संख्या-2/नि॰ स्था॰ सा॰ (01)-16/2006/4764 भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा संख्या-2/नि॰ स्था॰ सा॰ (01)-16/2006/4764 भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा संख्या-2/नि॰ स्था॰ सा॰ (01)-16/2006/4764 भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, सहकारिता विभाग के कार्यालयों के लिए लिपिक सम्वर्ग में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, सहकारिता विभाग के कार्यालयों के लिए लिपिक सम्वर्ग में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, सहकारिता विभाग के कार्यालयों के लिए लिपिक सम्वर्ग में भर्त्ती, प्रोन्नति एवं अन्य सेवा-शर्त्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :- भर्त्ती, प्रोन्नति एवं अन्य सेवा-शर्त्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :-

1॰ संक्षिप्त नाम, विस्तार एवं प्रारम्भ। - 1॰ संक्षिप्त नाम, विस्तार एवं प्रारम्भ। -

(क) यह नियमावली ''सहकारिता विभाग लिपिक सम्वर्ग नियमावली-2008'' कही जा सकेगी। (क) यह नियमावली ''सहकारिता विभाग लिपिक सम्वर्ग नियमावली-2008'' कही जा सकेगी। (क) यह नियमावली ''सहकारिता विभाग लिपिक सम्वर्ग नियमावली-2008'' कही जा सकेगी। (ख) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (ख) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (ग) यह तुरन्त प्रवृत्त होगी। (ग) यह तुरन्त प्रवृत्त होगी। 2॰ परिभाषा। -इस नियमावली में, जब तक विषय या सन्दर्भ मेें अन्यथा उपबन्धित न हो - 2॰ परिभाषा। -इस नियमावली मे ं, जब तक विषय या सन्दर्भ मेें अन्यथा उपबन्धित न हो -

(क) 'विभाग' से अभिप्रेत है सहकारिता विभाग; (क) 'विभाग' से अभिप्रेत है सहकारिता विभाग; (ख) 'सम्वर्ग' से अभिप्रेत है नियम 3(क) में विनिर्दिष्ट कोटि के पदों पर कार्यरत व्यक्ति समूह; (ख) 'सम्वर्ग' से अभिप्रेत है नियम 3(क) में विनिर्दिष्ट कोटि के पदों पर कार्यरत व्यक्ति समूह; (ख) 'सम्वर्ग' से अभिप्रेत है नियम 3(क) में विनिर्दिष्ट कोटि के पदों पर कार्यरत व्यक्ति समूह; (ग) 'सदस्य' से अभिप्रेत है सहकारिता विभाग लिपिक सम्वर्ग में कार्यरत व्यक्ति; (ग) 'सदस्य' से अभिप्रेत है सहकारिता विभाग लिपिक सम्वर्ग में कार्यरत व्यक्ति; (ग) 'सदस्य' से अभिप्रेत है सहकारिता विभाग लिपिक सम्वर्ग में कार्यरत व्यक्ति; (घ) 'नियुक्ति पदाधिकारी' से अभिप्रेत है निबंधक, सहयोग समितियाँ, बिहार; (घ) 'नियुक्ति पदाधिकारी' से अभिप्रेत है निबंधक, सहयोग समितियाँ, बिहार; (ङ) 'निबंधक, सहयोग समितियाँ' से अभिप्रेत है निबंधक, सहयोग समितियाँ के पद पर (ङ) 'निबंधक, सहयोग समितियाँ' से अभिप्रेत है निबंधक, सहयोग समितियाँ के पद पर (ङ) 'निबंधक, सहयोग समितियाँ' से अभिप्रेत है निबंधक, सहयोग समितियाँ के पद पर नियुक्त/कार्यरत व्यक्ति; तथा नियुक्त/कार्यरत व्यक्ति; तथा

(च) 'आयोग' से अभिप्रेत है बिहार राज्य कर्मचारी चयन आयोग। (च) 'आयोग' से अभिप्रेत है बिहार राज्य कर्मचारी चयन आयोग।

3॰ सम्वर्ग की रचना। -(क) इस सम्वर्ग में निम्न कोटि के पद शामिल होंगे :-

(क) इस सम्वर्ग में निम्न कोटि के पद शामिल होंगे :-

(ख) दिनांक 20॰12॰2000 को विभाग के अन्तर्गत लिपिक पद पर कार्यरत्‌ सदस्य इस नियमावली के अधीन उच्चवर्गीय लिपिक के पद पर नियुक्त एवं कार्यरत्‌ समझे जायेंगे। दिनांक 20॰12॰2000 के बाद विभाग के अन्तर्गत निम्नवर्गीय लिपिक के पद पर कार्यरत सदस्य इस नियमावली के अधीन निम्नवर्गीय लिपिक पद पर नियुक्त एवं कार्यरत्‌ समझे जायेंगे।

