IN exercise of the power conferred on it by Section 61, 66, 86(1)(e) and 181 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling in its behalf, the Uttar Pradesh Electricity Regulatory Commission has made (Rooftop Solar PV Grid Interactive System Gross/ Net Metering) Regulation, 2019, which were published vide notification no. UPERC/Secretary/RSPV Regulations/434(A) dated January 4, 2019.
AND, WHEREAS, UPERC (Rooftop Solar PV Grid Interactive System Gross/ Net Metering) Regulation, 2019 (First Amendment / Addendum) were published vide U.P.E.R.C/Secretary/ RSPV Regulations/118, dated June 1, 2022.
AND, WHEREAS, UPERC (Rooftop Solar PV Grid Interactive System Gross/ Net Metering) Regulation, 2019 (Second Amendment) were published vide UPERC/Secretary/RSPV Regulations/002 dated November 17, 2023.
AND, WHEREAS, Uttar Pradesh Power Corporation Ltd. has filed a Petition No. 2149 of 2024 submitting that Regulation 10.3(ii) of UPERC (Rooftop Solar PV Grid Interactive System Gross/ Net Metering) Regulation, 2019 providing a methodology for determination of the rate at which Solar Injection Compensation is to be paid by the Distribution Licensee. UPPCL further submitted that in the financial year 2022-23 and 2023-24 no competitive bidding for tariff discovery had taken place whereas, the solar tariff has progressively fallen during the recent competitive bidding conducted by SECI and SJVN due to market development and technology advancement. It has thus prayed the Commission to invoke the Regulation 16: Power to relax and Regulation 17: Power to amend Principal Regulation and also allow to consider the weighted average tariff of large-scale solar projects of 5 MW and above, to reflect the latest tariff discovered in central and state government solar power tenders in the last financial year as adopted/approved by the Commission, plus an incentive of 25% or such as may be approved by the Commission. In view of prayer made by Uttar Pradesh Power Corporation Ltd., Uttar Pradesh Electricity Regulatory Commission, now in exercise of its power conferred under section 61, 86 (1) (e) and 181 of Electricity Act, 2003 and clause 17 of the aforesaid Regulation i.e. Power to Amend and all other enabling powers hereby makes the following amendments, namely:-
1- Short Title and Commencement:
a. These Regulations shall be called UPERC (Rooftop Solar PV Grid Interactive System Gross/ Net Metering) Regulation, 2019 (Third Amendment) hereinafter referred to as RSPV Regulation, 2019) (Third Amendment).
b. These Regulations shall come into force from the date of their notification in the Official Gazette of the State.
