मुख्य अभियंता का कार्यालय जल संसाधन विभाग, सिवान। ---- कार्यालय आदेश 10 जुलाई 2008 सं0 1स्था0अनु0-12-110/2008-124-1936—समाहर्ता सह अध्यक्ष जिला अनुकंपा समिति, पश्चिम चम्पारण बेतिया के पत्रांक 128/स्था0 दिनांक 13.02.07 द्वारा जिला स्तर पर गठित अनुकंपा समिति पश्चिम चम्पारण ,बेतिया की दिनांक 17.01.07 की बैठक में लिये गये निर्णय के आलोक में विभागीय पत्रांक 1306 दिनांक 18.6.08 से प्राप्त निदेश के क्रम में श्री राजू प्रसाद ठाकुर, पुत्र स्व0 राम ठाकुर, खलासी, सिंचाई यांत्रिक प्रमंडल बाल्मीकीनगर की अनुकंपा के आधार पर वेतनमान 3050-75-3950-80-4590/- रूपये एवं समय-समय पर सरकार द्वारा स्वीकृत भत्ते सहित निम्नवर्गीय लिपिक के पद पर नियुक्त किया जाता है। उन्हें आदेश दिया जाता है कि वे अपना योगदान रूपांकण आयोजन एवं गुण नियंत्रण अंचल, सिवान के कार्यालय में दिनांक 07.08.08 तक निश्चित रूप से दें दें अन्यथा उनकी नियुक्ति रद्‌द समझी जायेगी। यह नियुक्ति पूर्णतः अस्थाई है। 2. अगर इनके नियुक्ति के पूर्व से नियुक्ति के लिए संबंधित पदाधिकारी के अधीन कोई सूची तैयार की गई हो तो उनकी वरीयता उक्त सूची में अंकित व्यक्तियों के बाद होगी। 3. स्व0 राम ठाकुर के आश्रित परिवार के सदस्यों का भरण-पोषण का दायित्व श्री राजू प्रसाद ठाकुर पर होगी। उत्तरदायित्व का निर्वाह पूरी तत्परता के साथ नहीं करने पर गंभीर कदाचार माना जायेगा। इसके लिए उनके विरूद्ध27 , नियमानुसार कार्रवाई भी की जायेगी। इसके अलावा दायित्व की अवहेलना की संपुष्टि होने पर उनकी परिलब्धियों को एक अंश सरकारी सेवक के आश्रित सदस्यों को देने का आदेश सरकार दे सकती हे। 4. नियुक्त पद पर योगदान करते समय उन्हें जिला सिवान के असैनिक शल्य चिकित्सक का स्वास्थ्य प्रमाण पत्र हर हालत में प्रस्तुत करना होगा। 5. अगर राजू प्रसाद ठाकुर की नियुक्ति आरक्षित कोटा से रोस्टर पर हुई हो तो उक्त आरक्षित कोटा के पद को अग्रणित कर दिया जायेगा। 6. योगदान करने हेतु किसी प्रकार का यात्रा भत्ता किसी भी परिस्थिति में देय नहीं होगी। 7. किसी तरह की गलत सूचना अथवा धोखाधड़ी के आधार पर नियुक्ति प्राप्त कर लेने पर उन्हें सेवा से विमुक्त कर दिया जायेगा तथा समुचित कार्रवाई नियमानुसार की जायेगी। 8 अनुकंपा के आधार पर किसी पद पर नियुक्त होने पर उन्हें अनुकंपा का दोबारा लाभ लेते हुए प्रोन्नति अथवा संवर्ग परिवर्तन नहीं किया जा सकेगा। 9. नियुक्त पद पर योगदान करते समय उन्हें अपनी शैक्षणिक योग्यता का मूल प्रमाण-पत्र एवं वास्तविक जन्म तिथि से संबंधित प्रमाण-पत्र मूल में संबंधित पदाधिकारी के समक्ष प्रस्तुत करना होगा। जिसकी जांच कर संतुष्ट होकर उनके द्वारा इनका योगदान स्वीकृत किया जायेगा तथा इसकी सूचना तुरत अधोहस्ताक्षरी को दी जायेगी। 10. इन्हें छः माह के अन्दर इस कार्यालय द्वारा आयोजित की जानेवाली टंकण जॉच परीक्षा में उतीर्णता प्राप्त करनी होगी।

---- कार्यालय आदेश 23 सितम्बर 2008 सं0-1स्था0अनु0-12-109/2008/181-2815समाहर्ता सह अध्यक्ष जिला अनुकंपा समिति ,सिवान के पत्रांक 1268 स्था0 दिनांक 13.09.08 द्वारा जिला स्तर पर गठित अनुकंपा समिति सिवान की दिनांक 01.09.08 की बैठक में लिये गये निर्णय के आलोक में श्री सैयद राजा इमाम ,पिता स्व0 सैयद अली इमाम, भूतपूर्व कार्यदर्शक ,सारण नहर प्रमंडल ,महाराजगंज की अनुकंपा के आधार पर वेतनमान 2550-55-2660-60-3200/- रूपये एवं समय-समय पर सरकार द्वारा स्वीकृत भत्ते सहित अनुसेवक के पद पर नियुक्त किया जाता है। उन्हें आदेश दिया जाता है कि वे अपना योगदान कार्यपालक अभियंता ,सारण नहर प्रमंडल महाराजगंज के कार्यालय में दिनांक 20.10.08 तक निश्चित रूप से दें दें अन्यथा उनकी नियुक्ति रद्‌द समझी जायेगी। यह नियुक्ति पूर्णतः अस्थाई है। 2. अगर इनके नियुक्ति के पूर्व से नियुक्ति के लिए संबंधित पदाधिकारी के अधीन कोई सूची तैयार की गई हो तो उनकी वरीयता उक्त सूची में अंकित व्यक्तियों के बाद होगी। 3. स्व0 सैयद अली इमाम के आश्रित परिवार के सदस्यों का भरण-पोषण का दायित्व श्री सैयद राजा इमाम पर होगी। उत्तरदायित्व का निर्वाह पूरी तत्परता के साथ नहीं करने पर गंभीर कदाचार माना जायेगा। इसके लिए उनके विरूद्ध नियमानुसार कार्रवाई भी की जायेगी। इसके अलावा दायित्व की अवहेलना की संपुष्टि होने पर उनकी परिलब्धियों को एक अंश सरकारी सेवक के आश्रित सदस्यों को देने का आदेश सरकार दे सकती हे। 4. नियुक्त पद पर योगदान करते समय उन्हें जिला सिवान के असैनिक शल्य चिकित्सक का स्वास्थ्य प्रमाण पत्र हर हालत में प्रस्तुत करना होगा। 5. अगर श्री सैयद राजा इमाम की नियुक्ति आरक्षित कोटा से रोस्टर पर हुई हो तो उक्त आरक्षित कोटा के पद को अग्रणित कर दिया जायेगा। 6. योगदान करने हेतु किसी प्रकार का यात्रा भत्ता किसी भी परिस्थिति में देय नहीं होगी। 7. किसी तरह की गलत सूचना अथवा धोखाधड़ी के आधार पर नियुक्ति प्राप्त कर लेने पर उन्हें सेवा से विमुक्त कर दिया जायेगा तथा समुचित कार्रवाई नियमानुसार की जायेगी। 8 अनुकंपा के आधार पर किसी पद पर नियुक्त होने पर उन्हें अनुकंपा का दोबारा लाभ लेते हुए प्रोन्नति अथवा संवर्ग परिवर्तन नहीं किया जा सकेगा। 9. नियुक्त पद पर योगदान करते समय उन्हें अपनी शैक्षणिक योग्यता का मूल प्रमाण पत्र एवं वास्तविक जन्म तिथी से संबंधित प्रमाण पत्र मूल में संबंधित पदाधिकारी के समक्ष प्रस्तुत करना होगा। जिसकी जॉच कर संतुष्ट होकर उनके द्वारा इनका योगदान स्वीकृत किया जायेगा तथा इसकी सूचना तुरत अधोहस्ताक्षरी को दी जायेगी। 10. योगदान लेने के साथ ही संबंधित पदाधिकारी श्री सैयद राजा इमाम से भरण-पोषण पत्र एवं विवाह में तिलक दहेज नहीं लेने देने का प्रमाण पत्र प्राप्त कर लेंगे।

मानव संसाधन विकास विभाग ——— अधिसूचना 19 अगस्त 2008 सं0-3/आ2-27/96(अंश-1) 746—श्री नगीना, प्राचार्य, राजकीय शिक्षक प्रशिक्षण महाविद्यालय, तुर्की, मुजफ्‌फरपुर के विरूद्ध उनके जिला शिक्षा अधीक्षक, पूर्णियाँ के पदस्थापन काल में रू.3,18,500/- (तीन लाख अठारह हजार पाँच सौ रूपये) की अवैध निकासी कर अनियमित ढं़ग से शिक्षण सामग्री का क्रय करने, लगभग रू.40,00,000/- (चालीस लाख रूपये) का क्रय विहित प्रक्रिया अपनाये बिना करने तथा भवन मद में रू.78,000/- (अठहत्तर हजार रूपये) की निकासी कर सामग्रियों के क्रय करने संबंधी आरोपों के लिये दोषी मानते हुए उनके विरूद्ध बिहार लोक सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली के नियम 55 (A) के तहत विभागीय संकल्प संख्या 517 दिनांक 2.6.97 के द्वारा विभागीय कार्यवाही प्रारम्भ की गयी जिसमें उप सचिव-सह-मुख्य निगरानी पदाधिकारी, से0 प्रा0 एवं वयस्क शिक्षा विभाग को जाँच पदाधिकारी मनोनीत किया गया । जांच पदाधिकारी के जांच प्रतिवेदन से सरकार के असंतुष्ट एवं असहमत रहने के कारण सरकार द्वारा पुनः नये सिरे से जांच कराने का निर्णय लिया गया तथा तदनुसार विभागीय संकल्प रू0 885 दिनांकः 30-09-02 द्वारा निदेशक, प्राथमिक शिक्षा, बिहार, पटना को विभागीय कार्यवाही का संचालन पदाधिकारी नियुक्त किया गया।29 , 2. नियुक्त जांच पदाधिकारी, निदेशक, प्राथमिक शिक्षा, बिहार, पटना के कार्य-बोझ के कारण सुनवाई में कठिनाई के संसूचन के पश्चात, विभागीय संकल्प संख्या-280 दिनांक-22-05-06 द्वारा श्री ब्रज किशोर पाठक, उप सचिव, मानव संसाधन विकास विभाग, बिहार पटना को संचालन पदाधिकारी नियुक्त किया गया । 3. जांच पदाधिकारी के पत्रांक 35 दिनांक 27-7-06 द्वारा प्राप्त जांच प्रतिवेदन में आरोपी के विरूद्ध वित्तीय अनियमितता एवं राशि विचलन सम्बन्धी आरोप स्पष्ट रूप से प्रमाणित पाये गये, जिसमें सरकार को निश्चित रूप से आर्थिक क्षति हुयी है । 4. श्री नगीना के विरूद्ध उपर्युक्त प्रमाणित आरोपों की गम्भीरता को देखते हुए सरकार द्वारा बृहद्‌ दण्ड देने का निर्णय लिया गया तदनुसार विभागीय पत्रांक-222 दिनांकः 21-3-07 द्वारा जांच प्रतिवेदन की प्रति भेजते हुए प्रस्तावित दंड के बचाव हेतु द्वितीय कारण पृच्छा की मांग की गयी और बचाव संबंधी स्पष्टीकरण प्राप्त नहीं होने पर विभागीय पत्रांक-497 दिनांक 25-7-07 द्वारा स्मारित करते हुए एक सप्ताह के अन्दर बचाव पर स्पष्टीकरण देने और निर्धारित तिथि तक उत्तर प्राप्त नहीं होने की स्थिति में एक तरफा निर्णय लेने की सूचना दी गयी। इसके बावजूद भी आरोपी ने द्वितीय कारण-पृच्छा का बचाव हेतु स्पष्टीकरण समर्पित करना उचित नहीं समझा जो अनुशासनहीनता का द्योतक पाया गया है। अतः सरकार द्वारा लाचार होकर वृह्‌द दण्ड के रूप में अनिवार्य सेवा निवृति का दण्ड देने का निर्णय लेते हुए बिहार लोक सेवा आयोग से सहमति मांगने का निर्णय लिया गया। तत्पश्चात विभागीय पत्रांक 811 दिनांकः 30-11-07 द्वारा प्रस्तावित दण्ड पर बिहार लोक सेवा आयोग से सहमति मांगी गयी। 5. सरकार द्वारा लिए गये निर्णय के आलोक में प्रस्तावित वृहद्‌ दण्ड में अनिवार्य सेवा निवृति की सजा पर बिहार लोक सेवा आयोग, पटना के पत्रांक 1693 दिनांक 25-07-08 के द्वारा सहमति प्रदान की गयी। 6. उक्त तथ्यों के आलोक में सरकार ने संचालित विभागीय कार्यवाही में जांच प्रतिवेदन में प्रमाणित आरोपों के आधार पर श्री नगीना, प्रार्चाय, शिक्षक प्रशिक्षण महाविद्यालय, तुर्की, मुजफ्फरपुर बिहार शिक्षा सेवा वर्ग-II (वेतनमान रू0 6500-10500) को बिहार लोक सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली 2005 के नियम-18 (6 एवं 7) के तहत सरकारी सेवा से ''अनिवार्य सेवा निवृत'' करने का निर्णय लिया है। उक्त निर्णय अधिसूचना निर्गत होने की तिथि से प्रभावी होगा।

मानव संसाधन विकास विभाग ——— अधिसूचना 29 अगस्त 2008 सं0-3/आ2-24/06(अंश-1)मा0777—श्रीमती शांति देवी, तत्कालीन विद्यालय निरीक्षिका-सह-उप-शिक्षा निदेशिका(मा0शि0), बिहार, पटना सम्प्रति पुस्तकालय अधीक्षिका, बिहार, पटना के विरूद्ध केन्द्रीय अन्वेषण व्यूरो के केस सं0 पी0 ई0 3 (ए)01-पैट/ए0सी0पू0-XII/सी0 बी0 आई0, नई दिल्ली दिनांक 08.06.2001 के अन्तर्गत प्रतिवेदित आरोप यथा विद्यालय निरीक्षिका-सह-उप शिक्षा निदेशिका, बिहार, पटना के पद पर कारर्यरत अवधि में उनके द्वारा श्रीमती कंचन कुमारी को अप्रशिक्षित रहते हुये भी राजनीतिज्ञों की अनुशंसा के आधार पर शिक्षिका के पद पर अवैध रूप से नियुक्ति की गई, जिसमें सरकार द्वारा निर्धारित नियुक्ति प्रक्रियाओं का पालन नहीं किया गया । विभागीय संकल्प संख्या 332 दिनांक 12.06. 2006 द्वारा विभागीय कार्यवाही प्रारंभ की गई। 2. उक्त विभागीय कार्यवाही में संचालन पदाधिकारी, विभागीय जाँच आयुक्त, बिहार, पटना के पत्रांक 427 दिनांक 03.06.2008 द्वारा समर्पित जाँच प्रतिवेदन में उक्त आरोप को अंशतः प्रमाणित किया गया। 3. संचालन पदाधिकारी द्वारा समर्पित जाँच प्रतिवेदन के समीक्षोपरांत सरकार ने श्रीमती शांति देवी, पुस्तकालय अधीक्षक, बिहार, पटना को प्रमाणित आरोप के आधार पर बिहार लोक सेवाक/वर्गीकरण, नियंत्रण एवं अपील नियमावली-05 के नियम 14(IV) में वर्णित प्रावधान के अन्तर्गत लघु दंड यथा तीन वर्षों से अनअधिक अवधि के लिय असंचयात्मक प्रभाव से कालमान वेतन में न्यूनतर प्रक्रम पर अवनति देने का निर्णय लिया है। उक्त दंड अधिसूचलना निर्गत की तिथि से प्रभावी होगी।

सं0-3/आ2-29/06मा0 760—श्री राजमुकूल, क्षेत्रीय उप शिक्षा निदेशक, मुंगेर प्रमण्डल, मुंगेर के विरूद्ध श्री आनन्द लाल सिंह, सहायक शिक्षक, सीताराम राय उच्च विद्यालय, राजौड़ा, बेगूसराय के स्थानानतरण संबंधी निर्गत आदेश के बावजूद मामले को दबाकर 5 (पाँच) वर्षों तक रखने तथा वेतन भुगतान करने संबंधी आरोप पर विभागीय संकल्प संख्या-528 दिनांक 22.08.2006 के द्वारा विभागीय कार्यवाही संचालित की गयी । संचालन पदाधिकारी के जाँच प्रतिवेदन पत्रांक 99 दिनांक 06.06.2008 के समीक्षोपरान्त पाया गया कि जाँच प्रतिवेदन में दिये गये तथ्यों को स्वीकार करना संभव नहीं है क्योंकि जो कर्मी स्थानान्तरित हो चुके थे, उन सभी को विरमित करना चाहिए था, न कि जो विरमित नहीं हुए थे, उसके आधार पर श्री सिंह को रोक रखा जाना चाहिए था । इस आधार पर जाँच प्रतिवेदन से असहमत होते हुए श्री राजमुकूल को क्षेत्रीय उप शिक्षा निदेशक, मुंगेर को सरकार द्वारा लघु दण्ड के रूप में ''चेतावनी'' देने का निर्णय लिया गया है ।

2. अतः उपरोक्त निर्णय के आलोक में श्री राजमुकूल, क्षेत्रीय उप शिक्षा निदेशक, मुंगेर को लघु दण्ड के रूप में ''चेतावनी'' की सजा दी जाती है ।

मानव संसाधन विकास विभाग ——— अधिसूचना 16 सितम्बर 2008 संख्या-3/आ2-16/07-885—श्री प्रभात कुमार पंकज, जिला शिक्षा अधीक्षक, समस्तीपुर को समस्तीपुर जिले में गलत ढंग से बढ़ायी गयी योग्यता प्राप्त स्नातक प्रशिक्षित वेतनमान प्राप्त कुल 52 सहायक शिक्षकों को अनियमित प्रोन्नति देकर अपने पद एवं अधिकार का दुरूपयोग करने, अनुचित वित्तीय लाभ पहुँचाने, राज्य को वित्तीय क्षति पहुँचाने तथा क्षेत्रीय शिक्षा उप निदेशक, दरभंगा को जाँच में सहयोग नहीं करने आदि आरोपों में प्रथम द्रष्टव्या आरोप प्रमाणित होने के कारण सरकार के आदेशानुसार बिहार लोक सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली -05 के नियम-9(1) के तहत तात्कालिक प्रभाव से निलंबित करते हुए विभागीय कार्यवाही के अधीन किया जाता है। 2. निलंबन की अवधि में श्री पंकज को बिहार लोक सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली-05 के नियम 10 (1) के अधीन जीवन निर्वाह भत्ता देय होगा । 3. निलंबन की अवधि में श्री पंकज का मुख्यालय हाजीपुर, जिला शिक्षा पदाधिकारी का कार्यालय के अधीन किया जाता है।34 4. विभागीय कार्यवाही एवं उससे संबंधित संकल्प एवं प्रपत्र-क अलग से निर्गत की जा रही है । 5. श्री पंकज के निलंबन के फलस्वरूप जिला शिक्षा अधीक्षक, समस्तीपुर के रिक्त हुए पद पर नियमित पदस्थापन की अवधि तक जिला शिक्षा पदाधिकारी, समस्तीपुर अपने कार्यों के अतिरिक्त जिला शिक्षा अधीक्षक, समस्तीपुर का कार्य सम्पादित करेंगे।

श्री आदित्य राजहंस, तत्कालीन श्रम अधीक्षक कृषि श्रमिक, डालमियांनगर, सम्प्रति सहायक श्रमायुक्त, सहरसा के बिरूद्ध लगाये गये कतिपय आरोपों के सन्दर्भ में विभागीय पत्रांक-193 दिनांक 23.1. 06 द्वारा उनसे कारण-पृच्छा की मांग की गई ।

श्री राजहंस द्वारा समर्पित कारण-पृच्छा दिनांक 27.4.06 की समीक्षा उनके बिरूद्ध लगाये गये आरोपों के परिप्रेक्ष्य में की गई एवं उसे संतोषजनक नहीं मानते हुए विभागीय संकल्प सं0-147 दिनांक-3.6. 06 द्वारा विभागीय कार्यवाही संचालित करने का निर्णय लिया गया ।

श्री राजहंस के विरूद्ध संचालित विभागीय कार्यवाही का जाँच प्रतिवेदन विभागीय पत्र सं0-4/वि0 कार्य0-2006/2007- 1203 दिनांक-3.4.07 प्राप्त हुआ । संचालन पदाधिकारी ने उनके विरूद्ध किसी आरोप को प्रमाणित नहीं पाया । लेकिन विभागीय समीक्षोपरान्त आरोप कि रोकड़बही नियमित रूप से प्रतिहस्ताक्षरित नहीं करना अनियमित कार्य है" आशिंक रूप से प्रमाणित पाया गया । उक्त आंशिक रूप से प्रमाणित आरोप के लिए सरकार द्वारा गंभीर चेतावनी के साथ आरोपमुक्त करने का निर्णय लिया गया ।
