IN pursuance of the provisions of clause (3) of Article 348 of the Constitution of India, the Governor is pleased to order the publication of the following English translation of notification no. 1377/XXXVI-03-2026-1901341, dated August 12, 2026:

WHEREAS the draft of the Uttar Pradesh Code on Wages Rules, 2026 was published as required under sub-section (1) of Section 67 of the Code on Wages, 2019 (Act no. 29 of 2019) in the Official Gazette vide notification no. 426/36-03-2026-1901341, dated 10th of March, 2026 inviting objections and suggestions from all persons likely to be affected thereby within a period of forty-five days from the date on which the Gazette containing the said notification was made available to the public;

AND WHEREAS, the aforesaid notification was made available to the public on the 10th of March, 2026;

AND WHEREAS, suggestions and objections received from persons and stakeholders have been duly considered by the State Government;

NOW, THEREFORE, in exercise of the powers under sub-section (1) of Section 67 of the Code on Wages, 2019 (Act no. 29 of 2019) read with Section 24 of the General Clauses Act, 1897 (Act no. 10 of 1897) and in supersession of the,-

(a) Uttar Pradesh Payment of Wages Rules, 1936;

(b) Uttar Pradesh Minimum Wages Rules, 1952;

(c) Uttar Pradesh Code on Wages Rules, 2021

except as respects things done or omitted to be done before such supersession, the Governor is pleased to make the following rules, namely:-

THE UTTAR PRADESH CODE ON WAGES RULES, 2026

CHAPTER-I

PRELIMINARY

1.(1) These rules may be called the Uttar Pradesh Code on Wages Rules, 2026.

(2) They shall extend to the whole of Uttar Pradesh.

Short title, extent and commencement

(3) They shall come into force from the date of their publication in the Official Gazette.

Definitions 2.(1) In these rules, unless the subject or context otherwise requires, —

(a) "Authority" means the authority appointed by the State Government under sub-section (1) of Section 19 and sub-section (1) of Section 45;

(b) "Appellate authority" means the appellate authority appointed by the State Government under sub-section (1) of Section 49;

(c) "Appeal" means an appeal preferred under sub-section (1) of Section 49;

(d) "Board" means the State Advisory Board constituted by the State Government under sub-section (4) of Section 42;

(e) "Chairperson" means the Chairperson of the Board;

(f) "Code" means the Code on Wages, 2019 (Act no. 29 of 2019);

(g) "Committee" means a committee appointed by the State Government under clause (a) of sub-section (1) of Section 8;

(h) "Day" means a period of 24 hours beginning at mid-night;

(i) "Electronically" means any information submitted by e-mail or maintained or displayed on the designated portal or mobile application or website or digital payment in any mode for the purposes of the Code;

(j) "Form" means a form appended to these rules;

(k) "Geographical area" means the areas notified as such by the State Government from time to time;

(l) "Highly skilled occupation" means an occupation which calls in its

performance a specific level of perfection and required competence acquired

through intensive technical or professional training or practical occupational

experience for a considerable period and also requires of an employee to assume

full responsibility for his judgment or decision involved in the execution of such

occupation;

(m) "Inspector-cum-Facilitator" means a person appointed by the

State Government, by notification under sub-section (1) of Section 51;

(n) "Member" means a member of the Board and includes its Chairperson;

(o) "Normal rate of wage" means wage as defined under Clause (y) of

Section 2;

(p) "Officer" means an officer appointed by the State Government under

sub-section (1) of Section 53;

(q) "Registered trade union" means a trade union registered under Industrial

Relations Code, 2020 (Act no. 35 of 2020);

(r) "Section" means a Section of the Code;

(s) "Semi-skilled occupation" means an occupation which in its performance

requires the application of skill gained by the experience on job which is capable

of being applied under the supervision or guidance of a skilled employee and

includes supervision over the unskilled occupation;

(t) "Skilled occupation" means an occupation which involves skill and

competence in its performance through experience on the job or through training

as an apprentice in a technical or vocational institute and the performance of which

calls for initiating and judgment;

(u) "Unskilled occupation" means an occupation which in its performance

requires the application of simply the operating experience and involves no

further skills.

(2) Words and expressions used herein in these rules and not defined but defined

in the Code shall have the meanings respectively assigned to them under the Code.

CHAPTER-II

MINIMUM WAGES

Manner of

3.(1) For the purposes of sub-section (5) of Section 6, the minimum rate of wages

4. For the purposes of sub-section (6) of Section 6, the minimum rate of wages

20 percent of minimum wage;

(f) expenditure for children education, medical requirement, recreation and

expenditure on contingencies to constitute 25 percent of minimum wage.

5.(1) While fixing the minimum rates of wages under section 6, the State Government fixation of

(2) The State Government shall constitute a technical committee for the purpose of

advising the State Government in respect of skill categorization of occupation, arduousness

of work, hazardous occupations or processes and underground work and like other

categorization, which shall consist of the following members, namely:-

(a) Labour Commissioner, Uttar Pradesh - Chairperson;

(b) Director, Employment – Member;

(c) Mission Director, Uttar Pradesh Skill Development Mission or his

representative - Member;

(d) Commissioner and Director, Industries, Uttar Pradesh or his

representative- Member;

(e) Director of Factories – Member;

(f) Additional/Deputy Labour Commissioner, UP (Enforcement)- Member;

(g) Additional/Deputy Labour Commissioner, UP (Industrial Relations)–

Member - Secretary;

(h) Two technical experts in wage determination as nominated by the State

Government - Members;

(i) Two representatives each of employers and employees who are experts in the

area of skill development - Members;

(3) The State Government may, on the advice of the technical committee referred to in

sub-rule (2), by notification amend the Schedule-A in respect of categorization of

occupations into unskilled, semi-skilled, skilled and highly skilled by modifying, inserting or

omitting, any entry in respect of occupations specified in the said Schedule.

(4) The technical committee referred in sub-rule (2) while advising the

State Government, shall take into account, to the possible extent, the national classification

of occupation or national skills qualification framework or other similar frame work for the

time being formulated by Central Government to identify occupations.

6. The cost of living allowance and the cash value of the concession in respect of essential commodities at concession rate shall be computed once before 1st April and then before 1st October in every year to revise the variable dearness allowance payable to the employees on the minimum wages considering the Average Consumer Price Index Number

for Industrial Workers published by the Labour Bureau, Ministry of Labour and

Employment, Government of India.

(3) The State Government on the advice of the Committee constituted under

sub-rule (1) shall categorize the occupations of the employees in four categories i.e.

unskilled, semi-skilled, skilled and highly skilled by modifying, deleting or adding an entry

in the categorization of such of operation specified in Schedule-A of these rules.

(4) The State Government may for the purposes specified under clause (a) of

sub-section (1) of Section 8, constitute such number of Committees, as it considers

necessary.

Circumstances 8. An employee shall not be entitled to receive wages for a full normal working day

under clause (ii) under section 10, in case the employee has agreed to work on part time basis as per the terms

of the employment or not entitled to receive such wage under any other labour law for the

9.(1) The number of hours of work which shall constitute a normal working day,

for an employee whose wage period is on a daily basis shall be eight hours and interval for

rest shall be in accordance with notification issued in this regard under Occupational Safety,

Health and Working Conditions Code, 2020 (37 of 2020).

(2) The number of hours of work which shall constitute a normal working day for

an employee whose wage period is other than on a daily basis shall be so fixed that the total

number of weekly working hours shall not exceed forty-eight hours.

10.(1) Subject to the provisions of this Rule, an employee shall be allowed rest for

one day or more than one day as the case may be, every week (hereinafter referred to as

"the rest days") which in case of six day week shall ordinarily be Sunday and in case less of

than six day week shall include Saturday and Sunday, however, the employer may fix any

other days of the week as the rest days for any employee or class of employees:

Provided that in a six day working week or less than six days working week, as

the case may be, the remaining days of the week shall be paid rest days for such employees:

Number of hours of work which shall constitute a normal working day for the purpose of sub-section (1) of Section 13 Determination of weekly rest day for the purpose of sub-section (1) of Section 13 and payment to be made in relation to the work done on the rest day Provided further that an employee shall be entitled for the rest days under this

sub-rule if he has worked under the same employer in case of six day week for a continuous

period of not less than six-days and in case of less than six day working week for a

continuous period of the stipulated number of working days as the case may be:

Provided also that the employee shall be informed of the days fixed as the rest days and of any subsequent change in the rest days before the change is effected, by display of a notice to that effect at a conspicuous place in the place of employment or electronically.

Explanation:- For the purpose of computation of the continuous period of not less than six days or the stipulated number of working days in a week specified in the second proviso to this sub-rule,–

(a) any day on which an employee is required to attend for work but is given only an allowance for attendance and is not provided with work;

(b) any day on which an employee is laid off on payment of compensation under the Industrial Relations Code, 2020 (Act no. 35 of 2020); and

(c) any leave or holiday, with or without pay, granted by the employer to an employee in the period of six days or during the stipulated number of working days of a week as the case may be, immediately preceding the rest days, shall be deemed to be days on which the employee has worked.

(2) Any such employee shall not be required or allowed to work on the rest day unless he has or shall have a substituted rest day for a whole day on one of the working days in a week immediately before or after the rest day:

Provided that no substitution shall be made which will result in the employee working for more than ten days consecutively without a rest day for a whole day.

(3) Where in accordance with the sub-rules (1) and (2), any employee works on a rest day and has been given a substituted rest day on any one of the working days before or after the rest day, the rest day shall, for the purpose of calculating the weekly hours of work, be included in the week in which the substituted rest day occurs.

