Read: Order No. 2/39/2014-LD(Estt)/Part/1824 dated 10-11-2020.

The Government of Goa hereby empowers the District Registrar (North), Panaji, Goa and the District Registrar (South), Margao, Goa to exercise the powers under Article 32 of the Civil Registration Code of the State of India, approved by Decree dated 9th November, 1912 to be performed by the Conservador Geral (Conservator General), only in respect of correction of names, surnames, including Father's/Mother's names, date of marriage, place of marriage, in the Marriage Register maintained by the Civil Registrar within the limits of their respective jurisdiction.

This Order is issued in supersession to the Government Order No. 2/39/2014/LD(Estt)/Part/ 1824 dated 10-11-2020, published in the Official Gazette, Series I No. 33 dated 12-11-2020.

Notification

DMG/MMDR/DMF/01/2015/117

In exercise of the powers conferred by section 15 read with sub-sections (2) and (3)

of section 9B of the Mines and Minerals

(Development and Regulation) Act, 1957

(Central Act 67 of 1957) and all other powers

enabling it in this behalf, the Government of

Goa hereby makes the following rules

so as to further amend the Goa District

Mineral Foundation (Trust) Rules, 2018,

namely:—

1. Short title and commencement.— (1)

These rules may be called the Goa District

Mineral Foundation (Trust) (Second

Amendment) Rules, 2021.

(2) They shall come into force on the date

of their publication in the Official Gazette.

2. Amendment of rule 4.— In rule 4 of the

Goa District Mineral Foundation (Trust) Rules,

2018, (hereinafter referred to as the "Principal Rules"), in clause (d), in the table, in the entry

against serial No. 14, for the words "Mineral

Foundation of Goa", the words "Centre for

Environment Education" shall be substituted.

3. Amendment of rule 15.— In rule 15 of the Principal Rules, after clause (d), the

following clause shall be inserted, namely:—

"(e) The Government shall set up a

Project Management Unit (PMU) at the

State level. The Project Management Unit

shall assist the District Mineral Foundation

in planning, supervising, monitoring works

undertaken by the District Mineral

Foundation.

4. Insertion of new rule 15A.— After rule

15 of the Principal Rules, the following rule

shall be inserted, namely:—

"15A. Constitution of State Level

Monitoring Committee.— (1) The

Government shall constitute a State Level

Monitoring Committee consisting of the

following members, namely:—

(i) Chief Minister ... Chairperson.

(ii) Minister for Mines/ … Member.

(iii) Chief Secretary … Member.

(iv) Secretary (Mines) … Member.

(v) Secretary (Finance) … Member.

(vi) Director of Mines & … Member.

(2) The State Level Monitoring

In exercise of the powers conferred by the

proviso to Article 309 of the Constitution of

India, the Governor of Goa hereby makes the

following rules to regulate the recruitment to

the Goa General Service, Group 'A', Gazetted

post, for the Employees State Insurance

Hospital, under the Office of the

Commissioner, Labour and Employment,

Government of Goa, namely:—

1. Short title, application and

commencement.— (1) These rules may be

called the Government of Goa, Office of the

Commissioner of Labour and Employment,

Group 'A', Gazetted post, Recruitment Rules,

2021.

(2) They shall apply to the post specified in

column (1) of the Schedule to these rules

(hereinafter called as the "said Schedule").

(3) They shall come into force from the date

of their publication in the Official Gazette.

2. Number, classification and the level in

the pay matrix.— The number of posts,

classification of the said post and the level in

the pay matrix attached thereto shall be as

specified in columns (2) to (4) of the said

Schedule:

Provided that the Government may vary

the number of posts specified in column (2)

of the said Schedule from time to time subject

to exigencies of work.

3. Method of recruitment, age limit and

other qualifications.— The method of

recruitment to the said post, age limit,

qualifications and other matters connected therewith shall be as specified in columns

(5) to (13) of the said Schedule.

4. Disqualification.— No person who has

entered into or contracted a marriage with a

person having a spouse living or who, having

a spouse living, has entered into or contracted

a marriage with any person, shall be eligible

for appointment to the service:

Provided that the Government may, if

satisfied that such marriage is permissible

under the personal law applicable to such

person and the other party to the marriage

and that there are other grounds for so doing,

exempt any person from the operation of this

rule.

5. Power to relax.— Where, the Government

is of the opinion that it is necessary or

expedient so to do, it may, by order, for

reasons to be recorded in writing and in

consultation with Goa Public Service

Commission, relax any of the provisions of

these rules with respect to any class or

category of persons.

6. Saving.— Nothing in these rules shall

affect reservation, relaxation of age limit and

other concessions required to be provided

for Scheduled Castes, Scheduled Tribes, Other

Backward Classes, Ex-servicemen and Other

Special Categories of persons in accordance

with the orders issued by the Government

from time to time in that regards.

These rules are issued in consultation with

the Goa Public Service Commission conveyed

vide their letter No. COM/II/13/28/(1)/2021/

/3001 dated 16-03-2021.

In exercise of the powers conferred by the

Division Clerk, notified vide Government

Notification No. 1/3/2018-PER dated

15-09-2020, published in the Official Gazette,

regulate the recruitment to the Group 'C',

Ministerial, Non-Gazetted, Common post

(outside Secretariat) under the Government

of Goa, namely:—

1. Short title, application and commence-

ment.— (1) These rules may be called the

Government of Goa, Group 'C', Ministerial,

Non-Gazetted, Common post (outside

Secretariat), Recruitment Rules, 2021.

(2) They shall apply to the post specified in

column (1) of the Schedule to these rules

(hereinafter called as the "said Schedule").

(3) They shall come into force on the date

of their publication in the Official Gazette.

In exercise of the powers conferred by section 96 of the Goa, Daman and Diu Public Health Act, 1985 (Act No. 25 of 1985) and all other powers enabling it in this behalf, the Government of Goa hereby makes the following rules so as to further amend the Goa Public Health Rules, 1987, namely:—

1. Short title and commencement.— (1) These rules may be called the Goa Public Health (Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Amendment of rule 15D.— In rule 15D of the Goa Public Health Rules, 1987, in clause I, after sub-clause (o), the following sub-clause shall be inserted, namely:—

"(p) the ambulance is equipped with Geographic Information System/Global Positioning System mapping".

MORMUGAO PORT TRUST STEVEDORING AND SHORE HANDLING REGULATIONS, 2021

In exercise of the powers conferred by section 123 of the Major Port Trusts Act, 1963 (38 of 1963), the Board of Trustees of the Port of Mormugao hereby frames, subject to the approval of Central Government the following regulations in supersession of the Mormugao Port Trust (Licensing of Stevedores) Regulations, 2010 and subject to the publication as required under section 124 of the said Act, namely:—

1. Short title and commencement.— (1) These regulations may be called the Mormugao Port Trust Stevedoring and Shore Handling Regulations, 2021.

(2) These regulations shall come into force on the date of their publication in the Official Gazette.

2. Definitions.— (1) In these regulations, unless

the context otherwise requires,—

(a) "Act" means the Major Port Trusts Act,

1963 (38 of 1963);

(b) "Agent" means a person to whom stevedoring and shore handling licence has been issued under regulation 4;

(d) "Chairman" means Chairman of the Board.

(e) "Form" means forms annexed to these

regulations;

(f) "License" means a stevedoring and shore

handling license issued under regulation 4.

