1. संि(cid:177)(cid:302) नाम और (cid:255)ार(cid:204)भ–(1) यह िनयमावली उ(cid:176)र (cid:255)देश आबकारी िवदेशी शराब (बीयर को छोड़कर) क(cid:236) फु टकर िब(cid:248)(cid:236) के अनु(cid:178)ापन(cid:332) का (cid:211)यव(cid:214)थापन (बाइसवॉ संशोधन) िनयमावली, 2024 कही जायेगी। (2) यह िदनांक 01 अ(cid:255)ैल, 2024 से (cid:255)वृ(cid:176) ह(cid:242)ई समझी जायेगी।

2. िनयम-8 का संशोधन– उ(cid:176)र (cid:255)देश आबकारी िवदेशी शराब (बीयर को छोड़कर) क(cid:236) फु टकर िब(cid:248)(cid:236) के अनु(cid:178)ापन(cid:332) का (cid:211)यव(cid:214)थापन िनयमावली, 2001 (िजसे आगे उ(cid:265) िनयमावली कहा गया है) म(cid:164) नीचे (cid:214)त(cid:204)भ-1 म(cid:164) िदये गये िव(cid:299)मान िनयम-8 के (cid:214)थान पर (cid:214)त(cid:204)भ-2 म(cid:164) िदया गया िनयम रख िदया जायेगा, अथा(cid:170)त्ः–

8- आवेदक के िलए पा(cid:253)ता क(cid:236) शत(cid:165)ः-

फु टकर िवदेशी मिदरा क(cid:236) िब(cid:248)(cid:236) क(cid:236) दुकान(cid:332) के लाइस(cid:164)स के िलए पा(cid:253) आवेदक(cid:332) को िन(cid:204)निलिखत शत(cid:166) पूरी करनी होगी- अथा(cid:170)त्-

(क) आवेदन एक (cid:211)यि(cid:265) (cid:300)ारा हो जो भारत का नाग(cid:229)रक हो, पर(cid:198)तु नवीकरण क(cid:236) ि(cid:214)थित म(cid:164) सह-आवेदक, यिद कोई हो जो भारत का नाग(cid:229)रक हो, भी मा(cid:198)य होगा।

भागीदार वाली फम(cid:170) अथवा क(cid:204)पनी फु टकर लाइस(cid:164)स क(cid:236) (cid:214)वीकृ ित के िलये पा(cid:253) नह(cid:233) होगी। इसी (cid:255)कार थोक िव(cid:248)े ता अथवा आसवनी/ मिदरा िनमा(cid:170)ता भी िकसी (cid:255)कार क(cid:236) फु टकर दुकान का लाइस(cid:164)स धारण करने के िलये पा(cid:253) नह(cid:233) होगा।

दुकान के आवंटन के प(cid:306)ात् आवेदक क(cid:236) ि(cid:214)थित म(cid:164) कोई प(cid:229)रवत(cid:170)न अनुम(cid:198)य न होगा, लाइस(cid:164)सधारी क(cid:236) मृ(cid:194)यु क(cid:236) दशा म(cid:164) लाइस(cid:164)सधारी (cid:300)ारा िदये गये नामिनद(cid:165)शन शपथ प(cid:253) (यिद कोई हो) के अनुसार िविधक वा(cid:229)रस(cid:332)/प(cid:229)रवार के सद(cid:214)य(cid:332)/ िनकट स(cid:204)बि(cid:198)धय(cid:332), के नाम यिद अ(cid:198)यथा अपा(cid:253) न ह(cid:332), लाइस(cid:164)स क(cid:236) शेष अविध के िलए लाइस(cid:164)सधारक बने रहने के िलये नामिनद(cid:165)शन शपथ प(cid:253) म(cid:164) विण(cid:170)त वरीयता के अनुसार िवचा(cid:229)रत िकये जाय(cid:164)गे।

पर(cid:198)तु यह िक मृतक लाइस(cid:164)सधारी के नामिनद(cid:165)शन शपथ प(cid:253) क(cid:236) अनुपल(cid:202)धता क(cid:236) ि(cid:214)थित म(cid:164) उसका िविधक वा(cid:229)रस यिद अ(cid:198)यथा पा(cid:253) है लाइस(cid:164)स क(cid:236) अवशेष अविध के िलए लाइस(cid:164)सधारक बना रह सकता है।

