Dated Lucknow, December 8, 2025IN excercise of the powers under Section 54 of the Air (Prevention and Control of Pollution) Act, 1981 (Act no. 14 of 1981) read with Section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor, after consultation with the Uttar Pradesh Pollution Control Board, is pleased to make the following rules with a view to amend the Uttar Pradesh (Prevention and Control of Pollution) Rules, 1983: 279 RPH 2025 (Paryavaran Anubhag-4) data 1e 6 mRrj izns'k vlk/kkj.k xtV] 8 fnlEcj] 2025 THE UTTAR PRADESH AIR (PREVENTION AND CONTROL OF POLLUTION) (FOURTH AMENDMENT) RULES, 2025

1.(1) These rules may be called the Uttar Pradesh Air (Prevention and Control Short title and commencement

of Pollution) (Fourth Amendment) Rules, 2025. (2) They shall come into force with effect from the date of publication in the Official Gazette.

2.In the said rules for the existing Schedule-1 set out in Column-I below, the Amendment of Schedule-1

(B) Fees to be paid along with application for abtaining Consent prior to Establish,& A fees to be paid alongwith application for the obtaining prior consent before the establishment this Article shall apply where fees has not been deposited under the Water (Prevention and Control of Pollution) Act, 1974. (B) Fees to be paid along with application for obtaining Consent to Establish shall be as below:- Consent to Establish Fee shall be 1.5 times of consent to operate fees. Fees to be paid along with application for the consent to establish shall apply where fees has not been deposited under the Water (Prevention and Control of Pollution) Act, 1974.

(C) Annual Fees For Local Bodies And Infrastructure Projects (Residential And Other) shall be as below:- (a) In respect of infrastructure projects covered under notification no. SO 1533(A) of the Government of India, capital investment for the purpose of determining annual fee for setting up, shall be based on the capital investment during the setting up phase as on 14th September, 2006, as amended from time to time. This includes residential (standalone apartments/ colleges) layouts, integrated projects, commercial complexes, office complexes, educational institutions, townships and local bodies water supply and sewerage boards. Annual fee for setting up shall be as per the formula adopted for industrial units, as given in item A and B above. (b) The fees required for consent to operate the projects in sub-paragraph (a) above shall be based on the quantity of sewage generated/treated:
