1. संखप्ति नाम और प्रारम्भ–(1) र्ह मनर्मालिी उत्तर प्रदेश आबकारी (वदिेशी मददरा के प्रीममर्म फु टकर वक्र्रि के लाइसेंसों का र्व्स्थिापन) (चतुथा संशोनि) मनर्मालिी, 2025 कही र्जाेगी।

(2) र्ह ददनांक 1 अप्रैल, 2025 से प्रृित्त समझी र्जाेगी।

2. मनर्म-2 का संशोनि– उत्तर प्रदेश आबकारी (वदिेशी मददरा के प्रीममर्म फु टकर वक्र्रि के लाइसेंसों का र्व्स्थिापन) मनर्मालिी, 2020, खजसे आगे उक्त मनर्मालिी कहा र्गा है, में नीचे स्तम्भ-एक में दर्दे र्गे वद्यिमान मनर्म-2 के स्थान पर स्तम्भ-दो में दर्दा र्गा मनर्म रख दर्दा र्जाेगा, अथाात ् :–

2. पररभाषा-

(2) भारत मनममात वदिेशी मददरा (आई.एम. एफ.एल.)- (दो) भारत मनममात वदिेशी मददरा(आई.एम. एफ.एल.)- भारत में मनममात खस्प्रटर् ा मददरा, खजसे सुगंर् िा रंग भारत में मनममात खस्प्रट र्ा मददरा, औरस्ािद र्ा रंग की दृव ि से भारत में र्आामतत खस्प्रट र्ा मददरा के की दृव ि से भारत में र्आामतत खस्प्रट र्ा मददरा के समान पररष्कृ त दर्का र्गा हो और खजसमें माल्ट समान पररष्कृ त दर्का र्गा हो और खजसमें माल्ट खस्प्रट, खव्हस्की, ब्रान्डी, रम, खजन, बोद्द्का ि लीकसा खस्प्रट, खव्हस्की, ब्रान्डी, रम, खजन, बोद्द्का ि लीकसा सखम्ममलत है। इसमें भारत में मनममात र्बीर, पैक की सखम्ममलत है। इसमें भारत में मनममात र्बीर, पैक की र्हुी ड्राट र्बीर, पोटार, साइडर, ऐल, ािइन ि कम हुई ड्राट र्बीर, पोटार, साइडर, ऐल, ािइन िकम तीव्रता तीव्रता के मादक र्पे (एल.ए.बी.) भी सखम्ममलत है;

वद्यिमान मनर्म

एतद्द्वारा प्रमतस्थावपत मनर्म

(ि) ''प्रमतभूमत निरामश'' का तात्र्पा लाइसेंस फीस के (ि) "प्रमतभूमत निरामश"का तात्र्पा लाइसेंस फीस के दस एक चौथाई निरामश के समतुर्ल् निरामश, जो सामि ि प्रमतशत के बराबर की निरामश से है, जो खजला जमा रसीद के माध्र्म से खजला आबकारी अमकिारी आबकारी अमकिारी के प ि में मगरीिकृ त ई-बैंक के प ि में मगरीिकृ त होगी अथाि ई-पेमेंन्ट के गारंटी के माध्र्म से र्ा आबकारी र्आुक्त वारा र्था माध्र्म से जमा की र्जाेगी और जो लाइसेंस वदिहत दकसी अर्न् रीमत के माध्र्म से जमा की संचालन में लाइसेंसािरी वारा दर्के र्गे दकसी जाएगी, जो रार्ज् सरकार को सभी दाोिं और र्दे के व्र्मतक्रम की खस्थमत में समपत त दर्के जाने र्ोर्ग् अंमतम मनपटान के पश्चात ् प्रमतर्दे की जाएगी।

(ढ) ''पररहिन अनुज्ञा पत्र''का तात्र्पा थोक लाइसेंसर् था (ढ) ''पररहिन अनुज्ञा पत्र''का तात्र्पा थोक लाइसेंसर् था एफ.एल.-2, एफ.एल.-2बी, एंि बी.आई.ओ.-1 से वदिेशी एफ.एल.-2,एफ.एल.-2बी, एंि बी.आई.ओ.-1/ मददरा के पररहिन हेतु जारी अनुज्ञापन से है।

बी.आई.ओ.-1A से वदिेशी मददरा के पररहिन हेतु

(2) इस मनर्मालिी में प्र्रुक्त दकन्तु अपररभावषत शब्द (2) इस मनर्मालिी में प्र्रुक्त दकन्तु अपररभावषत शब्द और पदो के हिी अथा होंगे जो अममिनर्म में उनके और पदो के हिी अथा होंगे जो अममिनर्म में उनके मलए क्रमशाः समनुदेमशत हैं।

मलए क्रमशाः समनुदेमशत हैं।

3. मनर्म-3 का संशोनि- उक्त मनर्मालिी में नीचे स्तम्भ-एक में, ददए गए वद्यिमान मनर्म-3 के स्थान पर स्तम्भ-दो में दर्दा र्गा मनर्म रख दर्दा र्जाेगा, अथाात ्:-