(g) "Licensee" shall mean a person to whom a stevedoring and shore handling license has been issued under these regulations;

(h) "Licensing Authority" means the

Chairman of the Port;

(i) "Port" means the Mormugao Port;

(j) "Port Trust" means the Mormugao Port

Trust;

(k) "Royalty" means the amount fixed by Mormugao Port Trust which is payable by the stevedoring and shore handling agent to the Mormugao Port Trust from the revenue receivable (based on the tariffs fixed by Tariff Authority for Major Ports) by them for rendering stevedoring or shore handling services to their principals;

(l) "Shore Handling" includes arranging and receiving the cargo to or from the hook point, inter modal transport from wharf to stack-yard and vice-versa and also receiving and delivering of a cargo from or to sea, railways, waterways or roadways;

(m) "Stevedore" is an agent authorised under these regulations for loading and unloading and stowage of cargo in any form on the board;

(n) "Stevedoring" includes loading, unloading and stowage of cargo in any form on board the vessel;

(o) "Stevedoring and Shore Handling Agent" means a person who has been issued license to carry out stevedoring and shore handling activities under regulation 4;

(p) "Tariff Authority " means the Tariff Authority for Major Ports constituted under section 47A of the Act;

(q) "Traffic Manager" means the Officer in charge of the Traffic Department of the Mormugao Port Trust and includes his deputies or assistants or any other officer acting under his authority;

(2) Words and expressions used herein and not defined but defined in the Act shall have the same meaning as assigned to them in the Act.

3. Application.— These regulations shall apply to

the following activities, namely:—

(a) Stevedoring and shore handling activities undertaken by the licensed stevedore and shore handling agent in the Mormugao port;

(b) The stevedoring and shore handling activities both on the board and the shore undertaken by the licensed stevedore and shore handling agent in the Mormugao port by using partly or fully port's labour or otherwise:

Provided that these regulations shall not apply to the stevedoring and shore handling activities by the Port, Public Private Partnership projects, Build, Operate and Transfer berth operations/ agreements or such other agreements as have been entered into by the Board.

4. Licensing of stevedoring and shore handling agent.— (1) Any eligible person fulfils the eligibility criteria can apply for license at any time in the format available on the website of the Board or in writing to the Chairman in Form-A, alongwith the documents specified therein and a fee of rupees fifty thousand or such higher fee, as the Board may fix, from time to time.

(2) The stevedoring and shore handling license shall be issued by the port to the applicant subject to fulfillment of following criteria:

(i) applicant is an eligible person registered as a company under the Company 's Act or a107 OFFICIAL GAZETTE — GOVT. OF GOA SERIES I No. 4 22ND APRIL, 2021 Partnership Firm or registered as any other legal entity;

(ii) applicant deposits security amount of atleast rupees five lakhs to meet any contingency which shall be refunded without interest after adjusting the claims, if any, when the licensee ceases to operate;

(iii) applicant submits an undertaking to provide equipment or gear required for both the operations as specified by the port trust board;

(iv) applicant submits an undertaking to employ atleast six supervisory personnel with minimum two years of cargo handling or stowage experience for undertaking both the operations and their profiles shall be enclosed alongwith the application; and

(v) applicant submits an undertaking to the effect that they undertake to pay all charges on behalf of their principals payable to the Port.

(3) No person to undertake stevedoring or shore handling activities without licence – No person shall undertake to perform the stevedoring and shore handling activities in the port unless he has been issued a valid licence under these regulations;

Provided that a person to whom licence has been issued prior to coming into the force of these regulations, may continue to operate under the existing licence for a period of sixty (60) days or till he obtains a licence under these regulations, whichever is earlier after fulfilling additional requirements, if any, to be satisfied based on these new regulations.

5. Licensing Authority.— Chairman shall be the

licensing authority under these regulations.

6. License Fees.— The fee for issue of license shall be rupees fifty thousand only excluding taxes for a period of three years which may be revised

from time to time by the port trust board.

7. Stevedoring and Shore Handling Charges.— (1) Tariff authority for major ports shall notify the

normative tariff for stevedoring and shore handling activities, separately for mechanized and manual operations based on a set of guidelines to be issued

to tariff authority for major ports. This tariff shall be ceiling tariff. In case of any change in the role for tariff authority for major ports in future, board of mormugao port shall fix and notify the rates based on the performance norms enforced in mormugao port as per performance norm policy guidelines.

(2) All port customers will be notified on the ceiling tariff set for stevedoring and shore handling activities and the tariff will be mandatorily displayed on the mormugao port website. No agent shall charge tariff exceeding the ceilings rates notified by the tariff authority.

(3) The traffic manager shall be the nodal officer responsible for monitoring of stevedoring and shore handling tariff and the traffic manager will be responsible for handling all complaints on violation of stevedoring and shore handling ceiling tariff.

(4) Mormugao port trust shall charge a royalty for the stevedoring and shore handling. Mormugao port shall fix a per metric tonne royalty rate from all agents based on the rates as per scale of rates and no discrimination will be made among the stevedoring and shore handling agents on the royalty license fee.

8. Payment of Royalty.— (1) The Board shall, in respect of the licence issued by it, charge a royalty as the licence fee on per ton basis fixed by the Board and no discrimination shall be made in charging such royalty for the same type and quantity of cargo handled by the agents.

(2) Every agent shall be liable to pay royalty in advance, prior to calling of vessel, on the basis of import general manifest quantity, in case of import and on the basis of the quantity declared by the vessel's agent or exporter or export general manifest, in case of export and the actual royalty payable shall be calculated after completion of the vessel's operation based on the total quantum of cargo handled by the agent.

(3) The difference in amount of royalty, if any, shall be payable within ten days from the date of raising of the bill and in case of delay in payment of royalty, interest shall be payable as specified in the scale of rates of the port;

(4) The Board may consider the waiver of royalty

in following circumstances, namely;—

(a) cargo handled by the agents during the period of strike called by the registered cargo handling workers of the port;

(b) relief cargo handled during the natural

calamities

emergencies and war like situations

(d) if such direction is issued by the

Government.

9. Change in Name, Constitution, etc. to be communicated.— (i) Any company registered under the Companies Act, 2013 (18 of 2013) or a Partnership firm or any other legal entity holding a stevedoring license shall immediately communicate

to the Chairman about any change of the director, managing director or partner as the case may be, with a copy of the document in support of such

change.

(ii) Any change in the name, title or constitution

of a firm or company holding a stevedoring license

shall be communicated to the Chairman forthwith

and the firm or company undergoing such a change

shall submit a fresh application for the grant of a

license, provided that the Chairman may at his

discretion allow such a firm or company to carry on

business till such time a decision is taken on such

fresh application and the fresh license required to

be issued in such cases will however attract the

same charges as are payable for the issue of a new

license.

10. Validity/Renewal of License.— (i) The license

will be valid for a period of three financial years

from the date of issuance of the license.

(ii) An eligible person shall be issued stevedoring

license, shore handling license or both, and

exception, if any, shall be with the approval of the

board on credible justifications.

(iii) The daily performance report capturing

productivity achieved by the stevedoring agent in

the prescribed format shall be submitted by the

stevedoring and shore handling agent to the traffic

department online. The Chairman of the port trust,

traffic manager or the officer acting on his behalf

will review the performance of stevedoring and shore

handling agent every month.

(iv) Compliance of terms and conditions of the

license issued to the agents, safety norms followed

by the agents will be monitored by Traffic Manager and a report shall be submitted to the Chairman.

(v) If the traffic manager finds any default on the part of stevedoring and shore handling agent, he shall cause to issue warning in the event of first default and in the event of second default, the

license of the stevedoring and shore handling agent shall be liable to be cancelled, apart from levying penalties.

