_____

STATEMENT OF OBJECTS AND REASONS

The Uttar Pradesh Revenue Code (U.P. Act No. 8 of 2012) has been enacted to consolidate and amend the law relating to land tenures and land revenue in the State of Uttar Pradesh, and to provide for matters connected therewith and incidental thereto.

After the partition of India, and the subsequent creation of Pakistan, and the subsequent emergence of Bangladesh in the year 1971, thousands of displaced/rehabilitated families from there were settled on various categories of land available at that time. At the time of India's partition, many families crossed the border and entered India from Punjab and other provinces of Pakistan (then undivided India) and took refuge in various parts of Pilibhit, Lakhimpur Kheri, Rampur and Bijnor districts, residing on vacant land and cultivating agriculture to earn their living. Since the land occupied by them belongs to Colonization Schemes, Gram Sabha, ceiling, forest, and other departments, and due to the non-availability of records of displacement, these families have not been granted Bhumidhari rights even after the passage of more than 50 years. The lack of Bhumidhari rights causes difficulties for the said displaced/rehabilitated families in obtaining bank loans, as well as in the sale of agricultural produce at Government Procurement Centers. Constant requests have been received from various sources for a long time to resolve the aforesaid problems and grant Bhumidhari rights to the families/farmers displaced from Pakistan, Bangladesh, and different areas of Uttar Pradesh and settled in the districts of Pilibhit, Lakhimpur Kheri, Rampur and Bijnor. The said issue has been raised several times in the State Legislature and in various committees of the State Legislature, and continuous requests are being made by various public representatives and the displaced persons concerned to grant Bhumidhari rights.

462 RPH 2026 (Rajswa Sanhita) data 7e 6

In view of the above, to solve the problems of the families/farmers settled in the districts of Pilibhit, Lakhimpur Kheri, Rampur, and Bijnor and to provide Bhumidhari rights to them, it was decided to amend Section 76 of the aforesaid Act.

Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Revenue Code (Third Amendment) Ordinance, 2026 (U.P. Ordinance No. 13 of 2026) was promulgated by the Governor on 23rd May, 2026.

This Bill is introduced to replace the aforesaid Ordinance.
