Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing personation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing personation of electors and facilitating their identification at the time of

3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors' Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector Photo Identity Card may result in the denial of permission to vote; and

4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Elector Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and

5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors' Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, Electors' Photo Identity Card have been issued to approximately 100% electors in the States of Assam, Kerala, Tamil Nadu, West Bengal, Puducherry, Maharashtra, Goa, Karnataka, Nagaland, Tripura and Gujarat; and

7. Now, therefore, after taking into account all relevant factors and the legal and factual positions, the Election Commission hereby directs that for the current general election to the Legislative Assemblies of Assam, Kerala, Tamil Nadu, West Bengal and Puducherry and bye-elections to 8 Assembly constituencies in 6 States (as per Annexure-I) to be notified on 16-03-2026, 30-03-2026 and 02-04- 2026, all electors who have been issued EPIC are expected to produce the EPIC for their identification at the polling stations before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity:-

(i) Aadhaar Card;

(ii) MGNREGA Job Card;

(iii) Passbooks with photograph issued by Bank/Post Office;

(iv) Health Insurance Smart Card issued under the scheme of Ministry of Labour/Ayushman Bharat Health Card;

(v) Driving License;

(vi) PAN Card;

(vii) Smart Card issued by RGI under NPR;

(viii) Indian Passport;

(ix) Pension document with photograph;

(x) Service Identity Cards with photograph issued to employees by Central/State Govt./PSUs/Public Limited Companies;

(xi) Official identity cards issued to MPs/MLAs/MLCs and

(xii) Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of India

8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided that the identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided that the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above.

9. Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral roll under Section 20A of the Representation of the People Act, 1950, based on the particulars in their1770 OFFICIAL GAZETTE — GOVT. OF GOA SERIES II No. 50 (EXTRAORDINARY No. 6) 17TH MARCH, 2026 Indian Passport, shall be identified on the basis of their original passport only (and no other identity document) at the polling station.

आदे

यतः लोक तिनिधि अधिनियम, 1951 की धारा 61 म यह उपबंधित है कि निवाचकों के तिपण का निवारण करने की ि से, ताकि उ अधिनियम की धारा 62 के अधीन वाविक निवाचकों का उनके मत देने के अधिकार को और अधिक भावी बनाया जा सके , मतदान के समय निवाचकों की पहचान सुनिति करने के साधन के प म निवाचकों के लिए निवाचक फोटो पहचान प के उपयोग हेतु नियमों के ारा उपबंध किए जा सकते ह, तथा

2. यतः निवाचकों का रजि करण नियम, 1960 का नियम 28 निवाचन आयोग को, इस ि से कि निवाचकों के तिपण का निवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके , निवाचको को रा की लागत पर फोटोयु निवाचक फोटो-पहचान प जारी करने के लिए निदेश देने की श दान करता है; तथा

3. यतः, निवाचनों का संचालन नियम, 1961 के नियम 49 ज(3) और 49 ट(2) (ख) म यह उपबंधित है कि जहाँ किसी निवाचन े के निवाचकों को निवाचक रजि करण नियम, 1960, के नियम 28 के उ उपबंधों के अधीन निवाचक फोटो पहचान-प दिए गए ह, वहां निवाचकों को मतदान के म अपना निवाचक फोटो पहचान-प दिखाना होगा तथा उनकी ओर से उन निवाचक फोटो पहचान पों को नहीं दिखाए जाने या दिखाने म असमथ होने पर उ मत डालने की अनुमति देने से इार किया जा सकता है; तथा

4. यतः, उ अधिनियम, और नियमों के उपयु उपबंधों को मिलाकर एवं सामंजपूण ढं ग से उनके अयन से यह षट होता है कि यपि मत देने का अधिकार निवाचक नामावली म नाम के होने से ही होता ह, यह निवाचन आयोग ारा रा की लागत पर, मतदान के समय उनकी पहचान सुनिति करने के साधन के प म दान करवाए गए निवाचक फोटो पहचान प के योग पर भी निभर करता है, तथा दोनों का एक साथ योग करना होता है; तथा1771 OFFICIAL GAZETTE — GOVT. OF GOA SERIES II No. 50 (EXTRAORDINARY No. 6) 17TH MARCH, 2026 5. यतः, निवाचन आयोग ने एक समयब कायम के अनुसार सभी निवाचकों को निवाचक फोटो पहचान-प ई0पी0आई0सी0 जारी करने का निदेश देते ए 28 अग, 1993 को एक आदेश जारी किया है; तथा

