अधिसूचना
चूँकि भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (अधिनियम संख्या 30 सन् 2013), जिसे आगे "उक्त अधिनियम सन् 2013" कहा गया है, की धारा 11 की उपधारा (1) के अधीन प्रारम्भिक अधिसूचना राज्य सरकार द्वारा ग्राम-चंचलिया पनारी टोला गुरूर, परगना-अगोरी, तहसील-ओबरा, जिला-सोनभद्र में कुल 72.9230 हेक्टेयर भूमि के अर्जन के लिये लोक प्रयोजन अर्थात् उत्तर प्रदेश राज्य विद्युत उत्पादन निगम लिमिटेड के माध्यम से जिला सोनभद्र में 2x660 मेगावाट ओबरा 'सी' तापीय परियोजना के राख बाँध के निर्माण के लिए अधिसूचना संख्या 1511/24-03-2023-1294-2020 दिनांक 12-09-2023 जारी की गयी थी।
और, चूंकि उक्त अधिनियम, सन् 2013 की धारा 19 की उपधारा (1) के अधीन घोषणा, धारा 11 के अधीन प्रारम्भिक अधिसूचना के दिनांक से विस्तारित दिनांक 12-03-2025 के भीतर जारी नहीं की जा सकी, अतएव उक्त अवधि को अधिसूचना संख्या 845/24-पी-3-2024-1294-2020 दिनांक 04-11-2024 द्वारा अतिरिक्त छह माह के लिए बढ़ा दिया गया;
और, चूंकि उक्त अधिनियम, सन् 2013 की धारा 11 की उपधारा (1) के अधीन अधिसूचना द्वारा प्रकाशित 72.923 हेक्टेयर भूमि के कुल क्षेत्रफल में से 64.519 हेक्टेयर भूमि को भारतीय वन अधिनियम, 1927 (अधिनियम संख्या 16 सन् 1927) की धारा 4 के अधीन आरक्षित वन भूमि के रूप में घोषित किया गया है;
और, चूंकि उक्त अधिनियम, सन् 2013 की धारा 19 की उपधारा (1) के अधीन अधिसूचना, भारतीय वन अधिनियम, 1927 (अधिनियम संख्या 16, सन् 1927) की धारा 20 के अधीन अधिसूचना के प्रकाशन की प्रक्रिया पूर्ण किए बिना जारी नहीं की जा सकती है;
2 उत्तर प्रदेश असाधारण गजट, 4 अगस्त, 2025और, चूंकि उक्त अधिनियम, सन् 2013 की धारा 19 की उपधारा (7) के अनुसार, जहां प्रारम्भिक अधिसूचना के दिनांक से बारह माह के भीतर धारा 19 की उपधारा (1) के अधीन कोई घोषणा नहीं की जाती हैं, तो ऐसी अधिसूचना रद्द कर दी गई समझी जाएगी;
और, चूंकि उक्त अधिनियम, सन् 2013 की धारा 19 की उपधारा (1) के अधीन घोषणा की कार्यवाही पूर्वोक्त विस्तारित अवधि के भीतर पूर्ण नहीं की जा सकी;
और, चूंकि जिला मजिस्ट्रेट, सोनभद्र ने कारणों सहित बारह माह की अवधि बढ़ाने का अनुरोध किया है; और, चूंकि राज्य सरकार की राय है कि अनवधानता से देरी के लिए परिस्थितियां विद्यमान हैं; अतएव, अब, भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 19 की उपधारा (7) के अंतिम परंतुक के अधीन शक्तियों का प्रयोग करके राज्यपाल उक्त अधिनियम, सन् 2013 की धारा 19 की उपधारा (1) के अधीन घोषणा के प्रकाशन की अवधि को छह माह की अतिरिक्त अवधि के लिए विस्तारित करते हैं।

IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 251/XXIV-3-2025 dated August 4, 2025:
No. 251/XXIV-3-2025
Dated Lucknow, August 4, 2025
WHEREAS a preliminary notification under sub-section (1) of Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act no. 30 of 2013), hereinafter referred to as the "said Act of 2013", was issued by the State Government for acquisition of a total of 72.9230 hectares of land in Village-Chanchaliya Panari Tola Gurur, Pargana-Agori, Tehsil-Obra, District-Sonbhadra, for public purpose namely construction of an ash dam of the 2x660 MW Obra 'C' Thermal Project through the Uttar Pradesh Rajya Vidyut Utpadan Nigam Ltd. in District Sonbhadra was vide notification no. 1511/24-03-2023 -1294-2020 dated 12.09.2023;
AND, WHEREAS since the declaration under sub-section (1) of Section 19 of the said Act of 2013 could not be issued within the extended date 12.03.2025 from the date of the preliminary notification under Section 11, therefore the said period was extended for another six months vide notification no. 845/24-P- 03-2024-1294-2020 dated 04.11.2024;
AND, WHEREAS out of the total area of 72.923 hectares of land published vide notification under sub-section (1) of Section 11 of the said Act of 2013, 64.519 hectares of land has been declared as reserved forest land under Section 4 of the Indian Forest Act, 1927 (Act no.16 of 1927);
AND, WHEREAS a notification of under sub-section (1) of Section 19 of the said Act of 2013 cannot be issued without completing the process of publication of notification under Section 20 of the Indian Forest Act, 1927 (Act no.16 of 1927);
AND, WHEREAS as per sub-section (7) of Section 19 of the said Act of 2013, where no declaration is made under sub-section (1) of Section 19 within twelve months from the date of preliminarily notification, then such notification shall be deemed to have been rescinded;
AND, WHEREAS the proceedings for declaration under sub-section (1) of the Section 19 of the said Act of 2013 could not be completed within the aforesaid extended period;

AND, WHEREAS the State Government is of the opinion that circumstances exist for inadvertent delay;
NOW, THEREFORE, in exercise of the powers under the last proviso to sub-section (7) of Section 19 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the Governor is pleased to extend the period of publication of declaration under sub-section (1) of Section 19 of the said Act of 2013 by a further period of six months.