मॉल में सीलबंद बोतलों/पैके टों में वदिेशी मददरा की प्रामकिारी वारा मनम्नांदकत शतों के अीिन प्रदान दर्के

फु टकर वबक्री हेतु प्रपत्र वि0म0.-4ग में एक र्ा अमकि र्जाेंगेाः

लाइसेंस प्रदान दर्के जा सकते हैं।

वद्यिमान मनर्म

एतद्द्वारा प्रमतस्थावपत मनर्म

रार्ज् सरकार वारा सर्म-सर्म पर वमिनददाि खजलों/ेित्रों

में एफ.एल.-4ग लाइसेंस में अनुज्र्ञे ेिणी की ािइन एंि

एल.ए.बी.की वबक्री हेतु प्रपत्र एफ.एल.-4घ में एक र्ा

अमकि लाइसेंस और समस्त एम0आर0पी0 की र्बीर

प्रदान की जा सकती है। लाइसेंस देने से पहले

लाइसेंमसंग प्रामकिारी मनम्नमलखखत शतों को सुमनखश्चत

करेगा :

(एक) र्ह दक वक्र्रि हेतु दुकान र्न्ूनतम 500 गिाफु ट कापेट

ेित्र में होगी और दुकानों में ग्राहकों हेतु प्रेिश करने तथा (एक) र्ह दक वक्र्रि हेतु दुकान र्न्ूनतम 500 गिा फु ट का अपनी इच्छानुसार शेल्फ से ब्राण्ड चुनने की सुवािि

पेट ेित्र में होगी और दुकानों में ग्राहकों हेतु प्रेिश करने प्रदान की र्जाेगी।

तथा अपनी इच्छानुसार शेल्फ से ब्राण्ड चुनने की सुवािि

प्रदान की र्जाेगी।

(दो) र्ह दक वक्र्रि हेतु दुकान अच्छी गुणत्तिा की फ्लोररंग

और सुसखज्जत शेल्फ सदहत ाितानुकू मलत होगी खजससे (दो) र्ह दक वक्र्रि हेतु दुकान अच्छी गुणत्तिा की फ्लोररंग दक वमिभन्न प्रकार के ब्राण्ड शेल्फ में र्व्खिस्थत ढंग से

और सुसखज्जत शेल्फ सदहत ाितानुकू मलत होगी खजससे प्रदमशात दर्के जा सकें ।

(तीन) र्ह दक वक्र्रि हेतु दुकान में मददरा भण्डारण एंि

(तीन) र्ह दक वक्र्रि हेतु दुकान में मददरा भण्डारण एंि

प्रदशान हेतु पृथक-पृथक प्रांगण होंगेऔर

(चार) र्ह दक दुकान का लाइसेंसािरी के लि उन्हीं ेिखर्णों की

वदिेशी मददरा, खजसे आबकारी र्आुक्त वारा र्था खस्थमत (चार) र्ह दक दुकान का लाइसेंसािरी के लि उन्हीं ेिखर्णों की प्रामकिृ त दर्का र्जा, की वबक्री सील्ड बोतलों/पैके टों में