(4) An employee shall be granted, for rest day, wages calculated at the rate applicable to the previous working day; and where he works on the rest day and has been given a substituted rest day, then, he shall be paid wages for the rest day on which he worked, at the overtime rate and wages for the substituted rest day at the rate applicable to the previous working day:

Provided that in case of six day week where-

(a) the minimum rate of wages of the employee as notified under the Code has been worked out by dividing the minimum monthly rate of wages by twenty- six; or

(b) the actual daily rate of wages of the employee has been worked out by dividing the monthly rate of wages by twenty-six and such actual daily rate of wages is not less than the notified minimum daily rate of wages of the employee, then, no wages for the rest day shall be payable; and

(c) the employee works on the rest day and has been given a substituted rest day, then, he shall be paid, only for the rest day on which he worked, an amount equal to the wages payable to him at the overtime rate, which shall not be less than twice the normal rate of wages,

and, if any dispute arises whether the daily rate of wages has been worked out in accordance with the provisions of this proviso, the Labour Commissioner, Uttar Pradesh or the Additional/Deputy Chief Labour Commissioner having territorial jurisdiction may, on application made to him in this behalf, decide the same, after giving an opportunity to the parties concerned to make written representations:

Provided further that in case of an employee governed by a piece-rate system, he shall be paid wages for the rest day on which he works, at the overtime rate and wages for the substituted rest day at the rate applicable to the previous working day.

Explanation:- For the purposes of this sub-rule the words "previous working day" means the last day on which the employee has worked, which precedes the rest day or the substituted rest day, as the case may be; and where the substituted rest day falls on a day immediately after the rest day, the previous working day means the last day on which the employee has worked, which precedes the rest day.

(5) The provisions of this rule shall not operate to the prejudice of more favourable

terms, if any, to which an employee may be, entitled under any other law or under the

terms of any award, agreement or contract of service, and in such a case, the employee

shall be entitled only to more favourable terms aforesaid.

Explanation:- For the purposes of this rule, 'week' shall mean a period of seven

days beginning at midnight on Saturday night.

Determination of 11. Where an employee in an employment works on a shift which extends beyond

night shift under midnight, then:-

(a) a rest day for the whole day for the purposes of rule 10 shall, in this case

sub-section (1) of Section 13

means a period of twenty-four consecutive hours beginning from the time when his

shift ends; and

(b) the following day in such a case shall be deemed to be the period of

twenty-four hours beginning from the time when such shift ends, and the hours after

midnight during which such employee was engaged in work shall be counted

towards the previous day.

establishment a copy of such approved list in English together with a literal translation

in Hindi.

(4) No fine may be imposed by any person other than an employer or a person

holding an appointment named in the list submitted under clause (b) of sub-rule (1).

(5) As per sub-section (3) of Section 19, the employer shall give intimation

electronically or in writing to the employee concerned specifying therein the particulars of

acts and omissions done by the employee, warranting the imposition of fine for showing

cause within seven days.

(6) On establishment of charges, fine shall be imposed on the delinquent

employee.

(7) Wherein no reply is received from the employee within the scheduled period,

fine shall be imposed and the same shall be intimated to the employee within fifteen days of

the implementation of such fine.

(8) The person imposing a fine or directing the making of deduction for damage or

loss shall without unnecessary delay inform the employer of all particulars and the employer

shall maintain the details of such fines or deductions in a register as mentioned in Form-I.

(9) The amount so accumulated, by way of all sorts of deductions, fines and

realisations shall be applied only to such beneficial purposes to the persons employed in the

establishment through such welfare schemes or measures, to be prepared by the employer

and approved by Labour Commissioner, Uttar Pradesh or Additional Labour Commissioner/

Deputy Labour Commissioner, having territorial jurisdiction:

Provided that, nothing in these rules, prevents the employer to contribute any

amount for these welfare measures or schemes meant for these purposes.

Manner of

18.(1) Where an employer desires to make deductions under proviso to deduction and

sub-section (2) of Section 20, the employer shall intimate electronically or in writing to the intimation of

employee concerned regarding their intention of making such deduction seeking their reply deduction

19. Any employer, desiring to make deduction for damages or loss under

sub-section (1) of Ssection 21, from the wages of an employee:–

(i) shall give the employee an opportunity to submit explanation within a period of seven days, showing cause, the value of the damage caused or loss of goods

expressly entrusted to the employee.

(ii) On establishment of the charges, deduction shall be made from the wages of Procedure for deduction for damage or loss under sub-section (1) of Section 21 and entry in registers under sub-section (3)

(iii) In case no reply is received from the employee concerned within seven days, the employer shall make such deduction from the wage of the employee

concerned and the same shall be intimated to the employee within fifteen days of the

date of such deduction.

