1. सॊखऺप्त नाभ औय प्रायम्ब्ब–(1) मह ननमभावरी उत्तय प्रदेश आफकायी (देशी शयाफ की थोक क्तफक्री के नरमे राइसेंसों का व्मवस्थाऩन) (अठायहवॉ सॊशोधन) ननमभावरी, 2025 कही जामेगी।

(2) मह ददनाॊक 1 अप्रैर, 2025 से प्रवृत्त हुमी सभझी जामेगी।

2. ननमभ-2 का सॊशोधन– उत्तय प्रदेश आफकायी (देशी शयाफ की थोक क्तफक्री के नरमे राइसेंसों का व्मवस्थाऩन ) ननमभावरी, 2002, भें नीचे स्तम्ब्ब -एक भें, ददमे गमे क्तवद्यभान ननमभ -2 के स्थान ऩय स्तम्ब्ब -दो भें ददमा गमा ननमभ यख ददमा जामेगा, अथाात ् :–

(ख) ''अनतरयक्तॊ प्रनतपर शुल्कभ'' का तात्ऩ मा देशी भददया के अनधकतभ खुदया भूल्मथ को दो रूऩमे के अगरे गुणक तक ऩूणाांदकत दकमे जाने के परस्वयरूऩ प्राप्तक अन्र की धनयानश से है जो , आवसनी स्तयय ऩय देम होगी।

(ग) ''कम्ब्ऩनी'' का तात्ऩामा कम्ब्ऩानी अनधननमभ, 1913 के अनधकतभ खुदया भूल्मम को दो रूऩमे के अगरे गुणक तक ऩूणाांदकत दकमे जाने के परस्वयरूऩ प्राप्तक अन्र की धनयानश से है जो , आवसनी स्तयय ऩय देम होगी।

(घ) ''प्रनतपर शुल्की'' का तात्ऩहमा कम्ब्ऩीनी अनधननमभ की अधीन यखजस्रीककृ त दकसी कम्ब्ऩननी से है,

(घ) ''प्रनतपर शुल्कन'' का तात्ऩ्म कम्ब्ऩीनी अनधननमभ की धाया-30 के अधीन याज्मी सयकाय द्वाया देशी भददया की तीव्रता के अनुसाय प्रनत रीटय की दय से ननधाारयत पीस से है, जो देशी भददया की आऩूनता से ऩूवा राइसेंसधायी द्वाया सयकायी कोषागाय भें जभा की जामेगी।

(ङ) "देशी खस्ऩरयट " 25 प्रनतशत व 36 प्रनतशत (सादा, धाया-30 के अधीन याज्मन सयकाय द्वाया देशी भददया की तीव्रता के अनुसाय प्रनत रीटय की दय से ननधाारयत पीस से है , जो देशी भददया की आऩूनता से ऩूवा राइसेंसधायी द्वाया सयकायी कोषागाय भें जभा की जामेगी।

(ङ) "देशी खस्ऩरयट " 25 प्रनतशत (सुवानसत), 36 प्रनतशत सुवानसत औय भसारा ) औय 42॰8 प्रनतशत (सादा, सुवानसत औय भसारा ) के रुऩ भें ऐसी अल्कोहरीम साॊद्रता के एक्सरा न्मूरर अल्कोहर से क्तवनननभात देशी खस्ऩरयट औय उत्तय प्रदेश क्तवनननभात भददया

(मू.ऩी.एभ.एर.) ( भसारा सदहत ) बी सखम्ब्भनरत है , खजसभें ऐसी भद्यसारयक सान्द्रता होगी जैसा दक आफकायी आमुक्त द्वाया सभम सभम ऩय याज्म सयकाय के ऩूवाानुभोदन से ननमत दकमा जाम।

