(2) If the answer to the issue No. (1) above is in the affirmative, then, what relief the workmen are entitled to?"
2. Upon receipt of the reference, it was registered as IT/04/14 and registered AD notices were issued to both the parties. Pursuant to service of notices, Party I workmen at Sr. Nos. 1, 2, 9, 11, 12, 13, 16 and 17 filed a Claim statement at Exb. 9 and Party I workmen at Sr. Nos. 3, 4, 5, 6, 7, 8, 10, 14, 15, 18, 19 and 20 also filed a Claim statement at Exb. 12. Party II filed a Written statement at Exb. 15. Party I then filed a rejoinder at Exb. 22.
3. In short, the case of Party I is that the Party I are the workers of Party II which is a Private Limited Company involved in the business of manufacturing of pharmaceutical machinery and equipments at Verna and Kundaim. The Party I workers were employed and working in the establishment situated at Verna Industrial Estate, Verna. The Party II were having huge turnover and earning huge profits in their business and notwithstanding the profitable business of Party II, it unilaterally issued transfer orders on 10-8-2013 and directed the Party I workmen to join the head office at Mumbai. The said act of Party II is in utter violation of principles of natural justice, equity and conscience. The Party II has also illegally closed down its establishment at Verna without following the procedure established by law. The Party II has retrenched the workers from service under the garb of transfer orders. The workmen have been victimized by Party II for no reasons. The Party II has adopted unfair labour practice and thereby attempted to deprive them of their day-to-day livelihood. The closure of the establishment as well as transfer orders are illegal, arbitrary, unreasonable, unjust and in violation of principle of natural justice. The illegal closure of establishment caused great prejudice to Party I in terms of livelihood and status. Hence, the dispute.
4. In the Written statement, Party II claimed that there does not exist an industrial dispute under Section 2(k) of the Industrial Disputes Act, 1947. The present reference is not maintainable. The unit at Verna Industrial Estate came to be temporarily closed down w.e.f. 14-8-2013 on account of non- -viability of the business, heavy loss for last three years, lack of power supply in the factory, etc. and the workmen were transferred to the head office and at factory at Mumbai in order to protect the services of the workmen concerned, however none of the workmen have reported to duty. The disciplinary action taken against the workmen has been proved under the law and they were afforded opportunity to defend in the enquiry. The Party I is not entitled for any relief.
5. In the rejoinder, the Party I denied the case
put forth by Party II in Written statement.
6. Based on the averments of the respective parties, the following issues were framed at Exb. 27.
1) Whether the Party I proves that the retrenchment of Party I/Workmen from service under the garb of transfer orders without complying with the procedures prescribed is illegal and unjustified?
2) Whether Party I proves that the closure of the Party II company as well as their transfer orders are illegal and unjust and in violation of principle of natural justice?
3) Whether Party II proves that reference is not maintainable as claim of Party I is not an "Industrial Dispute" as defined under Section 2(k) of Industrial Disputes Act, 1947?
4) What Order? What relief?
7. It is matter of record that Ld. Adv. Roesha Mascarenhas for the Party I workmen filed an application at Exb. 26 stating that she sent notices of withdrawal to some of the workers viz. Mr. Rajesh Naik, Darshan A. Naik, Sangamesh Kolkar, Siddhalingayya Chikamath, Sanjay Mirashi, Babani Asolkar, Suraj Haldankar and Rajesh Sawal at their addresses mentioned in the cause title on 02-12-2016 and that Mr. Rajesh Naik, Suraj Haldankar and Darshan A. Naik have been served with the said notices of withdrawal, whilst the notices sent to Mr. Sangamesh Kolkar, Babani Asolkar, Rajesh Sawal and Siddhalingayya Chikamath were returned unserved with the endorsement from the postal authorities "Not Known". It is also claimed that the notice sent to Mr. Sanjay Mirashi was returned with the endorsement from the postal authorities "not claimed, returned to sender" and also that she is not aware of any other address of the parties' viz. Mr. Sangamesh Kolkar, Babani Asolkar, Rajesh Sawal and Siddhalingayya Chikamath. Be that as it may, none of the workmen who have been duly served put in their appearance nor prosecuted the case.

