The following draft rules which the Governor proposes to issue in exercise of the powers under sub-section (1) and Clause (e) of sub-section (2) of Section 53 of the Legal Metrology Act, 2009 (Act no.1 of 2010) are hereby published for information of all concerned and with a view to invite objections or suggestions in respect thereof as required under sub-section (4) of Section 53 of the aforesaid Act;

2. Objections or suggestions, if any, with respect to the proposed rules may be sent in writing addressed to the Principal Secretary, Consumer Affairs Department, Section-1, Government of Uttar Pradesh, Lucknow. Only such objections or suggestions shall be taken into consideration as are received within 15 days from the date of publication of this notification in the Official Gazette.

DRAFT RULES

THE UTTAR PRADESH LEGAL METROLOGY (GOVERNMENT APPROVED TEST

CENTRE) RULES, 2026

CHAPTER-I

PRELIMINARY

1.(1) These rules may be called the Uttar Pradesh Legal Metrology (Government Short title and commencement Approved Test Centre) Rules, 2026.

(2) They shall come into force on the date of their final publication in the

Official Gazette.

Definitions

2. (1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Legal Metrology Act, 2009 (Act no. 1 of 2010) ;

(b) "Government Approved Test Centre" means a person who has been

approved by the Controller, Legal Metrology, Uttar Pradesh to undertake

verification of weights or measures specified in these rules ;

(c) "Principal Officer" means the officer who is in-charge of Government

Approved Test Centre;

(d) "Schedule" means a Schedule appended to these rules.

(2) Words and expressions used herein and not defined in these rules but defined

in the Act shall have the same meanings respectively assigned to them in the said Act.

CHAPTER-II

Verification of Weights and Measures in Government Approved Test Centre

General

3. (1) Weights or Measures as specified in the Legal Metrology (Government

Provisions relating Approved Test Centre) Rules, 2013 as amended from time to time and as specified in

to Government the First Schedule, shall either be verified by a Government Approved Test Centre or by

Approved Test the Legal Metrology Officers.

(2) The list of recognized Government Approved Test Centers shall be notified

in the Official Gazette as per section 24(3) of the Legal Metrology Act, 2009.

(3) The Controller, Legal Metrology, Uttar Pradesh may, by general or special

order, specify the mode of providing services of verification by Government Approved

Test Centre.

(4) The Government Approved Test Centre shall maintain standard weights or

measures as specified in the Legal Metrology (General) Rules, 2011, and other

instruments and equipment as advised by the Controller, Legal Metrology,

Uttar Pradesh.

CHAPTER-III

Approval of Government Approved Test Centre

Approval of 4. (1) Any person desirous of obtaining recognition under these rules for

Government carrying out verification of weights or measures specified herein shall submit an

Approved Test application to the Controller, Legal Metrology, Uttar Pradesh in the Form specified in

(2) The Controller, with his recommendation, shall forward it to the State

Government and the State Government, after considering recommendations of the

Controller, may approve or reject it.

(3) The State Government may delegate its power of approval to the Controller

or to any other officer as it may deem fit.

(4) While making recommendation for approval of a Government Approved Test Centre, the Controller, Legal Metrology shall consider the following:-

(a) availability and accessibility of land and building;

(b) adequacy of measuring equipments, testing facilities and other infrastructure;

(c) availability of technically qualified manpower;

(d) capacity for efficient and timely service to customers;

(e) mechanism for grievance redressal with contact number;

(f) willingness to get equipment periodically verified by secondary standard laboratory or any other agency specified by Controller, Legal Metrology, Uttar Pradesh;

(g) willingness to train its employees in institutions nominated by the Director Legal Metrology, Government of India;

(h) any other factor, which in the opinion of the Controller, Legal Metrology shall affect proper functioning of the Government Approved Test Centre.

5. (1) Non-standard weight or measure shall not be verified by the Government Conditions to

(2) Government Approved Test Centre shall verify the weights and measures Government

which are submitted with requisite fee of verification with an application indicating Approved Test Centre

therein,—

(a) name and full address of manufacturer or importer or dealer or user;

(b) location of the factory or premises in which such weights or measures is manufactured or imported or intended to be used;

(c) maximum and minimum capacity, 'e' or 'd' value, accuracy class of weight or measure, to be verified.

(3) After verification, the Government Approved Test Centre shall issue the certificate of verification.

(4) The certificate of verification shall remain valid for the period as specified in the Legal Metrology (General) Rules, 2011 and shall be renewed for such period on payment of prescribed fee.

(5) Every Government Approved Test Centre shall submit to the State Government, at the end of the calendar year, a statement as to the number of the weights and measures verified.

(6) The Controller, Legal Metrology, Uttar Pradesh will issue a specific code number to each Government Approved Test Centre for easy identification and records.

(7) In case of non-fulfillment of eligibility conditions, the State Government shall reject the application and send a written communication to the applicant, to this effect.

(8) The Controller, Legal Metrology, Uttar Pradesh, or the officers authorized by him in this behalf, may visit the Government Approved Test Centre as and when required and the Principal Officer shall permit inspections and render all assistance for the purpose including the production of records with regard to verification of weights and measures.

(9) The Principal Officer shall submit a quarterly report to the Controller, Legal Metrology, Uttar Pradesh in respect of the weights and measures verified by him, the fee collected, time taken for each testing and such other relevant information, as required.

(10) The Principal Officer, while verifying the weights and measures, shall

follow the procedure laid down in the Legal Metrology (General) Rules, 2011.

(11) The competent authority may require Government Approved Test Centre to

take out third party liability insurance, as the case may be, sufficient to cover any claim

for damage due to any lapses or non-compliance of Government instructions by such

Government Approved Test Centre.