पर(cid:198)तु यह और िक यिद संयु(cid:265) (cid:322)प से दो (cid:211)यि(cid:265)य(cid:332) (cid:300)ारा लाइस(cid:164)स (cid:255)ा(cid:302) िकया गया हो, तो िकसी एक (cid:211)यि(cid:265) क(cid:236) (cid:170)(cid:265)ानुसार चयिनत मृ(cid:194)यु क(cid:236) ि(cid:214)थित म(cid:164) जीिवत (cid:211)यि(cid:265) एवं उपयु मृत लाइस(cid:164)सधारी का िविधक वा(cid:229)रस अथवा नामिनद(cid:165)िशती, यिद अ(cid:198)यथा पा(cid:253) ह(cid:332), लाइस(cid:164)स क(cid:236) शेष अविध के िलए लाइस(cid:164)सधारक बने रह सकते है। (cid:211)यि(cid:265)य(cid:332) के िविधक दािय(cid:194)व(cid:332) म(cid:164) कोई भेद नह(cid:233) िकया जायेगा जो संयु(cid:265) (cid:322)प से और अलग- अलग उ(cid:176)रदायी ह(cid:332)गे;

पर(cid:198)तु यह और िक पूव(cid:170) वष(cid:334) से नवीकृ त होती आ

रह(cid:233) दो लाइस(cid:164)स वाली दुकान(cid:332) के मामल(cid:332) म(cid:164) नवीकरण के पूव(cid:170) ही िकसी एक लाइस(cid:164)धारी क(cid:236) मृ(cid:194)यु हो जाती है

तथा उसके िविधक वा(cid:229)रस अथवा नामिनद(cid:165)िशती (cid:300)ारा

आवेदन नही िकया जाता है अथवा अनुपयु(cid:179)त पाया

जाता है तो, आवेदन (cid:255)ा(cid:200)त होने पर, दूसरे जीिवत लाइस(cid:164)धारी के प(cid:224)ा म(cid:164) स(cid:204)बि(cid:198)धत वष(cid:170) हेतु दुकान क(cid:236) संपूण(cid:170) (cid:255)ितभूित, िविहत िदनांक तक जमा करने के

िनब(cid:171)धन के साथ, दुकान का नवीकरण िकया जाना अनुम(cid:198)य होगा। िव(cid:194)तीय वष(cid:170) क(cid:236) समाि(cid:302) पर उस वष(cid:170) क(cid:236)

जमा (cid:255)ितभूित िनयमानुसार वापस क(cid:236) जायेगी।

पर(cid:198)तु यह और भी िक यिद पूव(cid:170)वत(cid:234) वष(cid:333) से नवीकृ त

होती आ रह(cid:233) दो जीिवत लाइस(cid:164)धारी वाली दुकान(cid:332) का नवीकरण के वल दोन(cid:332) ही लाइस(cid:164)धा(cid:229)रय(cid:332) के म(cid:197)य

नवीकरण हेतु सहमित क(cid:236) दशा म(cid:164) ही िकया जायेगा।

सहमित न होने क(cid:236) दशा म(cid:164) नवीकरण िकया जाना

अनुम(cid:198)य नही होगा।

(ख) आवेदन प(cid:253) (cid:255)ा(cid:302) िकये जाने के िलये िनयत अविध के (cid:255)थम

(एक)यह िक उसके पास समय-समय पर यथा संशोिधत उ(cid:176)र (cid:255)देश आबकारी दुकान(cid:332) क(cid:236) सं(cid:180)या एवं ि(cid:214)थित िनयमावली, 1968 के उपबंध(cid:332) के अनुसार उस (cid:214)थान पर दुकान खोलने हेतु उपयु(cid:265) प(cid:229)रसर है अथवा उसने िकराए पर उस (cid:214)थान पर उपयु(cid:265) प(cid:229)रसर का (cid:255)ब(cid:198)ध िकया है;

(एक) यह िक उसके पास समय-समय पर यथा संशोिधत उ(cid:176)र (cid:255)देश आबकारी दुकान(cid:332) क(cid:236) सं(cid:180)या एवं ि(cid:214)थित िनयमावली, 1968 के उपबंध(cid:332) के अनुसार उस (cid:214)थान पर दुकान खोलने हेतु उपयु(cid:265) प(cid:229)रसर है अथवा उसने िकराए पर उस (cid:214)थान पर उपयु(cid:265) प(cid:229)रसर का (cid:255)ब(cid:198)ध िकया है;

(दो) यह िक उसक(cid:236) दुकान के (cid:255)(cid:214)तािवत प(cid:229)रसर के िनमा(cid:170)ण म(cid:164) (दो) यह िक उसक(cid:236) दुकान के (cid:255)(cid:214)तािवत प(cid:229)रसर के िनमा(cid:170)ण म(cid:164) िकसी िविध अथवा िनयम(cid:332) का उ(cid:208)लंघन नह(cid:233) िकया गया है; िकसी िविध अथवा िनयम(cid:332) का उ(cid:208)लंघन नह(cid:233) िकया गया है;

(तीन) यह िक उसका एवं उसके प(cid:229)रवार के सद(cid:214)य(cid:332) का नैितक च(cid:229)र(cid:253) अ(cid:184)छा है और उनक(cid:236) कोई अपरािधक पृ(cid:311)भूिम नह(cid:233) है और संयु(cid:265) (cid:255)ा(cid:198)त आबकारी अिधिनयम, 1910 या (cid:214)वापक ओषिध एवं मनः(cid:255)भावी अिधिनयम 1985 के अधीन द(cid:193)डनीय िकसी अपराध या िकसी अ(cid:198)य सं(cid:178)ेय एवं गैर जमानती अपराध के िलए दोषिस(cid:294) न िकया गया हो;

(चार) यह िक लाइस(cid:164)सधारी के (cid:322)प म(cid:164) उसके चयिनत हो जाने क(cid:236) दशा म(cid:164) िजला, जहॉ का वह िनवासी है, के िजला कले(cid:179)टर या स(cid:204)बि(cid:198)धत िजला के पुिलस अधी(cid:177)क/ व(cid:229)र(cid:311) पुिलस अधी(cid:177)क या स(cid:204)बि(cid:198)धत पुिलस किम(cid:212)नरी के पुिलस आयु(cid:179)त (cid:300)ारा नामिनिद(cid:170)(cid:310), सहायक पुिलस आयु(cid:179)त क(cid:236) र(cid:167)क से अिन(cid:204)न अिधकारी (cid:300)ारा जारी (cid:255)माण-प(cid:253) यह दशा(cid:170)ते ह(cid:242)ए (cid:255)(cid:214)तुत करना होगा िक लाइस(cid:164)स जारी होने के पूव(cid:170) उसका एवं उसके प(cid:229)रवार के सद(cid:214)य(cid:332) का नैितक च(cid:229)र(cid:253) अ(cid:184)छा है एवं उनक(cid:236) कोई आपरािधक पृ(cid:311)भूिम या आपरािधक अिभलेख नह(cid:233) है।

(पाँच) यह िक वह िकसी ऐसे (cid:211)यि(cid:265) को िब(cid:248)(cid:236)कता(cid:170) या (cid:255)ितिनिध के (cid:322)प म(cid:164) िनयोिजत नह(cid:233) करेगा, िजसक(cid:236) कोई आपरािधक पृ(cid:311)भूिम होगी, जैसा िक ख(cid:193)ड-तीन म(cid:164) उि(cid:208)लिखत है या जो िकसी सं(cid:248)ामक रोग से (cid:250)िसत हो या 21 वष(cid:170) से कम आयु का हो या मिहला हो। लाइस(cid:164)सधारी िजला आबकारी अिधकारी से रा(cid:186)य सरकार (cid:300)ारा समय-समय पर यथािविहत फ(cid:236)स के संदाय के उपरा(cid:198)त (cid:255)ािधकृ त िब(cid:248)े ता/(cid:255)ािधकृ त (cid:255)ितिनिध का फोटोयु(cid:265) नौकरनामा (cid:255)ा(cid:302) करेगा।

(छः) यह िक उस पर िकसी साव(cid:170)जिनक देय(cid:332) या सरकारी देय(cid:332) का (छः) यह िक उस पर िकसी साव(cid:170)जिनक देय(cid:332) या सरकारी देय(cid:332) का बकाया नह(cid:233) है।

(cid:214)त(cid:204)भ-1 िव(cid:299)मान िनयम

(cid:214)त(cid:204)भ-2 एतद्(cid:300)ारा (cid:255)ित(cid:214)थािपत िनयम

(आठ) यह िक आवेदक मािफया गितिविधय(cid:332), असामािजक गतिविधय(cid:332) एवं संगिठत अपरािधक गितिविधय(cid:332) म(cid:164) िल(cid:302) नह(cid:233) है। यिद लाइस(cid:164)स (cid:255)ा(cid:302) हो जाने के उपरा(cid:198)त यह (cid:255)मािणत हो जाता है िक वह मािफया गितिविधय(cid:332), असामािजक गितिविधय(cid:332) एवं संगिठत अपरािधक गितिविधय(cid:332) म(cid:164) िल(cid:302) है तो उसे आवंिटत िकया गया लाइस(cid:164)स िनर(cid:214)त कर िदया जायेगा।

जाता है िक वह मािफया गितिविधय(cid:332), असामािजक गितिविधय(cid:332) एवं संगिठत अपरािधक गितिविधय(cid:332) म(cid:164) िल(cid:302) है तो उसे आवंिटत िकया गया लाइस(cid:164)स िनर(cid:214)त कर िदया जायेगा।