GOVERNMENT OF GOA
AT PANAJI
(Before Mr. Vincent D'Silva, Hon'ble Presiding
Officer)
8. It is matter of record that the matter was posted for evidence, however neither workmen nor Advocate for the Party I workmen remained present and accordingly the evidence of Party I was closed and the matter was fixed for the evidence of Party II. Ld. Adv. Shri P. Chawdikar for Party II submitted that he is not leading evidence and that his evidence be closed and accordingly, the evidence of Party II was also closed and the matter was fixed for final arguments. Needless to mention, the
burden of proving the case referred to the Tribunal for adjudication by the Government at the instance of the workmen lies on the Workmen/Union and that burden of proof never shifts. The Party I have not led any evidence on record to prove the allegations made in the Claim statements filed by
them. The Party I having failed to discharge the burden of proving the case, I am unable to record any finding on the issue referred to the Tribunal by the appropriate Government for want of evidence adduced by the Party I. The Party I having failed to prosecute the matter or lead any evidence in
support of the case, the reference is bound to be answered against the workmen.

(2) If not, to what relief the above workmen
are entitled?"
2. Upon receipt of the reference, it was registered as IT/39/01 and registered A/D notices were issued to both the parties. Pursuant to service of notices, Party I filed a Claim statement at Exbt. 4 and Party II filed a Written statement at Exbt. 5.
3. In short, the case of Party I is that about 79 workers were recruited by the management of M/s. Osaka Limited, M/s. Medispray Pvt. Ltd. and M/s. Meditab Specialities Pvt. Ltd. and all the said workers were inter-rotated on the rolls of three companies and subsequently they were transferred on the rolls of contractor, namely Shri Lawrence Fernandes who is running the contract in the name of M/s. Sheryl & Company, M/s. Trevor Enterprises and M/s. Trinity Enterprises. The Party I workmen were put on the rolls of M/s. Trinity Enterprises and were employed at M/s. Osaka Ltd. The Principal Employer and the Contractor were paying the workers less salary; however they were made to work in most inhumane working conditions. The said workers thereafter unionized themselves under the banner of Goa Trade & Commercial Workers' Union and requested to treat the workmen as 'Protected Workmen'. However, the Party II started harassing and victimizing the workers and forced them to leave the Union and since they refused to resign from the Union, all the workmen refused employment w.e.f. 23-11-1998. The refusal of employment is illegal and bad-in-law as no enquiry of whatsoever nature has been conducted. The Party I had worked efficiently and diligently with clean and unblemished past service record. Hence, the dispute.
4. In the Written statement, the Party II has claimed that their activities have been closed after the strike resorted to by the workers engaged for services and all the workmen were offered their legal dues arising out of the closure. The services of the workmen were terminated since the factory is already closed and all the workers were paid their dues.
5. In the rejoinder at Exbt. 6, the Party I denied the case put forth by Party II in Written statement.
6. Issues came to be framed at Exbt. 7. They are:
1) Whether the Workmen/Party I proves that the Employer/Party II refused employment to them from 23-11-1998?
2) Whether the Workmen/Party I proves that refusal of employment to them by the Employer/Party II w.e.f. 23-11-98 is illegal and unjustified?
3) Whether the Employer/Party II proves that the reference made by the Government is bad in law and not maintainable?
4) Whether the Employer/Party II proves that its establishment is permanently closed from 25-11-98 and the services of the Workmen/Party I were terminated?
5) Whether the Workmen/Party I entitled to
any relief?
6) What Order?
7. In the course of further proceedings, the parties arrived at an amicable settlement and filed consent terms along with Annexure 'A' at Exhibit 29 colly, and prayed to dispose of reference in terms of the settlement.
8. The Consent terms read as follows:
a) It is agreed between the parties that each workmen concerned in the reference as per Annexure A to the settlement shall be paid a sum of Rs. 25,000.00 (Rupees Twenty five thousand only) in full and final settlement of their dispute arising out of their employment and reference which includes earned wages, retrenchment compensation, unpaid salary, gratuity, bonus, ex-gratia, if any etc.
b) It is agreed specifically by workmen and the union that the amount of money mentioned in clause No. 1 in full and final settlement of claim of each workmen arising out of their employment and reference and the amount mentioned in clause No. 1 includes earned wages, retrenchment compensation, unpaid salary, gratuity, bonus, ex-gratia, if any etc. and it shall also include any benefit which can be computed in terms of money and this settlement is in full and final satisfaction of all claims of workmen including any claims of re-instatement or re-employment.
