उ(cid:176)र (cid:255)देश आबकारी (भांग क(cid:236) फु टकर िब(cid:248)(cid:236) के िलये लाइस(cid:164)स(cid:332) का (cid:211)यव(cid:214)थापन) (तृतीय संशोधन) िनयमावली, 2024

1. संि(cid:177)(cid:302) नाम और (cid:255)ार(cid:204)भ–(1) यह िनयमावली उ(cid:176)र (cid:255)देश आबकारी (भांग क(cid:236) फु टकर िब(cid:248)(cid:236) के िलये लाइस(cid:164)स(cid:332) का (cid:211)यव(cid:214)थापन)(तृतीय संशोधन) िनयमावली, 2024 कही जायेगी।

(2) यह िदनांक 01 अ(cid:255)ैल, 2024 से (cid:255)वृ(cid:176) ह(cid:242)ई समझी जायेगी।

2. िनयम-8 का संशोधन– उ(cid:176)र (cid:255)देश आबकारी (भांग क(cid:236) फु टकर िब(cid:248)(cid:236) के िलये लाइस(cid:164)स(cid:332) का (cid:211)यव(cid:214)थापन) िनयमावली, 2019 िजसे आगे उ(cid:265) िनयमावली कहा गया है, म(cid:164) नीचे (cid:214)त(cid:204)भ-1 म(cid:164) िदये गये िनयम-8 के (cid:214)थान पर (cid:214)त(cid:204)भ-2 म(cid:164) िदया गया िनयम रख िदया जायेगा, अथा(cid:170)त् –

एतद्(cid:300)ारा (cid:255)ित(cid:214)थािपत िनयम

8-आवेदक(cid:332) के िलये पा(cid:253)ता क(cid:236) शत(cid:166)- फु टकर भॉग क(cid:236) दुकान के लाइस(cid:164)स के िलए पा(cid:253) आवेदक(cid:332) को िन(cid:204)निलिखत शत(cid:166) अव(cid:212)य पूरी करनी होगी- अथा(cid:170)त्

(क) भारत का नाग(cid:229)रक हो, पर(cid:198)तु भांग का थोक आपूित(cid:170)कता(cid:170) िकसी फु टकर दुकान का लाइस(cid:164)स धारण करने हेतु पा(cid:253) नह(cid:233) होगा। दुकान आवंटन के प(cid:306)ात आवेदक क(cid:236) ि(cid:214)थित म(cid:164) कोई प(cid:229)रवत(cid:170)न अनुम(cid:198)य न होगा,

इ(cid:184)छु क फु टकर और थोक लाइस(cid:164)सधारी (cid:300)ारा लाइस(cid:164)स के अंतरण के संबंध म(cid:164) एक नामिनद(cid:165)शन शपथ प(cid:253) भी (cid:255)(cid:214)तुत िकया जा सकता है िजसम(cid:164) (cid:255)थम, ि(cid:300)तीय, तृतीय आिद वरीयता (cid:248)म म(cid:164) अपने वा(cid:229)रस(cid:332)/प(cid:229)रवार के सद(cid:214)य(cid:332)/िनकट संबंिधय(cid:332) का नाम, आधार सं(cid:180)या, संबंध आिद का उ(cid:208)लेख िकया जा सकता है। मृ(cid:194)यु के (cid:255)करण(cid:332) म(cid:164) सव(cid:170)(cid:255)थम नामिनद(cid:165)शन शपथ प(cid:253) के अनुसार (cid:255)(cid:214)तुत (cid:255)ाथ(cid:170)ना प(cid:253)(cid:332) पर िवचार िकया जायेगा अ(cid:198)यथा िनयमानुसार काय(cid:170)वाई क(cid:236) जायेगी। उ(cid:265) नामिनद(cid:165)शन नोटरीकृ त शपथ प(cid:253) पर लाइस(cid:164)स (cid:255)ािधकारी के काया(cid:170)लय म(cid:164) िविहत (cid:255)ा(cid:322)प म(cid:164) (cid:255)(cid:214)तुत िकया जायेगा ।

पर(cid:198)तु, लाइस(cid:164)सधारी क(cid:236) मृ(cid:194)यु क(cid:236) दशा म(cid:164) उसका िविधक वा(cid:229)रस, यिद अ(cid:198)यथा पा(cid:253) हो, लाइस(cid:164)स क(cid:236) शेष अविध के िलए लाइस(cid:164)सधारी बना रह सकता है।

पर(cid:198)तु यह िक लाइस(cid:164)सधारी क(cid:236) मृ(cid:194)यु क(cid:236) दशा म(cid:164) उसका िविधक वा(cid:229)रस, यिद अ(cid:198)यथा पा(cid:253) हो, लाइस(cid:164)स क(cid:236) शेष अविध के िलए लाइस(cid:164)सधारी बना रह सकता है।

पर(cid:198)तु यह और िक पूव(cid:170)वत(cid:234) वष(cid:334) से नवीकृ त होती आ रह(cid:233) दो लाइस(cid:164)स(cid:332) वाली दुकान(cid:332) के मामल(cid:332) म(cid:164) नवीकरण के पूव(cid:170) ही िकसी एक लाइस(cid:164)धारी क(cid:236) मृ(cid:194)यु हो जाती है तथा उसके िविधक वा(cid:229)रस अथवा नामिनद(cid:165)िशती आवेदन नही देता है अथवा वह अनुपयु(cid:179)त पाया जाता है तो, आवेदन प(cid:253) (cid:255)ा(cid:200)त होने पर अ(cid:198)य जीिवत लाइस(cid:164)धारी के प(cid:224)ा म(cid:164) स(cid:204)बि(cid:198)धत वष(cid:170) हेतु दुकान क(cid:236) संपूण(cid:170) (cid:255)ितभूित, िविहत िदनांक तक जमा करने के िनब(cid:171)धन के साथ दुकान का नवीकरण िकया जाना अनुम(cid:198)य होगा। िव(cid:194)तीय वष(cid:170) क(cid:236) समाि(cid:302) पर उस वष(cid:170) क(cid:236) जमा (cid:255)ितभूित िनयमानुसार वापस क(cid:236) जायेगी। पर(cid:198)तु यह और भी िक यिद पूव(cid:170)वत(cid:234) वष(cid:333) से नवीकृ त होती आ रह(cid:233) दो जीिवत लाइस(cid:164)धारी वाली दुकान(cid:332) का नवीकरण के वल दोन(cid:332) ही लाइस(cid:164)धा(cid:229)रय(cid:332) के म(cid:197)य सहमित क(cid:236) दशा म(cid:164) ही िकया जायेगा। सहमित के अभाव म(cid:164) नवीकरण िकया जाना अनुम(cid:198)य नही होगा।

(cid:214)त(cid:204)भ-1 िव(cid:299)मान िनयम

(cid:214)त(cid:204)भ-2 एतद्(cid:300)ारा (cid:255)ित(cid:214)थािपत िनयम

(ख)आवेदन करने के समय आवेदनकता(cid:170) क(cid:236) आयु इ(cid:179)क(cid:236)स वष(cid:170) से (ख) आवेदन करने के समय आवेदनकता(cid:170) क(cid:236) आयु इ(cid:179)क(cid:236)स वष(cid:170) अिधक हो।

से अिधक हो।

(ग) (cid:211)यित(cid:248)मी/काली सूची म(cid:164) सि(cid:204)मिलत अथवा अिधिनयम के अधीन बनाई गई िकसी िनयमावली के उपबंध(cid:332) के अधीन आबकारी लाइस(cid:164)स धारण करने से िवविज(cid:170)त न िकया गया हो। कोई (cid:211)यि(cid:265) िजसे िकसी (cid:198)यायालय (cid:300)ारा िकसी आबकारी अपराध के िलए दोषिस(cid:294) िकया गया हो, लाइस(cid:164)स धारण

करने से (cid:214)वतः िवविज(cid:170)त हो जायेगा जब तक िक उसे पूण(cid:170)तः और अि(cid:198)तम (cid:322)प से दोषमु(cid:265) न कर िदया गया हो।

