Judgement and Order

Vide this Judgement and Order; I shall dispose of the complaint dated 08-11-2021 received from Mr. Walter Fernades, r/o H. No. 593/2, Grande Pulvaddo, Benaulim, Salcete-Goa against Mr. Felix Savio Castello, r/o H. No. 1313, Mazilvaddo, Benaulim, Salcete-Goa regarding fraudulently obtaining Renewal of Certificate of Registration for Guest House named "Tourist Nest" at H. No. 1313, Mazilvaddo, Benaulim, Salcete-Goa for the year 2021-22 by forging Cana-Benaulim Village Panchayat Rental Tax Receipt No. 99 of Receipt Book No. 512 dated 03-06-2020 issued by Village Panchayat of Cana-Benaulim.

The brief facts of the case are as under:-

6. On 24-02-2022 matter was heard and Respondent has shown original copy of receipt No. 31 dated 19-07-2021 and produce xerox copy of the same which is taken on record. Further Respondent has sought some time to produce original receipt No. 99 of Book No. 512 dated 03-06-2020 for the year 2020-21 and accordingly time was granted and the matter was adjourned to 15-03-2022.

7. On 15-03-2022 matter was heard and Respondent has admitted his fault/mistake and stated that as Village Panchayat was not accepting fees the Respondent compelled to Forged the receipt No. 99 dated 03-06-2020. Respondent has sought time of one week to furnish explanation and accordingly time was granted and Respondent was called for hearing on 12-07-2022.

8. On 12-07-2022 matter was heard and Respondent admitted to his mistake and said he has nothing to say further.

Order

1. A complaint letter dated 08-11-2021 was received from Mr. Walter Fernandes, r/o H. No. 593/2, Grande Pulvaddo, Benaulim, Salcete-Goa against Mr. Felix Savio Castello, r/o H. No. 1313, Mazilvaddo, Benaulim, Salcete-Goa regarding fraudulently obtaining Renewal of Certificate of Registration for Guest House named "Tourist Nest" at H. No. 1313, Mazilvaddo, Benaulim, Salcete-Goa for the year 2021-22 by forging Cana-Benaulim Village Panchayat Rental Tax Receipt No. 99 of Receipt Book No. 512 dated 03-06-2020 issued by Village Panchayat of Cana-Benaulim.

2. On the basis of the complaint, the Respondent was issued Notice No. 5/S(1-23)2021-DT/91 dated 02-12-2021 under rule 4 of the Goa Registration of Tourist Trade Rules, 1985, and the hearing was fixed on 28-12-2021.

3. The above Notice No. 5/S(1-23)2021-DT/91 dated 02-12-2021 was retuned back by the Postal Department with remarks "refused", Accordingly fresh Notice No. 5/S(1-23)2021-DT/ /187 dated 23-12-2021 was served to the Respondent through Police and hearing was fixed on 27-01-2022.

4. Letter dated 18-01-2022 was inwarded in the Office of Department of Tourism, South Zone Office Margao, on 18-01-2022 by the Respondent stating that he is not running fraudulently Respondent also stated that he has paid his tax in month of July and produced rental tax receipt and NOC from Goa State Pollution Control Board.

5. Thereafter matter fixed on 27-01-2022 was postponed to 24-02-2022 due to General Election to the Goa State Legislative Assembly 2022.

By virtue of the powers conferred upon me under Section 10 (d) of the Goa Registration of Tourist Trade Act, 1982, I, Shri Ganesh R. Teli, Prescribed Authority (South), hereby remove the name of Felix Savio Castello, Owner of Tourist Nest, H. No. 1313, Mazilvaddo, Benaulim, Salcete-Goa from the Register of South Goa Hotel Keeper No. D-1, page No.19 maintained under the foresaid Act.

Consequently, the Certificate of Registration bearing No. 326 (old) and Certificate No. HOTS000121 (New) of D category issued under the said Act stands cancelled.

The above Speed Breakers and Thick Rumbler Strips shall be painted with white thermoplastic fluorescent paint and fixed with blinkers for better visibility.

Further, in exercise of the powers conferred on me under Section 116 of the above Act, I also authorize the erection of cautionary sign boards "Speed Breaker Ahead" at about 40 mts. on the left side of the road at the placement of the Speed Breaker & Rumbler Strips in order to regulate the motor vehicular traffic.