(iv) The employer shall record such deductions in register as specified in Form-I.

Conditions

20. The recovery, as the case may be, of:–

(i) advances of money given to an employee after the employment begins recovery of

employee in installments determined by the employer, so as any or all installments in a

wage period shall not exceed fifty percent of wages of the employee subject to the celling

specified in Rule 14 in that wage period and the particulars of such recovery shall be

recorded in the register maintained in Form-I.

Extent of loan 21. The extent of loans granted under clause (g) of sub-section (2) of Section 18 and

the deductions for recovery of such loans granted for house building or other purposes

and deduction under Section 24 approved by the Central or State Government, and the interest due in respect thereof shall

be, subject to any direction made or circular issued by the Central or State Government

from time to time regulating the extent to which such loans may be granted, and the rate of

interest shall be payable thereon.

CHAPTER-IV

STATE ADVISORY BOARD

22.(1) The State Government shall constitute a State Advisory Board for the

purpose of sub-section (4) of Section 42.

(2) The Board shall consist of the persons to be nominated by the State Government

representing employers and employees, as specified in clauses (a) and (b) of

sub-section (6) of Section 42 and the independent persons of that sub-section as specified

Constitution of State Advisory Board, its Committees and sub-committees under sub-section (4) of Section 42 in clause (c).

(3) The persons representing employers as referred to in clause (a) of

sub-section (6) of Section 42 shall not be less than twelve and the persons representing

employees referred to in clause (b) of that sub-section shall also not be less than twelve.

(4) Independent Persons referred under clause (c) of sub-section (6) of Section 42,

to be nominated by State Government in State Advisory Board shall consist of following: -

(i) Minister for Labour and Employment, Government of Uttar Pradesh–

ex-officio Chairperson;

(ii) Two nominated members of State Legislature;

(iii) Additional Chief Secretary/Principal Secretary, Labour and Employment,

Government of Uttar Pradesh;

(iv) Additional Chief Secretary/Principal Secretary, Finance, Government of

Uttar Pradesh;

(v) Additional Chief Secretary/Principal Secretary, Industries, Government of

Uttar Pradesh;

(vi) Two members having expertise on wage and labour related matters;

(5) The Labour Commissioner, Uttar Pradesh shall be Member-Secretary of State

Advisory Board.

(6) The State Advisory Board may constitute one or more Committees or

sub-committees in accordance with sub-section (6) of Section 42. The Chairperson of the

Committees and sub-committees, formed by the Board shall be appointed by the Board and

the so chairperson, shall be a member from the independent members of the Board.

(7) The State Government shall, while nominating the members of the Board, take

into account that the independent members under sub-rule (2) shall not exceed one third of

the total members of the Board and minimum one third of the members of the Board shall

be women.

23. The Chairperson of the Board or Committees or sub-committees constituted

by Board, as the case may be, may, subject to the provisions of Rule 22 call a meeting of

the Board at any time he thinks fit:

Provided that on requisition in writing from not less than one half of the

Meeting of the Board, Committees and sub-committees under sub-section (10) of Section 42 members, the Chairperson shall call a meeting within thirty days from the date of receipt of

such requisition.

Notice of

24. The Chairperson shall fix the date, time and place of every meeting and a meetings of the

notice in writing containing the aforesaid particulars along with a list of business to be Board,

conducted at the meeting shall be sent to each member by registered post and Committees and

electronically at least fifteen days before the date fixed for such meeting:

Provided that in the case of an emergent meeting, notice of seven days only

may be given to every member.

25. The Chairperson shall:–

Functions of the Chairperson

(i) preside at the meetings of the Board: Provided that in the absence of the Chairperson at any meeting, the

Chairperson shall nominate a person, amongst the members of the Board, to

preside at such meeting;

(ii) decide agenda of each meeting of the Board; (iii) wherein the meeting of the Board, if any, issue must be decided by voting, conduct the voting and count or cause to be counted the secret voting in

the meeting.

Quorum 26. No business shall be transacted in a meeting if at least one-third of the

members and at least one member each from employers and employees are present in

a meeting:

Provided that, if at any meeting less than one-third of the members are present,

the Chairperson may adjourn such a meeting for maximum seven days and in the adjourn

it shall be lawful to transact the business even if the members attending the meeting for

short of the Quorum:

Provided further that the date, time and place of such adjourned meeting shall

be intimated to all the members electronically or by a registered post.

Disposal of

27. All business of the State Advisory Board, Committees and sub-committees business of the

28. Voting in the State Advisory Board, Committees and sub-committees voting

appointed by State Advisory Board shall ordinarily be by show of hands, but if any

member asks for voting by ballot, or if the Chairperson so decides, the voting shall be by

secret ballot and shall be held in such manner as the Chairperson may decide.

Proceedings of

29.(1) The proceedings of each meeting of the State Advisory Board, the meeting

Committees and sub-committees appointed by State Advisory Board showing inter alia

the names of the members present there at shall be forwarded to each member and to the

State Government as soon after the meeting as possible, and in any case, not less than

seven days before the next meeting.

(2) The proceedings of each meeting of the State Advisory Board, Committees

and sub-committees appointed by State Advisory Board shall be confirmed with such

modification, if any, as may be considered necessary at the next meeting.

30.(1) The Chairperson may summon any person to appear as a witness if

required in the course of the discharge of his duty and require any person to produce any Summoning of witnesses and production of documents

(2) Every person who is summoned and appears as a witness before the Board

shall be entitled to an allowance for expenses by him in accordance with the scale for the

time being in force for payment of such allowance to witnesses appearing before a civil

Court.

31.(1) The term of office of a nominated member of the Board or the Chairperson

of any committee or sub-committee, as the case may be, shall be normally two years

commencing from the date of his appointment or nomination, as the case may be,

under sub-section (6) of Section 42.

(2) An independent member of the Board nominated to fill a casual vacancy shall

hold office for the remaining period of the term of office of the member in whose place he

is nominated.

Term of office of members of the Board, Committees and sub-committees of State Advisory Board under sub-section (2) of Section 42 (3) The official members of the Board shall hold office till they are replaced by

respective such other official members.

(4) Notwithstanding anything contained in sub-rules (1), (2) and (3), the members

of the Board, shall hold office during the pleasure of the State Government.

(5) An outgoing member shall be eligible for re-nomination to the Board:

provided that they shall hold office for a maximum of two terms.

32. The Chairperson and the non-official members of the State Advisory Board, Travelling allowance

Committees and sub-committees, shall be entitled to draw travelling, daily and halting

allowances for any journey performed by them in connection with their duties at such

rates as are admissible to lowest of Group-A officers of the State Government.

33. The State Government may, apart from Member-Secretary of the Board, Officers and Staff

appoint a Secretary to the Board and one or more secretaries to Committees and

sub-committees of the Board not below the rank of Deputy Labour Commissioner,

Government of Uttar Pradesh and other officers and staff to the Board, Committees and

sub-Committees, as it may think necessary for the functioning of the Board Committees

and sub-Committees.

34.(1) A nominated member of the Board, other than the Chairperson,

Committees and sub-committees, may, by giving notice in writing to the Chairperson,

resign his membership and the Chairperson, may resign by a letter addressed to the

State Government.

(2) A resignation shall take effect from the date of Communication of its

Resignation of the Chairperson and other members of the Board, Committees and sub-committees

acceptance or on the expiry of 30 days from the date of resignation, whichever is earlier.

(3)When a vacancy occurs or is likely to occur in the membership of the Board,

the Member-Secretary shall submit a report to the State Government immediately and the

State Government shall, then, take steps to fill the vacancy in accordance with the

provisions of the Code.

35. If a member of the Board, Committees and sub-committees fails to attend Cessation of membership three consecutive meetings, without prior intimation to the Chairperson, he shall, cease to

be a member thereof.

Disqualification 36.(1) A person shall be disqualified for being nominated as, and for being a

member of the State Advisory Board –

(i) If he is declared to be of unsound mind by a competent Court; or (ii) If he is an un-discharged insolvent; or (iii) If before or after the commencement of the Code, he has been

convicted of an offence involving moral turpitude.

(2) If any question arises whether a disqualification has been incurred under

sub-rule (1), the decision of the State Government thereon shall be final.

CHAPTER-V PAYMENT OF UNDISBURSED DUES, CLAIMS ETC.

37.(1) (a) Under clause (a) of sub-section (1) of Section 44, every employee shall

make a declaration in Form-XII in physical form or electronically, nominating a person

conferring the right to receive the amount that may stand in the credit of the employee on

the event of death, before that amount standing to the credit of such employee has

become payable or where the amount has become payable, before payment has been

(b) If the employee has a family at the time of making nomination, the nomination shall be in favour of the spouse or the spouse is in preference followed by one or more members of the family:

Provided that nomination made by an employee having a family in favour of a person other than member of the family shall be invalid:

Provided further, that a fresh nomination towards the spouse of the employee shall be made by the employee on marriage and any nomination made before such marriage shall be deemed to be invalid.

(c) where the nomination is wholly or partly in favour of a minor, the employee may appoint a major person of the family to be the guardian of the minor nominee and where there is no major person in the family, the employee may by description appoint any other person to be the guardian of the minor nominee.

(d) If the employee nominates more than one member, the nominations shall specify the amount or share payable to each of the nominees at employee's own discretion, so as to cover the whole of the amount that may stand to the credit of the employee.

(2) Where any amount payable to an employee under the Code is due after the date on account of where abouts not being known of employee and the amount could not be paid to the nominee of the employee until the expiry of three months from the date the amount has become payable, the such amount shall be deposited by the employer with the Regional Additional/Deputy Labour Commissioner having jurisdiction, who shall disburse the amount to the person nominated by the employee after ascertaining the identity of the employee within two months from the date on which the amount was so deposited.

Deposit of the

38.(1) Where any amount payable to an employee under clause (b) of undisbursed

sub-section (1) of Section 44 remains undisbursed, since no nomination has been made by dues in case of

such employee or for any other reason, such amount could not be paid to the nominee of death of

the employee, all such amount shall be deposited by the employer after the expiry of six employeeunder

clause (b) of months from the date the amount become payablewith the Additional/Deputy Labour sub-section (1)

Commissioner having jurisdiction, before the expiry of fifteenth day after the last day of of Section 44

the said period of six months.

(2) The amount to be deposited under sub-rule (1) shall be through bank transfer or through a crossed demand draft obtained from any nationalised or scheduled bank in India drawn in favour of such Additional/ Deputy Labour Commissioner.

(3) Who shall disburse the amount to the person nominated by the employee after ascertaining his identity within two months of the date on which the amount was so deposited with him. For the purpose of ascertaining the identity of nominated person, the Additional/Deputy Labour Commissioner may seek help from the officers of the Revenue and Police Department.

(4) Where any amount payable to an employee under this Code is due after his death or on account of his where abouts not being known, remains undisbursed because either no nomination has been made by such employee or for any other reason, such amounts could not be paid to the nominee of employee until the expiry of three months from the date the amount had become payable, all such amounts shall be deposited by the employer with the Regional Additional/Deputy Labour Commissioner, Government of Uttar Pradesh having jurisdiction through Demand Draft or electronic transfer before the expiry of the fifteenth day after the last day of the said period of three months.

39.(1) The amount referred to in Rule 37 and 38 (hereinafter in this rule referred

to as the amount) deposited with the Regional Additional/Deputy Labour Commissioner,

Government of Uttar Pradesh having jurisdiction shall remain with him and be invested

in the Central or State Government Securities or deposited as a fixed deposit in a

Manner of dealing with the undisbursed dues under clause (b) of sub-section (1) of Section 44 nationalized bank.

(2) The Regional Additional/Deputy Labour Commissioner, Government of

Uttar Pradesh having jurisdiction shall exhibit, as soon as may be possible, a notice

containing such particulars regarding the amount as the Regional Additional/ Deputy

Labour Commissioner, Government of Uttar Pradesh considers sufficient for information

at least for fifteen days on the notice board and a copy of such information shall be sent to

the employer as well, through manually and electronically both and the same shall be

published in two local newspapers having maximum circulation. This notice shall also be

displayed on the web-site of Labour Commissioner, Uttar Pradesh through a separate link

meant for this purpose:

Provided that the expenses against the publication of notices in local

newspapers shall be borne by the State Government.

(3) Subject to the provision of sub-rule (4), the Regional Additional/Deputy

Labour Commissioner, Government of Uttar Pradesh having jurisdiction shall release the

amount to the nominee or to that person who has claimed such amount, as the case may be,

in whose favour such Regional Additional/Deputy Labour Commissioner has decided,

after giving the opportunity of being heard, the amount to be paid. For the purpose of

ascertaining the identity of nominated person or legal heirs, the Additional/ Deputy Labour

Commissioner may seek help from the officers of the Revenue and Police Department.

(4) If the undisbursed amount remains unclaimed for a period of two years, the

Regional Additional/ Deputy Labour Commissioner, Government of Uttar Pradesh having

jurisdiction, shall transfer the amount, with interest, if any, to Uttar Pradesh Labour

Welfare Fund constituted under Section 3 of the Uttar Pradesh Labour Welfare Fund

Act, 1965 (Act no. 14 of 1965).

(5) The amount so transferred to Uttar Pradesh Labour Welfare Fund in

accordance with sub-rule (4), shall be administered by the provisions of the Uttar Pradesh

Labour Welfare Fund Act, 1965 (Act no. 14 of 1965) and rules made thereafter.

CHAPTER-VI

FORMS, REGISTERS AND WAGE SLIP

40. Every employer to whom Code on Wages, 2019 applies shall maintain

following registers-

Registers to be maintained by employers

(i) mentioning the details of wages, overtime, fines, various deduction made

in accordance with the Code in Form-I;

(ii) as per the provisions of sub-section (1) of Section 50 of the Code in

Form-II;

(iii) nomination form as per the provisions of Clause (a) of sub-section (1) of

Section 44 of the Code in Form-XII;

(iv) all the registers shall be maintained in physical format or in a digital

format electronically;

(v) registers required to be maintained under these rules shall be preserved for

a period of 5 years after the date of the last entry made therein.

