7/नि॰ (विधि-04) नियम-114/2006/7340—बिहार सहकारी सोसाईटी अधिनियम, 1935 की धारा बिहार सहकारी सोसाईटी अधिनियम, 1935 की धारा 66 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार सहकारी सोसाईटी नियमावली, 1959 में 66 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार सहकारी सोसाईटी नियमावली, 1959 में निम्नलिखित संषोधन किए हैं, जिन्हें अधिनियम की उक्त धारा की उप धारा (3) में यथापेक्षित बिहार राजपत्र दिनांक निम्नलिखित संषोधन किए हैं, जिन्हें अधिनियम की उक्त धारा की उप धारा (3) में यथापेक्षित बिहार राजपत्र दिनांक निम्नलिखित संषोधन किए हैं, जिन्हें अधिनियम की उक्त धारा की उप धारा (3) में यथापेक्षित बिहार राजपत्र दिनांक 18 सितम्बर, 2008 में पहले प्रकाषित किया जा चुका है। 18 सितम्बर, 2008 में पहले प्रकाषित किया जा चुका है।
संक्षिप्त ''नाम और आरम्भ''
1. संक्षिप्त ''नाम और आरम्भ''
बिहार सहकारी सोसाईटी (संषोधन) नियमावली, 2008 कही जा सकेगी। बिहार सहकारी सोसाईटी (संषोधन) नियमावली, 2008 कही जा सकेगी। (क) यह नियमावली बिहार सहकारी सोसाईटी (संषोधन) नियमावली, 2008 कही जा सकेगी। (ख) यह तुरत के प्रभाव से प्रवृत होगी। (ख) यह तुरत के प्रभाव से प्रवृत होगी।
बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 2 में संषोधन। -
2. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 2 में संषोधन। -
(क) उक्त नियमावली के नियम 2 ( ) में ''बिहार'' के बाद प्रयुक्त शब्द ''और उड़ीसा'' विलोपित किया उक्त नियमावली के नियम 2 (i) में ''बिहार'' के बाद प्रयुक्त शब्द ''और उड़ीसा'' विलोपित जाएगा। उक्त नियमावली के नियम 2 (vi) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-
) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-
(ख) उक्त नियमावली के नियम 2 ( ''कार्यषील पूँजी'' से अभिप्रेत है ''उधार और स्वाधिकृत पूँजी के योग से घटाए गए समेकित ''कार्यषील पूँजी'' से अभिप्रेत है ''उधार और स्वाधिकृत पूँजी के योग से घटाए गए समेकित ''कार्यषील पूँजी'' से अभिप्रेत है ''उधार और स्वाधिकृत पूँजी के योग से घटाए गए समेकित हानि के पश्चात् अवषेष राषि।'' हानि के पश्चात् अवषेष राषि।'' उक्त नियमावली के नियम 2 (ix) का खण्ड (क) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा खत द्वारा प्रतिस्थापित किया जाएगाः- (ग) उक्त नियमावली के नियम 2 ( ''(क) सहकारी सोसाईटी, जिसका कार्य क्षेत्र सम्पूर्ण बिहार राज्य हो और जिसके सदस्य केन्द्रीय ''(क) सहकारी सोसाईटी, जिसका कार्य क्षेत्र सम्पूर्ण बिहार राज्य हो और जिसके सदस्य केन्द्रीय ''(क) सहकारी सोसाईटी, जिसका कार्य क्षेत्र सम्पूर्ण बिहार राज्य हो और जिसके सदस्य केन्द्रीय सोसाईटी हों'', या सोसाईटी हों'', या
(घ) उक्त नियमावली के नियम 2 (xi) का खण्ड (क) को निम्नलिखित द्वारा प्रतिस्थापित किया ) का खण्ड (क) को निम्नलिखित द्वारा प्रतिस्थापित किया (घ) उक्त नियमावली के नियम 2 (

) का खण्ड (क) विलोपित किया जाएगा।