(नौ) यह िक आवेदक बार काउिसंल म(cid:164) रिज(cid:214)(cid:367)ीकृ त अिधव(cid:265)ा नह(cid:233) है। यिद लाइस(cid:164)स (cid:255)ा(cid:302) कर लेने पर उसे बार काउिसंल म(cid:164) रिज(cid:214)(cid:367)ीकृ त अिधव(cid:265)ा पाया जाता है तो लाइस(cid:164)स िनर(cid:214)त कर िदया जायेगा। रा(cid:186)य सरकार का कम(cid:170)चारी भी लाइस(cid:164)स

(cid:214)वीकृ ित हेतु आवेदन करने के िलये अपा(cid:253) होगा।

(दस) यह िक लाइस(cid:164)सधारी के (cid:321)प म(cid:164) चयन हो जाने पर चयन के अड़तालीस घंटे के भीतर धरोहर धनरािश का ब(cid:167)क (cid:369)ॉ(cid:201)ट, िजसे ऑन-लाइन आवेदन के साथ अपलोड िकया गया हो, को िजला आबकारी अिधकारी के काया(cid:170)लय म(cid:164) जमा करा को िजला आबकारी अिधकारी के काया(cid:170)लय म(cid:164) जमा करा देगा।

नवीकरण फ(cid:236)स व लाइस(cid:164)स फ(cid:236)स, यिद उसके (cid:300)ारा जमा क(cid:236)

(क) इस िनयमावली के अधीन लाइस(cid:164)सधारी िवदेशी मिदरा (वाइन सिहत) के लागत मू(cid:208)य का पूण(cid:170) भुगतान, िजसके अ(cid:198)तग(cid:170)त सभी कर, (cid:255)ितफल शु(cid:208)क (अित(cid:229)र(cid:265) (cid:255)ितफल शु(cid:208)क सिहत) जो समय-समय पर उद(cid:250)हीत िकये जांय, अिधमानतः ई-पेमे(cid:198)ट (cid:200)लेटफाम(cid:170) के मा(cid:197)यम से जमा करने के प(cid:306)ात् िजला के िकसी थोक लाइस(cid:164)सधारी (िवदेशी मिदरा-2/ िवदेशी मिदरा-2बी) से आपूित(cid:170) (cid:255)ा(cid:302) करेगा। यिद स(cid:204)बि(cid:198)धत िजला म(cid:164) िवदेशी मिदरा-2/ िवदेशी मिदरा-2बी का लाइस(cid:164)स (cid:214)वीकृ त नह(cid:233) है या आपूित(cid:170) बािधत है तो लाइस(cid:164)सधारी, आबकारी आयु(cid:265) क(cid:236) पूवा(cid:170)नुमित से अ(cid:198)य िजला/िजल(cid:332) के थोक िब(cid:248)(cid:236) लाइस(cid:164)सधारी (िवदेशी मिदरा- 2/ िवदेशी मिदरा-2बी) से िवदेशी मिदरा (वाइन सिहत)क(cid:236) आपूित(cid:170) (cid:255)ा(cid:302) करेगा।

(क) इस िनयमावली के अधीन लाइस(cid:164)सधारी िवदेशी मिदरा (वाइन सिहत) के लागत मू(cid:208)य का पूण(cid:170) भुगतान, िजसके अ(cid:198)तग(cid:170)त सभी कर, (cid:255)ितफल शु(cid:208)क (अित(cid:229)र(cid:265) (cid:255)ितफल शु(cid:208)क सिहत) जो समय-समय पर उद(cid:250)हीत िकये जाये, अिधमानतः ई-पेमे(cid:198)ट (cid:200)लेटफाम(cid:170) के मा(cid:197)यम से जमा करने के प(cid:306)ात् िजला के िकसी थोक लाइस(cid:164)सधारी (िवदेशी मिदरा-2/ िवदेशी मिदरा-2बी) से आपूित(cid:170) (cid:255)ा(cid:302) करेगा। यिद स(cid:204)बि(cid:198)धत िजला म(cid:164) िवदेशी मिदरा-2/ िवदेशी मिदरा-2बी का लाइस(cid:164)स (cid:214)वीकृ त नह(cid:233) है या आपूित(cid:170) बािधत है तो लाइस(cid:164)सधारी, आबकारी आयु(cid:265) क(cid:236) पूवा(cid:170)नुमित से अ(cid:198)य िजला/िजल(cid:332) के थोक िब(cid:248)(cid:236) लाइस(cid:164)सधारी (िवदेशी मिदरा- 2/ िवदेशी मिदरा-2बी) से िवदेशी मिदरा (वाइन सिहत)क(cid:236) आपूित(cid:170) (cid:255)ा(cid:302) करेगा।

िकसी िजला म(cid:164) अपया(cid:170)(cid:302) आपूित(cid:170) क(cid:236) ि(cid:214)थित म(cid:164) िजला आबकारी अिधकारी, आबकारी आयु(cid:265) से आदेश (cid:255)ा(cid:302) करेगा।

(ख) लाइस(cid:164)सधारी के िलए (cid:250)ाहक(cid:332) क(cid:236) मौसमी आव(cid:212)यकताओं के अनुसार ि(cid:214)थर तथा िनर(cid:198)तर गुणव(cid:176)ापूण(cid:170) आपूित(cid:170) सुिनि(cid:306)त करने और साथ ही साथ बाजार म(cid:164) नकली आपूित(cid:170)य(cid:332) के िक(cid:198)ही अवसर(cid:332) को दूर करने हेतु लगातार िवदेशी मिदरा का उठान करना बा(cid:197)यकारी होगा। उसे िनर(cid:198)तर पोट(cid:170)ल पर िलिखत मांगप(cid:253) अथवा संदेश थोक िव(cid:248)े ता को (cid:255)(cid:214)तुत करना होगा। उपरो(cid:265) आव(cid:212)यकताओं क(cid:236) पूित(cid:170) हेतु लाइस(cid:164)सधारी को कम से कम शासन (cid:300)ारा िवदेशी मिदरा का िकसी माह हेतु िनधा(cid:170)(cid:229)रत (cid:255)ितफल शु(cid:208)क के समतु(cid:208)य क(cid:236) िवदेशी मिदरा क(cid:236) मा(cid:253)ा का उठान करना बा(cid:197)यकारी होगा;

(ग) (एक) यिद लाइस(cid:164)सधारी िकसी माह म(cid:164) कम से कम अपने मािसक (cid:198)यूनतम (cid:255)(cid:194)याभूत राज(cid:214)व के समतु(cid:208)य मिदरा (िवदेशी मिदरा, वाइन एवं कम ती(cid:260)ता के मादक पेय) का उठान करने म(cid:164) िवफल रहता है तो वह स(cid:204)बि(cid:198)धत माह के बकाया राज(cid:214)व के समतु(cid:208)य 10 िदवस के अंदर अित(cid:229)र(cid:179)त (cid:255)ितभूित जमा करने क(cid:236) अपे(cid:177)ा क(cid:236) जायेगी िजसम(cid:164) िवफल रहने पर लाइस(cid:164)स (cid:214)वत: िनर(cid:214)त हो जायेगा और बकाया राज(cid:214)व क(cid:236) िनयमानुसार वसूली क(cid:236) (cid:255)िकया आर(cid:204)भ क(cid:236) जायेगी। दुकान पर अिव(cid:248)(cid:236)त (cid:214)टाक भी ज(cid:202)त कर िलया जायेगा।

समतु(cid:208)य उठान लाइस(cid:164)सधारी (cid:300)ारा िकया जा सके गा।

िकसी माह/(cid:253)ैमास के िलए िनधा(cid:170)(cid:229)रत कु ल राज(cid:214)व के

समतु(cid:208)य उठान कर िलये जाने पर पूव(cid:170) म(cid:164) जमा अित(cid:229)र(cid:179)त

(cid:255)ितभूित िजला आबकारी अिधकारी (cid:300)ारा अ(cid:198)य कोई

बकाया शेष न रहने क(cid:236) ि(cid:214)थित म(cid:164) तुरंत वापस कर दी

जायेगी। अगले माह/(cid:253)ैमास म(cid:164) िपछले माह/(cid:253)ैमास के

बकाया राज(cid:214)व सिहत अपेि(cid:177)त राज(cid:214)व के समतु(cid:208)य उठान

न करने पर (cid:255)शमन क(cid:236) काय(cid:170)वाही क(cid:236) जायेगी।

एतद्(cid:300)ारा (cid:255)ित(cid:214)थािपत िनयम

(घ) (एक) अपनी दुकान के मािसक (cid:198)यूनतम (cid:255)(cid:194)याभूत राज(cid:214)व, िजसे वह उठाने म(cid:164) स(cid:177)म न हो, अ(cid:198)य दुकान अथवा दुकान(cid:332) को अ(cid:198)त(cid:229)रत करना चाहने वाले लाइस(cid:164)सधारी को, िकसी आबकारी िजला के भीतर मािसक आधार पर ऐसे अंश(कोटा) का अंतरण करने क(cid:236) अनु(cid:178)ा (cid:255)दान क(cid:236) जा सकती है।

(दो) अंतरणकता(cid:170) लाइस(cid:164)सधारी, अंत(cid:229)रती लाइस(cid:164)सधारी क(cid:236) सहमित से िजला के िजला आबकारी अिधकारी से अनुरोध करेगा। अंतरण क(cid:236) िनब(cid:198)धन(cid:332) का िविन(cid:306)य, दोन(cid:332) अंतरणकता(cid:170) और अंत(cid:229)रती लाइस(cid:164)सधा(cid:229)रय(cid:332) (cid:300)ारा पार(cid:214)प(cid:229)रक (cid:321)प से िकया जायेगा।