(घ) आवेदनकता(cid:170) िकसी एक दुकान के िलए (cid:214)वयं के नाम से मा(cid:253) (घ) आवेदनकता(cid:170) िकसी एक दुकान के िलए (cid:214)वयं के नाम से मा(cid:253) एक आवेदन (cid:255)(cid:214)तुत िकये जाने के िलए पा(cid:253) होगा।

एक आवेदन (cid:255)(cid:214)तुत िकये जाने के िलए पा(cid:253) होगा।

(ङ) िन(cid:204)निलिखत क(cid:236) पुि(cid:310) म(cid:164) पि(cid:202)लक नोटरी (cid:300)ारा स(cid:204)यक (cid:322)प से (ङ) िन(cid:204)निलिखत क(cid:236) पुि(cid:310) म(cid:164) पि(cid:202)लक नोटरी (cid:300)ारा स(cid:204)यक (cid:322)प से अिभ(cid:255)मािणत शपथप(cid:253) (cid:255)(cid:214)तुत करेगा, अथा(cid:170)त्ः-

अिभ(cid:255)मािणत शपथप(cid:253) (cid:255)(cid:214)तुत करेगा, अथा(cid:170)त्ः-

(एक) यह िक समय-समय पर यथा संशोिधत उ(cid:176)र (cid:255)देश आबकारी दुकान(cid:332) क(cid:236) सं(cid:180)या एवं ि(cid:214)थित िनयमावली, 1968 के उपबंध(cid:332) के अनुसार उस (cid:214)थान पर दुकान खोलने हेतु उपयु(cid:265) प(cid:229)रसर रखता है अथवा िकराए पर उस (cid:214)थान पर उपयु(cid:265) प(cid:229)रसर का (cid:255)ब(cid:198)ध कर सकता है।

(दो) यह िक दुकान के उसके (cid:255)(cid:214)तािवत प(cid:229)रसर के िनमा(cid:170)ण म(cid:164) िकसी (दो) यह िक दुकान के उसके (cid:255)(cid:214)तािवत प(cid:229)रसर के िनमा(cid:170)ण म(cid:164) िकसी िविध अथवा िनयम(cid:332) का उ(cid:208)लंघन नह(cid:233) िकया गया है।

िविध अथवा िनयम(cid:332) का उ(cid:208)लंघन नह(cid:233) िकया गया है।

(तीन) यह िक उसका एवं उसके प(cid:229)रवार के सद(cid:214)य(cid:332) का नैितक च(cid:229)र(cid:253) अ(cid:184)छा है और उनक(cid:236) कोई अपरािधक पृ(cid:311)भूिम नह(cid:233) है और संयु(cid:265) (cid:255)ा(cid:198)त आबकारी अिधिनयम, 1910 या (cid:214)वापक ओषिध एवं मनः(cid:255)भावी अिधिनयम 1985 के अधीन द(cid:193)डनीय िकसी अपराध या िकसी अ(cid:198)य सं(cid:178)ेय एवं गैर जमानती अपराध के िलए दोषिस(cid:294) न िकया गया हो।

(चार) यह िक लाइस(cid:164)सधारी के (cid:322)प म(cid:164) चयिनत हो जाने क(cid:236) दशा म(cid:164) िजला, जहाँ का वह िनवासी है, के िजला कल(cid:179)टर या स(cid:204)बि(cid:198)धत िजला के पुिलस अधी(cid:177)क/ व(cid:229)र(cid:311) पुिलस अधी(cid:177)क या स(cid:204)बि(cid:198)धत पुिलस किम(cid:212)नरी के पुिलस आयु(cid:179)त (cid:300)ारा नामिनिद(cid:170)(cid:310), सहायक पुिलस आयु(cid:179)त के र(cid:167)क के अिन(cid:204)न अिधकारी, (cid:300)ारा जारी इस आशय का (cid:255)माण-प(cid:253) लाइस(cid:164)स जारी होने के पूव(cid:170) (cid:255)(cid:214)तुत करेगा िक उसका एवं उसके प(cid:229)रवार के सद(cid:214)य(cid:332) का च(cid:229)र(cid:253) अ(cid:184)छा है एवं उनक(cid:236) कोई अपरािधक पृ(cid:311)भूिम या आपरािधक इितहास नह(cid:233) है।

जारी होने के पूव(cid:170) (cid:255)(cid:214)तुत करेगा िक उसका एवं उसके प(cid:229)रवार के सद(cid:214)य(cid:332) का च(cid:229)र(cid:253) अ(cid:184)छा है एवं उनक(cid:236) कोई अपरािधक पृ(cid:311)भूिम या आपरािधक इितहास नह(cid:233) है।

(cid:214)त(cid:204)भ-1 िव(cid:299)मान िनयम

(cid:214)त(cid:204)भ-2 एतद्(cid:300)ारा (cid:255)ित(cid:214)थािपत िनयम

(पॉच) यह िक वह िकसी ऐसे (cid:211)यि(cid:265) को िब(cid:248)(cid:236)कता(cid:170) या (cid:255)ितिनिध के (cid:322)प म(cid:164) िनयोिजत नह(cid:233) करेगा, िजसक(cid:236) कोई आपरािधक पृ(cid:311)भूिम होगी, जैसा िक ख(cid:193)ड-तीन म(cid:164) उि(cid:208)लिखत है या जो िकसी सं(cid:248)ामक रोग से (cid:250)िसत हो या इ(cid:179)क(cid:236)स वष(cid:170) से कम आयु का हो या मिहला हो। लाइस(cid:164)सधारी को िजला आबकारी अिधकारी से अपने (cid:255)ािधकृ त िब(cid:248)(cid:236)कता(cid:170)/ (cid:255)ितिनिध का फोटोयु(cid:265) पहचान प(cid:253) (cid:255)ा(cid:302) करना होगा।

(छः) यह िक उस पर कोई लोक देयता या सरकारी देयता का (छः) यह िक उस पर कोई लोक देयता या सरकारी देयता का बकाया नह(cid:233) है।

बकाया नह(cid:233) है।

(सात) यह िक वह ऋणशोध(cid:177)म है और आव(cid:212)यक िनिध रखता है या उसके कारोबार के सं(cid:211)यवहार के िलए आव(cid:212)यक िनिध का (cid:255)ब(cid:198)ध कर िलया है, िजसका (cid:202)यौरा, यिद अपेि(cid:177)त होगा, तो लाइस(cid:164)स (cid:255)ािधकारी को उपल(cid:202)ध करा देगा।

(आठ) यह िक आवेदक सि(cid:248)य (cid:321)प से मािफया गितिविधय(cid:332), असमािजक काय(cid:333) एवं संगिठत अपरािधक गितिविधय(cid:332) म(cid:164) िल(cid:302) नह(cid:233) है। यिद लाइस(cid:164)स जारी हो जाने के प(cid:306)ात् भी यह (cid:255)मािणत हो जाता है िक वह सि(cid:248)य (cid:321)प से मािफया गितिविधय(cid:332), असमािजक काय(cid:333) एवं संगिठत अपरािधक गितिविधय(cid:332) म(cid:164) िल(cid:302) है तो उसे (cid:255)दान िकया गया लाइस(cid:164)स रदद् कर िदया जायेगा।

(नौ) यह है िक आवेदक बार काउिसंल म(cid:164) रिज(cid:214)(cid:367)ीकृ त अिधव(cid:265)ा नह(cid:233) है। यिद लाइस(cid:164)स (cid:255)ा(cid:302) कर लेने पर उसे बार काउिसंल म(cid:164) रिज(cid:214)(cid:367)ीकृ त अिधव(cid:265)ा पाया जाता है तो लाइस(cid:164)स रदद् कर िदया जायेगा। रा(cid:186)य सरकार का कम(cid:170)चारी, लाइस(cid:164)स (cid:214)वीकृ ित हेतु आवेदन करने के िलये अनह(cid:170) होगा।