(vi) At the end of three years, the license shall be renewed strictly on the basis of above mentioned performance reports.

(vii) The application for renewal of license shall be submitted in Form-A, at least three months prior to expiry of license alongwith the requisite fee/late

fees. Before renewal of the license a report shall be obtained from the Inspector appointed under the Dock Workers or Safety Health and Welfare Act,

1986 (54 of 1986) in respect of compliance with the safety norms as per the statute and the same shall be taken into consideration for granting renewal.

(viii) If the application for renewal is not received within the stipulated period of three months, such applications may be accepted by the traffic

manager, upon payment of rupees five thousand only excluding taxes, to the port, provided that the application for renewal together with the late fee

is received by the traffic manager before the actual date of the expiry of the license.

(ix) Before issue of renewal of licenses, a report regarding the safety performance and compliance of dock safety statutes shall be obtained from the 'Inspector' declared under the Dock Workers (Safety, Health and Welfare) Act, 1986 (54 of 1986) which shall be taken into consideration while granting the renewal of the license. If the stevedore and shore handling agent fulfils the required conditions and is eligible for renewal but awaiting safety clearance or any other clearances before expiry of the license period, port will permit the stevedoring operation by executing an indemnity bond (Form D - indemnity bond) and retention of the security deposit during such period when the renewal application is under process.

(x) All the unexpired licensees, undertaking stevedoring and shore handling activity in Mormugao Port issued license earlier under the erstwhile repealed regulations shall apply afresh109 OFFICIAL GAZETTE — GOVT. OF GOA SERIES I No. 4 22ND APRIL, 2021 under these regulations, if not the same shall be terminated after giving due notice in writing and migration to the new scheme shall be subject to fulfillment of all the provisions of these regulations.

(xi) The application for grant or renewal of stevedoring license shall be made in Form "A" to the Chairman.

(xii) Every license granted or renewed under

these regulations shall be in Form "B".

(xiii) In the event of loss or defacing of the original license, a duplicate license may be obtained on an application made to the traffic manager on payment of rupees two thousand only, excluding taxes in Form "C"- duplicate license.

11. Duties and Responsibilities of Stevedores.— Stevedores or shore handling agent, as the case may be, shall perform the following duties, namely:—

(i) comply with applicable safety norms and labour laws specified under any law for the time being in forcein relation to his activity;

(ii) indemnify the board against all third party claims arising out of such operations (Form D- indemnity bond);

(iii) be solely responsible for any accident or damage resulting either out of negligence, from the use of defective gear or for any other reasons or actions;

(iv) ensure that the casual workers deployed by him are covered by the insurance policy and such other benefits under applicable law;

(v) liable to settle claims as per the Employees' Compensation Act, 1923 (8 of 1923) in case of any accident;

(vi) liable to pay scheduled charges, as per the Scale of Rates in force, to the port in advance;

(vii) employ duly tested adequate equipment or gear, either owned or hired, and deploy adequate supervisory personnel for each vessel;

(viii) ensure that all the amounts due to the

board are paid on the appointed dates;

(ix) comply with such instructions as may be issued from time to time by the traffic manager or any officer acting on his behalf, in the interest of safety, operational requirement, improved

productivity, labour discipline or such related matters;

(x) shall compensate the board for any loss or damage caused to any gear, plant or other property of the board in the course of stevedoring and shore handling operation;

(xi) if any gear, plant and/or other property of the Board is damaged in the course of operations, stevedores or shore handling agent shall

compensate the Board for such loss or damage; the extent of which shall be decided by the Chairman after carrying out proper enquiry;

(xii) ensure compliance with the terms and

conditions of license;

(xiii) achieve the performance norms fixed by

the port trust;

(xiv) get the tariff along with break up

approved by the port trust and up load on its

website.

(xv) submit promptly any information sought

for by the traffic manager or any officer acting

under his authority.

(xvi) shall take effective steps to improve the

performance and submit the daily performance

report to the traffic department;

(xvii) shall provide the workers necessary

protective safety appliances appropriate for the

type of cargo.

12. Cancellation or suspension of license.— (1) The

port may at any time suspend or cancel the license

issued to a stevedore or shore handling agent for

violation of any of the following grounds, namely:—

(i) the performance norms specified by the

port trusthas not been achieved for an average

over a period of three months;

(ii) charges higher tariff than the tariff

approved by the port trust;

(iii) has been convicted by the Court of any

offence involving moral turpitude and sentenced

imprisonment for not less than six months;

(iv) contravened safety regulations and failure

comply with mandatory dock safety measures;

(v) failed to adopt proper and safe handling

methods;

(vi) misrepresentation or misstatement of

material facts;

(vii) has been adjudged insolvent or under

liquidations;

(viii) transfer or sub-contracting of the stevedoring operations or activities to any other individual or parties;

(ix) failed to comply with security rules, instructions or International Ship and Port Facility Security code;

(x) guilty of misconduct which in the opinion of the Chairman warrants cancellation or suspension of license;

(xi) indulged in illegal or corrupt practices;

(xii) causes obstruction to any work in the port or compromised safety of port or any illegal or malicious acts;

(xiii) for non-compliance of any direction given by the traffic manager or an officer acting on his behalf;

(xiv) has failed to submit daily performance report or any other information sought by the Traffic Manager or an officer acting on his behalf;

(xv) for contravention and/or violation of any

law for the time being in force;

(xvi) Non payment of dues payable to the Port either by the stevedore or shore handling agent or the principal who he is representing for the transactions with the Port:

Provided that no such license shall be cancelled or suspended as the case may be until the holder of the license has been given a reasonable opportunity for showing cause why his license should not be cancelled or suspended as the case may be.

(2) An order of suspension or cancellation of license shall be communicated in writing within a period of thirty days from the date of order.

13. Appeal.— (i) Any person aggrieved by any order relating to cancellation or suspension or refusal to issue license, under these regulations, may prefer an appeal in writing to the Central Government or any other appropriate higher authority as the case may be within thirty days of the communication of the order appealed against.

(ii) The Central Governmentor any such authority as the case may be shall pass such order on the appeal as it deems fit after giving an opportunity of being heard to the appellant.

14. Refund of security deposit.— The security deposit is liable to be refunded to the agent, after making adjustments of the claims of the Board, if any, in the following circumstances, namely:—

(a) on the expiry of the period of licence and

no application has been made for renewal;

(b) on the refusal of the application for renewal

of license;

(d) if the agent desires to foreclose the licence issued to him and makes an application in writing to the Chairman for foreclosure and refund of security deposit.

15. Deployment of Workers from Port or Dock Labour Board or License Holder or Outside.— (1) Stevedore and shore handling agent shall deploy port labour for carrying out his activities.

(2) In case the port trust is unable to supply the requisite workers against the requisition placed by stevedore and shore handling agent, the port may allow the stevedore and the shore handling agent to make their own arrangement for this purpose:

Provided that no notional booking or levying of charges should be made and agents shall not be levied any charges for labour, in case the port trust does not supply the labour.

16. Performance Norms.— (i) The Board shall from time to time specify the performance standards to be followed by the agents for carrying out stevedoring and shore handling activities in the port.

(ii) The Board may, for the purpose of encouraging compliance with the performance standards specified by it, fix incentives for the agents and specify penalty for non-performance and may publish quarterly summary of performance achieved by the agents on its website.