(भसारा), 28 प्रनतशत (भसारा) औय 42॰8 प्रनतशत (भसारा) के रुऩ भें ऐसी अल्कोहरीम साॊद्रता के एक्सरा न्मूरर अल्कोहर से क्तवनननभात देशी खस्ऩरयट औय उत्तय प्रदेश क्तवनननभात भददया (मू.ऩी.एभ.एर.) (भसारा सदहत ) बी सखम्ब्भनरत है , खजसभें ऐसी भद्यसारयक सान्द्रता होगी जैसा दक आफकायी आमुक्त द्वाया सभम सभम ऩय याज्म सयकाय के ऩूवाानुभोदन से ननमत दकमा जाम।

आवेदक के आवेदन कयने ऩय प्रदान दकमा जामेगा।

ददवस के अॊदय जभा कयने का ननदेश ददमा जामेगा।

NOTIFICATION

In exercise of the powers under sections 24 and 41 of the United Provinces Excise Act, 1910 (U.P.

Act no. 4 of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no.1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, hereby makes the following rules with a view to amend the Uttar Pradesh Excise (Settlement of License for Wholesale of Country Liquor) Rules, 2002 published vide Excise Commissioner Notification No. 31276/X- Licence-58/2002-2003/dated March 26, 2002, namely:–

THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENCES FOR WHOLESALE OF

COUNTRY LIQUOR) (EIGHTEENTH AMENDMENT) RULES, 2025

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of licences for Wholesale of Country Liquor) (Eighteenth Amendment) Rules, 2025.

(2) They shall be deemed to have come into force with effect from 01st April, 2025.

2. Amendment of rule-2–In the Uttar Pradesh Excise (Settlement of Licences for Wholesale of Country Liquor) Rules, 2002, for the existing rule 2 setout in Column-I below, the rule as set out in Column-II shall be substituted, namely:–

(b) The license for wholesale of Country Liquor in Form CL-2 may be renewed by the Deputy Excise Commissioner of the concerned charge with the prior approval of the joint Excise commissioner of the concerned zone subject to the terms and conditions prescribed by the State Government.

The licencees of wholesale licenses willing to renew for the next year shall submit the renewal application online, upload the prescribed affidavit and the No Objection Certificate issued by the concerned District Excise Officer and deposit the renewal fee amount online. Within 07 working days from the date of receipt of the application, the licensing authority or the authorized authority shall take a decision on renewal and direct the concerned interested licencee to deposit the prescribed license fee amount for the concerned license within 03 working days. (4) The applicant has not been a defaulter/ blacklisted for the excise dues or debarred from holding and excise license under the provisions of any rules made under the Act.

(5) (i) The applicant does not possess any licence for retail sale of country liquor, foreign liquor, beer and model shop in the State.

(ii) Applicant shall be bearer of solvency certificate or certificate of owned property issued by authorized Income Tax Valuer and his solvency shall not be less than the amount equivalent to the licence fee of concerned licence.

(6) The applicant shall submit an affidavit duly verified by Notary public as proof of the following, namely:-

(1) That he possesses or has an arrangement for taking on rent a suitable premise in that locality for opening the shop in accordance with the provisions of Uttar Pradesh Number and Location of Excise Shop Rules, 1968 as amended from time to time

(II) That his proposed premises of the shop have not been constructed in violation of any Law or Rules;

(III).That he and his family members and managers/Directors of the distillery possess good moral character and have no criminal background nor have been convicted of any offence punishable under United Provinces Excise Act, 1910 or Narcotic Drugs. and Psychotropic Substances Act, 1985 or any other cognizable and non-bailable offence;

(IV)That the applicant shall furnish a character certificate issued by the District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank of assistant commissioner of police nominated by the police commissioner of the concerning police Commissionerate of the district , which he is the resident showing that he as well as his family members possess good moral character and have no criminal background or criminal history;

Provided further that in case of

wholesale licenses having two licensees which

have been renewed since previous years, if one of

the licensees dies before renewal and an

application is given by his legal heir or nominee

or if he is found unsuitable, then on receipt of

the application, the licence will be allowed to be

renewed in favour of the other surviving licensee

with the condition of depositing the entire

security amount of the licence for the next year

by the prescribed date. At the end of the year,

the security amount deposited for the previous

year will be returned as per rules.
