सं0 5622/जे0-सिविल प्रक्रिया संहिता, 1908 के आदेश XXVI के नियम-9 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल सिविल न्यायालय सर्वे कमीशन नियमावली, 1954 का संशोधन करने हेतु निम्नलिखित संशोधन नियमावली बनाते हैंः- 1. (1) यह नियमावली व्यवहार न्यायालय सर्वेक्षण आयोग (प्रथम संशोधन) नियमावली, 2008 कही जा सकेगी।
(2) यह नियमावली सरकारी राजपत्र में इसके प्रकाशन की तिथि से अथवा राज्य सरकार द्वारा अधिसूचित होने की तिथि से प्रभावी होगें।
2. नियम 2(बी) ः- नियम के अन्तर्गत ''अधीनस्थ अभियांत्रिक प्रमाण-पत्र परीक्षा'' एवं ''सिविल अभियंत्रण के लिए अनुज्ञप्ति डिप्लोमा परीक्षा'' शब्दों के बीच ''अभियंत्रण में डिप्लोमा'' शब्द जोड़ें। 3. नियम 2(सी) :- ''व्यवहार न्यायालयों'' एवं ''न्याय मंडल'' में शब्दों के बीच ''एवं उच्च न्यायालय राजस्व न्यायालय इत्यादि'' शब्द जोडें़।
4. नियम 3 ः- इन शब्दों को विलोपित करें- ''1 दिसम्बर, 1934 से पहले'' इन शब्दों ''जो अधिवक्ता (प्लीडर) के रूप में सम्यक रूप से नामांकित नहीं हुए थे'' को ''जो अधिवक्ता/अधिवक्ता (प्लीडर) के रूप में सम्यक् रूप से नामांकित नहीं हुए थे'' से प्रतिस्थापित करें।
5. नियम 4(3) ः- ''बिहार अभियंत्रण महाविधालय के प्राचार्य'' के स्थान पर'' निदेशक, राष्ट्रीय तकनीकी संस्थान, पटना (एतत् पश्चातृ एन0आई0टी0 के नाम से भी अभिहित) से प्रतिस्थापित करें। 6. नियम 4(4) ः- नियम 4 (5) के रूप में ''आयुक्त-सह-सचिव, राजस्व एवं भूमि सुधार'' शब्द जोडे़ं।2 (cid:18)बहार गजट, (असाधारण), 21 नवम्बर 2008 7. नियम 4(4) ः- ''तिरहुत अभियंत्रण विद्यालय'' के स्थान पर ''मुजफ्फरपुर तकनीकी संस्थान (एतत् पश्चात् एम0आई0टी0 के नाम से भी अनिहित) प्रतिस्थापित करें एवं इसे नियम 4(6) के रूप में संशोधित करें। वर्त्तमान नियम 4(6) को विलोपित करें।
8. नियम 6 ः- ''बिहार सरकार एवं उड़ीसा सरकार के परामर्श से'' की जगह पर ''एन0आई0टी0 अथवा एम0आई0टी0, जैसा भी मामला हो, के परामर्श से'' प्रतिस्थापित करें। ''तथा उड़ीसा सरकार'' शब्दों को विलोपित करें।
9. नियम 6(टिप्पणी) :- इन शब्दों को प्रतिस्थापित करें- ''सचिव अथवा अन्य संयुक्त सचिव, जैसा भी मामला हो, के द्वारा पटना अथवा मुजफ्फरपुर केन्द्र पर उपस्थित होने वाले प्रत्याशियों से प्राप्त की गई फीस एन0आई0टी0, पटना/ एम0आई0टी0, मुजफ्फरपुर, जैसा भी मामला हो, के खाते में जमा की जाएगी। पटना एवं मुजफ्फरपुर केन्द्रों पर आयोजित की जाने वाली परीक्षाओं का व्यय एन0आई0टी0, पटना/एम0आई0टी0, मुजफ्फरपुर द्वारा, जैसा भी मामला हो, सरकार की मदद से, यदि आवश्यक हो, वहन किया जाएगा। चूंकि सैद्धांतिक पत्र वही रहेगें, इसके प्रश्न पत्र की तैयारी एवं जांच का व्यय प्रत्येक केन्द्र पर अभ्यार्थियों की संख्या के अनुसार एन0आई0टी0, पटना/एम0आई0टी0, मुजफ्फरपुर के द्वारा वहन किया जाएगा''।
10. नियम 7 :- इन शब्दों को विलोपित करें- ''वर्ष में एक बार, फरवरी माह में अथवा'' .............