वदिेशी मददरा, खजसे आबकारी र्आुक्त वारा र्थाखस्थमत र्व्वक्र्तों को करेगा।

(पॉच) र्ह दक दुकान का लाइसेंसािरी र्व्वक्र्तों को पररसर में

उपभोग हेतु मददरा की वबक्री नहीं करेगा।

(पॉच) र्ह दक दुकान का लाइसेंसािरी र्व्वक्र्तों को पररसर में

उपभोग हेतु मददरा की वबक्री नहीं करेगा।

(छाः) र्ह दक दुकान का लाइसेंसािरी दकसी अर्न्

लाइसेंसािरी को मददरा की वबक्री नहीं करेगा।

(छ:) र्ह दक दुकान का लाइसेंसािरी दकसी अर्न्

लाइसेंसािरी को मददरा की वबक्री नहीं करेगा।

(सात) इस संबंि में ऐसी अर्न् शतें, खजन्हें आबकारी र्आुक्त

अमरिोवपत करना उमचत समझें।

(सात) इस संबंि में ऐसी अर्न् शतें, खजन्हें आबकारी र्आुक्त

अमरिोवपत करना उमचत समझें।

(आि) र्ह दक दुकान का लाइसेंसािरी क्रे ता को ािइन

आस्ािदन कि की सुवािि प्रदान करेगा।

(आि) र्ह दक दुकान का लाइसेंसािरी क्रे ता को ािइन

आस्ािदन कि की सुवािि प्रदान करेगा।

(नौ) र्ह दक दुकान का लाइसेंसािरी, मददरा उपभोग से

सम्बखन्ति उपसानि की वबक्री कर सके गा।

(नौ) र्ह दक दुकान का लाइसेंसािरी, मददरा उपभोग से

सम्बखन्ति उपसानि की वबक्री कर सके गा।

वद्यिमान मनर्म

एतद्द्वारा प्रमतस्थावपत मनर्म

(दस) लाइसेंसािरी को दुकान के अंदर के दृर्श् और दुकान

के बाहर के दृर्श् को कै द करने और संग्रहीत करने के

मलए दो सी.सी.टी.ीि. कै मरे अमर्नािा रूप से लगाने होंगे।

(र्ग्ारह) लाइसेंसािरी को मददरा की दुकान पर दडखजटल

भुगतान सुवािि का वकिल्प अमर्नािा रूप से उपलब्ि

कराना होगा।

(बारह) लाइसेंसािरी को पी.ओ.एस. मशीन के माध्र्म से

शराब की वबक्री करनी होगी।

(तेरह) मॉल के मल्टी्लेक्स ेित्रों में प्रीममर्म फु टकर वक्र्रि

अनुमर्न् नहीं होगा।

(चौदह) प्रीममर्म फु टकर वक्र्रि का हस्तांतरण अनुमर्न्

होगा, दकन्तु र्ह मनर्म-6(ख) के उपबन्ोिं के अर्ध्ीिन

होगा।

(पंद्रह) वकिास प्रामकिरणों और औद्योमगक वकिास

प्रामकिरणों में खस्थत 20,000 गिामीटर र्ा उससे

अमकि ेित्रािले आई.टी./आई.टी.ई.एस. प्रमतष्ठानों में

संस्थागत सुवाििओं के अीिन रेस्तरां/कैं टीन के साथ

प्रीममर्म फु टकर वक्र्रि की सुवािि अनुमर्न् होंगी।

4. मनर्म-5 का संशोनि - उक्त मनर्मालिी में नीचे स्तम्भ-एक में, ददए गए वद्यिमान मनर्म-5 के स्थान पर स्तम्भ-दो में दर्दा र्गा मनर्म रख दर्दा र्जाेगा, अथाात ्:-

(2) लाइसेंस प्रामकिारी आेिदन पत्र को स्ीिकृ त अथाि कोई (2) लाइसेंस प्रामकिारी आेिदन पत्र को स्ीिकृ त अथाि कोई कारण समनुदेमशत दर्के वबना अस्ीिकृ त कर सकता है कारण समनुदेमशत दर्के वबना अस्ीिकृ त कर सकता है और हि लाइसेंस स्ीिकृ त करने के मर्ले बार्ध् नहीं होगा। और हि लाइसेंस स्ीिकृ त करने के मर्ले बार्ध् नहीं र्दद कोई आेिदन पत्र अस्ीिकृ त दर्का जाता है तो होगा। र्दद कोई आेिदन पत्र अस्ीिकृ त दर्का जाता है तो प्रमतभूमत निरामश नब्बे ददनों के भीतर ािपस कर दी प्रमतभूमत निरामश नब्बे ददनों के भीतर ािपस कर दी र्जाेगी।

13. लाइसेंसािरी (लाइसेंसािरर्रों) की मृर्त्ु होने पर 13. लाइसेंसािरी (लाइसेंसािरर्रों) की मृर्त्ु होने पर उत्पररतिान-

नामांतरण –

(1) र्दद लाइसेंस दकसी र्व्वक्त वारा ािररत दर्का जाता है (1) लाइसेंस दकसी र्व्वक्त वारा ािररत दर्का जाता हैर् ा र्ा र्संुक्त रूप से दोर् ा उससे अमकि भागीदारों वारा र्संुक्त रूप से दो र्ा उससे अमकि भागीदारों वारा ािररत दर्का जाता है।

(2) इच्छु क लाइसेंसािरी वारा अनुज्ञापन के अंतरण के (2) लाइसेंसािरी अपने ािररसों /पररािर के सदर्स्ों/मनकट संबं ि में एक नाममनदेशन शपथ पत्र भी प्रस्तुत सम्बखर्न्ोिंके नाम, आािर संर्ख्ा, सम्बं ि आदद को दर्का जा सकता है खजसमें प्रथम, दवर्ती, तृर्ती र्रिीता क्रम में प्रथम, दवर्ती, तृर्ती आदद का आदद र्रिीता क्रम में अपने ािररसों/पररािर के उल्लेख करते र्हुे लाइसेंस के अंतरण के सम्बन् िमें सदर्स्ों/मनकट संबंर्मोिं का नाम, आािर नम्बर, एक नाममनदेशन शपथ पत्र एंि प्रथम नाममनी का संबं ि आदद का उल्लेख दर्का जा सकता है। मृर्त्ु सहममत शपथ पत्र भी प्रस्तुत कर सकता है। मृर्त्ु के प्रकरणों में सािप्रथम नाममनदेशन शपथ पत्र के के मामलों में सािप्रथम नाममनदेशन शपथ पत्र के अनुसार प्रस्तुत प्राथाना पत्रों का संज्ञान मर्ला र्जाेगा अनुसार प्रस्तुत प्राथाना पत्रों का संज्ञान मर्ला र्जाेगा अर्न्था की खस्थमत में मनर्मानुसार र्कााािही की अर्न्था की खस्थमत में मनर्मानुसार र्कााािही की र्जाेगी।

(एक) र्दद दकसी लाइसेंसािरी की अगले षिा के नीिकरण

हेतु निरामश जमा करने के पश्चात मृर्त्ु हो जाती है तथा

उसके दकसी भी वमिकि ािररस र्ा नाम मनदेमशती को

इसके मलए उर्पुक्त नहीं र्पाा जाता है, तो नीिकरण हेतु

जमा की गई निरामश प्रोसेमसंग फीस को छोड़कर उनके

वमिकि ािररस को ािपस कर दी जाएगी।

(दो) र्दद दकसी प्रीममर्म फु टकर वक्र्रि लाइसेंसािरी की

मृर्त्ु हो जाती है, खजनके लाइसेंस पूाि षिों से नीिकृ त हैं

तथा उसके वमिकि ािररस र्ा नाम मनदेमशती वारा शपथ

पत्र नहीं दर्दा जाता है अथाि ेि अनुर्पुक्त पाए जाते हैं,

तो आेिदन पत्र प्राप्त होने पर, अगले षिा के मलए मर्नत

ददनांक तक आेिदन पत्र प्रस्तुत करने पर जीवति

लाइसेंसी के पि में दुकान का नीिकरण कर दर्दा

जाएगा। षिा के अंत में, पूाि षिा के मलए जमा की गई

प्रमतभूमत निरामश ािपस कर दी जाएगी।

(तीन) दो जीवति लाइसेंसरिर्रों ािले प्रीममर्म वक्र्रि का

नीिकरण तभी दर्का जाएगा, जब नीिकरण हेतु दोनों

लाइसेंसरिर्रों के बीच सहममत हो। सहममत न होने की

दशा में नीिकरण अनुज्र्ञे नहीं होगा।

(3) लाइसेंसािरीर् ा भागीदारों में से दकसी एक भागीदार (3) लाइसेंसािरीर् ा भागीदारों में से दकसी एक भागीदार

की मृर्त्ु की दशा में लाइसेंस प्रामकिारी को आेिदन की मृर्त्ु की दशा में लाइसेंस प्रामकिारी को आेिदन

अनुमोदन से लाइसेंस अमि िके प्रक्रम के दौरान कारबार अनुमोदन से लाइसेंस अमिि के प्रक्रम के दौरान कारबार के

(ग) समस्त ेिखर्णों की र्बीर; की वबक्री करेगा।

परन्तु र्ह दक आबकारी र्आुक्त वारा अनुज्ञा प्राप्त समस्त परन्तु र्ह दक आबकारी र्आुक्त वारा अनुज्ञा प्राप्त समस्त एस0के 0र्ू0 (स्टॉक कीवपंग र्ूमनट) में पात्र ब्राण्डों की एस0के 0र्ू0 (स्टॉक कीवपंग र्ूमनट) में पात्र ब्राण्डों की वबक्री की जा सकती है।

वबक्री की जा सकती है।

(2) लाइसेंसािरी, वदिेशी मददरा, एफ0एल0 2, एफ0एल0 (2) लाइसेंसािरी, वदिेशीमददरा, एफ0एल0 2, एफ0एल0 2बी, बी0आई0ओ0-1 लाइसेंसािरक र्ा आबकारी 2बी, बी0आई0ओ0-1/बी0आई0ओ0-1A लाइसेंसािरक र्ा र्आुक्त वारा प्रामकिृ त दकसी लाइसेंसािरी से प्राप्त करेगा। आबकारी र्आुक्त वारा प्रामकिृ त दकसी लाइसेंसािरी से प्राप्त र्आातक इकार्इों में समुद्रपार वदिेशी मददरा के दकसी करेगा। र्आातक इकार्इों में समुद्रपार वदिेशी मददरा के प्रकार के ब्राण्डों की अनुपलब्तिा की खस्थमत में प्रामकिृ त दकसी प्रकार के ब्राण्डों की अनुपलब्तिा की खस्थमत में र्व्वक्र्तों वारा आबकारी र्आुक्त की वशिेष अनुज्ञा के प्रामकिृ त र्व्वक्र्तों वारा आबकारी र्आुक्त की वशिेष अनुज्ञा अीिन इन ब्राण्डों को उत्तर प्रदेश में समुद्रंपार की वदिेशी के अीिन इन ब्राण्डों को उत्तर प्रदेश में समुद्रंपार की वदिेशी मददरा का र्आात मनर्मालिी, 2003 के उपबंोिं के मददरा का र्आात मनर्मालिी, 2003 के उपबंोिं के अीिन अीिन अर्न् रार्ज्ों र्ा संघरार्ज् ेित्रों में स्थावपत अर्न् रार्ज्ों र्ा संघरार्ज् ेित्रों में स्थावपत कस्टम बाण्डों से कस्टम बाण्डों से प्राप्त दर्का जा सकता है।

अीिन प्रामकिृ तन हो।

परन्तु प्रीममर्म फु टकर वक्र्रि बी0आई0ओ0-1

अथाि बी0आई0ओ0-1ए से क्र्र की गई मददरा पर

(6) लाइसेंसािरी लाइसेंस प्राप्त पररसर से मभन्न दकसी स्थान (6) लाइसेंसािरी लाइसेंस प्राप्त पररसर से मभन्न दकसी स्थान पर वदिेशी मददरा संमचत नही करेगा। लाइसेंसािरी पर वदिेशी मददरा संमचत नही करेगा। लाइसेंसािरी लाइसेंस प्राप्त पररसर के बाहर र्ा उसके मनकट लाइसेंस प्राप्त पररसर के बाहर र्ा उसके मनकट अनमकिृ त रुप में रखी र्गी दकसी वदिेशी मददरा के मलए अनमकिृ त रुप में रखी र्गी दकसी वदिेशी मददरा के मलए उत्तरर्दाी होगा।

(7) लाइसेंसािरी सुसंगत मनर्मालिी के अीिन जारी (7) लाइसेंसािरी सुसंगत मनर्मालिी के अीिन जारी पररहिन पास के माध्र्म से लाइसेंस प्राप्त पररसर के पररहिन पास के माध्र्म से लाइसेंस प्राप्त पररसर के मलए वदिेशी मददरा का पररहिन करेगा।

(9) ोिदका एंि रम रू. 700 प्रमत 750 एम.एल. र्ा इससे (9) ोिदका एंि रम अमकितम खुदरा मूर्ल्रू. 700 प्रमत अमकि एम.आर.पी. प्रमत 750 एम.एल. ािले ब्राण्ड 750 एम.एल. र्ा इससे अमकि अमकितम खुदरा और र्बीर के रू.140 प्रमत 500 एम.एल. मूर्ल् ािले ब्राण्ड और र्बीर के अमकितम खुदरा के नके एम.आर.पी. र्ा इससे अमकि एम.आर.पी. प्रमत मूर्ल्रू.140 प्रमत 500 एम.एल. र्ा इससे अमकि ािले प्रमत 500 एम.एल. के न ािली ब्राण्ड की वबक्री ही के न की वबक्री ही अनुमर्न् होगी। एफ.एल.-4डी अनुमर्न् होगी।

लाइसेंस को छोडकर, जहॉ समस्त ेिणी की वर्बर की

वबक्री अनुमर्न् होगी।

(10) (क) समि प्रामकिारी से अनापवत्त प्रमाण पत्र प्राप्त होने (10) (क) समि प्रामकिारी से अनापवत्त प्रमाण पत्र प्राप्त होने पर हािई अड़डों और मेरो स्टेशन/रेलेि स्टेशन के अंदर

के पश्चात हािई अड्डों और मेरो स्टेशनों/रेलेि स्टेशनों भी प्रीममर्म ररटेल ेिण्ड अनुमर्न् होंगे। ऐसी दुकानों का

के मुर्ख् भनि के अंदर भी प्रीममर्म फु टकर वक्र्रि प्रेिश एंि मनकास वार मुर्ख् भनि के अंदर से होगा।

एफएल-4सी प्रीममर्म फु टकर वक्र्रि का मामसक

प्रर्त्ाभूत राजस्ि, ािवषाक प्रर्त्ाभूत राजस्किा 1/12ािाँ

भाग होगा। प्रीममर्म फु टकर वक्र्रि का ािवषाक प्रर्त्ाभूत

राजस् ि मतमाही आािर पर वभिाखजत दर्का जाएगा, जो

उसी ािवषाक प्रर्त्ाभूत राजस् ि का 1/4ािं भाग होगा।

परन्तु समस्त एफएल 4सी प्रीममर्म फु टकर वक्र्रि के

मलए र्ह अमर्नािा होगा दक ेि रार्ज् सरकार वारा र्था

वदिहत र्न्ूनतम वमिनददाष्ट प्रमतशतरामश, जो दक

मामसक/त्रैमामसक जैसा भी मामला हो के मलए वदिहत

कु ल प्रमतफल शुल्क के बराबर हो, वदिेशी मददरा के रूप

में उािना होगा।

प्रीममर्म फु टकर वक्र्रिों में वदिेशी मददरा, ािइन,

र्बीर और एल.ए.बी. (कम तीव्रता के मादक र्पे) से प्राप्त

राजस् िसखम्ममलत होगा;