(iii) Daily performance report in the prescribed format (Form – E) shall be submitted by the stevedoring and shore handling agent to the traffic department online. Performance of the agent in terms of productivity achieved will be reviewed by the port Traffic Manager or any other officer acting under his authority every month. The monthly performance summary capturing productivity achieved by the respective agents will be published on the Port website to ensure transparency to the customers.

(iv) Licenses of agents failing to meet productivity norms for an average over a period of three months can be revoked by the port trust.

(v) In case of dry bulk cargo, the norms fixed by port trust under the berthing policy for dry bulk cargo for Major Ports, 2016 shall be the performance norms for the purpose of these regulations also.

(vi) In respect of other cargo, not covered under the berthing policy for dry bulk cargo for Major Ports, 2016, including break-bulk and container the performance norms will be those fixed by port trust for the purpose of these regulations.

(vi) The stevedoring and shore handling agent will also be liable to performance based penalty and incentives in accordance with the berthing policy for dry bulk cargo for Major Ports, 2016 as will be adopted by port trust from time to time with the approval of Tariff Authority for Major Ports or any other Competent Authority.

17. Training, Use of Modern Technology.— The personnel deployed in stevedoring and shore handling activities shall be trained in modern methods of cargo handling for improving the productivity, efficiency and safety.

18. Miscellaneous.— (i) The Traffic Manager may issue, from time to time, such appropriate operational guidelines or instructions or such other directions as is required for the smooth implementation and execution of these regulations; after obtaining the approval of the deputy chairman.

(ii) The forms required for grant or renewal of stevedoring license under these regulations shall be such as may be prescribed from time to time.

19. Interpretation.— If any question arises as to the interpretation of these regulations or in respect of any matter not hereinabove or subsequently provided for, the same shall be decided by the Board.

20. Repeal and savings.— The Mormugao Port Trust (Licensing of Stevedores) Regulations, 2010 and the procedures, practices and customs corresponding to these regulations and in force immediately before the commencement of these regulations are hereby repealed:

Provided that any order made or action taken under the regulations, procedure, practices and customs so repealed shall be deemed to have been made or taken under the corresponding provisions of these regulations.

Whereas the Indemnifier has applied for grant/renewal of stevedoring and shore handling licence to the traffic manager/Mormugao Port Trust under regulation 9(xi) of the Mormugao Port Trust (Stevedoring and Shore Handling) Regulations, 2021 and under the said regulations the indemnifier is lawfully required to perform his obligations set out under the said regulations and any violations or non-performance or mis- performance or wrong performance thereof entails or makes liable for indemnifying all such demands, losses, damages, costs, charges, expenses, suits or proceedings caused or suffered by the indemnified arising directly or indirectly during the course of or anytime the vessel is within the port limits or otherwise in any such situation or in the eventuality whereby the indemnified suffers financially or otherwise on account of the indemnifier due to third party claim or any such loss sustained in the course of licensing period or otherwise.

And whereas the indemnifier hereby agrees and accepts by this indemnity bond unconditionally to indemnify the Board of Trustees of the Port of Mormugao to pay without raising any objection all such claims, demands, losses or damages, costs, charges, expenses, suits or proceedings caused to or suffered by or would be caused to or suffered by the indemnified whatsoever arising directly or indirectly during the course of or anytime during the subsistence of the said licence or after the expiry of the said licence.

And 'the indemnifier' hereby agree/s with the "the indemnified" that this indemnity bond shall be unconditional and remain valid and irrevocable until the license of the indemnifier is in force, including the period during which the application for renewal of licence is being processed and until such more time the payments are made and the claims are settled in favour of the Board of Trustees of the Port of Mormugao.

(cid:7)(cid:3) प(cid:28)रभाषा--(cid:1)(1) इन (cid:19)व(cid:30)नयम6 म= जब तक संदभC म= अ(cid:13)यथाअपेONत न हो --(cid:1)

(क) "अ+ध(cid:30)नयम" का अथC महाप(cid:10)तन (cid:13)यास अ+ध(cid:30)नयम (1963 क2 (cid:8)(cid:9)) है।(cid:1)

(ख)(cid:1) "एजेणट" अथाCत वहXयि5त िज(cid:13)ह= (cid:19)व(cid:30)नयम (cid:4) के तहत (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग लाइस=स जार(cid:18) Dकया गया है । (cid:1)

(ग) "मंडल" का अथCअ+ध(cid:30)नयम के अंतगCत ग#ठत मुरगांव प(cid:10)तन (cid:13)यास का (cid:13)यासी मंडल है। (cid:1)

(घ) "अMयN" का अथC मंडल का अMयN है।(cid:1)

(ड) "फामC" का अथCहै इन (cid:19)व(cid:30)नयम6 के साथ संलBन फामC।

(च) "लाइस=स" का अथC है (cid:19)व(cid:30)नयम-(cid:4) के तहत जार(cid:18) (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोरहै(cid:27)ड(cid:28)लंगलाइस=स । (cid:1)

(छ) "लाइस=सधार(cid:18)" वह Xयि5त है िज(cid:13)ह= इन (cid:30)नयम6 के तहत (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोरहै(cid:27)ड(cid:28)लंग लाइस=सजार(cid:18) Dकया गया है।(cid:1)

(ण) "(cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग" म= जहाज पर Dकसी भी (कार के नौभार का भारण, तथा (cid:16)टोवेज शा(cid:28)मलहै। (cid:1)

(त) "(cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एजे(cid:27)ट" वह Xयि5त है िज(cid:13)ह= (cid:19)व(cid:30)नयम-4 के तहत (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोरहै(cid:27)ड(cid:28)लंग D>याकलाप (cid:30)नfपा#दत करने के (cid:28)लए लाइस=स जार(cid:18) Dकयागया है। (cid:1)

(थ) "(शु^क (ा*धकार(cid:18)" का अथC है अ*ध(cid:30)नयम क2 धारा 47 ए के तहत ग#ठत महाप(cid:10)तन(शु^क (ा*धकार(cid:18)। (cid:1)

(द) "यातायात (बंधक" का अथC मुरगांव प(cid:10)तन (cid:13)यास के यातायात (cid:19)वभाग के (भार(cid:18)अ*धकार(cid:18) से है और इसम= उनके डी`यु#टज या सहायक या उनके अ*धकार म= कायC करनेवाले कोई अ(cid:13)य अ*धकार(cid:18) शा(cid:28)मल है। (cid:1)

(cid:22)ट(cid:24)वीडो(cid:28)रंग तथा शोर है!ड"लंग एजे!ट7 का लाइस:"संग :-(cid:1) (cid:4)1(cid:7)(cid:1) कोई भी पाV Xयि5त जो पाVता मानद(cid:27)ड6 को पूरा करते है, वे लाइस=स के (cid:28)लए Dकसी भी समय मंडल क2 वेबसाईट पर उपलiध फॉरमेट अथवा फॉमC-क म= अMयN को (cid:28)लQखत म= आवेदन कर सकते है िजसके साथ (cid:30)न#दCfट द(cid:16)तावेज तथा पचास हजार का शु^क अथवा अ*धक शु^क, जो मंडल 3वारा समय- समय पर (cid:30)नधाC(cid:22)रतDकया हो, ((cid:16)तुत करना होगा। (cid:1)

(cid:5)(cid:3)(cid:7) आवेदक को प(cid:10)तन 3वारा (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग लाइस=स तभी जार(cid:18) Dकया जाएगा य#द वे (cid:30)नPन(cid:28)लQखत मानद(cid:27)ड6 को पूरा करते हp :- (cid:1)