41.(1) Forms appended to these rules and mentioned in the table below shall be used to be used for

CHAPTER-VII

PROCEDURE FOR DISPOSAL OF CLAIM APPLICATIONS AND APPEALS Application form

43. A single application on behalf of or in respect of any number or of group of for claim before

employees employed in the same establishment wherein their claims relate to the same authority

wage period or any incident of discrimination, may be filed under sub-section (5) of Section 45 in Form-III, manually or electronically along with documents as specified in the said Form before the Authority notified by the State Government under sub-section (1) of the Section 45 to here and determine claims which arise under the provisions of the Code. 44.(1) Where an application under Rule 43 is filed the Authority shall serve upon applications filed

the employer electronically or by post a notice in Form-V to appear before them on the before Authority

date specified in the notice with all relevant documents and witnesses, if any, and shall inform the applicant of the date so specified.

(2) In case where the employer or their authorised representative, duly authorised and in Form-IV, fails to appear on the specified date, the Authority may hear and determine the application ex-parte.

(3) In case where the applicant or their authorised representative fails to appear on the specified date without any reasonable cause, shown in advance, the authority may dismiss the application.

(4) The Authority shall pass the order in Form-VI.

Procedure for

45.(1) Any person aggrieved by an order passed by the authority under sub section 2 disposal of

of Section 45 may prefer an appeal under sub-section one of Section 49 in form 7 Appeal

electronically or by post speed post along with documents mentioned by the applicant in the set form to the appellate authority having jurisdiction:

provided that no appeal by an implied shall be admitted unless at the time of

preferring the appeal the appellant has deposited the claim amount with the appellate

authority.

(2) Where an appeal under sub-section (1) of Section 49 is entertained, the

Appellate Authority shall serve upon the respondent electronically or by speed post, a

notice in Form-VIII to appear before them on the date specified in the notice and shall

inform the appellant of the date so specified.

(3) In case where the employer or their representative fails to appear on the

specified date, the Authority may hear and determine the application ex-parte.

(4) In case where the applicant or their representatives failed to appear on the

specified date the authority may dismiss the appeal.

CHAPTER-VIII

INSPECTIONS AND INSPECTOR-CUM-FACILITATOR

Inspection

46.(1) For the purposes of this Code and these rules, there shall be formulated an

scheme under inspection scheme by the Labour Commissioner, Uttar Pradesh with the approval of the

State Government for inspection of the establishments covered under the Code.

who, he has reasonable cause to believe, is an employee employed therein or an

employee to whom work is given out therein and require any person giving

out-work and out-workers, to give any information, which is his power to give,

with respect to the names and addresses of the persons to, for and from whom the

work is given out or received and with respect to the payments to be made for

the work;

(c) seize or take copies of such register, record of wages or notices or portions

thereof, as he may consider relevant in respect of an offence under this Code,

which he has reason to believe, has been committed by an employer;

(d) supervise the payment of wages to persons employed in any factory or

industrial or any other establishment;

(e) to prosecute, conduct or defend before a Court or competent Authority,

any complaint or other proceeding arising under the Code or in discharge of his

duties as an Inspector-cum-Facilitator and secure such evidence, as may be

necessary for the purpose;

(f) upon complaint received from an employee or worker or a registered trade

union related to the establishment, regardless of the fact, whether an inspection

scheme stands formulated as per sub-section (2) of Section 51, the Inspector-cum-

Facilitator shall be required to undertake complete inspection of the

establishment(s) and make as many visit to the establishment(s) as may be

necessary, with the prior written approval of Labour Commissioner Uttar Pradesh:

Provided that, inspection shall be done with the prior approval of regional Additional/Deputy Labour Commissioner and ex-facto approval shall be obtained from Labour Commissioner, Uttar Pradesh within 72 hours of such inspection, in case if complaint is received through any Commission established under law (e.g. National Human Rights Commission, State Human Rights Commission, National Commission for Protection of Child Rights, State Commission for Protection of Child Rights etc.) or the compliant is related to issues regarding employment of child labour and/or bonded labour or if the Inspector-cum-Facilitator is informed by any means that any fatal accident has occurred in the establishment.

(g) Every Inspector-cum-Facilitator shall be deemed to be a public servant within the meaning of the Bharatiya Nyaya Sanhita, 2023 (Act no. 45 of 2023).

(h) Any person required to produce any document or thing or to give any information to an Inspector-cum-Facilitator under sub-rule (a) to (e) shall be deemed to be legally bound to do so within the meaning of Section 210 and Section 211 of the Bharatiya Nyaya Sanhita, 2023 (Act no. 45 of 2023).