(दस) यह िक लाइस(cid:164)सधारी के (cid:321)प म(cid:164) चियनत हो जाने पर चयन के 48 घंटे के भीतर धरोहर धनरािश का ब(cid:167)क (cid:369)ॉ(cid:201)ट, िजसे आँन-लाइन आवेदन के साथ अपलोड िकया गया है, को उसके (cid:300)ारा िजला आबकारी अिधकारी के काया(cid:170)लय म(cid:164) जमा करा देगा।

((cid:181)यारह) यह िक उसने धरोहर धनरािश के ब(cid:167)क (cid:369)ा(cid:201)ट का (cid:255)योग इस चरण म(cid:164) िकसी अ(cid:198)य दुकान हेतु आवेदन म(cid:164) नही िकया है।

(च) रा(cid:186)य सरकार क(cid:236) पूव(cid:170) (cid:214)वीकृ ित से आबकारी आयु(cid:265) (cid:300)ारा िनयत धरोहर धनरािश का ब(cid:167)क (cid:369)ॉ(cid:201)ट, जो स(cid:204)बि(cid:198)धत दुकान के िजला के िजला आबकारी अिधकारी के नाम से बना हो, क(cid:236) (cid:214)कै न (cid:255)ित आनलाइन आवेदन के साथ अपलोड िकया जायेगा;

(cid:214)त(cid:204)भ-2 एतद्(cid:300)ारा (cid:255)ित(cid:214)थािपत िनयम

(छ) लाइस(cid:164)सधारी के (cid:322)प म(cid:164) चियनत हो जाने क(cid:236) दशा म(cid:164) धरोहर धनरािश का ब(cid:167)क (cid:369)ा(cid:201)ट चयन के प(cid:306)ात् 48 घ(cid:193)टे के भीतर स(cid:204)बि(cid:198)धत िजला आबकारी अिधकारी के काया(cid:170)लय म(cid:164) जमा करना अिनवाय(cid:170) होगा, िजसे दुकान क(cid:236) सभी देयताओं के भुगतान के प(cid:306)ात् वापस कर िदया जायेगा;

(ज) आवेदक ऋणशोधन (cid:177)मता (cid:255)माण प(cid:253) या (cid:255)ािधकृ त आयकर वैलुअर (cid:300)ारा जारी धा(cid:229)रत स(cid:204)पि(cid:176) (cid:255)माण-प(cid:253) का धारक हो तथा उसक(cid:236) ऋणशोधन (cid:177)मता/(cid:255)ािधकृ त आयकर वैलुअर (cid:300)ारा जारी धा(cid:229)रत स(cid:204)पि(cid:176) (cid:255)माण-प(cid:253) क(cid:236) मािलयत िजला म(cid:164) आवेिदत दुकान का लाइस(cid:164)स (cid:255)दान करने के िलये अवधा(cid:229)रत लाइस(cid:164)स फ(cid:236)स के समतु(cid:208)य धनरािश से कम नह(cid:233) होगी। लाइस(cid:164)सधारी से यह अपे(cid:177)ा क(cid:236) जायेगी िक वह उस िजला म(cid:164) ऋणशोधन (cid:177)मता (cid:255)माण-प(cid:253) अथवा (cid:255)ािधकृ त आयकर वे(cid:208)युअर (cid:300)ारा जारी धा(cid:229)रत संपि(cid:176) (cid:255)माण-प(cid:253) क(cid:236) मूल (cid:255)ित (cid:255)(cid:214)तुत करे, जहां से उसे लाइस(cid:164)स (cid:214)वीकृ ित के समय जारी िकया गया है;

पर(cid:198)तु नवीकरण क(cid:236) ि(cid:214)थित म(cid:164), गत वष(cid:170) के (cid:211)यव(cid:214)थापन के दौरान (cid:255)(cid:214)तुत िकये गये ऋणशोधन (cid:177)मता (cid:255)माण प(cid:253) अथवा (cid:255)ािधकृ त आयकर मू(cid:208)यांकक (cid:300)ारा जारी स(cid:204)पि(cid:176) (cid:214)वािम(cid:194)व (cid:255)माण प(cid:253), यिद यह वैध एवं अपेि(cid:177)त धनरािश के िलए है, (cid:255)ित(cid:250)ा(cid:315) ह(cid:332)गे;

3-िनयम-12 का संशोधन- उ(cid:179)त िनयमावली म(cid:164), नीचे (cid:214)त(cid:204)भ-1 म(cid:164), िदए गए िव(cid:299)मान िनयम-12 के (cid:214)थान पर (cid:214)त(cid:204)भ-2 म(cid:164) िदया गया िनयम रख िदया जायेगा, अथा(cid:170)त्:-

4-िनयम-20 का संशोधन-उ(cid:265) िनयमावली म(cid:164), नीचे (cid:214)त(cid:204)भ-1 म(cid:164) िदये गये िव(cid:299)मान िनयम-20 के (cid:214)थान पर (cid:214)त(cid:204)भ-2 म(cid:164) िदया गया िनयम रख िदया जायेगा, अथा(cid:170)त्:-

20- दुकान(cid:332) का अ(cid:198)त(cid:229)रम (cid:211)यव(cid:214)थापन - (1) इन िनयम(cid:332) के उपब(cid:198)ध(cid:332) के अनुसार िकसी लाइस(cid:164)स के िनल(cid:204)बन, िनर(cid:214)तीकरण, अ(cid:203)यप(cid:170)ण या अ(cid:198)य िकसी कारण से दुकान अ(cid:211)यवि(cid:214)थत होने के मामले म(cid:164) लाइस(cid:164)स (cid:255)ािधकारी सरकार क(cid:236) पूव(cid:170) (cid:214)वीकृ ित से आबकारी आयु(cid:265) (cid:300)ारा यथा अिधसूिचत ऐसी दर(cid:332) पर दैिनक लाइस(cid:164)स फ(cid:236)स और समानुपाितक (cid:255)ितफल फ(cid:236)स (अथा(cid:170)त दैिनक (cid:198)यूनतम (cid:255)(cid:194)याभूत मा(cid:253)ा म(cid:164) िनिहत (cid:255)ितफल फ(cid:236)स), जो िक एक बार म(cid:164) अिधकतम चौदह िदन(cid:332) क(cid:236) अविध या िनयिमत (cid:211)यव(cid:214)थापन के िदनांक तक इसम(cid:164) से जो भी पहले हो, के िलए होगी, के संदाय पर दुकान का अ(cid:198)त(cid:229)रम (cid:211)यव(cid:214)थापन सव(cid:333)(cid:184)च आफर पर कर सकता है। एक दुकान के िलये दो या दो से अिधक समान आफर (cid:255)ा(cid:302) होने के मामले म(cid:164) साव(cid:170)जिनक मैनुअल लाटरी के मा(cid:197)यम से (cid:211)यव(cid:214)थापन कराया जायेगा। ऐसे लाइस(cid:164)सधारी को अ(cid:198)त(cid:229)रम (cid:211)यव(cid:214)थापन क(cid:236) अविध म(cid:164) िनिहत (cid:255)ितफल फ(cid:236)स तथा लाइस(cid:164)स फ(cid:236)स के योग क(cid:236) 1/6 धनरािश के बराबर क(cid:236) (cid:255)ितभूित धनरािश जमा करना होगा। लाइस(cid:164)स (cid:255)ािधकारी (cid:300)ारा िकसी दुकान का ऐसा (cid:211)यव(cid:214)थापन दो से अिधक बार िकया जा सकता है पर(cid:198)तु ऐसी ि(cid:214)थित म(cid:164) आबकारी आयु(cid:265) को सूिचत करना अिनवाय(cid:170) होगा।

NOTIFICATION

In exercise of the powers under section 41 of the United Provinces Excise Act, 1910 (U.P.

Act no 4 of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no 1 of 1904) the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government is pleased to makes the following rules with a view to amend the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Bhang) Rules, 2019 published vide Notification no. 26743/X-Licence 185/2018-2019/dated: January 29, 2019, namely:–

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR RETAIL SALE OF BHANG) (THIRD AMENDMENT) RULES, 2024

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of licenses for Retail Sale of Bhang) (Third Amendment) Rules, 2024.

(2) They shall be deemed to have come into force with effect from 01st April, 2024.

2. Amendment of rule–(2) In the Uttar Pradesh Excise (Settlement of Licenses for Retail Sale of Bhang) Rules, 2019 hereinafter referred to as the said rules, for rule 8 set out in Column-I below, the rule as set out in Column-II shall be substituted, namely :–8 mÙkj izns'k vlk/kkj.k xtV] 31 tuojh] 2025 bZ0 Column-I Column-II Existing rule

8. Eligibility conditions for applicants:- eligible applicants for license of a retail bhang shop must fulfill follwing conditions, namely :–

(a) be a citizen of India, but whole sale supplier of Bhang shall be not eligible for holding license of any retail shop. No change in the status of applicant shall be allowed after allotment of shop;

A nomination affidavit can also be submitted by the interested retail and wholesale licensee regarding the transfer of license in which he can mention the name of his heirs/family members/close relatives, Aadhaar number, relation etc. in first, second, third etc. order of preference. In cases of death, the applications submitted as per the nomination affidavit will be considered first, otherwise action will be taken as per the rules. The said nomination will be submitted in the prescribed format in the office of the licensing authority on a notarized affidavit:

Provided that in the event of death of licensee, his/her legal heir, if otherwise eligible, may continue to hold the license for the remaining period of the license:

Provided further that in the case of shops with two licenses which have been renewed since previous years, if one of the licensees dies before renewal and his legal heir or nominee does not submit the application or is found unsuitable, then on receipt of the application, renewal of the shop for the concerned year in favour of the second surviving licensee will be permissible with the restriction of depositing the entire security of the shop by the prescribed date. At the end of the financial year, the security deposit of that year will be returned as per rules.

(ix) that applicant is not an advocate registered with Bar Council. If he is found registered advocate after getting the license then the license shall be cancelled. An employee of the Government shall also be ineligible to apply for the grant of license;

(x) that in case of being selected as licensee, bank drafts of earnest money which has been uploaded online along with application shall be deposited by him in the office of District Excise Officer within 48 hours after selection;

(xi) that he has not made use of the bank drafts of earnest money in making application for any other shop in the same phase;

(f) That he shall upload a scanned copy of bank draft of earnest money issued in favour of District Excise Officer of the district of the concerned shop along with online application as may be fixed by the Excise Commissioner with the prior sanction of the State Government;

(g) In case of being selected as licensee, it shall be necessary to deposit bank draft of earnest money in the office of the concerned District Excise Officer within 48 hours after selection, which shall be refunded to applicant after payment of all dues;

(h) That he is holder of solvency certificate or certificate of owned property issued by Income Tax valuer and the worth of solvency or certificate of owned property issued by Income Tax valuer shall be equivalent to not less than the amount of license fee determined for the grant of license of applied shop in the district. Licensees shall be required to submit the original copy of solvency certificate or certificate of owned property issued by Income Tax valuer in that district from where it has been issued at the time of grant of license:

Provided further that in case of licence being settled through the e-lottery/ e-tender, his earnest money and license fee as well as the security amount, if deposited by him, and in case of licence being renewed, fifteen percent of security amount of last year along with renewal fee and licence fee, if deposited by him, shall also be forfeited in favour of State Government and the said shop shall be resettled forthwith, in manner as prescribed by the Government.

20- Interim Settlement of shop-

(1) In case a license is suspended, cancelled or surrendered in accordance with the provisions of these rules or if the shop remains unsettled for any reasons the licensing authority may make interim settlement of the shop at the highest offer on the payment of daily license fee on such rates as notified by the Excise Commissioner with the prior sanction of the Government and proportionate consideration fee (i.e. consideration fee involved in the daily minimum guaranteed quantity) for a maximum period of fourteen days at one stretch or till the date of regular settlement, whichever is earlier. In case of obtaining two or more equal offers for one shop, settlement shall be done through manual public lottery. Such licensee shall also be required to deposit security amount equivalent to 1/6th of the sum of consideration fee and license fee involved in the period of interim settlement. Such settlement of shop can be done more than twice by the licencing authority, but in such situation it will be essential to inform the Excise Commissioner.