(तीन) अंतरणकता(cid:170) लाइस(cid:164)सधारी के अनुरोध का अनुमोदन िकये जाने पर उसके (cid:300)ारा अंत(cid:229)रत िकये जाने हेतु करारकृ त कोटा को उसके मािसक (cid:198)यूनतम (cid:255)(cid:194)याभूत राज(cid:214)व म(cid:164) से घटा िदया जायेगा और उसे उठा िलया गया समझा जायेगा तथा उसे अंत(cid:229)रती लाइस(cid:164)धारी के लेखा म(cid:164) अंत(cid:229)रत मािसक (cid:198)यूनतम (cid:255)(cid:194)याभूत राज(cid:214)व के (cid:321)प म(cid:164) जोड़ िदया जायेगा। यह मा(cid:253)ा अंत(cid:229)रती लाइस(cid:164)सधारी के मूल मािसक (cid:198)यूनतम (cid:255)(cid:194)याभूत राज(cid:214)व के अित(cid:229)र(cid:265) होगी और उसका मूल कोटा उठाये जाने से स(cid:204)बि(cid:198)धत उसका दािय(cid:194)व (cid:255)भािवत नह(cid:233) होगा।

पर(cid:198)तु यह िक इस उपब(cid:198)ध के अधीन अंत(cid:229)रत कु ल कोटा, अंतरणकता(cid:170) लाइस(cid:164)सधारी के मािसक (cid:198)यूनतम (cid:255)(cid:194)याभूत राज(cid:214)व के 20 (cid:255)ितशत से अिधक नह(cid:233) होगा।

5. िनयम-18 क का संशोधन–उ(cid:265) िनयमावली म(cid:164), नीचे (cid:214)त(cid:204)भ-1 म(cid:164) िदये गये िव(cid:299)मान िनयम-18क के (cid:214)थान पर (cid:214)त(cid:204)भ-2 म(cid:164) िदया गया िनयम रख िदया जायेगा, अथा(cid:170)त्ः-

18 (क) अ(cid:198)त(cid:229)रम (cid:211)यव(cid:214)थापन-

यिद लाइस(cid:164)स को इस िनयमावली के उपब(cid:198)ध(cid:332) के अनुसरण म(cid:164) िनलि(cid:204)बत, िनर(cid:214)त या समिप(cid:170)त िकया जाता है या यिद िकसी अ(cid:198)य कारण से दुकान का (cid:211)यव(cid:214)थापन होना रह गया हो तो लाइस(cid:164)स (cid:255)ािधकारी सरकार के पूवा(cid:170)नुमोदन से आबकारी आयु(cid:265) (cid:300)ारा यथा अिधसूिचत दर(cid:332) के उ(cid:184)चतम (cid:255)(cid:214)ताव पर दैिनक लाइस(cid:164)स फ(cid:236)स का भुगतान िकए जाने पर दुकान का अ(cid:198)त(cid:229)रम (cid:211)यव(cid:214)थापन एक बार म(cid:164) अिधकतम् 14 िदन(cid:332) के िलए या िनयिमत (cid:211)यव(cid:214)थापन के िदनांक तक, जो भी पहले हो, कर सकता है। एक दुकान के िलये दो या दो से अिधक

समान आफर (cid:255)ा(cid:302) होने पर साव(cid:170)जिनक मैनुअल लाटरी के मा(cid:197)यम से (cid:211)यव(cid:214)थापन कराया जायेगा। ऐसे लाइस(cid:164)सधारी को दैिनक लाइस(cid:164)स फ(cid:236)स क(cid:236) दर के अनुसार अ(cid:198)त(cid:229)रम (cid:211)यव(cid:214)थापन क(cid:236) अविध के िलए (cid:255)ितभूित धनरािश जमा करना भी अपेि(cid:177)त होगा।लाइस(cid:164)स (cid:255)ािधकारी (cid:300)ारा िकसी दुकान का ऐसा (cid:211)यव(cid:214)थापन दो से अिधक बार िकया जा सकता है पर(cid:198)तु ऐसी ि(cid:214)थित म(cid:164) आबकारी आयु(cid:265) को सूिचत िकया जाना अिनवाय(cid:170) होगा।