11. नियम 7(i) एवं 7 (ii) ः- वर्तमान प्रावधानों के स्थान पर ''राष्ट्रीय तकनीकी संस्थान, पटना में प्रशिक्षण प्राप्त कर रहे अभ्यर्थियों के लिए राष्ट्रीय तकनीकी संस्थान, पटना तथा मुजफ्फरपुर तकनीकी संस्थान, मुजफ्फरपुर में प्रशिक्षण प्राप्त कर रहे अभ्यर्थियों के लिए मुजफ्फरपुर, तकनीकी संस्थान, मुजफ्फरपुर'' को प्रतिस्थापित करें। नियम 7 (iii) को विलोपित करें।
12. नियम 10 :- ''बिहार अभियंत्रण महाविद्यालय एवं तिरहुत अभियंत्रण विद्यालय'' के स्थान पर क्रमशः ''राष्ट्रीय तकनीकी संस्थान एवं मुजफ्फरपुर तकनीकी संस्थान, मुजफ्फरपुर'' प्रतिस्थापित करें। इन शब्दों को विलोपित करें। 'उड़ीसा अभियंत्रण विद्यालय''
13. नियम 11 :- नियम 11 नियम 11 (i) में अधिवक्ता (प्लीडर) के स्थान पर ''अधिवक्ता अथवा अधिवक्ता (प्लीडर)'' शब्द से प्रतिस्थापित करें।
14. नियम 11 (ii) ः- ''पटना विश्वविद्यालय अथवा बिहार विश्वविद्यालय का इण्टरमिडिएट अभियंत्रण परीक्षा'' शब्दों को ''पटना विश्वविद्यालय अथवा कोई अन्य विश्वविद्यालय से अभियंत्रण परीक्षा में डिप्लोमा'' से प्रतिस्थापित करें।
15. नियम 13 :- ''जनवरी में उक्त तिथि को'' शब्दों को ''परीक्षा समिति द्वारा अधिसूचित तिथि को'' से प्रतिस्थापित करें।
16. नियम 13 ः- इन शब्दों को विलोपित करें- ''एवं बिहार राजपत्र एवं उड़ीसा राजपत्र के पूर्ववर्ती महीने के दो अंकों में अधिसूचित''। ''शुल्क के रूप में 50/- रुपये'' को शुल्क के रूप में 500/- रुपये जो कि एन0आई0टी0, पटना अथवा एम0आई0टी0, मुजफ्फरपुर, जैसा भी मामला हो, को भुगतान किया जाता है'' से प्रतिस्थापित करें।
17. नियम 16 का परन्तुक ः- ''परन्तु यह कि परीक्षा समिति यथा अपेक्षित समय पर नियमानुसार उपरोक्त पाठ्क्रम की समीक्षा एवं उसे अद्यतन करने हेतु अधिकृत है।''
18. नियम 17 ः- ''बिहार अभियंत्रण महाविद्यालय, पटना तिरहुत अभियंत्रण विद्यालय, मुजफ्फरपुर एवं उड़ीसा अभियंत्रण विद्यालय, कटक'' के स्थान पर ''राष्ट्रीय तकनीकी संस्थान, पटना एवं मुजफ्फरपुर तकनीकी संस्थान, मुजफ्फरपुर'' प्रतिस्थापित करें। इन शब्दों को विलोपित करें ''उड़ीसा अभियंत्रण विद्यालय, कटक''। इन शब्दों को विलोपित करें। ''प्रत्येक वर्ष जनवरी एवं फरवरी माह में'' तथा इन शब्दों को प्रतिस्थापित करें- नियमावली के नियम-4 के अधीन गठित समिति के द्वारा विनिश्चत प्रत्येक वर्ष का उक्त महीना''।3 (cid:18)बहार गजट, (असाधारण), 21 नवम्बर 2008 19. नियम 17 ः- (टिप्पणी) निम्न रूप में प्रतिस्थापित किया जाय ''पटना एवं मुजफ्फरपुर केन्द्रों पर प्रशिक्षण के सभी व्यय एन0आई0टी0, पटना/एम0आई0टी0, मुजफ्फरपुर द्वारा सरकार के सहयोेग से वहन किये जायेगें। ''इन शब्दों को विलोपित करें ''तथा कटक के केन्द्रों का उड़ीसा सरकार के सहयोग से।''
20. नियम 20 ः- ''बिहार अभियंत्रण महाविद्यालय'' एवं ''तिरहुत अभियंत्रण विद्यालय'' के स्थान पर ''राष्ट्रीय तकनीकी संस्थान'' एवं ''मुजफ्फरपुर तकनीकी संस्थान,'' प्रतिस्थापित करें। ''कटक'' शब्द को विलोपित करें एवं इन शब्दों को भी विलोपित करें ''एवं उड़ीसा अभियंत्रण विद्यालय, कटक के प्राचार्य''।
21. नियम 25 ः- ''बिहार अभियंत्रण महाविद्यालय'' एवं ''तिरहुत अभियंत्रण विद्यालय'' के स्थान पर क्रमशः ''राष्ट्रीय तकनीकी संस्थान'' एवं ''मुजफ्फरपुर तकनीकी संस्थान,'' प्रतिस्थापित करें। इन शब्दों को भी विलोपित करें ''अथवा उड़ीसा अभियंत्रण विद्यालय, कटक के प्राचार्य''।
