IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Shiksha Sewa Chayan Aayog (Sanshodhan) Adhiniyam, 2025 (Uttar Pradesh Adhiniyam Sankhya 11 of 2026) as passed by the Uttar Pradesh Legislature and assented to by the Governor on January 2, 2026. The Uchha Shiksha Anubhag-5 is administratively concerned with the said Adhiniyam.
THE UTTAR PRADESH EDUCATION SERVICE SELECTION COMMISSION (AMENDMENT) ACT, 2025
(U.P. Act no. 11 of 2026)

AN
ACT
to amend the Uttar Pradesh Education Service Selection Commission
Act, 2023.
IT IS HEREBY enacted in the Seventy-sixth Year of the Republic of India as
follows :–
1. (1) This Act may be called the Uttar Pradesh Education Service Selection Short title and commencement Commission (Amendment) Act, 2025.
(2) It shall be deemed to have come into force with effect from the 18th day of
November, 2025.
Amendment of 2. In sub-section (2) of Section 4 of the Uttar Pradesh Education Service
Section 4 of U.P.
Act no. 15 of 2023 Selection Commission Act, 2023, for clause (a), the following clause shall be substituted, namely:-
" (a) is holding or has held the post of Principal Secretary to the State
Government or a post equivalent thereto; or"
Power to remove 3. (1) The State Government may, for the purpose of removing any difficulty in
difficulties
respect of the provisions made by this Act, by order published in the Gazette, direct that
the provisions of the principal Act shall during such period, as may be specified in the
order, have effect subject to such adaptations, whether by way of modification, addition or omission, as it may deem necessary or expedient:
Provided that no such order shall be made after two years from the date of
commencement of this Act.
(2) Every order made under sub-section (1) shall be laid before both Houses of
the State Legislature as soon as may be after it is made.
Repeal and
U.P. Ordinance 4. (1) The Uttar Pradesh Education Service Selection

no. 15 of 2025 Commission (Amendment) Ordinance, 2025 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action
taken under the provisions of the principal Act as amended by the
Ordinance referred to in sub-section (1) shall be deemed to have been
done or taken under the corresponding provisions of the principal Act as
amended by this Act as if the provisions of this Act were in force at all
material times.
4 mRrj izns'k vlk/kkj.k xtV] 2 tuojh] 2026STATEMENT OF OBJECT AND REASONS
The Uttar Pradesh Education Service Selection Commission has been constituted under the Uttar Pradesh Education Service Selection Commission Act, 2023 (U.P. Act no. 15 of 2023) to conduct examinations in a transparent and fair manner for various departments like the Higher Education Department, Secondary Education Department, Basic Education Department, etc..
In view of the vast work structure of the Commission, the modernization of examination processes in the era of modern information technology, and the need for a skilled and experienced personality for conducting fair, transparent, and time-bound examinations with integrity, it was decided to expand the eligibility criteria for selection to the post of Chairman by amending Section 4 of the aforesaid Act.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Education Service Selection Commission (Amendment) Ordinance, 2025 (U.P. Ordinance no. 15 of 2025) was promulgated by the Governor on November 18, 2025.
This Bill is introduced to replace the aforesaid Ordinance.
