In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the
Governor is pleased to make the following Rules with a view to amending The Uttar Pradesh Government
Servant (Discipline and Appeal) Rules, 1999:
THE UTTAR PRADESH GOVERNMENT SERVANT (DISCIPLINE AND APPEAL)
(SECOND AMENDMENT) RULES, 2025
1. (1) These Rules may be called The Uttar Pradesh Government Servant Short title and commencement (Discipline And Appeal) (Second Amendment) Rules, 2025.
Amendment of Rule 7(VII)
(2) They shall come into force at once. 2. In the Uttar Pradesh Government Servants (Discipline and Appeal) Rules, 1999, for existing sub-rule (vii) of rule-7 set out in column-1 below, the rule as set out in column-2 shall be substituted, namely:-
COLUMN-1 Existing Rule 7(vii) Where the charged Government Servant denies the charges, the Inquiry Officer shall proceed to call the witnesses proposed in the charge sheet and record their oral evidence in the presence of the charged Government Servant who shall be given an opportunity to cross-examine such witnesses. After recording the aforesaid evidences, the Inquiry Officer shall call for and record the oral evidence which the charged Government Servant desired in his written statement to be produced in his defence:
Provided that the Inquiry Officer may, for reasons to be recorded in writing, refuse to call a witness.
COLUMN-2 Rule as hereby substituted 7(vii) Where the charged Government Servant denies the charges, only if according to sub rule 7(iii) there is the name of the witnesses proposed to prove the documentary evidence is mentioned in the charge sheet, the Inquiry Officer shall proceed to call the witnesses mentioned in the charge sheet and record their oral evidence in the presence of the charged Government servant who shall be given opportunity of cross-examination of such witnesses. After recording the aforesaid evidences, the Inquiry Officer shall call and record the oral evidence which the charged Government Servant desired in his written statement to be produced in his defence:
Provided that the Inquiry Officer may, for reasons to be recorded in writing, refuse to call a witness:
Provided further that if the charged Government servant himself, through his written statement, does not desire for any certification of the documentary evidence as well as oral evidence, the inquiry officer shall record this fact in writing and without giving any opportunity to oral cross- examination, only on the basis of the written statement of the charged Government Servant and documentary evidence the inquiry officer shall conclude the inquiry proceeding.