समान आफर (cid:255)ा(cid:302) होने पर साव(cid:170)जिनक मैनुअल लाटरी के मा(cid:197)यम से (cid:211)यव(cid:214)थापन कराया जायेगा। ऐसे लाइस(cid:164)सधारी को दैिनक लाइस(cid:164)स फ(cid:236)स क(cid:236) दर के अनुसार अ(cid:198)त(cid:229)रम (cid:211)यव(cid:214)थापन क(cid:236) अविध के िलए (cid:255)ितभूित धनरािश जमा करना भी अपेि(cid:177)त होगा। लाइस(cid:164)स (cid:255)ािधकारी (cid:300)ारा िकसी दुकान का ऐसा (cid:211)यव(cid:214)थापन दो से अिधक बार िकया जा सकता है पर(cid:198)तु ऐसी ि(cid:214)थित म(cid:164) आबकारी आयु(cid:265) को सूिचत िकया जाना अिनवाय(cid:170) होगा।

(ख) इस िनयमावली के उपब(cid:198)ध(cid:332) के अनुसार िकसी लाईस(cid:164)स के िनर(cid:214)तीकरण या अ(cid:203)यप(cid:170)ण के मामल(cid:164) म(cid:164) दुकान का म(cid:197)य-स(cid:253) म(cid:164) िनयिमत (cid:211)यव(cid:214)थापन लाइस(cid:164)स (cid:255)ािधकारी (cid:300)ारा शी(cid:325)ाितशी(cid:325) साव(cid:170)जिनक िव(cid:178)ापन देकर ई-टे(cid:193)डर (cid:255)णाली के मा(cid:197)यम से कराया जायेगा। पूव(cid:333)(cid:265) (cid:211)यव(cid:214)थापन क(cid:236) सूचना आबकारी आयु(cid:265) को त(cid:194)काल (cid:255)ेिषत िकया जाना होगा।

(ख) इस िनयमावली के उपब(cid:198)ध(cid:332) के अनुसार िकसी लाईस(cid:164)स के िनर(cid:214)तीकरण या अ(cid:203)यप(cid:170)ण के मामल(cid:164) म(cid:164) दुकान का म(cid:197)य-स(cid:253) म(cid:164) िनयिमत (cid:211)यव(cid:214)थापन लाइस(cid:164)स (cid:255)ािधकारी (cid:300)ारा शी(cid:325)ाितशी(cid:325) साव(cid:170)जिनक िव(cid:178)ापन देकर ई-टे(cid:193)डर (cid:255)णाली के मा(cid:197)यम से कराया जायेगा। म(cid:197)य स(cid:253) म(cid:164) (cid:211)यव(cid:214)थािपत क(cid:236) जाने वाली दुकान(cid:332) के िलए ईिनिवदा (cid:255)ि(cid:248)या म(cid:164) एकल िनिवदा भी (cid:214)वीकार क(cid:236) जायेगी । पूव(cid:333)(cid:265) (cid:211)यव(cid:214)थापन क(cid:236) सूचना आबकारी आयु(cid:265) को त(cid:194)काल (cid:255)ेिषत िकया जाना होगा।

9-लाइस(cid:164)सधारी दुकान के (cid:255)वेश (cid:300)ार पर आबकारी आयु(cid:265) (cid:300)ारा अनुमोिदत (cid:255)प(cid:253)/आकार का एक सहज (cid:320)(cid:212)य साइनबोड(cid:170) लगाएगा, िजसके ऊपर लाइस(cid:164)सधारी का नाम, दुकान क(cid:236) अवि(cid:214)थित, लाइस(cid:164)स क(cid:236) अविध, दुकान खुलने व ब(cid:198)द होने का समय और लाइस(cid:164)स (cid:255)ािधकारी (cid:300)ारा यथा िविहत अ(cid:198)य सूचनाए भी मोटे अ(cid:177)र(cid:332) म(cid:164) मुि(cid:254)त क(cid:236) जाय(cid:164)गी। साइन बोड(cid:170) म(cid:164) िन(cid:204)निलिखत सूचना को (cid:255)दिश(cid:170)त करना होगाः-

19-लाइस(cid:164)सधारी लाइस(cid:164)स क(cid:236) समाि(cid:302) पर अवशेष (cid:214)टाक के लाइस(cid:164)स िदया गया है, लाइस(cid:164)सधारी को लाइस(cid:164)स (cid:255)ा(cid:302) प(cid:229)रसर म(cid:164) कोई अ(cid:198)य (cid:211)यवसाय चलाने क(cid:236) अनुमित नह(cid:233) दी जायेगी।

19-लाइस(cid:164)सधारी लाइस(cid:164)स क(cid:236) समाि(cid:302) पर अवशेष (cid:214)टाक के िन(cid:214)तारण के िलए िजला आबकारी अिधकारी को (cid:229)रपोट(cid:170) करेगा, िजसे िनयम-16 के अनुसार िन(cid:214)ता(cid:229)रत िकया जायेगा।

20-लाइस(cid:164)सधारी आबकारी आयु(cid:265) या लाइस(cid:164)स (cid:255)ािधकारी (cid:300)ारा समय-समय पर जारी सामा(cid:198)य एवं िविश(cid:310) शत(cid:333) को मानने के िलए बा(cid:197)य होगा।

