Now therefore, on being satisfied of the need to take preventive action based on the report of the Superintendent of Police, South Goa District, Margao, I, Egna Cleetus, IAS, District Magistrate, South Goa District, Margao, in exercise of the powers vested in me under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023, do hereby order that:

Whereas, it is reported by the Superintendent of Police, South Goa District, Margao, that criminals with an intention of committing crime in Goa, usually stay in hotel/rented premises with fictitious names and bogus residential/official addresses and telephone numbers and after commission of crime, it becomes difficult to identify culprits, as the details furnished by them to the hotels or landlords are found fictitious/bogus/false;
And Whereas, anti-social/criminal or undesirable elements can camouflage their identity for illegal/ /immoral operations, which need to be contained and regulated. Certain hotel owners/landlords/ /establishment have a tendency to rent out premises a) All owners of the houses, buildings, flats and other residential accommodations and the owners/ /Management of all Hotels, Lodging & Boarding, Shacks, private guest houses, paying guest facilities, religious bodies, offering temporary accommodations, temporarily residential accommodation, etc., in the whole of South Goa District must verify the bonafides of persons through their proof of identity such as Election card, Driving License, Aadhar card, Passport, Smart card, etc. and make necessary arrangements for entry of details of Customers/visitors in the PATHIK (Programme for Analysis of Traveler and Hotel Informatics) software prepared by the Police.
b) No landlords, tenants, owners or person of any house/property falling under the territorial jurisdiction of South Goa District, Goa, shall let, sublet or rent out any accommodation to any person unless the particulars of the tenants have been furnished to the Officer-in-charge of the concerned Police Station.
c) All In-charges of such accommodations shall provide such facilities for inspection and the OFFICIAL GAZETTE — GOVT. OF GOA SERIES III No. 44 30TH JANUARY, 2025 maintenance of record in the aforementioned software by the Police Authorities or any other authority authorized by the undersigned.
d) All Head/In-charges of Nationalized Banks of South Goa District must deploy security guards for security of their ATM's round the clock and install CCTV cameras or shall installed ESS (Electronic Survey System) equipped with Panic button hooter, two-way communication system & remote outstanding control.
The circumstances do not permit serving of the notice individually to the concerned persons. Therefore, this order is hereby passed ex-parte. It shall be published for public information through the Press, Social Media, etc. and also by affixing copies on the Notice Boards of all Sub-Divisional Magistrates, Mamlatdars and Police Stations.
This order shall come into force with effect from 08-01-2025 and shall remain in operation for a period of 60 days (both days inclusive) unless withdrawn earlier.
Violation of this order is punishable u/s 223 of
the Bharatiya Nyaya Sanhita, 2023.
All the Deputy Collector and Sub-Divisional Magistrates of South Goa are authorized to verify the violation of this order issued under Section 163 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and to file FIR before the concerned Court/Police Station and to lodge complained before the concerned Judicial Magistrate.
The Superintendent of Police (South), Margao- -Goa, is directed to issue direction to all the Police Stations of South Goa District to take note of this order and to place the matter before the concerned Deputy Collector and Sub-Divisional Magistrates of South Goa in case of violation under Section 223 of the Bharatiya Nyaya Sanhita, 2023.