22. नियम 26 :- वर्तमान प्रावधानों- ''उक्त पाठ्क्रम के लिए शुल्क 100/- रुपये अग्रिम देय होगा'', के स्थान पर इन शब्दों को प्रतिस्थापित करें- ''इसके साथ 2500/- रुपया एवं 500/- रुपया क्रमशः प्रशिक्षण एवं परीक्षा शुल्क हेतु अग्रिम देय होगा''।
नीचे की टिप्पणी में ''एन0आई0टी0, पटना/एम0आई0टी0, मुजफ्फरपुर/बिहार सरकार'' शब्दों को प्रतिस्थापित करें एवं इन शब्दों को विलोपित करें ''तथा उड़ीसा के अभ्यर्थी द्वारा उड़ीसा सरकार को वे सभी''।
23. नियम 27 :- ''सचिव द्वारा उस महीने की अवधि में बिहार राजपत्र एवं उड़ीसा राजपत्र के प्रथम दो अंकों में अधिसूचित एवं प्रत्येक वर्ष के नवम्बर एवं दिसम्बर महीने में विनिश्चित तिथि के बाद नहीं'' को ''ऐसी तिथि एवं महीने में अधिसूचित किया जाना है जैसा समिति विनिश्चित करें एवं बिहार में प्रचलित किसी प्रसिद्ध हिन्दी एवं अंग्रेजी दैनिक समाचार पत्र में तथा बिहार राजपत्र में अधिसूचित किया जाना है।'' से प्रतिस्थापित करें। अधिवक्ताओं (प्लीडरों) के मामले में आवेदन-पत्र जिला न्यायाधीश द्वारा पृष्ठांकित किया जाएगा अथवा विधि स्नातकों या विधि छात्रों के मामले में विधि महाविद्यालय के प्राचार्य द्वारा आवेदन पत्र को पृष्ठांकित किया जाएगा। इसमें उस केन्द्र का जिक्र होगा जहां अभ्यर्थी प्रवेश चाहता है तथा इसके साथ कोषागार की प्राप्ति रसीद संलग्न होगी जो इस बात का प्रमाण होगी कि पाठ्क्रम के लिए 100/- रुपये का शुल्क कोषागार में जमा किया जा चुका है, जब तक उक्त रसीद प्राप्त नहीं होता है, अभ्यर्थी का नाम निबंधित नहीं किया जाएगा'' शब्दों को निम्नलिखित शब्दों से प्रतिस्थापित करें- ''अधिवक्ताओं/अधिवक्ताओं (प्लीडरों) के मामले में आवेदन-पत्र जिला न्यायाधीश द्वारा पृष्ठांकित किया जाएगा अथवा विधि स्नातकों अथवा विधि छात्रों के मामले में विधि महाविद्यालय के प्राचार्य द्वारा आवेदन पत्र पृष्ठांकित किया जाएगा। इसमें उस केन्द्र का जिक्र होगा जहां अभ्यर्थी प्रवेश चाहता है तथा इसके (आवेदन पत्र के) साथ रसीद संलग्न होगी तथा अभ्यर्थी के नाम के निबंधन हेतु फीस प्राप्ति का तरीका समिति द्वारा तय किया जाएगा''
24. नियम 8 एवं 28 :- अंक ''20'' एवं ''24'' के स्थान पर अंक ''60'' प्रतिस्थापित करें। 25. नियम 29(ए) :- ''तथा एक सप्ताह के लेवलिंग पर'' के स्थान पर ''लेवलिंग का एक सप्ताह एवं इलेक्ट्रॉनिक कैस्ट्रल मेजरिंग इन्स्टीच्यूट का एक सप्ताह'' प्रतिस्थापित करें।
26. नियम 30 :- (समाविष्ट किया जाना है) यह नियम कठिनाइयां, यदि हों, तो उसे दूर करने के लिए है, जिसे निम्न प्रकार से निर्धारित किया जाता हैः- ''30'' उक्त संशोधनों के बावजूद व्यवहार न्यायालय सर्वेक्षण आयोग नियमावली, 1954 की उपधारा (1) अथवा अन्य अधिनियमों के द्वारा किया गया कोई कार्य अथवा उठाया गया कोई कदम अथवा किन्हीं अधिनियमों के अन्तर्गत किया जाने वाला कोई कार्य अथवा उठाया गया कोई कदम, यदि वह इन नियमों के प्रावधानों से असंगत नहीं हो, उसे इस नियम के प्रावधानों के अन्तर्गत किया गया अथवा उठाया गया (कदम) समझा जाएगा।''4 (cid:18)बहार गजट, (असाधारण), 21 नवम्बर 2008 fVIi.kh (1) प्रस्तावित संशोधित नियमावली के सम्पूर्ण विषय को प्रस्तुत करते समय, जहां कहीं भी, अधिवक्ता (प्लीडर) शब्द प्रयुक्त हुआ है उसे अधिवक्ता। अधिवक्ता (प्लीडर) शब्द से प्रतिस्थापित किया जाएगा।
