अधिसूचना
आदर््रभूमि (संरक्षण एवं प्रबन्धन) नियम, 2017 के नियम 7 के अधीन शक्तियों का प्रयोग करके राज्यपाल, जिस अधिसूचना को जारी करने का प्रस्ताव करते हैं, उसका निम्नलिखित प्रारूप जनसामान्य की सूचना के लिए तथा उक्त नियम के नियम 7 के उपनियम (3) के अधीन यथा अपेक्षित तत्संबंध में आपत्तियां आमंत्रित करने की –ष्टि से एतदद्वारा प्रकाशित की जाती है;
प्रस्तावित अधिसूचना के सम्बन्ध में आपत्तियां, यदि कोई हो, तो उसे प्रमुख सचिव, पर्यावरण, वन एवं जलवायु परिवर्तन अनुभाग-4, उत्तर प्रदेश शासन, बापू भवन, लखनऊ को संबोधित कर लिखित रूप में भेजा जाएगा। केवल उन्हीं आपत्तियों पर ही विचार किया जाएगा जो इस अधिसूचना के सरकारी गजट में प्रकाशित किए जाने के दिनांक से 60 दिनों के भीतर प्राप्त हों।
प्रारूप अधिसूचना
चूंकि, तहसील-औराई, जिला- संत रविदास नगर, भदोही में 106.212 हेक्टेयर क्षेत्रफल में फैला एक जल निकाय ''समधाताल आर्द्रभूमि'' विद्यमान है, जिसका विस्तृत विवरण नीचे अनुसूचियों में दिया गया है, जिसे स्थानीय समुदायों और समग्र समाज के लिए अपनी पारिस्थितिकी सेवाओं और जैव विविधता मूल्यों के लिए अत्यंत महत्वपूर्ण माना जाता है।
और, चूंकि, पूर्वोक्त जल निकाय हमारी सांस्—तिक विरासत का एक हिस्सा है, यह जल भंडारण, जल शोधन, बाढ़ शमन, कटाव नियंत्रण, जलभृत पुनर्भरण, सूक्ष्म जलवायु विनियमन, परि–श्यों के सौंदर्य संवर्धन जैसी पारिस्थितिकी सेवाओं की एक विस्तृत श्रृंखला प्रदान करता है, और पर्यावरण संरक्षण, पर्याप्त वनस्पतियों और जीवों, पारिस्थितिकी, परि–श्य और मानवीय मूल्यों के संवर्धन और विकास के लिए महत्वपूर्ण है 29 RPH 2026 (Paryavaran Anubhag-4) data 1e2 उत्तर प्रदेश असाधारण गजट, 2 अप्रैल, 2026 अतएव, अब, आर्द्रभूमि (संरक्षण और प्रबन्धन) नियम, 2017 के नियम 7 के उपनियम (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल "समधाताल" क्षेत्र को आर्द्रभूमि के रूप में घोषित करते हैं, जिसे "समधाताल आर्द्रभूमि" जिला संत रविदासनगर, भदोहीं के नाम से जाना जायेगा।
समधाताल आर्द्रभूमि के अधीन सम्मिलित क्षेत्र की सीमा और विवरण इस अधिसूचना की अनुसूची-एक में उल्लिखित है।
समधाताल आर्द्रभूमि के प्रभाव क्षेत्र का विवरण इस अधिसूचना की अनुसूची-दो में उल्लिखित है।
समधाताल आर्द्रभूमि एवं इसके प्रभाव क्षेत्र में प्रतिषिद्ध एवं विनियमित क्रियाकलापों का विवरण इस अधिसूचना की अनुसूची-तीन में उल्लिखित है।