OFFICIAL GAZETTE — GOVT. ________
By Order dated 6-6-2001, bearing No. IRM/CON/ /(120)/2000/2450, the Government of Goa in exercise of powers conferred by Section 10 (1)(d) of the Industrial Disputes Act, 1947 (for short The Act), has referred the following dispute to this Tribunal for adjudication.
"(1) Whether the action of the management of M/s. Sheryl and Company, Aradi, Guirim, Bardez, Goa, Contractor of M/s. Medispray Lab. Pvt. Limited, in terminating the services of the following workmen working as packers, is legal and justified?
Notification
No. 28/9/2017-LAB/Part-I/384
The following award passed by the Industrial Tribunal and Labour Court, at Panaji-Goa on 27-04-2017 in reference No. IT/40/01 is hereby 1. Urmila Naik. 2. Pushpalata Gurav. 3. Bharati Naik. 4. Deepak Naik. 5. Arti Gaude.
OFFICIAL GAZETTE — GOVT. OF GOA SERIES II No. 9 1ST JUNE, 20176. Vidhya Gaude. 7. Vishranti Gaude. 8. Prashanti Naik. 9. Anita Bhomkar.
10. Gomanti Nair. 11. Sumitra Gaude. 12. Nilima Gaonkar. 13. Amita Devidas. 14. Urmila Naik. 15. Anita Naik. 16. Nullo Gaude. 17. Anita M. Naik. 18. Manisha Shirodkar. 19. Sharmila Kholapurkar. 20. Prarthana Sawant. 21. Sugandha Sawal.
(2) If not, to what relief the above workmen
are entitled?"
2. Upon receipt of the reference, it was registered as IT/40/01 and registered A/D notices were issued to both the parties.
Ltd. and M/s. Meditab Specialties Pvt. Ltd. and all the said workers were inter-rotated on the rolls of three companies and subsequently they were transferred on the rolls of contractor, namely Shri Lawrence Fernandes who is running the contract in the name of M/s.
7. In the course of further proceedings, the
parties arrived at an amicable settlement and filed consent terms along with Annexure 'A' at Exhibit 24 colly, and prayed to dispose of reference in terms of the settlement.
1 includes earned wages, retrenchment compensation, unpaid salary, gratuity, bonus, ex-gratia, if any etc. and it shall also include any benefit which OFFICIAL GAZETTE — GOVT. OF GOA SERIES II No. 9 1ST JUNE, 2017 can be computed in terms of money and this
settlement is in full and final satisfaction of all claims of workmen including any claims of re-instatement or re-employment.
c) It is agreed by each individual workman that out of Rs. 25,000.00 paid/payable to them as per the settlement, a sum of
Rs. 2500.00 shall be paid to the Goa Trade & Commercial Workers Union by cheque from the said amount from each individual workman.
d) It is agreed by the Party I that Party II shall draw a cheque in the name of the workman
concerned in the reference for a sum of Rs. 25,000.00 (Rupees twenty five thousand only) each and will be handed over to the representative of Goa Trade and Commercial Workers Union along with the receipt and Annexure A and it would be
responsibility of the representative of Union to disburse the said cheque to said workman concerned in the reference and give receipt to the management within period of 15 days from acceptance of cheque.
9. The above Consent terms are signed by Shri Lawrence Fernandes and Ld. Adv. Shri M. S. Bandodkar of Party II, so also Shri Christopher Fonseca-President of Goa Trade & Commercial Workers Union and Ld. Adv. Shri Suhaas Naik, representing the Party I Workmen. I have gone through the records of the case and the above consent terms and I am convinced that the consent terms filed by the parties are just and fair and are in the interest of the Workmen/Party I and Employer/Party II and therefore, the same are accepted.
10. In view of above, I pass the following:
