IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the "Uttar Pradesh Nagar Nigam (Sanshodhan) Vidheyak, 2025" introduced in the Uttar Pradesh Legislative Assembly on December 22, 2025:

IT IS HEREBY enacted in the Seventy-sixth Year of the Republic of India as
follows:-
Short title,
1. (1) This Act may be called the Uttar Pradesh Municipal Corporation
extent and
(Amendment) Act, 2025.
commencement (2) It shall extend to the whole of the State of Uttar Pradesh. (3) It shall be deemed to have come into force with effect from the 22nd day of
September 2025.

2. In sub-section (1) of Section 305 of the Uttar Pradesh Municipal Corporation Section 305
Act, 1959, for the words "two years from the date of each such permission or of U.P. Act no.2
renewal", the words "fifteen years from the date of such permission or renewal, as of 1959
may be prescribed by rules " shall be substituted.
U.P. Ordinance Repeal and saving 3. (1) The Uttar Pradesh Municipal Corporation (Amendment)
no. 11 of 2025 Ordinance, 2025 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the principal Act as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been
done or taken under the corresponding provisions of the principal Act
as amended by this Act as if the provisions of this Act were in force
at all material times.

STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh Municipal Corporation Act, 1959 (U.P. Act no. 2 of 1959) has been enacted to establish and govern Municipal Corporations in the State of Uttar Pradesh, defining their administrative structures, powers and functions.
In the modern era of information, communication and digitalization, the cost of structures/equipment used at advertising sites such as digital displays, billboards, hoardings, kiosks, etc., is significantly high, resulting in substantial financial expenditure. After obtaining permission from Municipal Corporations for advertising, agencies have to invest large amounts of money in such structures.
Sub-section (1) of Section 305 of the aforesaid Act, specifies the duration of permission or its renewal as two years, which clearly implies that advertising agencies are required to remove their advertising structures after the expiry of the permission, that is, after two years.
Since advertising agencies invest a considerable amount of money in advertising structures, it becomes difficult for them to recover this investment within a period of two years. As a result, large and high-quality advertising agencies show reluctance in participating in the tendering process. In view of the above, it is inevitable and necessary that the maximum period mentioned under the aforesaid section be increased to "fifteen years".
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Municipal Corporation (Amendment) Ordinance, 2025 (U.P. Ordinance no. 11 of 2025) was promulgated by the Governor on September 22, 2025.
This Bill is introduced to replace the aforesaid Ordinance.
