(cid:581) कमी को (cid:292)शमन धनरािश जमा करते हुए (cid:468)जला आबकार(cid:547) अिधकार(cid:547) क(cid:551) अनु(cid:163)ा से अगले (cid:287)ैमािसक म(cid:581) पूण(cid:91) कर िलया जाना अनुमन ्य होगा।

एतद(cid:430)ारा (cid:292)ित(cid:232)था(cid:466)पत िनयम

तथा(cid:466)प संबंिधत माह/(cid:287)ैमास के बकाया राजस ्व के

(दो) अित(cid:464)रक्त (cid:292)ितभूित िनयत समय के भीतर जमा समतुल ्य अित(cid:464)रक्त (cid:292)ितभूित समयांतग(cid:91)त जमा करने क(cid:551) दशा म(cid:581) अगले माह हेतु अवधा(cid:464)रत राजस ्व के समतुल ्य उठान एवं (cid:466)पछले (cid:287)ैमास तक के बकाया राजस ्व के समतुल ्य िनकासी लाइस(cid:581)सधार(cid:547) (cid:430)ारा ली जा सके गी। (cid:465)कसी माह/(cid:287)ैमास तक अवधा(cid:464)रत कु ल चिलत राजस ्व के समतुल ्य उठान कर िलये जाने क(cid:551) दशा म(cid:581) पूव(cid:91) म(cid:581) जमा अित(cid:464)रक्त (cid:292)ितभूित (cid:468)जला आबकार(cid:547) अिधकार(cid:547) (cid:430)ारा अन ्य कोई बकाया न रहने क(cid:551) स ् िथित म(cid:581) तुरन ्त वापस कर द(cid:547) जायेगी। अगले (cid:287)ैमास म(cid:581) अपे(cid:468)(cid:162)त राज(cid:232)व ((cid:466)पछले (cid:287)ैमास के बकाया राज(cid:232)व स(cid:465)हत) का उठान न करने पर (cid:292)शमन क(cid:551) काय(cid:91)वाह(cid:547) क(cid:551) जायेगी।

(दो) अित(cid:464)रक्त (cid:292)ितभूित िनयत समय के भीतर जमा करने और गत माह के मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व म(cid:581) कमी के समतु(cid:227)य बीयर/वाइन/एल.ए.बी.

उठाने म(cid:581) (cid:466)वल(cid:224)ब के मष(cid:91)ण के प(cid:433)ात लाइस(cid:581)सधार(cid:547) को गतमाह के बकाया राज(cid:232)व और चालू माह के (cid:219)युनतम (cid:292)(cid:215)याभूत राज(cid:232)व का उठान अनुम(cid:219)य होगा।

(तीन) इस (cid:292)कार जमा क(cid:551) गयी अित(cid:464)र(cid:416) (cid:292)ितभूित, करने और गत माह के मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व म(cid:581) कमी के समतु(cid:227)य बीयर/वाइन/एल.ए.बी.

(तीन) इस (cid:292)कार जमा क(cid:551) गयी अित(cid:464)र(cid:416) (cid:292)ितभूित, अगले माह के मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व स(cid:465)हत गत माह म(cid:581) इस (cid:292)कार हुयी कमी के बराबर बीयर, वाइन और कम ती(cid:301)ता के मादक पेय का उठान (cid:465)कये जाने के प(cid:433)ात ् वापस कर द(cid:547) जायेगी।

(चार) य(cid:465)द लाइस(cid:581)सधार(cid:547) (cid:466)व(cid:419)ीय वष(cid:91) क(cid:551) समाि(cid:431) से पहले अगले माह के मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व स(cid:465)हत गत माह म(cid:581) इस (cid:292)कार हुयी कमी के बराबर बीयर, वाइन और कम ती(cid:301)ता के मादक पेय का उठान (cid:465)कये जाने के प(cid:433)ात ् वापस कर द(cid:547) जायेगी।

(चार) य(cid:465)द लाइस(cid:581)सधार(cid:547) (cid:466)व(cid:419)ीय वष(cid:91) क(cid:551) समाि(cid:431) से पहले एक या अिधक माह(cid:585) क(cid:551) मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व के बराबर बीयर, वाइन और कम ती(cid:301)ता के मादक पेय का उठान करने म(cid:581) (cid:466)वफल रहता है तो उसके (cid:430)ारा जमा क(cid:551) गयी अित(cid:464)र(cid:416) (cid:292)ितभूित एवं (cid:292)ितभूित को राज(cid:232)व क(cid:551) ऐसी कमी के सापे(cid:162) समायो(cid:468)जत कर ली जायेगी और शेष (cid:292)ितभूित वापस कर द(cid:547) जायेगी।

एक या अिधक माह(cid:585) क(cid:551) मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व के बराबर बीयर, वाइन और कम ती(cid:301)ता के मादक पेय का उठान करने म(cid:581) (cid:466)वफल रहता है तो उसके (cid:430)ारा जमा क(cid:551) गयी अित(cid:464)र(cid:416) (cid:292)ितभूित एवं (cid:292)ितभूित को राज(cid:232)व क(cid:551) ऐसी कमी के सापे(cid:162) समायो(cid:468)जत कर ली जायेगी और शेष (cid:292)ितभूित वापस कर द(cid:547) जायेगी।

(तीन) अंतरणकता(cid:91) लाइस(cid:581)सधार(cid:547) के अनुरोध का (तीन) अंतरणकता(cid:91) लाइस(cid:581)सधार(cid:547) के अनुरोध का अनुमोदन (cid:465)कये जाने पर उसके (cid:430)ारा अंत(cid:464)रत (cid:465)कये जाने हेतु करारकृ त कोटा को उसके मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व म(cid:581) से घटा (cid:465)दया जायेगा और उसे उठा िलया गया समझा जायेगा तथा उसे अंत(cid:464)रती लाइस(cid:581)धार(cid:547) के लेखा म(cid:581) अंत(cid:464)रत मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व के (cid:509)प म(cid:581) जोड़ (cid:465)दया जायेगा। यह मा(cid:287)ा अंत(cid:464)रती लाइस(cid:581)सधार(cid:547) के मूल मािसक (cid:219)यूनतम (cid:292)(cid:215)याभूत राज(cid:232)व के अित(cid:464)र(cid:416) होगी और उसका मूल कोटा उठाये जाने से सम ्ब(cid:468)(cid:219)धत उसका दािय(cid:215)व (cid:292)भा(cid:466)वत नह(cid:547)ं होगा।

In exercise of the powers under sections 24-B and 41of the United Provinces Excise Act, 1910

(U. P. Act no-IV of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U. P. Act

hereby makes the following rules with a view to amend the Uttar Pradesh Excise (Settlement of Licences for

1. Short title and commencement–1-(1) These rules may be called the Uttar Pradesh Excise (Settlement of Licences for Retail Sale of Beer) (Twenty second Amendment) Rules, 2024.

(2) They shall be deemed to have come into force with effect from 1st April, 2024.

two licenses which have been renewed since previous years, if one of the licencees dies before renewal and his legal heir or nominee does not give application or he is found unsuitable, then on receipt of application, renewal of shop in favour of other surviving licencee will be permissible with the restriction of depositing the entire security of the shop for the respective year by the prescribed date. At the end of the financial year, the security deposit of that year will be returned as per rules.

(iv) that in case he is selected as licensee he will furnish a certificate issued by the District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank of assistant commissioner of police nominated by the police commissioner of the concerning police Commissionerate of which he is the resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record prior to issuance of license.

(v) that he shall not employ and salesman or representative who has criminal background as mentioned in clause (iii) or, who suffers from any infectious contagious diseases or is below twenty-one years of age or a woman. 18 (A) Interim Settlement-

(a) In case a licence is suspended, cancelled or surrendered in accordance with the provisions of these rules or if the shop remains unsettled for any reason the licensing authority may make interim settlement of the shop at the highest offer on the payment of daily licence fee, on such rates as notified by the Excise Commissioner with prior sanction of the Government for a maximum period of fourteen days at one stretch or till the date of regular settlement, whichever is earlier. In case of obtaining two or more equal offers for one shop, settlement shall be done through manual public lottery. Such licensee shall also be required to deposit security amount according to the rate of daily licence fees for the period of interim settlement. Such settlement of shop can be done more than twice by the licencing authority but in such situation it will be essential to inform the Excise Commissioner:

(b) In case a license is cancelled or surrendered in accordance with the provisions of these rules, regular settlement of the shop shall be done as soon as possible by the Licensing Authority through the process of e-tender in mid session after giving public advertisement. The intimation of aforesaid settlement shall be sent forthwith to the Excise Commissioner.
