IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Sanjai Gandhi Snatkottar Ayurvigyan Sansthan (Sanshodhan) Adhiniyam, 2025 (Uttar Pradesh Adhiniyam Sankhya 2 of 2025) as passed by the Uttar Pradesh Legislature and assented to by the Governor on March 17, 2025. The Chikitsa Shiksha Anubhag-2 is administratively concerned with the said Adhiniyam.

SCIENCES (AMENDMENT) ACT, 2025

AN
ACT
further to amend the Sanjay Gandhi Post-Graduate Institute of Medical Sciences
Act, 1983.
IT IS HEREBY enacted in the Seventy-sixth year of the Republic of India
as follows:-
1. (1) This Act may be called the Sanjay Gandhi Post-Graduate Institute of Short title and commencement Medical Sciences (Amendment) Act, 2025.
(2) It shall be deemed to have come into force with effect from the 6th day of
February, 2025.
Insertion of new 2. In the Sanjay Gandhi Post-Graduate Institute of Medical Sciences Act, 1983,
section 12-A in after section 12, the following new section shall be inserted, namely:-
U.P. Act no. 30 of 1983 12-A. (1) The Director shall hold office for a term of five years from the date "Tenure of on which he enters upon his office or until he attains the age of Service of Sixty-five years, whichever is earlier; Director (2) Notwithstanding anything to the contrary in the Act, a Director who has not
attained the age of Sixty-five years may be granted an additional tenure not exceeding
three years, by the Visitor:
Provided that the Director may by writing under his hand addressed to the Visitor
resign from his office, and shall cease to hold his office upon the acceptance by the Visitor
of such resignation. "
Repeal and
3. (1) The Sanjay Gandhi Post-Graduate Institute of Medical U.P. Ordinance no. 2 of 2025 saving
Sciences (Amendment) Ordinance, 2025, is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the principal Act as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been
done or taken under the corresponding provisions of the principal Act
as amended by this Act as if the provisions of this Act were in force at
all material times.
4 mRrj izns'k vlk/kkj.k xtV] 17 ekpZ] 2025 STATEMENT OF OBJECTS AND REASONThe Sanjay Gandhi Post-Graduate Institute of Medical Sciences Act, 1983 (U.P. Act no. 30 of 1983) has been enacted to provide for the establishment of the Sanjay Gandhi Post-Graduate Institute of Medical Sciences, Lucknow with the objective of providing adequately trained and high quality doctors to the State and the Country through teaching and training in the field of medical education and to update the curriculum and develop new special training keeping in mind the future needs.
The role of the Director of the Institute is very important in the smooth and effective functioning of the Institute. In the aforesaid Act provision regarding the Director of the Institute has been provided in section 12. There is no provision mentioned in the Act regarding the tenure, age limit and extension of tenure of the Director. In view of the above it was decided to insert a new section 12-A in the aforesaid Act.
Since the State Legislature was not in session and immediate Legislative action was necessary to implement the aforesaid decision, the Sanjay Gandhi Post-Graduate Institute of Medical Sciences (Amendment) Ordinance, 2025 (U.P. Ordinance no. 2 of 2025) was promulgated by the Governor on February 07, 2025.
This Bill is introduced to replace the aforesaid Ordinance.
