IN pursuance of provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of notification no. 1047/LXXXI- 4–2026 dated May 30, 2026 :

WHEREAS there exists a water body known as "Barhara Taal" measuring an area of 7.6970 hectares situated in Tehsil Kaptanganj, District Kushinagar, detailed description whereof is given in the Schedules below, which is considered to be critically significant for its ecosystem services and biodiversity values for the local communities and society at large;

AND WHEREAS, the aforesaid water body is a part of our cultural heritage; provides a wide range of ecosystem services such as water storage, water purification, flood mitigation, erosion control, aquifer recharge, micro-climate regulation, aesthetic enhancement of landscapes; and is important for environmental conservation, enrichment and development of adequate flora and fauna, ecology, landscapeand humanitarian values; 172 RPH 2026 (Paryavaran Anubhag-4) data 1e 4 mRrj izns'k vlk/kkj.k xtV] 30 ebZ] 2026 AND WHEREAS, draft notification declaring the aforesaid water body as a "wetland" was published vide Government notification no. 542/81-4-2026 dated March 25, 2026 as required under sub-rule (3) of Rule 7 of the Wetlands (Conservation and Management) Rules, 2017 (hereinafter referred to as the "said rules"), for the information of the general public and with a view of inviting objections in respect thereof within 60 days from the date of publication of the said notification in the Official Gazette;

AND WHEREAS, no objection, in respect of the aforesaid draft notification, has been received within the stipulated period;

AND WHEREAS, considering the extent of ecological and biological diversity of "Barhara Taal" situated in District Kushinagar, it is necessary to make the ecological character and ecological importance thereof enduring and it is also necessary to regulate the developmental activities in "Barhara Taal" and its Zone of Influence for the benefit of local communities and society at large;

NOW, THEREFORE, in exercise of the powers under sub-rule (3) of Rule 7 of the said rules, the Governor, with effect from the date of publication of this notification in the Official Gazette, is pleased to declare the area of "Barhara Taal", detailed description whereof is given in the Schedules below, as wetland which will now onwards be known as "Barhara Taal Wetland", District Kushinagar.

The boundary and description of the area included under the Barhara Taal Wetland is mentioned in Schedule-I of this notification.

Details of the zone of influence (ZOI) of the Barhara Taal Wetland are mentioned in Schedule-II of this notification.

Description of prohibited and regulated activities in Barhara Taal Wetland and its zone of influence are mentioned in Schedule-III of this notification.

Description of permitted activities in Barhara Taal Wetland and its zone of influence are mentioned in Schedule-IV of this notification.

         The area  of Barhara  Taal Wetland, District  Kushinagar  is  7.6970  hectares, and the details  of its

ownership are as under: -

Description of prohibited and regulated activities in Barhara Taal Wetland,

District-Kushinagar and its Zone of Influence

Prohibited activities–

1. Conversion for non-wetland uses including encroachment of any kind.

2. Setting up new industries / expansion of existing industries.

3. Manufacturing, handling, storage and disposal of hazardous substance/construction and demolition waste.

4. Solid Waste dumping.

5. Sink for untreated sewage/ industrial effluent/waste water.

6. Construction activities (except boat jetties).

7. Plastic, polythene and other non bio-degradable waste pollution.

Regulated activities–

1. Withdrawal of water/impoundment/diversion or any other hydrological intervention.

2. Harvesting of resources (living/non-living).

3. Grazing.

4. Construction of boat jetties and facilities for temporary use, such as pontoon bridges.

5. Aquaculture activities within the Wetland boundaries.

6. Road proposed under prevalent master plan prepared under Uttar Pradesh Urban Planning and Development Act, 1973 and project including construction activities under Central Government, State Government and Authorities/ Local bodies constituted by them.

7. All activities having adverse effect on the wetland ecosystem.

Note: There will be no adverse effect on construction done before publication of this notification in the Official Gazette.

Permission for regulated activities within the wetland and within its Zone of Influence may be granted by Uttar Pradesh State Wetland Authority on the recommendation of District Wetland Committee as and when required.

Description of permitted activities in Barhara Taal Wetland,

District-Kushinagar and its Zone of Influence

All activities, except those described in Schedule-III, which are not in contravention of Wetlands (Conservation and Management) Rules, 2017.
