IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the "Uttar Pradesh Nirasan Vidheyak, 2025" introduced in the Uttar Pradesh Legislative Assembly on August 11, 2025.

THE UTTAR PRADESH REPEALING BILL, 2025 A BILL

to repeal certain enactments that have become redundant and obsolete in the

present times and to revive an enactment. IT IS HEREBY enacted in the Seventy-sixth year of the Republic of India as follows :– 1. (1) This Act may be called the Uttar Pradesh Repealing Act, 2025. (2) Save as otherwise provided, it shall be deemed to have come into force with effect from the 28th day of May, 2025. 2. (1) The enactments specified in the Schedule of this Act are hereby repealed.

purpose of wholly reviving the Uttar Pradesh Essential Services Maintenance Act,

1966 (U.P. Act no. 30 of 1966) from the date of its repeal.

Savings

3. The repeal by this Act of any enactment specified in the Schedule below

shall not,—

( a ) affect any other enactment in which the repealed enactment has

been applied, incorporated or referred to;

( b ) affect the validity, invalidity, effect or consequences of anything

already done or suffered or any right, title, obligation or liability already

acquired, accrued or incurred, or any remedy or proceeding in respect

thereof, or any release or discharge of or from any debt, penalty, obligation,

liability, claim or demand, or any indemnity already granted, or the proof of

any past Act or thing;

( c ) affect any principle or rule of law, or established jurisdiction,

form or course of pleading, practice or procedure, or existing usage, custom,

privilege, restriction, exemption, office or appointment, notwithstanding that

the same respectively may have been in any manner affirmed or recognized

or derived by, in or from any enactment hereby repealed;

( d ) revive or restore any jurisdiction, office, custom, liability, right,

title, privilege, restriction, exemption, usage, practice, procedure or other

matter or thing not now existing or in force;

(e) affect the audit, examination, accounting, investigation, inquiry

or any other action taken or to be taken in relation thereto by any authority

and such audit, examination, accounting, investigation, inquiry or action

could be taken, and, or continued as if the said enactments are not repealed

by this Act.

Acts being repealed

U.P. Ordinance 4. (1) The Uttar Pradesh Repealing Ordinance, 2025 is hereby

no. 4 of 2025 Repeal and Saving

repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the provisions of the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the corresponding provisions of this Act as if the provisions of this Act were in force at all material times.

This Bill is one of those periodical measures by which enactments which have become redundant and obsolete in the present times, are repealed. On recommendation of the State Law Commission, it has been decided to repeal 35 amending Acts, which have become redundant and obsolete in present times and retention whereof as separate Acts is unnecessary, after obtaining the consent of the Administrative Departments related therewith. Apart from this, in order to ensure smooth supply of essential goods and services to the general public there has been felt a need to partially repeal the Uttar Pradesh Repealing Act, 2022 (U.P. Act No. 18 of 2022) with a view to revive the Uttar Pradesh Essential Services Maintenance Act, 1966 (U.P. Act No. 30 of 1966).

In view of the above, it has been decided to introduce a repealing Bill in the second session, of the year 2025, of the State Legislature.

Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Repealing Ordinance, 2025 (U.P. Ordinance No. 4 of 2025) was promulgated by the Governor on 28th May, 2025.

This Bill is introduced to replace the aforesaid Ordinance.