परन्तु एफएल-4डी लाइसेंस के मलए कोई र्न्ूनतम

ािवषाक प्रर्त्ाभूत मात्रा वदिहत नहीं की गई है।

(घ) र्दद लाइसेंसािरी दकसी माह में कम से कम अपने

(घ) र्दद एफ0एल04सी लाइसेंसािरी दकसी माह में कम मामसक र्न्ूनतम प्रर्त्ाभूत राजस् िके समतुर्ल् मददरा

है तो उसे सम्बखन्ति माह के बर्काा राजस् ि के अमतररक्त प्रमतभूमत जमा करने की अपेाि की र्जाेगी

समतुर्ल् 10 ददसि के भीतर अमतररक्त प्रमतभूमत जमा खजसमें वफिल रहने पर लाइसेंस स्ति: मनरस्त हो

करना होगा, खजसमें वफिल रहने पर लाइसेंमसंग र्जाेगा और बर्काा राजस् ि की मनर्मानुसार सिूली

प्रामकिारी मनर्मानुसार मनरस्तीकरण की र्कााािही की प्रदर्का आरम्भ की र्जाेगी। दुकान पर अवक्रिीत

आरम्भ करेंगे तथा बर्काा राजस् ि की सिूली की स्टाक भी जब्त कर मर्ला र्जाेगा।

प्रदक्र्रा भी मनर्मानुसार आरम्भ की र्जाेगी। दुकान

पर अवक्रिीत स्टाक भी जब्त कर मर्ला र्जाेगा और

रार्ज् सरकार वारा वदिहत रीमत से उसका मनपटान

दर्का जाएगा।

र्ह लाइसेंस मनम्नमलखखत सामार्न् और वशिेष शतों के अर्ध्ीिन है, खजसमें से दकसी का व्र्मतक्रम करने पर र्ा र्संुक्त प्रान्त आबकारी अममिनर्म-1910र् ा स्ािपक ओषम िएंि मनाः प्रभाीि पदाथा अममिनर्म 1985 के अीिन दकसी अपरा िके मलए लाइसेंसािरी/लाइसेंसािरर्रों के दोषमसवद्ध परर् ा उत्तर प्रदेश गु ंडा मर्नंत्रण अममिनर्म, 1970 के अीिन बदहष्कृ त होने पर सुसंगत वर्मिोिं के अीिन अमरिोवपत दकन्हीं शाखस्र्तों के अमतररक्त लाइसेंस रद्द दर्के जाने र्ोर्ग् होगा तथा लाइसेंस फीस और प्रमतभूमत निरामश समपत त दकए जानेर् ोर्ग् होगी।

सामार्न् और वशिेष शतें

एक- लाइसेंसािरी खजला के एफ0एल0-2, एफ0एल0-2ख, बी0आई0 ओ0-1 लाइसेंस ािरक अथाि आबकारी र्आुक्त वारा प्रामकिृ त दकसी लाइसेंसािरी से ािइन, एल0ए0बी0 एंि र्बीर की आपूमता, सर्म-सर्म पर उदग्रहर्णी समस्त करों, प्रमतफल फीस, उपकर आदद को सखम्ममलत करते हुए मददरा के मूर्ल् का पूणा भुगतान करने के पश्चात ् प्राप्त करेगा। उत्तर प्रदेश में स्थावपत र्आातक इकार्इों में समुद्रपार र्बीर, ािइन एंि कम तीव्रता के मादक र्पे के दकसी प्रकार के ब्राण्डों की अनुपलब्तिा की खस्थमत में प्रामकिृ त र्व्वक्र्तों वारा आबकारी र्आुक्त की वशिेष अनुममत के अीिन इन ब्राण्डों को अर्न् रार्ज्ोंर् ा संघ रार्ज्ों में स्थावपत कस्टम बाण्डों से उत्तर प्रदेश में समुद्रंपार की र्बीर, ािइन एंि कम तीव्रता के मादक र्पेका र्आात मनर्मालिी, 2003 के उपबंोिं के अीिन खरीद सकता है।

दो - ािइन, एल0ए0बी0 एंि र्बीरकी बोतलों के लेबुलों पर 1x1 सेंटीमीटर के दृर्श् शब्दों में अमकितम ् फु टकर मूर्ल् मुदद्रत दर्का र्जाेगा। फु टकर लाइसेंसािरी मुदद्रत अमकितम ् फु टकर मूर्ल् से अमकि मूर्ल् नहीं प्रभाररत करेगा।

(क) लाइसेंसािरी को दुकान के अंदर के दृर्श् और दुकान के बाहर के दृर्श् को कै द करने और संग्रहीत करने के मलए दो सीसीटीीि कै मरे अमर्नािा रूप से लगाने होंगे।

(ख) लाइसेंसािरी को शराब की दुकान पर दडखजटल भुगतान की सुवािि अमर्नािा रूप से उपलब्ि करानी होगी।