CHAPTER-IV

Other Provisions related to Government Approved Test Centre

Qualifications 6. (1) Qualifications of Principal Officer of Government Approved Test Centre

and

out their duties under his guidance and supervision;

(c) to inform the Controller, Legal Metrology, Uttar Pradesh of cessation of

operation of the Government Approved Test Centre;

(d) to maintain the accuracy of testing equipments as per rules prescribed

under the Act, and directions issued from time to time;

(e) to maintain proper records of testing and certificates issued by

Government Approved Test Centre;

(f) to record and redress grievances of customers in appropriate manner;

(g) to abide by the directions issued by the Controller, Legal Metrology,

Uttar Pradesh from time to time;

(h) to ensure that only weights or measures conforming to prescribed

specification, are stamped;

(i) to ensure that verification stamps are adequately protected against

fraudulent use;

(j) to ensure that the weights and measures received for verification and

stamping are returned back by the Government Approved Test Centre, after due

verification, within fifteen days ;

(k) to ensure that all the duties and liabilities of the Government Approved

Test Centre, as specified in these rules, are complied with.

Fee for

8. (1) The fee payable to Government Approved Test Centre for verification or

verification or re-verification of weights or measures shall be as prescribed in Fifth Schedule.

re-verification (2) Any weight or measures rejected on verification shall be returned to the user

for necessary repair, and after repair, the weight or measure within seven days, may be

accepted for verification on payment of verification fee afresh.

9. (1) The Government Approved Test Centre, after carrying out metrological

verification evaluation of weight or measure and on being satisfied that the same conforms to

(a) the legend "UP" and the code number assigned to the test centre in the

upper half of the circle;

(b) code letter for the quarter of the year and last two digits for the year in the

lower half of the circle.

(3) The certificate of verification shall be issued, on the proforma, as specified in

Third Schedule, by the Government Approved Test Centre.

(4) The Government Approved Test Centres shall issue a separate certificate of

verification for each weight or measure, such that the certificate conforms to individual

instruments.

10. Every Government Approved Test Centre shall keep and retain records, for at Inspection of records

least five preceding calendar years, of verification of weight or measures carried out by

them. These records shall be produced by the Government Approved Test Centre before

the Controller Legal Metrology, Uttar Pradesh, or any officer authorized by him, as and

when directed.

Place of

11. The Government Approved Test Centre shall undertake verification of weights verification

or measures either in its authorized premises or within the territorial limits of the district. Supervision

12. The Controller Legal Metrology, Uttar Pradesh or any other authorized Legal of

Metrology Officer may visit the Government Approved Test Centre, as and when required, Government

to examine whether the Government Approved Test Centre is being run as per the laid down Approved

procedures and instructions issued by the Controller, Legal Metrology, Uttar Pradesh.

Liability 13. The Principal Officer responsible for the Government Approved Test Centre

shall be liable to the Government of Uttar Pradesh for any loss, damage, legal claims.

Contents of

14. (1) Every certificate of approval issued by the State Government shall contain Government

(c) the mark or code assigned to the Government Approved Test Centre;

(d) a brief statement about the Government Approved Test Centre;

(e) the special conditions, if any;

(f) period for which the Government Approved Test Centre is approved;

(g) name of weight and measure for which Government Approved Test Centre

has been approved;

(h) contact number for consumer's grievance redressal.

(2) Where any weight or measure is intended for a special use, the certificate of

approval in relation to such weight or measure shall indicate the special use.

(3) The Certificate issued to the Government Approved Test Centre shall be in the

format as prescribed in Fourth Schedule.

(4) The Controller Legal Metrology, Uttar Pradesh shall cause the necessary

Government Approved Test Centre certificate to be published on the official website of the

department.

15. The mark assigned to the Government Approved Test Centre shall contain the Government

State Identification Letters, namely,— UP, the code number assigned to the Government Approved

Approved Test Centre and the last two digits of the year of the issue. (for example, 25).

certificate of sub-rule (3) of Rule 14, for verification of specified weights and measures may be

Government suspended by the Controller, Legal Metrology, Uttar Pradesh in the event of the omission

or failure of the following on the part of the holder of such certificate:-

Approved Test Centre

(a) to verify the weights or measures in accordance to which the certificate

relates; or

(b) verification not conforming to the rules or standards specified in the Act

and rules made there under; or

(c) non-compliance with the conditions specified in the certificate:

Provided that no such suspension shall be made except after giving to the

holder of the certificate an opportunity of showing cause against the proposed action.

(2) Where any certificate has been suspended under sub-rule (1), the order of

suspension shall not be vacated unless the omission or failure, for which such suspension

was made, has been complied with and the sum of compounding for the offence has been

deposited to the State Government.

Revocation of 17. (1) Certificate of Government Approved Test Centre may be revoked if the

certificate of State Government is satisfied on the recommendation of Controller, that the Government

Government Approved Test Centre, no longer complies with the provisions specified in the rules made

Approved Test under the Act, or specifically violates the directions given by the Controller, Legal Centre

Metrology, Uttar Pradesh from time to time:

Provided that no such certificate shall be revoked unless the holder of such

certificate has been given an opportunity of showing cause against the proposed action.

(2) Where the certificate of Government Approved Test Centre has been revoked,

the verification work shall be stopped by that Government Approved Test Centre

immediately:

Provided that if it is found that the verification of any weight or measure is

conducted by the Government Approved Test Centre whose certificate has been revoked,

the Controller may, by order, prohibit the use of such weight or measure and initiate penal

action.

(3) Every order of revocation or suspension of certificate of approval shall be

duly notified.

Compounding 19. (1) Where it is found that the Government Approved Test Centre has

the offences contravened any of the provisions specified in the sub-section (1) of section 48, such an

offence may be compounded as prescribed under the Act.
