In exercise of the powers conferred by section 64 of the Water (Prevention and Control of Pollution) Act, 1974 (Central Act 6 of 1974), the Government of Goa hereby makes the following rules, so as to amend the Goa Water (Prevention and Control of Pollution) Rules, 2021, namely:—

1. Short title and commencement.— (1)

These rules may be called the Goa Water

(Prevention and Control of Pollution)

(Amendment) Rules, 2022;

(2) They shall come into force at once.

2. Amendment of rule 25.— (i) Amendment

of rule 25 (l) (n),— In the Goa Water Rules,

2021 (hereinafter referred as principal Rules),

in sub-section (n) of Section 1 of Rule 25, for

the expression "fees as specified in Table

1(A), 1(B) and 1(C) of Schedule I", the

expression "Fees as specified in the Table 1

of Schedule I" shall be substituted.

(ii) Amendment of rule 25 (6).— In section 6 of rule 25, for the expression "www. goapcb.gov.in", the words and expression "www.goaocmms.nic.in" shall be substituted.

3. Addition of new Rule 38.—

In the principal Rules, after Rule 37 new

"Rule 38" has been added, as below:-

"The service rules as applicable to the Government employees will be made applicable to the employees of the Goa State Pollution Control Board upto 31st October, 2022 or notification for regulation of services of the employees of the Board as provided under the Water (Prevention and Control of Pollution) Act, 1974 whichever is earlier".

4. Insertion of new Form V.— In the principal Rules, existing Form V is substituted with a new FORM V (A) and FORM V (B) are attached.

5. Insertion of new Schedule I.— In the principal Rules, for existing Schedule I new Schedule I is attached:

6. Amendment in Annexure "A".— In the principal Rules, in Annexure 'A'–Categorisa- tion of Industries.-

(i) under the heading "Orange Category" in Sr. No. 7, for the expression "Bakery and confectionary units (with wood fired ovens/furnaces) and electric/gas ovens__________________________________________________________________________________________ 459 Suggestions are welcomed on e-mail: [email protected] OFFICIAL GAZETTE — GOVT. (ii) under the heading "Green Category" in Sr. No. 28, the expression "Diesel generator sets (15KVA to 1MVA)", is substituted with the expression "Diesel generator sets (15KVA to 1MVA) (excluding standalone DG sets)".

(iii) under the heading "White Category" in Sr. No. 48, for the existing expression "Tea stall" the expression "Tea Stall and food cart" shall be inserted.

(i) A Green Category Industry shall be accompanied by Fee as specified in Table 1 below;

II An Application for Consent to Operate;-

(i) RED Category Industry (Large, Medium and Small scale) shall be accompanied by Fees as specified in Table 2(A) below.

(ii) ORANGE Category Industry (Large, Medium and Small scale) shall be accompanied by Fees as specified in Table 2(B) below.

(iii) GREEN Category Industry (Large, Medium and Small scale) shall be accompanied by Fees as specified in Table 2(C) below.

Note: Also 2% increase in the above fees for every subsequent financial year.

In exercise of the powers conferred by section 54 of the Air (Prevention and Control of Pollution) Act, 1981 (Central Act 14 of 1981), the Government of Goa hereby makes the following rules, so as to amend the Goa Air (Prevention and Control of Pollution) Rules, 2021, namely:—

4. Insertion of new Form V.— In the principal Rules, existing Form V is substituted with a new FORM V (A) and FORM V (B) are attached.

5. Insertion of new Schedule I.— In the principal Rules, for existing Schedule I new Schedule I is attached.

(2) They shall come into force at once.

6. Amendment in Annexure "A".— In the principal Rules, in Annexure 'A'-Categorisa- tion of Industries.—

2. Amendment of rule 25.— (i) Amendment of rule 25 (l) (n),- In the Goa Air Rules, 2021 (hereinafter referred as principal Rules), in sub-section (n) of Section 1 of Rule 25, for the expression "fees as specified in Table 1(A), 1(B) and 1(C) of Schedule I", the expression "Fees as specified in the Table 1 of Schedule I" shall be substituted.

(i) under the heading "Orange Category" in Sr. No. 7, for the expression "Bakery and confectionary units (with wood fired ovens/furnaces) and electric/gas ovens with >1T/day" the expression "Bakery and confectionary units (with wood fired ovens/furnaces of all capacities) and electric/gas ovens with >1T/daycapacity" shall be substituted.

(ii) Amendment of rule 25 (6),— in section 6 of rule 25, for the expression "www.goapcb.gov.in", the words and expression "www.goaocmms.nic.in" shall be substituted.