(ग) यह सम्वर्ग राज्यस्तरीय होगा। (घ) उपर्युक्त खण्ड-(क) के प्रावधान के अधीन विभिन्न कोटि के स्वीकृत पदबल का निर्धारण किया जाएगा। ऐसे पदबल-निर्धारण के फलस्वरूप यदि उच्चवर्गीय लिपिक का कार्यरत बल इस कोटि के लिए निर्धारित स्वीकृत पदबल से अधिक हो, तो ऐसे अतिरिक्त पद इस कोटि में रिक्ति होने तक उच्चवर्गीय लिपिक के पद समझे जायेंगे एवं ऐसे अतिरिक्त पदोें की संख्या के बराबर निम्नवर्गीय लिपिक के पद उपर्युक्त रिक्ति होने तक समायोजित समझे जायेंगे। उच्चवर्गीय लिपिक कोटि में कार्यरत बल जब तक अपनी कोटि में स्वीकृत पदबल से कम नहीं हो जाता है, तब तक उच्चवर्गीय लिपिक के पद पर प्रोन्नति नहीं दी जाएगी।

(ङ) सम्वर्ग में विभिन्न कोटि के स्वीकृत पदबल का, पदों के सृजन तथा प्रत्यर्पण के साथ, समय-समय पर राज्य सरकार द्वारा संषोधन किया जा सकेगा।

4॰ भर्त्ती की प्रक्रिया। - (1) सीधी भर्त्ती :-

(क) प्रत्येक वर्ष की 1ली अप्रील की स्थिति के आधार पर नियुक्ति पदाधिकारी रिक्तियों को विनिष्चित करेगा। उक्त रूप में विनिष्चित रिक्तियों का रोस्टर क्लीयरेन्स कराकर आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रील तक भेज दी जाएगी।

(ख) पदबल के 85% पद सीधी भर्त्ती से भरे जायेंगे :

परन्तु सीधी भर्त्ती से भरे जाने वाले पदों का अधिक-से-अधिक 10% पद मृत सरकारी सेवकों के आश्रितों की अनुकम्पा के आधार पर नियुक्ति के लिए कर्णांकित रहेगा।

(ग) उपर्युक्त खण्ड-(ख) के अधीन सीधी भर्त्ती आयोग द्वारा आयोजित प्रतियोगिता परीक्षा के आधार पर की जा सकेगी।

(घ) भर्त्ती हेतु न्यूनतम शैक्षणिक योग्यता मैट्रिक या समकक्ष परीक्षा में उत्तीर्णता होगी। इसके अतिरिक्त टंकण यन्त्र एवं कम्प्यूटर पर टंकण में दक्षता अनिवार्य होगी। न्यूनतम आयु सीमा 18 वर्ष तथा अधिकतम आयु सीमा वही होगी जो, राज्य सरकार (कार्मिक एवं प्रषासनिक सुधार विभाग) द्वारा समय-समय पर निर्धारित की जाए। आयु की पात्रता 1 अगस्त के अनुसार होगी :

परन्तु, वैसे निम्नवर्गीय अथवा उच्चवर्गीय लिपिक को, जो सम्वर्ग में स्वतः शामिल समझे गए हैं और जिनकी उम्र नियमावली प्रवृत्त होने की तिथि को 50 वर्ष से कम हो, नियमावली प्रवृत्त होने की तिथि से दो वर्षों के अन्दर टंकण यन्त्र एवं कम्प्यूटर पर टंकण में दक्षता प्राप्त करना अनिवार्य होगा। अन्यथा, ऐसी पात्रता हासिल नहीं करने पर आगे उन्हें कोई वेतनवृद्धि देय नहीं होगी।

(ङ) उपर्युक्त खण्ड-(ग) एवं (घ) के अधीन परीक्षा हेतु पाठ्‌यक्रम एवं प्राप्तांकों का विनिष्चय आयोग के परामर्ष से किया जा सकेगा।

(च) अनुकम्पा के आधार पर भर्त्ती, राज्य सरकार द्वारा, समय-समय पर विनिष्चत प्रक्रियानुसार की जाएगी।

(2) सीमित प्रतियोगिता परीक्षा द्वारा भर्त्ती ः- पदबल के शेष 15% पदों को राज्य सरकार के क्षेत्रीय/मुुफस्सिल कार्यालयों की नियमित स्थापना में कार्यरत्‌ एवं सेवा में सम्पुष्ट समूह 'घ' के ऐसे कर्मियों, जो न्यूनतम मैट्रिक या समकक्ष परीक्षा उत्तीर्ण हों तथा टंकण यन्त्र एवं कम्प्यूटर पर टंकण में दक्षता रखते हों और जो न्यूनतम 5 वर्षों से सेवारत हों, में से सीमित प्रतियोगिता परीक्षा के आधार पर भरा जाएगा। सीमित प्रतियोगिता परीक्षा हेतु पाठ्‌यक्रम एवं प्राप्तांक का विनिष्चय आयोग के परामर्ष से किया जा सकेगा।

5॰ परीक्ष्यमान अवधि। -नियुक्ति के पश्चात्‌ परीक्ष्यमान अवधि दो वर्षों के लिए होगी। उक्त अवधि में सेवा एवं आचार सन्तोषप्रद नहीं होने पर परीक्ष्यमान अवधि एक वर्ष के लिए बढ़ायी जा सकेगी। विस्तारित परीक्ष्यमान अवधि में भी सेवा एवं आचार सन्तोषप्रद नहीं रहने पर वैसे कर्मी की नियुक्ति बिना सूचना के समाप्त की जा सकेगी।

6॰ सम्पुष्टि। -नियुक्त सदस्यों को सन्तोषप्रद रूप से परीक्ष्यमान अवधि पूरा करने एवं राज्य सरकार द्वारा लिपिकाें के लिए यथा विनिष्चित विभागीय परीक्षा उत्तीर्ण होने पर सम्वर्ग में सम्पुष्ट किया जा सकेगा।

7॰ प्रोन्नति। -(क) सम्वर्ग में सम्पुष्ट सदस्यों को निम्नवर्गीय लिपिक कोटि से उच्चवर्गीय लिपिक कोटि एवं उच्चवर्गीय लिपिक कोटि से प्रधान लिपिक कोटि के पदों पर प्रोन्नति वरीयता-सह-योग्यता के आधार पर राज्य सरकार द्वारा विनिष्चित नियमों के अनुसार विभागीय प्रोन्नति समिति की अनुषंसा पर की जा सकेगी।3 (cid:1)बहार गजट, (असाधारण)] 23 अ&तूबर 2008 (ख) एक कोटि से दूसरी कोटि में प्रोन्नति के सम्बन्ध में राज्य सरकार (कार्मिक एवं प्रषासनिक सुधार विभाग) द्वारा समय-समय पर यथा विनिष्चित कालावधि पूरा करना आवष्यक होगा। 8॰ पदस्थापन। -सम्वर्ग के सदस्यों का पदस्थापन सहकारिता विभाग के किसी भी क्षेत्रीय कार्यालय में उनकी कोटि के लिए चिह्नित पदों पर किया जा सकेगा।

9॰ कठिनाई का निराकरण। - इस नियमावली के किसी भी नियम को लागू करने में कठिनाई होने की स्थिति में राज्य सरकार ऐसी कठिनाई का निराकरण आवष्यक आदेष से कर सकेगी।

10॰ इस नियमावली में जिन विषयों पर प्रावधान नहीं है, उनके लिए राज्य सरकार की प्रासंगिक संहिता/ नियमावली/संकल्प/अनुदेष लागू होंगे।

11॰ इस नियमावली के प्रवृत्त होने की तिथि से पूर्व के प्रासंगिक संकल्प/परिपत्र आदि जो इस नियमावली के प्रावधानों के प्रतिकूल हों, उस हद तक निरसित समझे जायेंगे।

No.-2/नि॰/स्था॰सा॰ (01)-16/2006 4764—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following rules for recruitment, promotion and regulation of other Service-Conditions for the Clerk Cadre Cooperative Department Offices: -

1. Short title, extent and commencement. –

(a) These rules may be called the Cooperative Department Clerk Cadre Rules, 2008.

(b) It extends to the whole State of Bihar. (c) It shall commence at once.

2. Definition. - In these rules, unless otherwise provided in the context: –

(a) 'Department' means the Cooperative Department; (b) 'Cadre' means group of persons working on posts specified in rule 3(a);

(c) 'Member' means person working in the Clerk Cadre of the Cooperative Department;

(d) 'Appointing Officer' means the Registrar, Cooperative Societies, Bihar;

(e) 'Commission' means the Bihar Staff Selection Commission.