री सोसाईटी जिसके सदस्य केवल प्राथमिक सहकारी सोसाईटी हों'', या री सोसाईटी जिसके सदस्य केवल प्राथमिक सहकारी सोसाईटी हों'', या ''(क) सहकारी सोसाईटी जिसके सदस्य केवल प्राथमिक सहकारी सोसाईटी हों'', या (ङ) उक्त नियमावली के नियम 2 (xii) का खण्ड (क) विलोपित किया जाएगा। (ङ) उक्त नियमावली के नियम 2 ( (च) उक्त नियमावली का नियम 2 (xiii) विलोपित किया जाएगा। (च) उक्त नियमावली का नियम 2 ((cid:1)बहार गजट (असाधारण), 26 नव'बर 2008 2 (छ) उक्त नियमावली का नियम 2 (xiv) विलोपित किया जाएगा। (ज) उक्त नियमावली का निमय 2 (xv) विलोपित किया जाएगा। (झ) उक्त नियमावली के नियम 2 (xvi) का खण्ड (क) विलोपित किया जाएगा। () उक्त नियमावली का नियम 2 (xvii) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
''निर्वाचन पदाधिकारी'' से अभिप्रेत है ''कोई भी पदाधिकारी, जिसे किसी भी नाम से जाना जाता हो, जिसे इस नियमावली के अधीन किसी सहकारी सोसाईटी का निर्वाचन संपन्न कराने का दायित्व सौंपा गया हो।''
(ट) उक्त नियमवाली के नियम 2 (xix) में शब्द ''एक प्रतिनिधि-प्रतिनिधियों'' को विलोपित किया जाएगा।
(ठ) उक्त नियमावली का नियम 2 (xx) के खण्ड (ख) विलोपित किया जाएगा। (ड) उक्त नियमावली का नियम 2 (xx) के खण्ड (ग) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः- ''अन्य मामलों में आम सभा के लिए निर्वाचन पदाधिकारी द्वारा यथा प्रकाषित प्रतिनिधियों की सूची।''
(ढ) उक्त नियमावली का नियम 2 (xxi) विलोपित किया जाएगा। (ण) उक्त नियमावली का नियम 2 (xxviii) विलोपित किया जाएगा और निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः- ''निर्वाचन प्राधिकार'' से अभिप्रेत है ''वह प्राधिकार जिसे अधिनियम की धारा 14 क (1) के अधीन किसी वर्ग या वर्गों की निबन्धित सहकारी सोसाईटी के प्रबन्ध समिति के निर्वाचन का संचालन करने के लिए परिभाषित किया गया है।''
(त) उक्त नियमावली के नियम 2 (xxviii) के बाद निम्नलिखित नियम 2 (xxix) जोड़ा जाएगा :- ''अधिसूचित सोसाईटी'' से अभिप्रेत है अधिनियम की धारा 14 क (1) के अधीन अधिसूचित वर्ग या वर्गों की निबंधित सोसाईटी।''
3. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 7 में संषोधन। -उक्त नियमावली के नियम 7 के उप-नियम (3) के बाद निम्नलिखित उप-नियम (4) जोड़ा जाएगा :-
''(4) इस नियमावली या किसी प्राथमिक कृषि साख सोसाईटी के उप-विधि में अन्तर्विष्ट किसी बात के प्रतिकूल होते हुए भी, कोई व्यक्ति, ऐसी किसी सोसाईटी का सदस्य बनने के लिए प्रखण्ड विकास पदाधिकारी या सहायक निबंधक, सहयोग समितियाँ या जिला सहकारिता पदाधिकारी के समक्ष घोषणा करता है कि -
(क) वह ऐसी सोसाईटी का सदस्य बनने की सारी शर्त्तों को पूरा करता है, (ख) उसके परिवार का कोई भी सदस्य सोसाईटी का सदस्य नहीं है और (ग) उसने ऐसी सोसाईटी के प्रबन्ध समिति के समक्ष सदस्य बनने के लिए आवेदन किया है और उसे सदस्य नहीं बनाया गया है तो,
यथास्थिति, सम्बन्धित प्रखण्ड विकास पदाधिकारी या सहायक निबंधक, सहयोग समितियाँ या जिला सहकारिता पदाधिकारी, ऐसे व्यक्ति को उस सोसाईटी का सदस्य बनाने के लिए आदेष करेगा।''
4. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 12 के बाद निम्नलिखित नियम 12क जोड़ा जाएगा।-
''12क इस नियमावली अथवा किसी सहकारी समिति की उप-विधि में अन्तर्विष्ट किसी बात के प्रतिकूल होते हुए भी, किसी भी शीर्ष सहकारी सोसाईटी अथवा केन्द्रीय सोसाईटी में कोई भी व्यक्तिगत सदस्य नहीं होगा और आगे कोई भी प्राथमिक सोसाईटी किसी शीर्ष सोसाईटी में सदस्य नहीं होगी परन्तु, किसी शीर्ष सोसाईटी अथवा केन्द्रीय सोसाईटी के व्यक्तिगत सदस्य ऐसी सोसाईटी के तब तक सदस्य रहेंगे जब तक ऐसे व्यक्ति उक्त सोसाईटी की सदस्यता नहीं खो देते हैं और किसी भी परिस्थिति में ऐसी सदस्यता का स्थानान्तरण नहीं किया जा सकेगा
परन्तु, और यह कि कोई प्राथमिक समिति पूर्व से किसी शीर्ष समिति का सदस्य है, तो वह उस शीर्ष समिति का सदस्य तब तक बनी रहेगी जब तक वह सोसाईटी ऐसी सम्बद्धक सोसाईटी की सदस्यता नहीं खो देती है।''
5. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 20 में संषोधन। -उप-नियम 20 (1) के बाद निम्नलिखित नया उप-नियम 20 (1क) जोड़ा जाएगा :- ''(क) इस नियमावली अथवा किसी सहकारी समिति की उप-विधि में अन्तर्विष्ट किसी बात के प्रतिकूल होने पर भी, किसी सहकारी समिति का अध्यक्ष ही उस सहकारी समिति का प्रतिनिधि होगा, जो अपनी समिति का प्रतिनिधित्व ऐसी सम्बद्धक समितियों और ऐसी सम्बद्धक समितियों की आम सभा3 (cid:1)बहार गजट, (असाधारण)] 26 नव'बर 2008 में करेगा, जिसका वह सहकारी समिति एक सदस्य है परन्तु यह कि किसी अवक्रमित सहकारी समिति में कोई प्रतिनिधि नहीं होगा।''
(ख) उक्त नियमावली के नियम 20 (3) में प्रयुक्त शब्द ''अनुग्रह अवधि'' शब्द ''छः माह'' द्वारा प्रतिस्थापित किए जाएँगे;
(ग) उक्त नियमावली के नियम 20 (5) (iii) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा -
''(iii) इस नियमावली अथवा किसी सहकारी समिति के उप-विधि में अन्तर्विष्ट किसी बात के प्रतिकूल होने पर भी, किसी सम्बद्धक समिति में प्रतिनिधित्व करने वाले सभी प्रतिनिधि ऐसी सम्बद्धक समिति की विषेष आम सभा में सीधे भाग लेंगे।''
6. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 21क में संषोधन। -
(क) उक्त नियमावली के नियम 21क में शब्द ''पदाधिकारियों और प्रतिनिधियों'' शब्द ''और पदाधिकारियों'' द्वारा प्रतिस्थापित किए जाएँगे;
(ख) उक्त नियमावली के नियम 21क के परन्तुक में शब्द ''पदधारियों और प्रतिनिधियों'' शब्द ''और पदधारियों'' द्वारा प्रतिस्थापित किए जाएँगे।
7. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 21ग में संषोधन।-उक्त नियमावली के नियम 21ग का उप-नियम (2) विलोपित किया जाएगा।
8. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 21त में संषोधन।-उक्त नियमावली के नियम 21त के उप-नियम (ii) का परन्तुक विलोपित किया जाएगा।
9. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 21भ में संषोधन।-उक्त नियमावली के नियम 21भ में शब्द ''30 दिनाें'' को शब्द ''90 दिनों'' द्वारा प्रतिस्थापित किए जाएँगे।
10. बिहार सहकारी सोसाईटी नियमावली, 1959 में नए नियम 21म का जोड़ा जाना।-