CHAPTER-IX

OFFENCES AND PENALTIES

Appointment of

48. The State Government by notification in the Official Gazette, shall appoint an officer to impose

Gazetted Officer not below the rank of Under Secretary of Government of Uttar Pradesh penalty under

or Deputy Labour Commissioner of minimum pay matrix-11 within the limits of its sub-section (1) of

territorial jurisdiction for the purpose of imposing penalty under clauses (a) and (c) of Section 53

sub-section (1) and sub-section (2) of Section 54 and sub-section (7) of Section 56, as the case may be, for holding enquiry in such matter, as prescribed in Rule 49 and Rule 50 of these rules.

Manner of

49.(1) Where a complaint is filed before the officer appointed under holding

sub-section (1) of Section 53 under Rule 48 (hereinafter in this Rule referred to as the enquiry under

Compounding Officer) in respect of the offences referred to in said sub-section either by sub-section (1)

of Section 53 an officer authorized for such purpose by the State Government or by an employee aggrieved or a registered trade union registered under Code on Industrial Relations, 2020 (Act no. 35 of 2020) or an Inspector-cum-Facilitator, the officer, after considering such evidence as produced before him by the complainant, is of the opinion that an offence has been committed, shall issue summons to the offender on the address specified in the complaint fixing a date for his appearance.

(2) If the offender to whom the summons has been issued under sub-rule (1) appears or is produced before the Officer, he shall explain the offender the offence complained against and if the offender pleads guilty, the Officer shall impose penalty on him in accordance with the provisions of the Code and if the offender does not plead guilty, the Officer shall take evidence of the witnesses produced by the complainant on oath and provide opportunity of cross examination of the witnesses so produced.

(3) The officer shall record the statement of the witnesses on oath and in cross-examination in writing and take the documentary evidence on record.

(4) The officer shall, after the complainant's evidence is complete, provide an opportunity of defense to the accused person and the witnesses produced by the accused shall be cross examined after their statements on oath by the complainant and documentary evidence in defense shall be taken on record by the officer.

(5) The officer shall after hearing the parties and considering the evidence both oral and documentary decide the complaint in accordance with the provisions of the Code.

The manner of 50.(1) An accused person desirous of making composition of offence under

imposing fine under sub-section (1) of Section 56 may make an application in Form-X, physically or

electronically, appended to these rules, electronically or otherwise to the Compounding

sub-section (1) of Section 56

Officer/Gazetted Officer notified under said sub-section (1).

(2) The Compounding Officer/Gazetted Officer referred to in sub-rule (1), shall,

on receipt of such application, satisfy himself as to whether the offence is compoundable

or not under the Code and if the offence is compoundable, he shall send a notice on

Form-XI and if the accused person agrees for the composition, compound the offence for

a sum of fifty percent of the maximum fine provided for such offence under the Code, to

be paid by the accused within thirty days of the order of composition issued by

such officer.

(3) The Compounding Officer shall issue a composition certificate in Part-B of

Form-XI within ten days of receipt of the composition amount, to such person from

whom such amount has been received in compliance of the composition notice.

(4) In case where a person should noticed fails to deposit the composition

amount within the time specified by the Compounding Officer prosecution shall be

instituted before the Competent Court against such person for such offense in respect of

which the compound notice was issued.

(5) Where the offence has been compounded under sub-rule (2) after the

institution of the prosecution, the Officer shall send a copy of such order for intimation to

the Officer referred to in sub-section (1) of Section 53 for action under sub-section (6) of

Section 56.

(6) The Compounding Officer/Gazetted Officer shall exercise the powers to

compound the offence under this Rule, subject to the direction, control and supervision of

the State Government.

CHAPTER-X

MISCELLANEOUS

Timely payment 51. Where the employees are employed in an establishment through contractor,

of wages

then, the company or firm or association or any other person who is the proprietor of the

establishment shall pay to the contractor the amount payable in respect of the wages of

employees in accordance with the provisions of the Code.

Explanation:– For the purpose of this Rule, the expression "firm" shall have

the meaning as assigned to it in the Indian Partnership Act, 1932 (Act no. 9 of 1932).

Responsibility for 52. Where in an establishment, the employees are employed through contractor

payment of

and the contractor fails to pay minimum bonus to them under section 26, then, the

minimum bonus company or firm or association or other person as referred to in the proviso to

under Section 26 Section 43 shall, on the written information of such failure, given by the employees or

any registered trade union or unions of which the employees are members and on

confirming such failure, pay such minimum bonus to the employees and may recover

the same from the contractor.

Display Notices to 53.(1) In terms of sub-section (2) of Section 50, all employers and principal

(j) Details of authority appointed under section 45;

(k) Wage period;

(l) Other such notices as prescribed under these rules.

Annual Returns 54. The return under these rules shall be filed electronically by every employer of an establishment to which the Code applies in the relevant Columns of the Form specified for such purpose in the rules made under the Occupational Safety, Health and Working Conditions Code, 2020 (Act no. 37 of 2020).