(cid:6)(cid:6)(cid:6)(cid:7) आवेदक वचन देता है Dक प(cid:10)तन (cid:13)यास मंडल 3वारा (cid:30)न#दCfट Dकए अनुसार दोन6 )चालन6 के (cid:28)लए आवtयक उपकरण/+गयर क2 Xयव(cid:16)था करेगा ;(cid:1)

(cid:6)(cid:10)(cid:7) आवेदक यह भी वचन देता है Dक वह कम से कम छह पयCवेNक2य का(cid:28)मCक6 को (cid:30)नयोिजत करेगा िज(cid:13)ह= दोन6 कायC करने के (cid:28)लए नौभार संभलाई अथवा (cid:16)टोवेज म= (cid:13)यूनतम दो वषu का अनुभव हो। आवेदन के साथ उ(cid:13)ह= अपना (cid:19)ववरण संलBन करना होगा ;(cid:1)

(cid:10)(cid:7) आवेदक यह भी वचन देता है Dक वे उनके )मुख6 क2 ओरसे प(cid:10)तन को देय सभी )भार6 का भुगतान कर=गे। (cid:1)

3) कोई भी Xयि5त लाइस=स के lबना प(cid:10)तन म= (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग ग(cid:30)त(cid:19)व+धयां शुv नह(cid:18)ं करेगा-- जब तक Dकसी Xयि5त को इन (cid:19)व(cid:30)नयम6 के तहत वैध लाइस=स जार(cid:18) नह(cid:18)ं Dकया जाता है तब तक वह प(cid:10)तन म= कोई भी (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग ग(cid:30)त(cid:19)व+धयां शुv नह(cid:18)ं करेगा।(cid:1)

बशतw Dक वह Xयि5त िज(cid:13)ह= यह (cid:19)व(cid:30)नयम लागू होने से पूवC लाइस=स जार(cid:18) Dकया गया है, वह मौजूदा लाइस=स के अधीन साठ (60) #दन6 क2 अव+ध के (cid:28)लए अथवा इन (cid:30)नयम6 के तहत लाइस=स )ा`त करने तक, जो भी पहले हो, अ(cid:30)त(cid:22)र5त शतk, य#द कोई हो, िज(cid:13)ह= इस नए (cid:30)नयम6 के आधार पर पूरा Dकया जाना है, क2 पू(cid:30)तC करने पर )चालन जार(cid:18) रख सकता है।(cid:1)

5. लाइसे"संग -(cid:17)धकार(cid:24)—इन (cid:19)व(cid:30)नयम6 के तहत अMयN, लाइस=(cid:28)संग )+धकार(cid:18) ह6गे।(cid:1)

6. लाइस;स शु>क(cid:11)(cid:12)(cid:1) लाइस=स जार(cid:18) करने हेतु शु^क तीन वषu क2 अव+ध के (cid:28)लए कर र#हत qपए पचास हजार माV है जो प(cid:10)तन (cid:13)यास के मंडल 3वारा समय-समय पर संशो+धत Dकया जाएगा। (cid:1)

7. (cid:22)ट(cid:24)(cid:25)वडो(cid:28)रंग तथा शोर है!ड"लंग -भार(cid:1) (cid:8)(cid:9)(cid:1) (1) महाप(cid:10)तन )शु^क )ा+धकरण मैकनाइyड तथा मै(cid:13)युअल )चालन6 के (cid:28)लए अलग से महाप(cid:10)तन )शु^क )ा+धकरण को )(cid:16)तुत Dकए जानेवाले #दशा(cid:30)नदwश6 के आधार पर (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग(cid:1) D>याकलाप6 के (cid:28)लए सामा(cid:13)य )शु^क अ+धसू+चत करेगा। यह )शु^क अ+धकतम )शु^क होगा। भ(cid:19)वfय म= महाप(cid:10)तन )शु^क )ा+धकरण क2 भू(cid:28)मका म= य#द कोई प(cid:22)रवतCन होता है तो मुरगांव प(cid:10)तन मंडल (cid:30)नfपादन मानक नी(cid:30)त #दशा(cid:30)नदwश6 के अनुसार एमपीट(cid:18) म= लागू (cid:30)नfपादन-मानक6 के आधार पर दर6 को (cid:30)नयत कर अ+धसू+चत करेगा । (cid:1)

(4) (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग हेतु मुरगांव प(cid:10)तन (cid:13)यास राय^ट(cid:18) )भा(cid:22)रत करेगा। मुरगांव प(cid:10)तन, दरमान6 के आधार पर सभी एजे(cid:27)ट6 से )(cid:30)त मेa(cid:18)क टन रॉय^ट(cid:18) दर (cid:30)नयत करेगा और रॉय^ट(cid:18) लाइस=स शु^क के संबंध म= (cid:16)ट(cid:18)(cid:19)वडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एजे(cid:27)ट6 के बीच कोई पNपात नह(cid:18)ं Dकया जाएगा। (cid:1)

8. रॉय>ट(cid:24) का भुगतान – (1) मंडल, जार(cid:18) लाइस=स के संबंध म=, मंडल 3वारा (cid:30)नधाC(cid:22)रत )(cid:30)त टन के आधार पर लाइस=स शु^क के qप म= रॉय^ट(cid:18) वसूल करेगा और एज=ट6 3वारा संभलाए गए एक ह(cid:18) )कार के नौभार व माVा के (cid:28)लए ऐसी रॉय^ट(cid:18) )भा(cid:22)रत करने म= कोई पNपात नह(cid:18)ं Dकया जाएगा ।

(2) )(cid:10)येक एज=ट जहाज के कॉल से पहले आयात के मामले म= इंपोटC जनरल मे(cid:30)नफे (cid:16)ट 5वां#टट(cid:18) आधार पर और (cid:30)नयाCत के मामले म= जहाज के एज=ट या (cid:30)नयाCतक 3वारा घो(cid:19)षत माVा अथवा ए5सपोटC जनरल मे(cid:30)नफे (cid:16)ट के आधार पर अ+zम म= रॉय^ट(cid:18) का भुगतान करने के (cid:28)लएउ(cid:10)तरदायी होगा और देय वा(cid:16)त(cid:19)वक रॉय^ट(cid:18) क2 गणना एज=ट 3वारा संभलाई गई नौभार क2 कु ल माVा के आधार पर जांच )चालन पूरा होने के बाद क2 जाएगी ।

(3) रॉय^ट(cid:18) क2 रा(cid:28)श म= अंतर, य#द कोईहो, lबल क2 तार(cid:18)ख से 10 #दन6 के भीतर देय होगा और रॉय^ट(cid:18) के भुगतान म= देर(cid:18) के मामले म= iयाज पतन के दरमान6 म= (cid:30)न#दCfट Dकए अनुसार देय होगा; (4) मंडल (cid:30)नPन(cid:28)लQखत प(cid:22)रि(cid:16)थ(cid:30)तय6 म= रॉय^ट(cid:18) म= छू ट देने पर (cid:19)वचार कर सकता है, अथाCत;---

(क) पतन के पंजीकृ त नौभार संभलाई j(cid:28)मक6 3वारा क2 गई हड़ताल क2 अव+ध के दौरान एज=ट6 3वारा संभलाया गया नौभार;

(ख) )ाकृ (cid:30)तक आपदाओं के दौरान संभलाया गया राहत नौभार;

(ग) आपात ि(cid:16)थ(cid:30)तय6 और यु| जैसी ि(cid:16)थ(cid:30)तय6 के दौरान संभलाया गया रNा नौभार;

(घ) य#द सरकार 3वारा ऐसा कोई (cid:30)नदwश जार(cid:18) Dकया गया है ।

9. नाम गठन आCद म; प(cid:28)रवतEन को सू(cid:17)चत Fकया जाना:-

(i) कं पनी अ+ध(cid:30)नयम, 2013(2013 का 18) के तहत पंजीकृ त कोई कं पनी या पाटCनर(cid:28)शप फमC या कोई अ(cid:13)य (cid:19)व+धक अि(cid:16)त(cid:10)व िजनके पास (cid:16)ट(cid:18)वी}ड(cid:22)रंग लाइस=स है वे, (cid:30)नदेशक, )बंध (cid:30)नदेशक या पाटCनर, जैसी भी ि(cid:16)थ(cid:30)त है, म= प(cid:22)रवतCन के संबंध म= तुरंत अMयN को सू+चत कर=गे और साथ ह(cid:18) ऐसे प(cid:22)रवतCन के समथCन म= द(cid:16)तावेज क2 )(cid:30)त(cid:28)ल(cid:19)प भी )(cid:16)तुत कर=गे ।

(ii)(cid:16)ट(cid:18)वीडो(cid:22)रंगलाइस=सधार(cid:18) फमC या कं पनी के नाम, शीषCक या गठन म= कोई भी प(cid:22)रवतCन को शी~ अMयN को सू+चत Dकया जाना है तथा ऐसा फमC या कं पनी जो ऐसा प(cid:22)रवतCन करना चाहते है वे, लाइस=स के (cid:28)लए पुनः आवेदन )(cid:16)तुत कर=गे बशतw Dक अMयN अपने (cid:30)नणCय पर उस फमC या कं पनी को तब तक Xयवसाय जार(cid:18) रखने क2 अनुम(cid:30)त दे सकते हp120 OFFICIAL GAZETTE — GOVT. OF GOA SERIES I No. 4 22ND APRIL, 2021 जब तक पुनः )(cid:16)तुत आवेदन पर (cid:19)वचार नह(cid:18)ं Dकया जाता है और ऐसे मामले म= जार(cid:18) Dकए जानेवाले नए लाइस=स के )भार भी वह(cid:18) ह6गे जैसे नए लाइस=स के (cid:28)लए भुगतान Dकए जाते हp ।

10. लाइस;स कG वैधता / नवीनीकरण-- (i) यह लाइस=स, जार(cid:18) होने क2 तार(cid:18)ख से तीन (cid:19)व(cid:10)तीय वषu के (cid:28)लए वैध होगा ।

(ii) पाV Xयि5त को (cid:16)ट(cid:18)वीडो(cid:22)रंग लाइस=स, शोर है(cid:27)ड(cid:28)लंग लाइस=स, या दोन6 जार(cid:18) Dकया जाएगा और अपवाद, य#द कोई हो, तो इसे (cid:19)वtवसनीय औ+च(cid:10)य पर मंडल के अनुमोदन से जार(cid:18) Dकया जाएगा ।

(iii) (cid:16)ट(cid:18)वीडो(cid:22)रंग एज=ट 3वारा )ा`त उ(cid:10)पादकता दशाCनेवाला दै(cid:30)नक (cid:30)नfपादन (cid:22)रपोटC (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट (cid:30)नधाC(cid:22)रत )पV म= यातायात (cid:19)वभाग को ऑनलाइन )(cid:16)तुत करेगा । प(cid:10)तन (cid:13)यास के अMयN, यातायात )बंधक या उनक2 ओर से कायCकार(cid:18) अ+धकार(cid:18) )(cid:30)तमाह (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट के (cid:30)नfपादन का पुनर(cid:18)Nण कर=गे ।

(iv) एज=ट6 को जार(cid:18) लाइस=स क2 शतu का अनुपालन, एज=ट6 3वारा अपनाए जानेवाले सुरNा मानक6 का मा(cid:30)नट(cid:22)रंग यातायात )बंधक 3वारा Dकया जाएगा िजसक2 (cid:22)रपोटC अMयN को )(cid:16)तुत क2 जाएगी ।

(v) (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट क2 ओर सेयातायात )बंधक 3वारा,य#द कोई चूक पायी जाती है तो वे पहल(cid:18) चूक पर चेतावनी जार(cid:18) कर=गे और दूसर(cid:18) चूकपर (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट पर शाि(cid:16)त लगाने के अ(cid:30)त(cid:22)र5त उनका लाइस=स र€ Dकया जाएगा ।

(vi) 3 वषu क2 समाि`त पर लाइस=स को उपरो5त उि^लQखत (cid:30)नfपादन (cid:22)रपोटu के आधार पर नवीनीकृ त Dकया जाएगा ।

(viii) लाइस=स के नवीनीकरण हेतु आवेदन लाइस=स समाि`त से कम से कम 3 माह पहले अपेONत शु^क / (cid:19)वलंब शु^क स#हत फामC 'क' म= )(cid:16)तुत Dकया जाएगा । लाइस=स नवीनीकरण से पहले (cid:30)नयम6 के अनुसार सुरNा मानक6 के अनुपालन के संबंध म= गोद(cid:18) कामगार अथवा सुरNा (cid:16)वा(cid:16)(cid:129)य तथा क^याण अ+ध(cid:30)नयम, 1986 (1986 का 54) के तहत (cid:30)नयु5त (cid:30)नर(cid:18)Nक से (cid:22)रपोटC )ा`त क2 जाएगी िजसपर लाइस=स का नवीनीकरण करते समय (cid:19)वचार Dकया जाएगा ।

(vii) य#द नवीनीकरण हेतु आवेदन, तीन माह क2 (cid:30)नधाC(cid:22)रत अव+ध के भीतर )ा`त नह(cid:18)ं होता है तो ऐसे आवेदन प(cid:10)तन को कर स#हत v 5000/- माV का भुगतान कर, यातायात )बंधक 3वारा (cid:16)वीकार Dकए जा सकते हp बशतw Dक (cid:19)वलंब शु^क स#हत नवीनीकरण हेतु आवेदन, लाइस=स समाि`त क2 वा(cid:16)त(cid:19)वक तार(cid:18)ख से पूवC यातायात )बंधक को )ा`त होते हp ।

(ix) नवीकृ त लाइस=स जार(cid:18) करने से पूवC, सुरNा (cid:30)नfपादन तथा गोद(cid:18) सुरNा सं(cid:19)व+ध के अनुपालन क2 (cid:22)रपोटC गोद(cid:18) कामगार (सुरNा, (cid:16)वा(cid:16)(cid:129)य व क^याण) अ+ध(cid:30)नयम, 1986 (1986 का 54) के तहत घो(cid:19)षत "(cid:30)नर(cid:18)Nक" से )ा`त करनी होगी, िजसपर लाइस=स का नवीनीकरण करते समय (cid:19)वचार Dकया जाएगा । य#द (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट आवtयक शतu को पूरा करते हp और नवीनीकरण के (cid:28)लए पाV है Dकं तु लाइस=स अव+ध क2 समाि`त पूवC सुरNा (cid:30)नबाCधता या कोई अ(cid:13)य (cid:30)नबाCधता क2 )(cid:10)याशा म= है, तो प(cid:10)तन एक N(cid:30)तपू(cid:30)तC बंधपV ( फॉमC 'घ' N(cid:30)तपू(cid:30)तC बंधपV) (cid:30)नfपा#दत करते हुए तथा नवीनीकरण आवेदन )D>याधीन रहने के दौरान जमानती जमा का )(cid:30)तधारण करते हुए (cid:16)ट(cid:18)वीडो(cid:22)रंग )चालन क2 अनुम(cid:30)त देगा ।

(x) मुरगांव प(cid:10)तन म= (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग ग(cid:30)त(cid:19)व+धयां (cid:30)नfपा#दत करने हेतु,पूवC म= (cid:30)नर(cid:16)त Dकए गए (cid:30)नयम6 के तहतपहले जार(cid:18) सभी असमा`त लाइस=सधा(cid:22)रय6 को इन (cid:19)व(cid:30)नयम6 के तहत नए लाइस=स के (cid:28)लए आवेदन करना होगा । य#द ऐसा नह(cid:18)ं Dकया जाता है तो उ(cid:13)ह= (cid:28)लQखत म= योBय नो#टस देते हुए उनके लाइस=स को समा`त Dकया जाएगा और नई योजना म= अंतरण तभी अनुमत होगा जब इन (cid:19)व(cid:30)नयम6 के सभी )ावधान6 क2 पू(cid:30)तC क2 जाती है ।

(xi) (cid:16)ट(cid:18)वीडो(cid:22)रंग लाइस=स क2 मंजूर(cid:18) अथवा नवीकरण के (cid:28)लए फॉमC "क" म= अMयN को आवेदन )(cid:16)तुत करना होगा ।

(xii) इन (cid:19)व(cid:30)नयम6 के अंतगCत मंजूर या नवीनीकृ त )(cid:10)येक लाइस=स फॉमC "ख" म= होगा ।

(xiii) मूल लाइस=स गुम होने पर या खराब होने पर यातायात )बंधक को फॉमC 'ग' डयू`ल(cid:18)के ट लाइस=स म= आवेदन कर, कर र#हत v. 2000 माV का भुगतान करने पर लाइस=स क2 दूसर(cid:18) )(cid:30)त )ा`तक2 जा सकती है ।

11. (cid:22)ट(cid:24)वीडोसE के कतEIय तथा उ(cid:10)तरदा$य(cid:10)व :- (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट, जो भी मामला हो, (cid:30)नPन(cid:28)लQखत का अनुपालन कर=गे, यथा :-

(i) उनक2 ग(cid:30)त(cid:19)व+ध के संबंध म= उस समय के (cid:28)लए )भावी Dकसी भी (cid:30)नयम के तहत (cid:30)न#दCfट लागू सुरNा मानक6 और jम (cid:30)नयम6 का अनुपालन;

(ii) ऐसे )चालन6 से उ(cid:10)प(cid:13)न तीसरे पN के सभी दाव6 के (cid:28)लए मंडल को N(cid:30)तपू(cid:30)तC ; (फॉमC 'घ' N(cid:30)तपू(cid:30)तC बंधपV)

(iii) लापरवाह(cid:18), खराब +गयर के इ(cid:16)तेमाल अथवा Dकसी अ(cid:13)य कारणवश / कारCवाई के कारण भी Dकसी दुघCटना या N(cid:30)त के (cid:28)लए उ(cid:10)तरदायी ;

(iv) सु(cid:30)निtचत करेगा Dक उनके 3वारा (cid:30)नयोिजत कामगार6 को बीमा पॉ(cid:28)लसी तथा (cid:30)नयम6 के तहत यथा लागू ऐसे अ(cid:13)य सु(cid:19)वधाओं के तहत शा(cid:28)मल Dकया गया है ;

(v) Dकसी भी दुघCटना के मामले म= कमCचार(cid:18), N(cid:30)तपू(cid:30)तC अ+ध(cid:30)नयम, 1923 (1923 का 8) के अनुसार दावे का (cid:30)नपटान करने के (cid:28)लए िजPमेदार होगा ;

(vi) लागू दरमान6 के अनुसार प(cid:10)तन को (cid:30)नधाC(cid:22)रत )भार6 का अ+zम भुगतान करेगा;

(vii) )(cid:10)येक जहाज के (cid:28)लए पयाC`त उपकरण या +गयर, चाहे अपनी मालDकयत का हो या Dकराए पर (cid:28)लया गया हो, का (cid:19)व+धवत पर(cid:18)Nण करेगा और पयाC`त पयCवेNक2य क(cid:28)मCय6 को तैनात करेगा;

(viii) सु(cid:30)निtचत करेगा Dक मंडल को देय पूर(cid:18) रा(cid:28)श (cid:30)नयत तार(cid:18)ख को अदा क2 जाती है;

(ix) सुरNा )चालन आवtयकता, उ(cid:13)नत उ(cid:10)पादकता, jम अनुशासनक2 'िfट सेया ऐसे संबं+धत मामल6 म= यातायात )बंधक अथवा उनक2 ओर से कोई भी कायCकार(cid:18) अ+धकार(cid:18) 3वारा समय-समय पर जार(cid:18) ऐसे अनुदेश6 का अनुपालन करेगा ;

(x) (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग )चालन के दौरान य#द मंडल के Dकसी भी +गयर, संयंV या Dकसी अ(cid:13)य संपि(cid:10)त ंचती है तो मंडल को N(cid:30)तपू(cid:30)तC करेगा;

OF GOA SERIES I No. 4 22ND APRIL, 2021 ंचती है तो (xi) )चालन के दौरान य#द मंडल के Dकसी भी +गयर, संयंV तथा/या Dकसी अ(cid:13)य संपि(cid:10)त को हा(cid:30)न पहु (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट ऐसी हा(cid:30)न या N(cid:30)त के (cid:28)लए अƒछ„ जांच पड़ताल करने उपरांत अMयN के (cid:30)नणCय पर, मंडल को N(cid:30)तपू(cid:22)रत करेगा ;

(xii) लाइस=स क2 शतu का अनुपालन सु(cid:30)निtचत करेगा ;

(xiii) प(cid:10)तन (cid:13)यास 3वारा (cid:30)नयत कायC(cid:30)नfपादन मानक6 को हा(cid:28)सल करेगा;

(xiv) …ेक-अप स#हत )शु^क को प(cid:10)तन 3वारा अनुमो#दत करवाकर अपनी वेबसाइट पर अपलोड करेगा;

(xv) यातायात )बंधक अथवा उनक2 ओर से कोई भी कायCकार(cid:18) अ+धकार(cid:18) 3वारा मांगी गई कोई भी जानकार(cid:18) तुरंत )(cid:16)तुत करेगा ;

(xvi) (cid:30)नfपादन म= सुधार करने हेतु )भावी क़दम उठाएगा और )(cid:30)त#दन (cid:30)नfपादन (cid:22)रपोटC यातायत (cid:19)वभाग को )(cid:16)तुत करेगा ;

(xvii) नौभार के )कार के अनुसार कामगार6 को आवtयक सुरNा उपकरण )दान करेगा ।

12. लाइस;स को रK या (cid:22)थ(cid:17)गत करना :- (1) पतन, नीचे उि^लQखत Dकसी का उ^लंघन करने पर (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट को लाइस=स Dकसी भी समय (cid:16)थ+गत या र€ कर सकता है :-

(i) औसतन तीन म#हन6 से अ+धक अव+ध के (cid:28)लए प(cid:10)तन (cid:13)यास 3वारा (cid:30)न#दCfट (cid:30)नfपादन मानक6को )ा`त नह(cid:18)ं करते हp;

(ii) प(cid:10)तन (cid:13)यास 3वारा अनुमो#दत )शु^क से अ+धक )शु^क )भा(cid:22)रत करते हp;

(iii) नै(cid:30)तक अधमतावाला कोई भी अपराध (cid:13)यायालय 3वारा (cid:28)स| हुआ है और अ+धकतम छह माह क2 सजा हुई है;

(iv) सुरNा (cid:19)व(cid:30)नयम6 का उ^लंघन तथा अ+धदेशा(cid:10)मक गोद(cid:18) सुरNा उपाय6 का गैर अनुपालन Dकया है ;

(v) उ+चत तथा सुरONत संभलाई प|(cid:30)तय6 को नह(cid:18)ं अपनाता है;

(vi) वा(cid:16)त(cid:19)वक त(cid:129)य6 को अयथाथC qप से )(cid:16)तुत करना या अनु+चत qप से बताना;

(vii) #दवा(cid:28)लया (cid:28)स| हुआ है अथवा प(cid:22)रसमापन अधीन है;

(viii) (cid:16)ट(cid:18)वीडो(cid:22)रंग )चालन या ग(cid:30)त(cid:19)व+धयां Dकसी अ(cid:13)य Xयि5त या पा#टCय6 को ह(cid:16)तांत(cid:22)रत करना या उप-ठे के पर देना;

(ix) सुरNा (cid:30)नयम, अनुदेश या अंतराCfa(cid:18)य जहाज तथा प(cid:10)तन सु(cid:19)वधा सुरNा सं#हता का अनुपालन न करना;

(x) ऐसे Dकसी भी कदाचार का दोषी है, िजसके (cid:28)लए अMयN के (cid:19)वचार से लाइस=स र€ या (cid:16)थ+गत Dकया जा सकता है ;

(xi) अवैध या ‡fट Xयवहार करता हो ;

(xii) प(cid:10)तन के Dकसी भी कायC म= vकावट पैदा करता है या पतन क2 सुरNा या Dकसी अवैध या (cid:19)व3वेfपूणC Xयवहार के साथ समझौता Dकया है ;

(xiii) यातायात )बंधकया उनक2 ओर से कायCकार(cid:18) अ+धकार(cid:18) 3वारा #दए Dकसी भी (cid:30)नदेश6 का अनुपालन न करना;

(xiv) )(cid:30)त#दन (cid:30)नfपादन (cid:22)रपोटC अथवा यातायात )बंधक या उनक2 ओर से कायCकार(cid:18) अ+धकार(cid:18) 3वारा मांगी गई कोई भी जानकार(cid:18) )(cid:16)तुत नह(cid:18)ं क2 गई है;

(xv) उस समय के (cid:28)लए लागू Dकसी भी कानून क2 अवहेलना तथा/या उ^लंघन Dकए जाने पर;

(xvi) (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट या )मुख, जो पतन के साथ संXयवहार का )(cid:30)त(cid:30)न+ध(cid:10)व करता है, 3वारा पतन को देय रा(cid:28)श का भुगतान न करने पर ;

उपबं+धत है Dक ऐसा कोई भी लाइस=स तब तक र€ या (cid:16)थ+गत नह(cid:18)ं Dकया जाएगा जब तक Dक लाइस=सधार(cid:18) को यह कारण बताने का पयाC`त अवसर नह(cid:18)ं #दया जाता है Dक उनका लाइस=स र€ या (cid:16)थ+गत, जैसी भी ि(cid:16)थ(cid:30)त हो, 5य6 नह(cid:18)ं Dकया जाए ।

(2) लाइस=स के (cid:16)थगन/(cid:30)नरसन का आदेश, आदेश क2 तार(cid:18)ख से 30 #दन6 क2 अव+ध के भीतर, (cid:28)लQखत म= सू+चत Dकया जाएगा ।

13. अपील:- (i) लाइस=स को र€ अथवा (cid:16)थ+गत अथवा जार(cid:18) करने से इनकार करने संबंधी Dकसी आदेश से,य#द कोई Xयि5तz(cid:28)सत होता है तो उस आदेश, िजसके (cid:19)वv| अपील क2 जा रह(cid:18) है, क2 )ाि`त के 30 #दन6 के भीतर क= @ सरकार या Dकसी अ(cid:13)य उƒच )ा+धकार(cid:18), जैसी भी ि(cid:16)थ(cid:30)त हो, को (cid:28)लQखत म= अपील कर सकता है ।

(ii) क= @ सरकार या ऐसी अ(cid:13)य )ा+धकार(cid:18), जैसी भी ि(cid:16)थ(cid:30)त हो, अपीलकताC को सुनने का अवसर देने उपरांत अपील पर यथो+चत आदेश दे सकता है ।

14. जमानती जमा कG वापसी :- जमानती जमा को, मंडल के दावे, य#द कोई हो, के समायोजन के बाद, एज=ट को (cid:30)नPन प(cid:22)रि(cid:16)थ(cid:30)तय6 म= वापस करनी होगी, अथाCत :-

(क) लाइस=स क2 अव+ध समा`त हुई है और नवीकरण के (cid:28)लए कोई आवेदन नह(cid:18)ं Dकया गया है;

(ख) लाइस=स के नवीनीकरण के (cid:28)लए आवेदन करने से इंकार करने पर;

(ग) लाइस=स र€ करने पर ; तथा

(घ) य#द एज=ट उसे जार(cid:18) Dकए गए लाइस=स को समा`त करना चाहता है तथा इसे समा`त करने और जमानती जमा वापस करने हेतु अMयN को (cid:28)लQखत qप म= आवेदन करता है ।

15. पतन अथवा गोद(cid:24) Lम मंडल अथवा लाइस;सधार(cid:24) या बाहर से कामगार8 कG तैनाती:- (1) (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट अपने कायCकलाप6 के (cid:28)लए प(cid:10)तन j(cid:28)मक6 को तैनात कर=गे ।

(2) य#द प(cid:10)तन (cid:13)यास (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग एज=ट6 क2 आवtयकतानुसार कामगार6 क2 आपू(cid:30)तC नह(cid:18)ं कर सकता है तो प(cid:10)तन, इस )योजन के (cid:28)लए (cid:16)ट(cid:18)वीडो(cid:22)रंग तथा शोर है(cid:27)ड(cid:28)लंग को अपनी Xयव(cid:16)था (cid:16)वयं करने क2 अनुम(cid:30)त दे सकता है ।

(iv) एज=ट जो औसतन 3 माह से अ+धक अव+ध के (cid:28)लए उ(cid:10)पादकता मानक पूरा नह(cid:18)ं कर पाता है तो उनका लाइस=स प(cid:10)तन (cid:13)यास 3वारा र€ Dकया जा सकता है ।

(v) शुfक ब^क नौभार के मामले म= शुfक ब^क नौभार हेतुमहाप(cid:10)तन 2016 क2 ब+थ‰ग नी(cid:30)त के अंतगCत प(cid:10)तन (cid:13)यास 3वारा (cid:30)नयत मानक इन (cid:19)व(cid:30)नयम6 के )योजनाथC भी (cid:30)नfपादन मानक ह6ग= ।

18. (cid:25)व(cid:25)वध :- (i) यातायात )बंधक उपाMयN का अनुमोदन )ा`त करने के पtचात समय-समय पर ऐसे उ+चत )चालन #दशा(cid:30)नदwश या अनुदेश या ऐसे अ(cid:13)य (cid:30)नदेश जार(cid:18) कर सकता है जो इन के (cid:19)व(cid:30)नयम6 के सुचाv कायाC(cid:13)वयन तथा (cid:30)नfपादन के (cid:28)लए आवtयक है ।
