NOTIFICATION
IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the "Uttar Pradesh Dand Vidhi (Apradhon Ka Shaman Aur Vicharanon Ka Upshaman) (Sanshodhan) Vidheyak, 2026" introduced in the Uttar Pradesh Legislative Assembly on August 4, 2026.

further to amend the Uttar Pradesh Criminal Law (Composition of Offences
and Abatement of Trials) (Amendment) Act, 1979.
IT IS HEREBY enacted in the Seventy-seventh Year of the Republic of India
as follows :-
Short title and
1. (1) This Act may be called the Uttar Pradesh Criminal Law (Composition of
commencement Offences and Abatement of Trials) (Amendment) Second Act, 2026.
(2) It shall be deemed to have come into force with effect from the 8th day of
April, 2026.
Amendment of 2. In sub-clause (i) of Clause (a) of sub-section (1) of section 9 of the
Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials)
Section 9 of U.P. Act No. 35 of 1979 (Amendment) Act, 1979, for the words, figures and symbols "the Motor Vehicles
Act, 1988; or", the words, figures and symbols "the Motor Vehicles Act, 1988, not
being such offence which is non-compoundable, or for which mandatory
imprisonment is provided, or which falls within the category of a repeat offence; or"
shall be substituted.
Repeal and
3.(1) The Uttar Pradesh Criminal Law (Composition of Offences and
saving
Abatement of Trials) (Amendment) Ordinance, 2026 (U.P. Ordinance No. 9 of 2026)
and the Uttar Pradesh Criminal Law (Composition of Offences and Abatement of
Trials) (Amendment) Second Ordinance, 2026 (U.P. Ordinance No. 12 of 2026) are
hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the
provisions of the principal Act, as amended by the Ordinance referred to in
sub-section (1), shall be deemed to have been done or taken under the corresponding
provisions of the principal Act as amended by this Act as if the provisions of this Act
were in force at all material times.
4 mRrj izns'k vlk/kkj.k xtV] 31 vxLr] 2026STATEMENT OF OBJECTS AND REASONS
The Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Act, 1979 (U.P. Act No. 35 of 1979) has been enacted to amend certain enactments to provide for the composition of certain offences and for abatement of certain criminal trials.
In Writ Petition (Civil) No. 295/2012 (S. Rajaseekaran versus Union of India & Ors.), pending before the Hon'ble Supreme Court, the Hon'ble Court, in its order dated 20.11.2025, observed that if a person currently commits an offence under the Motor Vehicles Act, 1988 and does not pay the fine, then after a certain period the proceedings would automatically abate. As a result, in cases involving serious traffic offences, the offender would escape without any punishment, which is an extremely serious matter.
In such circumstances, there should be certain deterrent measures to ensure control over persons involved in traffic offences, particularly young people.
In view of the above, it was decided to amend Section 9 of the aforesaid Act.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Criminal Law (Composition of Offences and Abatement of Trials) (Amendment) Second Ordinance, 2026 (U. P. Ordinance No. 12 of 2026) was promulgated by the Governor on May 13, 2026.
This Bill is introduced to replace the aforesaid Ordinance.