नियम 21भ के बाद निम्नलिखित एक नया नियम 21म जोड़ा जाएगा :
''21म निर्वाचन प्राधिकार द्वारा निर्वाचन - (क) निर्वाचन प्राधिकार के अधीक्षण, निदेषन एवं नियन्त्रण के अधीन किसी अधिसूचित सोसाईटी के प्रबन्ध समिति और पदधारियों का निर्वाचन होगा तथा इसमें निम्नलिखित शामिल किए जाएँगे :- (i) मतदाता सूची की तैयारी। (ii) निर्वाचन पदाधिकारी की नियुक्ति। (iii) निर्वाचन स्थल और मतगणना स्थल की अधिसूचना।
(ख) इस नियमावली अथवा किसी अधिसूचित समिति के उप-विधि में किसी बात के प्रतिकूल होने पर भी, निर्वाचन प्राधिकार (i) मतदाता सूची तैयार करेगा और मतदाता सूची की तैयारी के लिए कट-ऑफ तिथि का निर्धारण करेगा, जो निर्वाचन की तिथि के पूर्व अधिकतम 120 दिनाें की सीमा के अधीन होगा। (ii) ऐसे निर्वाचन के लिए कार्यक्रम निर्धारित करेगा, जिसमें निर्वाचन के सभी चरणों यथा निर्वाचन स्थल, तिथि और समय के साथ मतगणना भी शामिल होगा।
(iii) निर्वाचन पदाधिकारी को नियुक्त करेगा अथवा ऐसे पदाधिकारी, जो अनुमण्डल दण्डाधिकारी से अन्यून स्तर का न हो, को निर्वाचन पदाधिकारियों को नियुक्त करने के लिए प्राधिकृत करेगा।''
11. बिहार सहकारी सोसाईटी नियमावली, 1959 के नियम 22(1) के बाद नए उप-नियम 22 (1क) का अंतःस्थापन। -उप-नियम 22(1) के बाद निम्नलिखित उप-नियम 22(1क) अंतःस्थापित किया जाएगा :- ''(1क) नियमावली अथवा किसी सहकारी समिति के उप-विधि में अन्तर्विष्ट किसी बात के प्रतिकूल होने पर भी, यदि किसी सहकारी समिति की उप-विधि में विभिन्न प्रकार/वर्ग/समूह के सदस्यों का प्रावधान हो और यदि उस सहकारी समिति के पदधारियों अथवा प्रबन्ध समिति के सदस्यों का निर्वाचन, समिति की उप-विधि में प्रावधानित प्रकार/वर्ग/समूह के सदस्यों द्वारा किया जाना हो, तब केवल उन्हीं प्रकार/वर्ग/समूह के सदस्य, ऐसी निर्धारित प्रबन्ध समिति के प्रकार/वर्ग/समूह के सदस्यों के निर्वाचन हेतु मत देंगे।''

सं॰ 7/नि॰ (विधि-04)-नियम-114/06-7341—अधिसूचना संख्या 7340 दिनांक 26॰11॰08 के तहत् निर्गत बिहार सहकारी सोसाईटी (संषोधन) नियमावली, 2008 का संलग्न अंग्रेजी पाठ बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाषित किया जाता है, जिसे भारत-संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जाएगा।

THE BIHAR CO-OPERATIVE SOCIETIES (AMENDMENT) RULES, 2008
To amend the Bihar Co-operative Societies Rules, 1959
AMENDMENT
No. 7/नि॰ (विधि-04)-नियम-114/2006-7340—In exercise of powers conferred by section 66 of the Bihar Cooperative Societies Act 1935, the Governor of Bihar is pleased to make the following amendments to the Bihar Cooperative Societies Rules, 1959, the same having been previously published in the Bihar Gazette, dated 18th September, 2008, as required by sub-section (3) of the said section of Act.
1. Short Title and commencement:- (a) These rules may be called the Bihar Co-operative Societies (Amendment) Rules, 2008. (b) It shall come into force at once.