समधाताल में जल का स्रोत, वर्षा जल व ग्राम समधाताल का अपशिष्ट जल प्रवाह है।
अनुसूची-तीन
1- किसी भी प्रकार के अतिक्रमण सहित गैर- आर्द्रभूमि उपयोगों के लिए संपरिवर्तन ।
2- नए उद्योगों की स्थापना/विद्यमान उद्योगों का विस्तार ।
3- परिसंकटमय पदार्थों/निर्माण एवं विध्वंस अपशिष्ट का विनिर्माण, प्रबंधन, भंडारण एवं निपटान ।
4- ठोस अपशिष्ट पाटन।
5- अशोधित मलजल/औद्योगिक बहिःस्राव/अपशिष्ट जल के लिए निमग्न ।
6- निर्माण क्रियाकलाप (नाव घाटों को छोड़कर) ।
7- प्लास्टिक, पॉलीथीन एवं अन्य गैर-जैव-अपघटनीय अपशिष्ट प्रदूषण ।
1- जल निष्कासन/अवरोध/मोड़ या कोई अन्य जल विज्ञान हस्तक्षेप ।
2- संसाधनों (जीवित/अजीवित) की कटाई ।
3- चराई ।
4- नाव घाटों का निर्माण और अस्थायी उपयोग के लिए सुविधाएँ, जैसे कि पीपापुल ।
5- आर्द्रभूमि सीमाओं के भीतर जलीय —षि क्रियाकलाप ।
6- उत्तर प्रदेश नगर योजना और विकास अधिनियम, 1973 के अधीन तैयार प्रचलित महायोजना के अधीन प्रस्तावित सड़क तथा केन्द्र सरकार, राज्य सरकार एवं उनके द्वारा गठित प्राधिकरणों/स्थानीय निकायों के अधीन निर्माण क्रियाकलापों सहित परियोजना।
7- आर्द्रभूमि पारिस्थितिकी तंत्र पर प्रतिकूल प्रभाव डालने वाले समस्त क्रियाकलाप।
इस अधिसूचना के अंतिम प्रकाशन से पूर्व किये गये निर्माण पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा।
4 उत्तर प्रदेश असाधारण गजट, 2 अप्रैल, 2026 आर्द्रभूमि के भीतर तथा इसके प्रभाव क्षेत्र के भीतर विनियमित क्रियाकलापों की अनुज्ञा जब कभी अपेक्षितहो उत्तर प्रदेश राज्य आर्द्रभूमि प्राधिकरण द्वारा जिला आर्द्रभूमि समिति की संस्तुति पर दी जा सकेगी।
अनुसूची-चार
अनुसूची-तीन में वर्णित क्रियाकलापों के सिवाय समस्त क्रियाकलाप जो आर्द्रभूमि (संरक्षण एवं प्रबंधन) नियम, 2017 का उल्लंघन नहीं करते हैं।

IN pursuance of provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 662/LXXXI- 4–2026 dated April 2, 2026 :

The following draft notification which the Governor proposes to issue in exercise of the powers under rule 7 of the Wetlands (Conservation and Management) Rules, 2017, is hereby published for the information of the general public and with a view of inviting objections in respect thereof as required under sub-rule (3) of Rule 7 of the said rules;
Objections, if any, with respect to the proposed notification shall be sent in writing addressed to the Pramukh Sachiv, Paryavaran, Van Evam Jalvayu Parivartan Anubhag-4, Uttar Pradesh Shasan, Bapu Bhawan, Lucknow. Only such objections shall be taken into consideration as are received within 60 days from the date of publication of this notification in the Official Gazette.
DRAFT NOTIFICATION
WHEREAS, there exists a water body known as "Samdha Tal" measuring an area of 106.212 hectares situated in Tehsil-Aurai, District-Sant Ravidas Nagar (Bhadohi) detailed description whereof is given in the Schedules below, which is considered to be critically significant for its ecosystem service and biodiversity values for the local communities and society at large;
AND, WHEREAS, the aforesaid water body is a part of our cultural heritage; provides a wide range of ecosystem services such as water storage water purification, flood mitigation, erosion control, aquifer recharge, micro climate regulation, aesthetic enhancement of landscapes and is important for environmental conservation, enrichment and development of adequate flora and fauna, ecology, landscape and humanitarian values.
NOW, THEREFORE, in exercise of powers conferred by sub rule (3) of Rule 7 of the Wetlands (Conservation and Management) Rules, 2017 the Governor is pleased to declare the area of "Samdha Tal" as wetland which will be known as "Samdha Tal Wetland", District- Sant Ravidas Nagar (Bhadohi).
The boundary and descripition of the area included under the Samdha Tal Wetland are mentioned in Schedule-I of this notification.
Details of the zone of influence of the Samdha Tal Wetland are mentioned in Schedule-II of this notification.
Description of prohibited and regulated activities in Samdha Tal Wetland and its zone of influence are mentioned in Schedule-III of this notification.

Description of permitted activities in Samdha Tal Wetland District-Sant Ravidas Nagar
(Bhadohi) and its zone of influence
Prohibited activities–
1. Conversion for non-wetland uses including encroachment of any kind.
2. Setting up new industries / expansion of existing industries.
3. Manufacturing, handling, storage and disposal of hazardous substance/construction and demolition waste.
4. Solid Waste dumping.
5. Sink for untreated sewage / industrial effluent / waste water.
6. Construction activities (except boat jetties).
7. Plastic, polythene and other non bio-degradable waste pollution.
Regulated Activities–
1. Withdrawal of water / impoundment / diversion or any other hydrological intervention.
2. Harvesting of resources (living/non-living).
3. Grazing.
4. Construction of boat jetties and facilities for temporary use, such as pontoon bridges.
5. Aquaculture activities within the Wetland boundaries.
6. Road proposed under prevalent master plan prepared under the Uttar Pradesh Urban Planning and Development Act, 1973 and project including construction activities under Central Government, State Government and authorities/local bodies constituted by them.
7. All activities having adverse effect on the wetland ecosystem.
Note: There will be no adverse effect on construction done before final publication of this notification.
Permission for regulated activities within the wetland and within its Zone of Influence may be granted by the Uttar Pradesh State Wetland Authority on the recommendation of District Wetland Committee as and when required.