6. यतः, असम, के रल, तमिलनाडु , पमि बंगाल, पुडु चेरी, महारा , गोवा, कनाटक, नागालड, पिुरा तथा गुजरात के राों मे लगभग 100% निवाचकों को निवाचक फोटो पहचान प जारी किए जा चुके ह ,तथा

7. अत: अब, सभी संब कारकों तथा विधिक एवं ताक थतियों को, ान म रखते ए, निवाचन आयोग, एत् वारा, यह निदेश देता है कि दिनांक 16.03.2026, 30.03.2026 and 02.04.2026 को अधिसूचित किये जाने वाले असम, के रल, तमिलनाडु , पमि बंगाल, पुडु चेरी की विधानसभाओं के साधारण निवाचन एवं 6 राों म 8 विधानसभा निवाचन ेों (अनुलक 1 के अनुसार) के उप निवाचनों के लिए सभी निवाचकों, जि निवाचक फोटो पहचान प जारी किए गए ह, से अपेा की जाती है कि वे मतदान थल पर अपना मत डालने से पहले अपनी पहचान सुनिति करने हेतु अपना निवाचक फोटो पहचान प दिखाएं गे। ऐसे निवाचक जो अपना निवाचक फोटो पहचान प ुत नहीं कर पाते ह, उ अपनी पहचान थापित करने के लिए निलिखत वैकक फोटो पहचान दावेजों म से कोई एक ुत करना होगा:-

i. आधार काड, ii. मनरे गा जॉब काड,

iii. बको/डाकघरों ारा जारी किए गए फोटोयु पासबुक,

iv. म मंालय की योजना के अगत जारी ा बीमा ाट काड/आयुान भारत है काड

v. ड ाइविंग लाइसे,

vi. पैन काड,

vii. एनपीआर के अंतगत आरजीआई ारा जारी किए गए ाट काड,

viii. भारतीय पासपोट,

ix. फोटोयु पशन दावेज,

x. के /रा सरकार/लोक उपम/पक लिमिटेड कं पनियों ारा अपने कमचारयों को जारी किए गए फोटोयु सेवा पहचान प,

xi. सांसदो/विधायकों/विधान परषद् सदों को जारी किए गए सरकारी पहचान प, और

xii. यूनिक डिसएबिलिटी आईडी (यूडीआईडी) काड़, सामाजिक ाय एवं अधिकारता मंालय, भारत सरकार।

8. एपिक के संबंध म, लेखन अशु, वतनी की अशु इादि को नजरअंदाज कर देना चाहिए बशत निवाचक की पहचान एपिक से सुनिति की जा सके । यदि कोई निवाचक फोटो पहचान प दशित करता है, जो कि किसी अ सभा निवाचन-े के निवाचक रजि ीकरण अधिकारी ारा जारी किया गया ह, ऐसे एपिक भी पहचान थापित करने हेतू ीकृ त किए जाएं गे बशत उस निवाचक का नाम जहां वह मतदान करने आया है उस मतदान क से संबंधित निवाचक नामावली म उपल हो। यदि फोटोाफ इादि के बेमेल होने के कारण निवाचक की पहचान सुनिति करना संभव न हो तब निवाचक को उपयु पैरा 7 म वणित किसी एक वैकक फोटो दावेज को ुत करना होगा।

9. उ पैरा 7 म किसी बात के होते ए भी, वासी निवाचकों को जो अपने पासपोट म विवरणों के आधार पर लोक तिनिधि अधिनियम, 1950 की धारा 20क के अधीन निवाचक नामावलियों म पंजीकृ त ह, मतदान के म के वल उनके मूल पासपोट (तथा कोई अ पहचान दावेज नहीं) के आधार पर ही पहचाना जाएगा ।

Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may be adopted in such constituency or constituencies as the Election Commission of India may, having regard to the circumstances of each case, specify; and

2. Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules, 1961, a printer with a drop box of such design, as may be approved by the Election Commission of India, may also be attached to voting machine for printing a paper trail of the vote, in such constituency or constituencies or parts thereof as the Election Commission of India may direct; and

3. Whereas, the Election Commission has considered the circumstances in current general election to the Legislative Assemblies of Assam, Kerala, Tamil Nadu, West Bengal and Puducherry and bye elections to 8 Assembly Constituencies in 6 States (as per Annexure-I) announced vide the Election Commission's Press Notes No. ECI/PN/029/2026 and No. ECI/PN/030/2026 both dated 15th March, 2026, and is satisfied that sufficient number of Electronic Voting Machines (EVMs) and Printers for printing Paper Trail [Voter Verifiable Paper Audit Trail (VVPAT)] are available for taking the poll in the above said Assembly Constituencies. The polling personnel are well trained in efficient handling of EVMs and 'VVPAT Printers' and the electors are also fully conversant with the operation of the EVMs and the VVPAT Printers;

