No. 4/1/92-MAG/Vol. V/(2 1/5)/4062 And whereas, the circumstances do not allow the serving of notice on all concerned, the order is hereby passed ex-parte. It shall be published for information of public through press and also by affixing copies on the notice boards of Sub-Divisional Magistrates, Mamlatdars and Executive Magistrates Valpoi and Police Stations in Valpoi, North Goa District.

Under Section 144 (1) of the Code of Criminal

Procedure, 1973

Whereas report has been received from the Superintendent of Police, North Goa, vide No. SP/ /North/Reader/2831/2017 dated 04-11-2017, inter-alia, stating that the Police Inspector, Valpoi Police Station has reported that there are repeated acts of the Shivpremis, without proper permission with regards to installation and restoration of Idol of Chatrapati Shivaji Maharaj at Hathwada Junction, Valpoi which is creating communal tension and due to this if other community anyone installs any other religious mementos at that place there is possibility of triggering of communal tension and communal riots cannot be ruled out.

Now therefore, in exercise of the powers vested in me under Section 144(1) of the Code of Criminal Procedure, 1973, I, Nila Mohanan, IAS, District Magistrate, North Goa, do hereby declare Hathwada Junction as Hyper Sensitive area within radius of 15 meters from erection of unauthorized statue at Hatwada circle, Valpoi, Satari and further prohibit:-

(a) Assembly and gathering of five or more persons and taking out or organizing of processions.

(b) The carrying of firearms or weapons of offences such as lathis, swords, daggers or spears.

(d) The shouting of slogans.

within the radius of 15 metres around the Hathwada Junction at Valpoi which comes under the jurisdiction of Valpoi Police Station.

And whereas, after having carefully examined the material put forth by the Superintendent of Police, I am satisfied that there are sufficient grounds for proceeding under Section 144 of the Criminal Procedure Code, 1973 to prevent the major law and order situation in the jurisdiction of Valpoi Police Station. This could adversely affect peace and harmony prevailing in the State of Goa and create fear in the minds of public and tourists thus I further direct that the above restriction shall not apply to public servants on duty and to 1089 OFFICIAL GAZETTE — GOVT. Any person/agency contravening this order will be punished under Section 188 of the Indian Penal Code.
