IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 04/2026/144/ LXXX-1-2026/80-1099/136–2025, dated March 6, 2026 :

IN exercise of the powers under clause (a) of sub-section (1) of Section 17-A of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964 (U.P. Act no. 25 of 1964) read with rule 137 of the Uttar Pradesh Krishi Utpadan Mandi Niyamawali, 1965, the Governor on being satisfied that it is necessary and expedient in the public interest so to do, is pleased to exempt the plant of M/S Om Shree Maha Kaleshwar Roller Mills Pvt. Ltd. 1/2 Part of khasra 475 Mi., Village Behloli Pargana, near St. James School, Hardoi, Uttar Pradesh, Pin-241001 from Mandi fee (excluding development cess) payable on purchase of wheat for a period of five years, with effect from the date of publication of this notification in the Gazette, on the terms and conditions given below:–

1. Licensee Unit/Firm/Processing Unit shall follow the provisions of the Uttar Pradesh Krishi Utpadan Mandi Adhniyam, 1964 and the rules framed thereunder and also follow the provisions of bye-laws framed by the Market Committee.

2. Licensee Unit/Firm/Processing Unit shall submit the weekly receipts of income of the business to the Market Committee.

3. Licensee Unit/Firm/Processing Unit shall submit the details of the employees working in the unit to the Market Committee.

4. If there is any change in the ownership/partnership, Licensee Unit/Firm/Processing unit shall take the previous approval from the Market Committee.

5. If there is any extension/change in the store and warehouse mentioned in the licence then the same shall be informed to the Market Committee.

6. The Licensee shall provide proper facilities to the Secretary and the authorized officers/employee/employees to check the records and staff.

7. The Licensee shall produce the license on demand of the Chairman/Secretary or any other authorized officers/employee/employees.

8. The Licencee shall be accountable and responsible for the safety and security of the agriculture produce brought for the sale or for storage at his premises.

9. Licensee Unit/Firm/Processing Unit shall not purchase processed product (Aata, Maida, Suji, Daliya and Choker) from farmers/traders under any circumstances.

10. Licence of the firm/unit shall be cancelled if it is confirmed that the unit has purchased processed produce from farmer/traders and the matter shall be referred to the Government for cancellation of exemption from market fee.

11. The concerning Market Committee shall realize the development cess as per the provisions of the aforesaid Act.

12. The exemption given under this notification shall not exceed the value of investment on plant and machinery.

13. The Licensee unit/firm shall be entitled to purchase the aforesaid commodities under this notification in such Agriculture Produce Market Committees in Uttar Pradesh from where it has obtained valid licence issued by the respective Agriculture Produce Market Committee.