(2) प्रस्तावित संशोधित नियमावली के सम्पूर्ण विषय में, जहां कहीं भी ''संयुक्त सचिवों'' का उल्लेख हुआ है उसे ''संयुक्त सचिव'' शब्द से प्रतिस्थापित किया जाएगा।

No. 5622.--In exercise of the powers conferred by Rule 9 of Order XXVI of the Civil Procedure Code, 1908 the Governor of Bihar is pleased to make the following Amendment rules to amend the Civil Court Survey Commission rules, 1954. 1. (1) These Rules may be called the Civil Court Survey Commission (First Amendment) Rules, 2008.
(2) These Rules shall come into effect from the date of its publication in Official Gazette or any date notified by the State Government.
2. Rule 2(b): Add the word "Diploma in Engineering" in between the words "Subordinate Engineer's Certificate Examination" and "examination for Licentiate Diploma in Civil Engineering" Occurring in Rule.
3. Rule 2(c): Add the words "and the High Court, Revenue Courts etc." in between the words "Civil Courts" and "in the Judgeship".
4. Rule 3: Delete the words "before the 1st December 1934" substitute the words, "who had not been duly enrolled as pleader" with the words, "who had not been duly enrolled as Advocates/Pleaders."
5. Rule 4(3) Substitute "the Director of the National Institute of Technology, Patna (hereinafter also called N.I.T.)" in place of the Principal of the Bihar Collector of Engineering.
6. Rule 4(4): Add the words "Commissioner and Secretary, Revenue and Land Reforms" Bihar as Rule 4(5).
7. Rule 4(5): Substitute Muzaffarpur Institute of Technology (hereinafter also called M.I.T.)" in place of "Tirhut School of Engineering" and amend it as Rule 4(6). Delete the existing rule 4(6).
8. Rule 6: Substitute the words "in consultation with the Government of Bihar and the Government of Orissa" with "in consultation with N.I.T. or M.I.t. as the case may be". Delete "and the Government of Orissa".
9. Rule 6 (NOTE): Substitute "The fees received by the Secretary or the other Joint Secretary, as the case may be, from candidates appearing at the Patna or Muzaffarpur centre, will be credited to the NIT, Patna/MIT, Muzaffarpur account as the case may be. All costs for holding the examination at Patna and Muzaffarpur Centers will be met by5 (cid:18)बहार गजट, (असाधारण), 21 नवम्बर 2008 N.I.T., Patna/M.I.T., Muzaffarpur as the case may be with the help of the Government if need be. As the theoretical paper will be the same, its cost of setting and examining will be paid by the NIT, Patna/M.I.T., Muzaffarpur according to the number of candidates appearing at each centre".
10. Rule 7 :Delete the words "once annually, in the month of February, or.............. 11. Rule 7 (i) & (ii): Substitute "National Institute of Technology, Patna for candidates receiving training at the National Institute of Technology, Patna" and Muzaffarpur Institute of Technology, Muzaffarpur for candidates receiving training at the Muzaffarpur Institute of Technology, Muzaffarpur" in place of existing previsions. Delete Rule 7(iii).
