Duties and Responsibilities of Registrar

As per section 7(2) to 7(4), every registrar/sub-registrar shall.

1. Without fee or reward, enter in the register maintained for the purpose all information given to him under section 8 or section 9 and shall also take steps to inform himself carefully of every birth and of every death which takes place in his jurisdiction and to ascertain and register the particulars required to be registered.

2. Have an office in the local area for which she/he is appointed, and

3. Attend her/his office for the purpose of registering births and deaths on such days and at such hours as the chief registrar may direct and shall cause to be placed in some conspicuous place on or near the outer door of the office of the registrar a board bearing, in the local language, his name with the addition of registrar of births and deaths for the local area for which she/he is appointed, and the days and hours of her/his aattendance as under.

8. Search of any entry in the birth and death register [section 17(1)(a) and 17(1)(b)]-

(a) Issuance of extract of prescribed particulars from the register of births and deaths.

(b) Non-availability certificate.

9. Submit monthly reports to prescribed authority [section 19 (1)],

10. Obtain a certificate as to the cause of death where the scheme of MCCD is implemented.

11. As soon as the registration is completed registrar shall give form 5 (for birth) and form 6 (for death) an extract of the prescribed particulars from the register birth and deaths, free of charge, to the person who has given the information for registration, first copy (whether computerised) free of the charge [section 12].

12. It will not be out of place to mention that registrar/sub registrars while acting or purporting to act in pursuance of the provisions of the RBD act or any rule or order made there under shall be deemed to be public servants within the meaning of section 210f the Indian penal code (45 of 1860) [section 26] The person concerned may collect the extracts of birth or death from the registrar (for domiciliary event) and the officer or person-in-charge of the institution (for institutional events) within thirty days of its reporting [rule8(2) to8(4) section 12]in case the extracts of birth and death is not collected as required under such rule of section 12, the registrar or the officer or person in charge of the concerned institution shall transmit the same to the concerned family by post within 15 days of expiry of the said period.

All the district magistrates/ district register (birth and death) are empowered to appoint registrar for their district and information to this effect shall be furnished to the Chief Register (birth and death)/D.G.

ORDER

No. 76/UP-LA/Lalitpur/2022/CEMS-III–WHEREAS, the General Election to 226-Lalitpur Legislative Assembly of Uttar Pradesh, 2022 was announced by Notification No. 60/61-2022 dated 25th January, 2022.

WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and,

WHEREAS, the result of the said election along with 226-Lalitpur Assembly Constituency was declared by the concerned Returning Officer on 10th March, 2022, Hence, the last date for lodging the account of Election Expenses was 09th April, 2022; and,

WHEREAS, as per the scrutiny report submitted by the District Election Officer, Lalitpur, Uttar Pradesh and forwarded by the Joint Chief Electoral Officer, Uttar Pradesh vide their letter No. 287/Nirvachan Vayy Cell/GE-LA/2022/Patra-01/2021, dated 27th April, 2022, Sh. Hariom, a contesting candidate of Uttar Pradesh from 226-Lalitpur Assembly Constituency of Uttar Pradesh, has failed to lodge account of his election expenses, in the manner, as required under law; and,

WHEREAS, on the basis of the reports of the District Election Office, Lalitpur, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause Notice, 76/UP-LA/2022/CEMS-III dated 11 November, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Hariom for not lodging the account of Election Expenses; and,

WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 11 November, 2022, Sh. Hariom was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,

WHEREAS, the said notice was received by the candidate on 05 December, 2022. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Lalitpur, vide its letter no. 497@19-fuokZpu O;;@fo0l0lk0fu0-22@2022 dated 19 December, 2022; and,

WHEREAS, the District Election Officer, Lalitpur in his Supplementary Report, vide its letter 582@19-fuokZpu O;;@fo0l0lk0fu0-22@2022 dated 04 March, 2023 has reported that Sh. Hariom had given a representation on 05 January, 2023 in which the candidate said that the candidate's statement in his representation is false and the candidate has not filed the account of election expenses. Hariom has failed to lodge the account of election expenses and has no good reason or justification for the failure,

WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that–

"If the Election Commission is satisfied that a person–

(a)-has failed to lodge an account of election expenses, within the time and in the manner required by or under this Act, and

(b)-has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order";

WHEREAS, on the basis of the reports of the District Election Office, Kasganj, Uttar Pradesh and the Chief Electoral Officer, Uttar Pradesh, a Show-Cause Notice, 76/UP-LA/2022/CEMS-III dated 19 December, 2022 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Kuldeep Kumar for not lodging the account of Election Expenses; and,Hkkx 7-[k ] mŸkj izns'k xtV] 08 twu] 2024 bZ0 ¼T;s"B 18] 1946 'kd laor~½ 107 WHEREAS, As per the sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, through the above said Show-Cause Notice, dated 19 December, 2022, Kuldeep Kumar was directed to submit his representation in writing with explaining the reasons for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,