3. The Cadre Constitution. -

(a) The Cadre shall include the following grades of posts: -

(b) The members working on the posts of Clerk under the department on dated 20.12.2000 shall be deemed appointed and working on the posts of Upper Division Clerk under this rule. The members working on the posts of Lower Division Clerk after dated 20.12.2000 shall be deemed appointed and working on the posts of Lower Division Clerk under this rule. (c) The Cadre shall be of State level. (d) The sanctioned strength of the different grades of posts shall be refixed under the provision of sub-clause (a). As a result of such fixation of strength of posts if the working strength of the Upper Division Clerk exceeds the sanctioned strength of posts in this grade, the number of such exceeded posts shall be deemed to be the posts of the Upper Division Clerk till vacancies of such deemed exceeded posts in the grade and the number of the Lower Division Clerk equivalent to the number of above exceeded posts shall be deemed excluded till above vacancies. There shall be no promotion to the posts of the Upper Division Clerk unless the working strength of the Upper Division Clerk does not come under the sanctioned strength in this grade.

(e) The sanctioned strength of different grades of posts in the Cadre shall be amended by the State Government with the creation and surrender of posts from time-to-time.

4. Recruitment Procedure. – (1) Direct Recruitment: -

(a) The Appointing Officer shall determine the vacancies on the basis of position as on 1st April every year. The requisition as per reservation categories shall be sent to the Commission till 30th April after getting roster of such determined vacancies cleared.

(b) 85% of the strength of posts shall be filled from direct recruitment:

Provided that the maximum 10% of the direct recruitment posts shall be earmarked for appointment from the dependents of deceased government servants on compassionate ground.

(c) Direct recruitment under above section (b) shall be made on the basis of competitive examination conducted by the Commission.

(d) Minimum educational qualification for recruitment shall be pass in Matric or equivalent examination. In addition proficiency in typing on type machine and computer shall be compulsory. The minimum age limit shall be 18 years and the5 (cid:1)बहार गजट, (असाधारण)] 23 अ&तूबर 2008 maximum age limit shall be that, determined by the State Government (Department of Personnel and Administrative Reforms) from time-to-time. Age eligibility shall be according to 1st August.

Provided that, such Lower Division Clerk or Upper Division Clerk, considered as deemed included in the Cadre and are less than 50 years of age on the date of commencement of the rule shall acquire proficiency in typing on type machine and computer compulsorily within two years from the date of commencement of this rule. Otherwise, there shall be no increment payable to those not acquiring such eligibility.

(e) The syllabus and the marks for examination under section (c) and (d) shall be determined in consultation with the Commission.

(f) Appointment of compassionate ground shall be made according to process determined by the State Government from time-to-time.

(2) Recruitment by Limited Competitive Examination: - Remaining 15% of the post strength shall be filled on the basis of the Limited Competitive Examination of such Group-'D' personnel working in regular field establishment of the State Government and confirmed in the service who are minimum pass in Matric or equivalent examination and are proficient in typing on type machine and computer and are working minimum for five years. The syllabus and the marks for the Limited Competitive Examination shall be determined in consultation with the Commission.

5. Probation Period. - The probation period after appointment shall be of two years. The probation period may be extended upto one year if the service and conduct is not found satisfactory. The appointment of such personnel shall be terminated without notice if service and conduct is not found satisfactory during the extended period.

6. Confirmation. – The appointed members may be confirmed in the Cadre after successful completion of probation period and passing the departmental examination as determined by the State Government for clerks.

7. Promotion. –

(a) Members confirmed in the Cadre may be promoted from Lower Division Clerk grade to Upper Division Clerk grade and from Upper Division Clerk grade to Head Clerk grade on the basis of seniority-cum-merit recommended by the Departmental Promotion Committee according to the rules determined by the State Government.

(b) It shall be compulsory to complete time period as determined for promotion from one grade to another by the State Government (Department of Personnel and Administrative Reforms) from time-to-time.

8. Posting. – Members of Cadre may be posted to the post identified for their grade in any of the field offices of the Cooperative Department.

9. Removal of Difficulty. – The State Government may remove the difficulty by necessary order in case any difficulty arises while implementing any of the provisions of this rule.

10. The relevant Code/Rule/Resolution/Circular of the State Government shall remain applicable for which provisions have not been made in this rule.

11. The relevant Resolution/Circular etc. contrary to these provisions of this rule prior to the date of commencement of this rule shall be considered as deemed repealed to that extent.