(ग) लाइसेंसािरी को शराब की वबक्री पी.ओ.एस. मशीन के माध्र्म से करनी होगी।

तीन- लाइसेंस प्राप्त पररसर पर वदिेशी मददरा र्बीर, ािइन एंि कम तीव्रता के मादक र्पे (एल.ए.बी.)की वबक्री के लि पररसर के बाहर उपभोग के मलए की र्जाेगी। पररसर में मददरापान मनवषद्ध होगा।

चार- वदिहत तीब्रता और मानक ािररता की मुहरबन्द बोतलों/कै नों में खजनपर आबकारी र्आुक्त वारा वदिहत सुराि कोड और लेवबल चस्पा होवदिेशी मददरा की वबक्री की र्जाेगी ।

पॉच- लाइसेंसािरी, लाइसेंस प्रामकिारी वारा वदिहत प्रपत्र और रखजस्टर (एफ0एल0-25ए) में मनर्ममत और सही-सही दैमनक लेखा अनुरखति रखेगा। लाइसेंसािरी वक्र्रि आदद का भी लेखा प्रस्तुत करेगा और मनरीणिकताा प्रामकिारी की अपेािनुसार सामग्री तथा दस्ताेिजो की सुवािि प्रदान करेगा तथा उन्हें उपलब् िकर्राेगा।

छाः- लाइसेंसािरी, र्बीर, ािइन एंि कम तीव्रता के मादक र्पे(एल0ए0बी0)का संपूणा स्टाक लाइसेंसप्राप्त पररसर में ही संमचत करेगा।

सात- लाइसेंसािरी दुकान के प्रेिश वार पर आबकारी र्आुक्त वारा अनुमोददत प्रारूप/आकार का एक सहज दृर्श् साइनबोडा लगाएगा, खजसपर लाइसेंसािरी का नाम, पद, दुकान की अखिस्थमत, लाइसेंस की अमिि, दुकान खुलने िबन्द होने का सर्म और लाइसेंस प्रामकिारी वारार् था वदिहत अर्न् सूचर्नाें भी मोटे अरिों में अंदकत होंगे।

आि- साइन बोडा में मनम्नमलखखत सूचना भी प्रदमशात होगीाः-

"दुकान के बाहर आस-पास र्ा साािजमनक स्थान पर शराब पीना खिजात है। इस संबं िमें कोई भी उल्लंघन दण्डर्नी होगा। "26 उत्तर प्रदेश असाधारण गजट, 21 जनवरी, 2026 ई0 ''शराब पीकर गाड़ी चलाना जानलेाि हो सकता है। कृ र्पा शराब पीकर गाड़ी न चर्लाें।"

नौ- लाइसेंसप्राप्त पररसर में शस्त्र लेकर प्रेिश करना सािथा मनवषद्ध होगा।

दस- लाइसेंसािरी दकसी भी ऐसे र्व्वक्त को वक्रिे ता के रूप में मर्नोखजत नहीं करेगा, जो 21 षिा से कम र्आु का होर् ा जो दकसी संक्रामक रोगर् ा छु आ-छू त रोग से ग्रस्त होर् ा आपरामकि पृष्ठभूमम का होर् ा मदहला हो।

र्ग्ारह- लाइसेंसािरी परममट के मर्साि एक बार में रार्ज् सरकार के अनुमोदन से आबकारी र्आुक्त वारार् थावदिहत मात्रा से अमकि की वबक्री दकसी भी क्रे ता को नहीं करेगा।

बारह- 21 षिा से कम र्आु के र्व्वक्तर् ा दिी ािररत दकसी सरकारी कमी को वक्रिी नहीं की र्जाेगी।

तेरह- लाइसेंसािरी के मलए दकसी दशा में बोतलों र्ा उनके लेबुलों, सुराि कोड और वपल्फरप्रूफ मुहरों से वबगाड़ करना (वकिृ त करना) सािथा मनवषद्ध है।

चौदह- लाइसेंसािरी अपने लाइसेंसप्राप्त पररसर में कोई भी (खस्प्रट)आसि, कै रामल, रंग, सुगन्ि, सुराि कोड, लेबुल, कै ्सूल, मुहरर् ा कोई हामनकारक सामग्री नहीं रखेगा।

पन्द्रह- लाइसेंसािरी वारा अपनी वबक्री बढ़ाने के मलए खरीददारों को प्रलोभन देनार् ा आकवषात करने का र्काा जैसे नृर्त्र् ा द्यूत र्कााक्रम कराना सािथा मनवषद्ध है।