12. Rule 10: Substitute "National Institute of Technology" and "Muzaffarpur Institute of Technology, Muzaffarpur" in place of Bihar College of Engineering" and Tirhut School of Engineering" respectively. Delete the words, "the Orissa School of Engineering". 13. Rule 11: Substitute the word 'Pleader' as "Advocate or Pleader", in Rule 11, Rule 11(i).
14. Rule 11(ii): Substitute the word "Intermediate Engineering Examination of the Patna University of the University of Bihar" "with Diploma in Engineering Examination in Patna University or any other University".
15. Rule 13: "On such date in January" be substituted as "on such date as notified by the Examination Board".
16. Rule 13: Delete "and notified in two issues of the Bihar Gazette and Orissa Gazette during the preceding month." "fee of Rs. 50/- "be substituted as "fee of Rs. 500/- to be paid N.I.T. Patna or M.I.T., Muzaffarpur as the case may be".
17. Proviso to Rule 16: "Provided that Examination Board as per Rule is authorised to review and update the above syllabus as and when required."
18. Rule 17: substitute the words "Bihar College of Engineering, Patna, the Tirhut School of Engineering, Muzaffarpur and the Orissa School of Engineering, Cuttack with" National Institute of Technology, Patna and Muzaffarpur Institute of Technology, Muzaffarpur", Delete "the word Orissa School of Engineering Cuttack." Delete the words in the months of January and February each year" with the following words" From such months each year as decided by the of the Board constituted under rule 4 of the Rules".
19. Rule 17 (NOTE): Be substituted as follows "all costs of training at Patna and Muzaffarpur Centers will be borne by the NIT, Patna/MIT, Muzaffarpur, with the help of the Government". Delete the words "and those at Cuttack Centre by the Orissa Government".
20. Rule 20: Substitute "National Institute of Technology" and Muzaffarpur Institute of Technology" in place of "Bihar College of Engineering" and "Tirhut School of Engineering" respectively Delete the word "Cuttack" and also delete the words" and the Principal of the Orissa School of Engineering, Cuttack".
21. Rule 25: Substitute "National Institute of Technology" and Muzaffarpur Institute of Technology" in place of "Bihar College of Engineering" and "Tirhut School of Engineering" respectively. Delete "or the Principal of the Orissa School of Engineering Cuttack".
22. Rule 26: Substitute the words "The fee for the course will Rs. 100/- payable in advance" with the fee for the course will be charged Rs. 2500/- and Rs. 500/- as training and examination fee respectively payable in advance" in place of existing provisions.
In the "Note below" substitute "NIT Patna/MIT, Muzaffarpur Bihar Government and delete the words "and those by Orissa candidate to the Orissa Government." 23. Rule 27: Substitute the words" not later than such date in November or December, as may be fixed annually by Secretary and notified by in the first two issues of the Bihar Gazette and the Orissa Gazette during the month" with to be notified on such date and month as may be fixed by the Board and notified in one reputed Hindi and English daily newspaper having circulation in Bihar as well as Bihar Gazette. Substitute the following words "The application shall be endorsed by the District Judge in the case of pleaders or by the Principal of the Law College in the case of Graduates-in-Law or Law students. It shall state the centre which the candidate wishes to join and shall be accompanied by a receipt from the treasury certifying that the fee or Rs. 100/- for the course has been deposited into the treasury: unless such receipt be received, the candidate's name will not be registered" with the words as follows: "The application shall be endorsed by the District Judge in the case of Advocates/Pleaders or by the Principal6 (cid:18)बहार गजट, (असाधारण), 21 नवम्बर 2008 or the Law College in the case of Graduates-in-Law or law student. It shall state the centre which the candidates wish to join and shall be accompanied by the receipt and the mode or receiving the fees shall be decided by the Board for registration of the name of the candidates.
24. Rule 8 & 28: Substitute the figure "60" in place of figure "20" and "24". 25. Rule 29(a): Substitute "one week of levelling and one week of Electronic Castral measuring Institute", in place of "and one week on levelling.
26. Rule 30: (To be added) This rule is for removing the difficulties, if any, which may be laid down as follows:
"30 Notwithstanding such amendments, anything done or any action taken or purported to have been done or taken under any of the enactments by Sub-section (1) of Civil Court Survey Commission Rules, 1954 or other enactments shall, in so far as it is not inconsistent with the provisions of these Rules be deemed to have been done or taken under the corresponding provisions of this Rules."
Note (1) While presenting the full text of the proposed amended rules, wherever, the word pleader has been used, the same shall be substituted by the word advocate/Pleader.
(2) In the proposed full text of amended rules, wherever the word "joint Secretaries" have been mentioned, the same shall be substituted by the word "Joint Secretary".
