IN exercise of the powers conferred by the proviso to Article 309 of the Constitution, the Governor is pleased to make the following rules with a view to amending the Uttar Pradesh Assistant Excise Commissioners Service Rules, 1992:

THE UTTAR PRADESH ASSISTANT EXCISE COMMISSIONERS SERVICE

(SECOND AMENDMENT) RULES, 2026

1.(1) These rules may be called 'The Uttar Pradesh Assistant Excise Short title and commencement

Commissioners' Service (Second Amendment) Rules, 2026.

(2) They shall come into force at once.

Amendment of

2. In The Uttar Pradesh Assistant Excise Commissioners Service Rules, 1992, Rule 4

Amendment of Rule 5 Assistant Excise Commissioner, including One post of Personal Assistant to Excise Commissioner 3. In the said rules, for existing Rule 5 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely:–

COLUMN-1 Existing Rule Source of Recruitment-5. Recruitment to the posts in the service shall be made by promotion through the Commission from amongst such Superintendents of Excise as are substantively appointed and continuing as such on the first day of the year of recruitment:

Source of Recruitment-5. Recruitment to the posts in the service shall be made by promotion through the Selection Committee from amongst substantively appointed Excise Inspectors who have completed Twelve years of service as such on the first day of the year of recruitment.

Amendment of Rule 7 Provided that if in any year of recruitment sufficient number of candidates are not available for promotion, the field of eligibility may be extended to include such substantively appointed Excise Inspectors who have completed fifteen years service, as such on the first day of the year of recruitment. Explanation:- ''Fifteen years service'' referred to in the proviso shall mean fifteen years service commencing from the date of substantive appointment. 4. In the said rules, existing Rule 7 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely:–

Determination of vacancies-7. The appointing authority shall determine number of vacancies to be filled in during the course of the year.

The appointing authority shall determine and intimate the commission the number of vacancies to be filled in during the course of the year as also the number of vacancies to be reserved for candidates belonging to Scheduled Castes, Scheduled Tribes and other categories under rule 6.

Amendment of Rule 8

5. In the said rules, for existing Rule 8 set out in Column-1 below, the rule as set out in Column-2 shall be substituted, namely:–

Rule as hereby substituted Procedure for recruitment by promotion-8. Recruitment by promotion shall be made on the basis of merit in accordance with the Uttar Pradesh Promotion by Selection in consultation with Public Service Commission (Procedure) Rules, 1970, as amended from time to to time.

Procedure for recruitment by promotion-8. Recruitment by promotion shall be made on the basis of the criterion laid down in the Uttar Pradesh Government Servants Criterion for Recruitment by Promotion Rules, 1994, as amended from time to time, through the Selection Committee constituted in accordance with the provisions of the Uttar Pradesh Constitution of Departmental Promotion Committee for Posts outside the Purview of the Service Commission Rules, 1992, as amended from time to time. NOTE- Nomination of officers for giving representation to the Scheduled Castes/ Scheduled Tribes and Other Backward Classes of Citizens in the Selection Committee shall be made in accordance with the order made under section 7 of the Uttar Pradesh Public Service (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994 as amended from time to time. (2) The appointing authority shall prepare eligibility list of the candidates in accordance with the Uttar Pradesh Promotion by Selection (on posts outside the pruview of the Public Service Commission) Eligibility List Rules, 1986, as amended form time to time, and place the same before the Selection Committee along with their character rolls and such other records, pertaining to them, as may be considered proper.

(3) The Selection Committee shall consider the cases of candidates on the basis of records, referred to in sub-rule (2), and, if it considers necessary, it may interview the candidates also. (4) The Selection Committee shall prepare a list of selected candidates in order of seniority as it stood in the cadre from which they are to be promoted and forward the same to the appointing authority.

6. In the said rules, existing Rule 10 shall be omitted.

7. In the said rules, existing Rule 11 shall be omitted.
