IN pursuance of the provisions of clause (3) of Article 348 of the Constitution, the Governor is pleased to order the publication of the following English translation of the "BHARTEEYA STAMP (UTTAR PRADESH SANSHODHAN) Vidheyak, 2026" introduced in the Uttar Pradesh Legislative Assembly on August 4, 2026.
THE INDIAN STAMP (UTTAR PRADESH AMENDMENT) BILL, 2026 A BILL
further to amend the Indian Stamp Act, 1899 in its application to Uttar Pradesh. IT IS HEREBY enacted in the Seventy-seventh Year of the Republic of India as
follows:-
Short title, 1. (1) This Act may be called the Indian Stamp (Uttar Pradesh Amendment)
Act, 2026.
extent and commencement (2) It extends to the whole of Uttar Pradesh. (3) It shall come into force on such date as the State Government may, by
notification in the Gazette, appoint in this behalf.
Amendment of 2. In the Indian Stamp Act, 1899 as amended in its application to Uttar Pradesh, for
Schedule I-B of Article 33 of Schedule I-B, the following Article shall be substituted, namely:-
| "33.Gift-Instrument of, not being a settlement (No. 58) or will or transfer (No. 62) | The same duty as a conveyance (No. 23) clause (a) for a minimum market value (Circle Rate) determined in accordance with the rules made under the said Act." |
——— STATEMENT OF OBJECTS AND REASONS The Indian Stamp Act, 1899 (Act no. 2 of 1899) (hereinafter referred to as the "said Act") has been enacted to consolidate and amend the law relating to stamps. Currently, in the State, stamp duty on gift deeds, as mentioned in Article 33 of Schedule 1-B of the said Act, is chargeable on the consideration equal to the value of the property, at the same duty as on a Conveyance/Sale Deeds. In Article 33, the term "Value'' of the Property is used for the calculation of stamp duty on gift deeds. However the provision for determining this "Value" has not been clearly defined. Consequently, several judgments have been passed by the Hon'ble High Court against the State regarding the deficiency of stamp duty imposed by Collectors on Gift Deeds based on market value. In view of the above, it has been decided to amend Article 33 of Schedule 1-B of the said Act by substituting the words "consideration equal to the value of the property" occurring therein with the words "minimum market value (circle rate) as determined in accordance with the rules made under the said Act." The Indian Stamp (Uttar Pradesh Amendment) Bill, 2026 is introduced accordingly.
