IN exercise of the powers under sub-section (1) and clause (d) of sub-section (2) of Section 40 of the United Provinces Excise Act, 1910 (U. P. Act No. 4 of 1910) read with Section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act No. 1 of 1904), the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh Excise Import, Export, Transport and Possession of Denatured Spirit Rules, 1931 relating to the import, export, transport and possession of denatured spirit published vide notification no. 129/XIII-204, dated March 13, 1931, as amended from time to time, namely:-
THE UTTAR PRADESH EXCISE IMPORT, EXPORT, TRANSPORT AND
POSSESSION OF DENATURED SPIRIT
(TWENTY-SIXTH AMENDMENT) RULES, 2025
Short title and commencement
1. (1) These rules may be called The Uttar Pradesh Excise Import, Export, Transport and Possession of Denatured Spirit (Twenty-Sixth Amendment) Rules, 2025. (2) They shall come into force with the effect from the date of their publication in the Official Gazette.
Insertion of rule 13-A
2. In the Uttar Pradesh Excise Import, Export, Transport and Possession of Denatured Spirit Rules, 1931 relating to import, export, transport and possession of denatured spirit published vide notification no. 129/XIII-204, dated March 13, 1931 (as amended from time to time) after rule 13, the following new rule 13-A shall be inserted, namely:-
mŸkj izns'k vlk/kkj.k xtV] 14 uoEcj] 2025 3"Special permit fees on E.N.A. for manufacture of IMFL & Country Liquor in Uttar Pradesh".
13-A. (1) For purchase of Extra Neutral Alcohol (Ε.Ν.Α.) produced in the State and used in the manufacture of country and foreign liquor in the State, the PD-1/2 License holder purchasing distillery or the FL-3/CLB-1 licensee operating under the PD-33 license shall submit an application on the portal of the Excise Department.
(2) The applicant shall have to pay the special permit fee for the E.N.A. purchased according to the following rates/details:-
(a) for the sale of E.N.A. used in the manufacture of foreign liquor within the State-Rs. 1.50 (Rupee one and paise fifty only) per bulk litre ;
(b) for the sale of E.N.A. used in the manufacture of country liquor within the State - Rs. 1.00 (Rupee one only) per bulk litre. (3) The aforesaid special permit fee shall also be applicable on E.Ν.Α. sold/transferred by the distillery for the use of F.L.- 3A and C.L.B.-2 licences operated within the distillery. "
