IN exercise of the powers under Section 54 of the Air (Prevention and Control of Pollution) Act, 1981 (Act no. 14 of 1981) read with Section 21 of the General Clauses Act, 1897 (Act no. 10 of 1897), the Governor, after consultation with the Uttar Pradesh Pollution Control Board, is pleased to make the following rules with a view to amend the Uttar Pradesh Brick Kilns (Sitting Criteria for Establishment) Rules, 2012, namely:–
THE UTTAR PRADESH BRICK KILNS (SITTING CRITERIA FOR
ESTABLISHMENT) (FIRST AMENDMENT) RULES, 2026
Short title and 1.(1) These rules may be called the Uttar Pradesh Brick Kilns (Sitting Criteria
commencement For Establishment) (First Amendment) Rules, 2026.
(2) They shall come into force with effect from the date of their publication in
the Official Gazette.
Amendment
2.(1) In the Uttar Pradesh Brick Kilns (Sitting Criteria for Establishment)
of rule 2
Rules, 2012 (hereinafter referred to as "said rules") in rule 2, – 4 mRrj çns'k vlk/kkj.k xtV] 3 Qjojh] 2026 (a) for the existing clause (i) set out in Column-I below, the clause as set out in Column-II shall be substituted, namely :–

"Provided that any brick kiln which was established prior to the commencement of the Uttar Pradesh Brick Kilns (Sitting Criteria for Establishment) Rules, 2012 and which have already submitted the Consent Application before the Board or have obtained Consent / Permission / No Objection Certificate / Licence / Registration Certificate / Royalty Challan from any Government Department / Authority like Mining Department, Zila Panchayat and Commercial Tax Department which proves that the brick kiln was established before the commencement of the Uttar Pradesh Brick Kilns (Sitting Criteria for Establishment) Rules, 2012 i.e. 27.06.2012, shall be deemed to be a valid Brick kiln. If production has been started by such brick kiln without any prior consent from the Board, in such cases, these Brick Kilns shall apply for Consent to Operate and the Board shall issue consent to operate the kiln by imposing a penalty of three times of one year fee for all defaulted years."

3. In the said rules, for the existing rule 4 set out in Column-I below, the rule as set out of rule 4
in Column-II shall be substituted, namely:–

Pollution Control System, including
height of Chimney for Brick Kilns as
notified by Ministry of Environment
and Forest (MOEF), Government of
India vide serial no. 74 of schedule I in
notification no. GSR 543 (E) dated 22nd July, 2009 shall be applicable in case of Brick Kilns, issued under the
Environment (Protection) Rules, 1986.

be inserted, namely:–

adversely affected by air emissions due to deterioration of Air
