Read: 1. Order No. 8/38/2014-MAG/L & O/
/Bicholim/3500 dt. 19-07-2018.
2. Resolution dated 27-07-2018 of the Village Panchayat, Dongurli Thane, Satari, Goa.
Under Section 29A of the Goa Excise Act, 1964 read
with Section 144 of the Code of Criminal
Procedure of 1973
OFFICIAL GAZETTE — GOVT. OF GOA SERIES III No. 20 (EXTRAORDINARY) 20TH AUGUST, 2018within the Dongurli-Thane Village Panchayat area of Satari Taluka in North Goa District from 20th July onwards for a period of 30 days.
And whereas vide order dated 19-7-2018 issued by this office, a report was called from the Commissioner of Excise as to whether the existing bars and wholesale liquor shop/establishment serving liquor are complying the licence conditions and also whether the said licences were issued in accordance with law. The Additional Commissioner of Excise is submitted his report dated 14-08-2018 informing that their office vide letter dated 14-08-2018 has asked the Village Panchayat Dongurli Thane, Satari that NOC issued by them for the Bars in Surla village has been revoked or not.
And whereas this office has received a Gram Sabha resolution dated 27-7-2018 from the Village Panchayat, Dongurli Thane for closure of bars in the village Surla, and requested for action by Excise Department for closure of Bars in Surla village.
And whereas I have heard the delegation of villagers of Surla who has also submitted a Memorandum and I have also previously heard the Bar owners. It is seen that not only the villagers of Surla but neighbouring State of Karnataka villagers are also agitated over the working of bars.
And whereas it is seen that the situation in the village Surla is still tense on the issue of tourist visiting the said village and create nuisance in the event such bars are allowed to continue.
Therefore, having considered above, I am satisfied that the Law and Order situation in the Village Surla has not been normalised and still continues to be very fragile and vulnerable to breach of peace. Hence the validity of period of the above read prohibitory orders issued u/s 144 of Cr. P. C. stands further extended for prohibiting all liquor bars, shops, pubs, clubs, provision stores or any establishment serving or selling liquor or alcoholic beverages in retail or in packed bottles in the Village of Surla, within the Dongurli-Thane Village Panchayat area of Satari Taluka in North Goa District from selling Liquor and all types of alcoholic beverages in retail or packed bottle/can, for a further period of 30 days w.e.f. 19-08-2018. The other conditions prescribed in the said order remains the same.
Further, considering the situation prevailing in the Village and the demand of the Villagers made by Gram Sabha resolution of the Village dated 27-07-2018, and as pointed out by the Additional Commissioner of Excise in his report dated 14-08-2018, the Secretary of Village Panchayat, Dongurli Thane shall clarify to the letter of Additional Commissioner of Excise dated 14-08-2018 expeditiously and further the Commissioner of Excise may take appropriate decision as expeditiously as possible in this matter, which is to be conveyed to this office.
The officials of the Excise Department, Police or any other authorized officers/officials shall act immediately to ensure strict enforcement of this prohibitory order and in case any violation comes to their notice or reported should forthwith report such cases to the Commissioner of Excise as well as SDM, Bicholim.
Given under my hand and seal of this office on
