IN exercise of the powers under section 19 read with section 6 of the Uttar Pradesh Industrial Area Development Act, 1976 (U.P. Act no. 6 of 1976) the Gorakhpur Industrial Development Authority hereby makes with the previous approval of the State Government following regulations for the purposes of proper planning and development of the Gorakhpur Industrial Development Area.
THE GORAKHPUR INDUSTRIAL DEVELOPMENT AREA (PREPARATION
AND FINALIZATION OF PLAN) REGULATIONS, 2025
CHAPTER-I
Preliminary
1. (1) These regulations may be called the Gorakhpur Industrial Development
Area (Preparation and Finalization of Plan) Regulations, 2025.
Short title, application and commencement (2) They shall come into force with effect from the date of their publication in in
the official Gazette.
(3) They shall apply to the Industrial Development Area as defined under
section 2(d) of the Act.
Definitions
2. (1) In these regulations, unless the context otherwise requires,-
(a) "Act'' means the Uttar Pardesh Industrial Area Development Act,
1976 (U.P. Act no. 6 of 1976);
(b) "Authority" means the Gorakhpur Industrial Development Authority constituted under Section 3 of the Uttar Pardesh Industrial Area Development Act, 1976;
(c) "Agricultural Use'' means the use as defined in the Plan as may be
approved in accordance with the Act and as per these regulations;
(d) ''Commercial Use'' means the use as defined in the Plan as may be
approved in accordance with the Act and as per these regulations;
(e) "Industrial Use" means the use as defined in the Plan as may be
approved in accordance with the Act and as per these regulations;
(f) "Institutional Use'' means the use as defined in the Plan as may be
approved in accordance with the Act and as per these regulations;
(g) "Land Use" means the use of any land or building or part thereof in the industrial development area or industrial, residential, Institutional, commercial water bodies, recreational organized recreational open spaces, roads, transportation, public and semi-public facilities, agriculture and other such purposes like land and building or part there of as may be determined by the authority in the Plan;
(h) "Layout plan" means a plan of the entire site showing location of plots/building blocks, roads, open spaces, parking, landscaping etc. indicating the use/ activity for land parcels;
(i) "Recreational use" means the use as defined in the plan as may be
approved in accordance with the Act and as per these regulation;
(j) ''Plan" means the Master plan prepared by the authority for the development of industrial development area under sub-section (2) of section 6 of the Act within the meaning of the Act;
(k) "Public or Semi Public Use" means the use as defined in the Plan as
may be approved in accordance with the Act and these regulations;
(l) "Residential Use" means the use as defined in the Plan as may be
approved in accordance with the Act and as per these regulations;
8 mRrj izns'k vlk/kkj.k xtV] 11 ekpZ] 2025(m) "Sector" means anyone of the divisons in which the industrial development area or part thereof may be divided for the purpose of planning and development under the Act;
(n) "Traffic and Transportation Use" means use as defined in the Plan as may be approved in accordance with the Act and as per these regulations;
(o) "Water Bodies" means any land for the carriage and storage of water on ground level.
CHAPTER-II
3. (1) The Authority shall, as soon as possible, carry out town planning and civic survey and prepare Draft Plan for the industrial development area.
Town Planning and Civic Survey form and contents of Plan
(2) The Draft Plan shall,-
(a) indicate and describe the existing various sectors into which the development area or part thereof is divided for the purpose of development and indicating the manner in which the land in each sector is being used;
(b) indicate the area of land under different land use;
(c) indicate and describe,-
(i) the existing roads;
(ii) the existing lines of transportations and communication
including railways and airport.
(3) The Draft plan may indicate,-
(a) the existing public facilities and physical features such as rivers, water bodies etc;
(b) all or any of the matters specified in regulation 3.
(4) The Draft Plan shall consist of such maps, diagrams, charts, reports and other written matter of any explanatory or descriptive nature as pertain to the development of the whole or any part of Industrial Development Area.
(5) Written matter forming part of Draft Plan shall include such summary of the main development features and such descripitive matter as the Authority may consider necessary to illustrate or explain the proposals indicated by maps, charts, diagrams and other documents.
(6) A plan of existing land use shall also form a part of the Draft Plan for proposing the desirable utilization of land for different purposes.
(7) The Plan may,-
(a) include various sectors into which the industrial development area or part thereof may be divided for the purpose of development;
(b) show the various existing and proposed land uses indicating the most desirable utilization of land for,-
(i) industrial use;
(ii) residential use;
(iii) commercial use;
(iv) public and semi public use;
(v) recreational use;
(vi) agriculture use;
(vii) such other use as the Authority may deem fit in the course of
proper development of the industrial development area.
(c) traffic and transportation plan consisting of proposals for road, railway and air transportation system;
mRrj izns'k vlk/kkj.k xtV] 11 ekpZ] 2025 9(d) infrastructural plan showing proposal for land/building for provision of water, electricity, drainage and disposal of sewage and refuse and also indicating proposals for recreational open space, civic and other infrastructural facility;
(e) proposals regarding housing;
(f) plan proposing zoning regulations regarding the various activities to
be permitted in different land use;
(g) plan giving the conceptual landscape for entire township, road side plantation, treatment of parks, open spaces and area of active and passive recreation;
(h) such maps, diagrams, charts, reports and other written matter of any explanatory or descriptive nature as pertain to the development of the whole or any part of the Industrial Area;
(i) written matter consisting of summary of main proposals and such descriptive matter as the Authority may consider necessary to illustrate or explain; the proposals indicated by the maps, charts, diagrams and other documents.
