THE following draft rules, which the Governor proposes to make, in exercise of the powers under section 101 of the Rights of Persons with Disabilities Act, 2016 (Act no. 49 of 2016) read with Section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no. 1 of 1904) is hereby published with a view to invite objections or suggestions thereon as required under sub-section (1) of Section 101 of the aforesaid Act of 2016;

Objections or suggestions, if any, shall be sent in writing addressed to the Pramukh Sachiv, Uttar Pradesh Shasan, Divyangjan Sashaktikaran Vibhag, Room no. 709, 7th floor, Lok Bhawan, Lucknow; Only such objections or suggestions shall be taken into consideration as are received within 15 days from the date of publication of this notification in the Official Gazette.

THE UTTAR PRADESH RIGHTS OF PERSONS WITH DISABILITIES

(THIRD AMENDMENT) RULES, 2026

1. (1) These rules may be called the Uttar Pradesh Rights of Persons with Short title and commencement Disabilities (Third Amendment) Rules, 2026.

(2) They shall come into force on the date of their final publication in the

Official Gazette.

Amendment of Rule 7

2. In the Uttar Pradesh Rights of Persons with Disabilities Rules, 2017, hereinafter referred to as the "said rules", for the existing Rule 7 set out in Column-I below, the Rule as set out in Column-II be substituted, namely:–

7.(1) A person desirous of establishing or maintaining an institution for persons with disabilities may apply to the competent authority using the online application form, as given in Form-A of these rules, following the procedure given below:-

(a) the interested person (authorized authority of the institution) shall apply online for registration on the departmental portal https://updivyangshaktingo.in/ by selecting the district in which the registered office of the institution is located;

(b) the fee for registration shall be Rs. 1000/- or the fee fixed by the State Government from time to time and the same shall be deposited online in the relevant head of the department and a copy of the challan shall be uploaded along with the application;

(c) after scrutiny of the application by the District Disability Empowerment Officer, if the application for registration is found complete, it shall be forwarded to the Directorate within 30 days.

prescribed for the grant of a certificate of

registration under sub-rule (1), using the

application form as given in Form-B of

these rules. In such a case, the application may be submitted with a late fee of 100/- per month until the expiry of the validity period of the registration certificate: Provided also that the competent authority may consider an application for renewal submitted after the expiry of the validity period of the certificate of registration but within a maximum period of one year, if it is satisfied that sufficient reasons has been given for such delay. In such a case, the application may be submitted with a late fee of Rs. 200/- per month after the expiry of the validity period of the registration certificate.

(8) An application for renewal will not be considered after one year from the expiry of the validity period of the certificate of registration.

(9) The certificate of renewal of registration shall be issued by the competent authority in Form-D.

(10) If an application for renewal of certificate of registration is made before its expiry as specified in the proviso to sub-rule (7), the certificate of registration shall remain in force until orders are passed on such application, and the certificate of registration shall be deemed to have expired if an application for its renewal is not presented within the period specified in the said proviso.

(11) Every application made under sub-rule (1) or sub-rule (10), in which the competent authority referred to in sub-section (1) of Section 51 of the Act is satisfied that the requirements for grant of certificate of registration under the Act and these rules have been complied with, shall be disposed of by it within a period of ninety days thereafter.