4. Now, therefore, the Election Commission of India, in exercise of its powers under the said Section 61A of the Representation of the People Act, 1951, and Rule 49A of the Conduct of Elections Rules, 1961, hereby specifies all the Assembly Constituencies in Assam, Kerala, Tamil Nadu, West Bengal and Puducherry and 8 Assembly Constituencies in 6 States (as per Annexure-I) to be notified on 16.03.2026, 30.03.2026 and 02.04.2026 as the constituencies in which the votes shall be given and recorded by means of EVMs and VVPAT printers in the manner prescribed, under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Election Commission from time to time on the subject.

5. The Election Commission also hereby approves the design of EVMs and VVPAT Printers as developed by the Bharat Electronics Ltd., Bangalore and Electronics Corporation of India Ltd., Hyderabad, which shall be attached to the said machines, to be used for the giving and recording of votes in all the Constituencies.

यतः, लोक तिनिधि अधिनियम, 1951 की धारा 61क म यह उपबंध किया गया है कि ऐसे निवाचन े या निवाचन ेों म वोटिंग मशीनों ारा मतदान करने और मतों के अभिलेखन का यथाविहित ऐसा तरीका अपनाया जाए, जैसा कि भारत निवाचन आयोग ारा ेक मामले की परथतियों को ान म रखते ए, विनिदि किया जाए;

2. यतः, निवाचनों का संचालन नियम, 1961 के नियम 49क के परुक के अनुसार भारत निवाचन आयोग ारा यथा-अनुमोदित ऐसे डिजाइन वाला ड ॉप बॉ यु एक ंिटर भी, ऐसे निवाचन े या निवाचन ेों या उसके भागों म मत के पेपर ट ेल के मुण के लिए मतदान मशीन के साथ जोड़ा जाए जैसा कि भारत निवाचन आयोग ारा निदेश दिया जाए;

3. यतः, निवाचन आयोग ने अपने ेस र्नोट सं. ईसीआई/पीएन/029/2026 सं. ईसीआई/पीएन/030/2026 र्दोनं कदनांि 15 माच, 2026 ेि जरए र्घोकषत असम, ेि रल, तकमलनाडु, पकम बंगाल और पुडुचेरी कवधानसभाओं ेि वतमान साधारण कनवाचन एवं 6 रां म 8 कवधानसभा कनवाचन ें (अनुलि-1 ेि अनुसार) ेि उपचुनावं विधान सभा निवाचन ेों म म सभी परथतियों पर विचार किया है, और निवाचन आयोग संतु है कि उपयु मतदान कराने के लिए पया संा म इले ॉनिक वोटिंग मशीन (ईवीएम) और पेपर ट ेल [मतदाता सापनीय पेपर ेल मशीन (वीवीपैट)] मुति करने के लिए ंिटर उपल ह। मतदान कामिक ईवीएम और 'वीवीपैट ंिटरों' ऑडिट ट को कु शलतापूवक संभालने म अी तरह से शिति ह और मतदाता भी ईवीएम और वीवीपैट ंिटरों के चालन से पूण प से अवगत ह ।

4. अब, इसलिए, भारत निवाचन आयोग, लोक तिनिधि अधिनियम, 1951 की उ धारा 61क तथा निवाचनों का संचालन नियम, 1961 के नियम 49क के तहत अपनी शयों का योग करते ए, एत् वारा, 16.03.2026, 30.03.2026 तथा 02.04.2026 र्ोि अकधसूकचत कएि जाने वाले असम, ेि रल, तकमलनाडु, पकम बंगाल और पुडुचेरी कवधानसभाओं ेि सभी कवधानसभा कनवाचन ें एवं 6 रां म 8 कवधानसभा कनवाचन ें (अनुलि-1 ेि अनुसार), र्ोि ऐसे कनवाचन ें ेि प म कवकनकद रिता है, जिनम निवाचनों का संचालन नियम, 1961 और इस विषय पर निवाचन आयोग ारा समय-समय पर जारी किए गए अनुपूरक अनुदेशों के अंतगत विहित तरीके से इले ॉनिक वोटिंग मशीनों तथा वीवीपैट ंिटरों के माम से मत डाले और अभिलिखत किए जाएं गे।
