IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of the Uttar Pradesh Rajaswa Sanhita (Dwitiya Sanshodhan) Adhyadesh, 2026 (Uttar Pradesh Adhyadesh Sankhya 7 of 2026) promulgated by the Governor. The Rajaswa Anubhag 2 is administratively concerned with the said Ordinance.

THE UTTAR PRADESH REVENUE CODE (SECOND AMENDMENT)

ORDINANCE, 2026

(U.P. ORDINANCE NO. 7 OF 2026)

[Promulgated by the Governor in the Seventy-seventh Year of the Republic of India]

ORDINANCE

further to amend the Uttar Pradesh Revenue Code, 2006

WHEREAS the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor is pleased to promulgate the following Ordinance:—

Short title and 1. (1) This Ordinance may be called the Uttar Pradesh Revenue

commencement Code (Second Amendment) Ordinance, 2026.

(2) It shall come into force at once.

Amendment of 2. In the Uttar Pradesh Revenue Code, 2006, in sub-section (1) of section 76,

Section 76 of after clause (dd), the following clauses shall be inserted, namely:-

U.P. Act no. 8 "(ddd) with effect from the date of operation of this Code, every person

of 2012

rehabilitated in the districts of Pilibhit, Lakhimpur Kheri, Rampur and Bijnor,

who-

(i) was displaced at the time of partition of India/Pakistan and is

eligible for Indian citizenship under the Citizenship (Amendment)

Act, 2019;

(ii) is belonging to the Scheduled Tribe community;

(iii) is settled under Upaniveshan Yojana /Colonization Scheme

and before the commencement of this Code, he is an agricultural

lessee under the Government Grant Act, 1895 and he is in

cultivatory possession of land other than that mentioned in Section 77

and is recorded as such in shreni 1 (Kh) in the Khatauni:

Provided that where the land in possession of a person, together with any other

land, held by him in Uttar Pradesh exceeds the ceiling area determined under the Uttar

Pradesh Imposition of Ceiling on Land Holdings Act, 1960, the rights of a Bhumidhar

with non-transferable rights shall accrue in favour of such person in respect of so much

area of the first mentioned land, as together with such other land held by him, does not

exceed the ceiling area applicable to him, and the said area shall be demarcated in the

prescribed manner in accordance with the principles laid down in the aforesaid Act;

(dddd) with effect from the date of operation of this Code, every person eligible for Indian citizenship under the Citizenship (Amendment) Act, 2019, who was displaced at the time of partition of India/Pakistan and is in cultivatory possession of any land vested in the Gram Sabha under Section 59 of this Code or any land granted by the State Government or any land of the State Government other than land mentioned in Section 77, before 25th October, 1980, in the districts of Pilibhit,42 RPH (Rajaswa) 9 April 2026 data 7e 4 mRrj izns'k vlk/kkj.k xtV] 8 vçSy] 2026 Lakhimpur Kheri, Rampur and Bijnor, Provided that non transferable rights will not be conferred on holding which is more than one acre per family:

Provided that where the land in possession of a person, together with any other land, held by him in Uttar Pradesh exceeds the ceiling area determined under the Uttar Pradesh Imposition of Ceiling on Land Holdings Act, 1960, the rights of a Bhumidhar with non-transferable rights shall accrue in favour of such person in respect of so much area of the first mentioned land, as together with such other land held by him, does not exceed the ceiling area applicable to him, and the said area shall be demarcated in the prescribed manner in accordance with the principles laid down in the aforesaid Act; "