(8) The Plan may also provide for any other matter which is deemed
necessary for the proper development of the Industrial Development Area.
(9) In case of any conflict or inconsistency between the number of proposals shown on one map and those shown on any other map in respect of any land to which the plan relates, the map which is of a larger scale shall prevail and in case of any such conflict or inconsistency between any maps and written matter the latter shall prevail.
CHAPTER-III
Procedure for finalization of plan
4. (1) Authority shall, as soon as may be after the draft plan has been
prepared, publish a public notice stating that,-
(a) the draft plan has been prepared and may be inspected by any

person at such time and place as may be specified in the notice;
(b) objections and suggestions,if any, in respect of the draft plan shall be sent in writing by any person to the Chief Executive Officer or any other officer authorized by the Chief Executive Officer of the Authority before such date not being earlier than 15 days from the date of publication of the notice and in such manner as may be specified in the notice.
(2) This notice may be issued in Form 'A' appended to these regulations.
Mode of publication of the Public Notice 5. Every public notice mentioned in regulations 4 herein shall be in writing under the signature of the Chief Executive Officer or any other officer authorized by the Chief Executive Officer and shall be published in newspaper having circulation in the town. This publication shall be by two or more newspapers, which the Chief Executive Officer or any other officer authorized by the Chief Executive Officer of the Authority may think fit.
Inquiry and hearing
6. (1) After the expiry of the period specified in the notice for making objections and suggestions the same will be placed before a Committee to consider the objections and suggestions. The Committee shall be constituted by the Chief Executive Officer and shall consist of three members one of whom shall be Town Planner.The Committee shall fix date (s) for the disposal of objection (s) received and shall serve notice on the affected person(s)/body who has filed objections (s) and may allow a personal hearing to the affected person (s)/body in connection with his/their objection (s), after intimating the date and place of hearing.
10 mRrj izns'k vlk/kkj.k xtV] 11 ekpZ] 2025Explanation- The identification of affected person (s)/body shall be done by the Committee and its decision in this regard shall be final and conclusive.
(2) The Committee shall, after conclusion of the hearing, submit its report/recommendation to the Chief Executive Officer of the Authority.
7. (1) The recommendations of the Committee shall be submitted to the Chief Executive Officer for the consideration thereof.
Consideration of the recommendation of the Committee
(2) If the Chief Executive Officer is of opinion that some matter has not been considered by the Committee, the recommendation may be referred back by him/her to the Committee for the consideration of the same.
(3) The Chief Executive Officer shall submit his/her report along with the recommendation of the Committee to the Authority for cosideration and approval.
Finalization/ Approval of the Draft Plan
8. (1) The Authority may, from time to time, after considering the recommendation of the committee and any other matter, issue directions for variations, modifications or amendment of the Draft Plan.
(2) The Authority shall approve the Plan with such variations, modifications or amendments that are deemed to be necessary by the Authority:
Provided further that the Authority shall obtain approval from the State Government before the final commencement of the Plan.
(3) The approved Plan shall be effective for a period specified by the Authority or till the new/revised Plan is approved and commenced.
Date and commencement of Plan
9. Immediately after a Plan has been approved by the State Government a public notice shall be published under the signature of the Chief Executive Officer or anyother Officer authorized by the Chief Executive Officer in the manner provided in regulations 5 stating therein that a Plan has been approved and naming a place where a copy of the plan may be inspected at all reasonable hours and from the date of first publication of the aforesaid notice, the Plan shall come into operation.
Amendment of the Plan
10. (1) The Authority may make such amendments in the approved plan as it think fit, except when it relates to the land use or its extent provided that any amendment in the approved plan which, in the opinion of the Authority relates to the land use or its extent, may be made by the Authority only with no objection of the State Government.
(2) Before making any amendment in the Plan the Authority shall publish a notice in at least two newspapers having circulation in the development area inviting objections and suggestions form any affected person with regard to the proposed amendment before such date not being earlier than 15 days form the date of publication of the notice and shall consider all objections that may be received.
(3) Every amendment made under this regulation shall be published in the manner specified in regulation 5 and the amendment shall come into operation either on the date of the date of the first publication or on such other date as the Authority may fix. The Chief Executive Officer shall send a copy of the amendment to the State Government for information.
Sector Layout Plan
11. The Chief Executive Officer shall be competent to approve the layout plan prepared for the sector or a part of the sector or a scheme. Any amendment in the layout plan a sector or a part of a sector or a scheme shall duly be approved by the Chief Executive Officer. If such amendment involves the change in the area of a sector and/or and inter-sector in the location of public parks and/or green belts, it shall be done in accordance of the procedure laid down in sub- regulation (2)of regulation 10.

(b) copy there of will be available for inspection at the office of the Gorakhpur Industrial Development Authority between the--------------- to----------- on all working days till the date mentioned in part 3 hereafter.
2. Objection and suggestion are hereby invited with respect to this draft Plan.
3. Objection and suggestios may be sent in writing to the Chief Executive Officer/Additional Chief Executive Officer Gorakhpur Industrial Development Authority before this date------------------day of----------------- Any person making objections or suggestions should mention his name and address.