िन(cid:214)तारण के िलए िजला आबकारी अिधकारी को (cid:229)रपोट(cid:170) करेगा, िजसे िनयम-16 के अनुसार िन(cid:214)ता(cid:229)रत िकया जायेगा।

21-िवदेशी मिदरा के लाइस(cid:164)स (cid:255)ा(cid:302) प(cid:229)रसर म(cid:164) देशी मिदरा एवं 21-िवदेशी मिदरा के लाइस(cid:164)स (cid:255)ा(cid:302) प(cid:229)रसर म(cid:164) देशी मिदरा एवं िबयर का सं(cid:250)ह (cid:255)ितबि(cid:198)धत रहेगा।

22-लाइस(cid:164)सधारी अपनी दुकान पर मिदरा िब(cid:248)(cid:236) के िलये िव(cid:248)े ताओं क(cid:236) सूची िजला आबकारी अिधकारी के सम(cid:177) (cid:255)(cid:214)तुत करेगा। िजला आबकारी अिधकारी शु(cid:208)क जमा होने पर तदनुसार िविहत (cid:255)प(cid:253) म(cid:164) नौकरनामा जारी करेगा।

11- लाइस(cid:164)सधारी िकसी (cid:248)े ता को िवदेशी मिदरा, ि(cid:211)ह(cid:214)क(cid:236), (cid:257)ा(cid:193)डी, रम((cid:211)हाइट रम सिहत), िजन, वोदका, वाइन, एल0ए0बी0 (कम ती(cid:260)ता के मादक पेय) और भारत म(cid:164) बोतल भराई क(cid:236) गयी और एक ही समय म(cid:164) पृथक-पृथक आयाितत अ(cid:198)य (cid:255)कार क(cid:236) मिदरा क(cid:236) अिधसूिचत मा(cid:253)ा से अिधक मा(cid:253)ा म(cid:164) िब(cid:248)(cid:236) िकसी अनु(cid:178)ाप(cid:253) के िबना नह(cid:233) करेगा।

In exercise of the powers under sections 24-B and 41 of the United Provinces Excise Act, 1910 (U.P. Act no-IV of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no.1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government hereby makes the following rules with a view to amend the Uttar Pradesh Excise Settlement of licences for Retail Sale of Foreign Liquor (Excluding Beer and Wine) Rules, 2001 published vide Notification no. 10806/X- 97B/Sansdhan dated March 08, 2001 as amended from time to time, namely:-

The Uttar Pradesh Excise Settlement of Licences for Retail Sale of Foreign Liquor (Excluding Beer) (Twenty second Amendment) Rules, 2024

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise Settlement of Licences for Retail Sale of Foreign Liquor(Excluding Beer) (Twenty second Amendment) Rules, 2024.

(2) They shall be deemed to have come into force with effect from 01st April, 2024.

2. Amendment of rule 8– In the Uttar Pradesh Excise Settlement of Licences for Retail Sale of Foreign Liquor (Excluding Beer) Rules, 2001, (herein after referred to as the ''said rules'') for the existing rule 8 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely :–

8-Eligibility conditions for applicant-

Eligible applicant for licence of a retail foreign liquor shop shall fulfill following conditions, namely:-

Provided also that if the shops with two surviving licensees which are getting renewed since previous years, will be renewed only in the case of consensus between both the licensees for renewal. In the absence of consensus, renewal will not be permissible.

(c) not be defaulter/blacklisted or debarred from holding an excise license under the provisions of any rules made under Act. Any person who has been convicted of any excise offence by any court of law unless fully and finally acquitted shall be automatically debarred from holding the license;

(cc) the applicant shall be eligible to make only one application in his own name for any one shop. Provided, in case of renewal, applicant and co-applicant both shall be eligible and their mutual consent for renewal shall be essential ;

(i) that he possesses or has an arrangement for taking on rent a suitable premises in that locality for opening the shop in accordance with the provisions of Uttar Pradesh Number and Location of Excise Shop Rules, 1968 as amended from time to time;

(ii) that his proposed premises of the shop have not been constructed in violation of any law or rules;

(iii) that he and his family members possess good moral character and have no criminal background nor have been convicted of any offence punishable under the United Provinces Excise Act, 1910 or the Narcotics Drugs and Psychotropic Substances Act, 1985 or any other cognizable and non bailable offence;

(iv) that in case he is selected as licensee he will furnish a certificate issued by the District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank of assistant commissioner of police nominated by the police commissioner of the concerning police Commissionerate of which he is the resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record, prior to issuance of licence;

(v) that he shall not employ and salesman or representative who has criminal background as mentioned in clause (iii) or, who suffers from any infectious contagious diseases or is below twenty-one years of age or a woman.