सोलह- लाइसेंसप्राप्त पररसर, 14 अप्रैल (अम्बेदकर र्जन्ती), 15 अगस्त (स्तिंत्रता ददसि), 2 अक्टू बर (गॉंीि र्जन्ती), 26 जनरिी (गणतन्त्र ददसि) और तीन ऐसे अमतररक्त ददनों जैसा दक लाइसेंस प्रामकिारी वारा बन्दी के मलए अमसिूमचत दर्का र्जा, को छोड़कर वबक्री के मलए सभी ददसिों में पूािान्ह 10 बजे से रावत्र 10 बजे तक खुला रहेगा। लाइसेंस प्रामकिारी सुसंगत वर्मिोिं के उपबन्ोिं के अीिन कानून और र्व्स्थिा र्ा सामार्न् मनािाचन से सम्बखन्ति दक्र्रा कलापों आदद के कारण से भी दुकान की प्रीममर्म फु टकर वक्र्रि की बन्दी के आदेश दे सकता है। उपरोक्त ददन/ददनों में प्रीममर्म फु टकर वक्र्रिकी बन्दी के मलए कोई प्रमतकर र्दे नहीं होगा।

सत्रह- र्बीर, ािइन एंि (कम तीव्रता के मादक र्पे) (एल.ए.बी.) की वबक्री को छोड़कर खजसके मलए दक लाइसेंस दर्दा र्गा है, लाइसेंसािरी को लाइसेंसप्राप्त पररसर में कोई अर्न् कारबार करने की अनुज्ञा नहीं प्रदान की र्जाेगी।

अािरह- लाइसेंसािरी लाइसेंस की समामप्त पर अशिेष स्टाक के मनस्तारण के मलए लाइसेंस प्रामकिारी को ररपोटा करेगा, खजसे मनर्म-16 के अनुसार मनस्ताररत दर्का र्जाेगा।

उन्नीस- प्रीममर्म फु टकर वक्र्रि के लाइसेंसप्राप्त पररसर में देशी मददरा र्ा अर्न् दकसी पदाथा का भण्डारण नहीं दर्का र्जाेगा।

बीस- लाइसेंसािरी मददरा की वबक्री हेतु दडखस्पेखन्संग मशीन स्थावपत कर सकता है।

इक्कीस- लाइसेंसािरी आबकारी र्आुक्त र्ा लाइसेंस प्रामकिारी वारा सर्म-सर्म पर जारी सामार्न् एंि वमिनददाष्ट अनुदेशों का पालन करेगा।

बाईस- दुकान का लाइसेंसािरी क्रे ता को ािइन के मलए आस्ािदन क िकी सुवािि प्रदान करेगा।

तेइस- दुकान का लाइसेंसािरी मददरा उपभोग से सम्बखन्ति उपसानि की वबक्री कर सकता है।

चौबीस- लाइसेंसािरी को अपनी दुकान पर मददरा वक्र्रि करने के मर्ले वक्रिे ताओं की सूची खजला आबकारी अमकिारी के सम िप्रस्तुत करना होगा। तद्नुसार खजला आबकारी अमकिारी को वदिहत प्रपत्र में नौकरनामा जारी करना होगा।

In exercise of powers conferred under section 41 of the United Provinces Excise Act, 1910 (U.P. Act no. 4 of 1910), read with section 21 of the Uttar Pradesh General Clauses Act, 1904(U.P. Act no.1 of 1904), the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government, makes the following rules with a view to amend the Uttar Pradesh Excise (Settlement of Licenses for Premium Retail Vends of Foreign Liquor) Rules, 2020:–

1. Short title and commencement–(1) These rules may be called the Uttar Pradesh Excise (Settlement of licences for Premium retail Vends of Foreign Liquor) (Fourth Amendment) Rules, 2025.

(2) They shall be deemed to have come into force with effect from 01st April, 2025.

2. Amendment of rule-2–In the Uttar Pradesh Excise (Settlement of Licences for Premium retail Vends of Foreign Liquor) Rules, 2020, hearinafter referred to as the said rules, for the existing rule 2 setout in Column-I below, the rule as setout in Column-II shall be substituted, namely :–

(k) "Mall" means a large business complex which contains a variety of walk-in store(s) housed in one large building or buildings (with interconnecting pathways, on same or different floors with common passage area for buyers/visitors including the atrium or foyer, having parking facility) with aminimum plinth area of 110111 square feet, situated within a compound and is owned by single firm/ company having multiple licenses to sell various commodities. (l) "Security Amount" means the amount equal to one-fourth of the amount of license fee, to be deposited through F.D.R/Bank Guarante epledged in favor of District Excise Officer or through e-payment within fifteen days of grant of license and is liable to be forfeited incase of any default committed by the licensee in the operation of license.

The Licensing Authority may also order for closure of premium retail vend on account of law and order or general election related activity under the provisions of relevant laws. No compensation shall be given for the closure of premium retail vend on above dates/days.

The license is subject to the following special & general conditions, the infraction of any of which or a conviction of the licensee(s) for any offence under the UP Excise Act, 1910 or Narcotic Drugs and Psychotropic Substances Act, 1985 or externment under U.P. Control of Goondas Act, 1970 shall make the license liable for cancellation, forfeiture of the license fee and security deposit, in addition to any penalties imposed under the relevant laws.