2. Amendment in Rule 2 of the Bihar Co-operative Societies Rules, 1959:-
(a) The word "and Orissa" after "Bihar" in rule 2 (i) of the said rules shall be deleted; (b) The rule 2 (vi) of said rules shall be substituted by the following:-
"working capital" means the sum of borrowing and owned fund minus accumulated loss";
(c) The clause (a) of rule 2 (ix) of the said rules shall be substituted by the following:-
"(a) a co-operative society whose area of operation covers the whole of Bihar and which has central societies as its members;" or
(d) The clause (a) of rule 2 (xi) of the said rules shall be substituted by the following:-
"(a) a co-operative society which has only primary Co-operative societies as its members;" or
(e) The clause (a) of rule 2 (xii) of the said rules shall be deleted; (f) The rule 2 (xiii) of the said rules shall be deleted; (g) The rule 2 (xiv) of the said rules shall be deleted; (h) The rule 2 (xv) of the said rules shall be deleted; (i) The clause (a) of rule 2 (xvi) of the said rules shall be deleted; (j) The rule 2 (xvii) of the said rules shall be substituted by the following:-
"Election Officer means any officer, by whatever name he/she may be known, entrusted in these rules with the responsibilities of conducting election of a co-operative society";
(k) In rule 2 (xix) of the said rules, the word "a delegate/delegates," shall be deleted; (l) The clause (b) of rule 2 (xx) of the said rules shall be deleted; (m) The clause (c) of rule 2(xx) may be substituted by the following:-
"in other cases, the list of delegates for the General Meeting, as published by the Election Officer";
(n) The rule 2 (xxi) of the said rules shall be deleted; (o) The rule 2 (xxviii) of the said rules shall be deleted and substituted by the following:- "Election Authority" means the authority as defined under Section 14 A(1) of the Act for the conduct of elections to the Managing Committee of a class or classes of registered societies";
(p) After Rule 2 (xxviii) of the said rules, the following rule 2 (xxix) shall be added :-
5 (cid:1)बहार गजट, (असाधारण)] 26 नव'बर 2008"Notified Society" means a class or classes of registered societies as notified under Section 14 A(1) of the Act.".
3. Amendment in Rule 7 of the Bihar Co-operative Societies Rules, 1959:-The following
sub-rule (4) shall be added after sub-rule (3) of Rule 7 of the said rules – "Notwithstanding anything contrary contained in this rule or bye-laws of a Primary Agriculture Credit Society, if any person applies for membership of such a society with a declaration to the Block development Officer or Assistant Registrar, Cooperative societies or District Cooperative Officer that-
(a) he fulfills the criteria for attaining membership of such a society, (b) no other member of his family is a member of the society and (c) he has applied for membership to the managing committee of such society and has not been admitted as a member,
the concerned Block Development Officer or Assistant Registrar Co-operative Societies or District Co-operative Officer, as the case may be, shall order such person to be made a member of the said society.".
4. The following rule 12A shall be added after Rule 12 of the Bihar Co-operative
Societies Rules, 1959:-
"12A. Notwithstanding anything contrary contained in this rule or bye-laws of a cooperative society, there shall be no individual member in any apex society or any central society and further no primary society shall be member of any apex society:
Provided that the individual members of any apex society or central society shall continue to remain members of such society till such individual ceases to be member of such society for whatever reason and such membership shall not be transferable;
Provided further that a primary society which is already a member of any apex society shall continue to be a member of such apex society till such society ceases to be member of such affiliating society."
5. Amendment in Rule 20 of the Bihar Co-operative Societies Rules, 1959:-The
following new sub-rule 20(1A) shall be added after sub-rule 20(1): "(a) Notwithstanding anything contrary contained in this rule or bye-laws of any cooperative society, the chairperson of the society shall be the delegate of that cooperative society who shall represent that society in the affiliating societies including the General Meetings of such affiliating societies of which that cooperative society is a member.
Provided that there shall be no delegate for a society which is under supersession." (b) In the rule 20(3) of the said rules, the words "Grace Period" shall be substituted by the words "six months."
(c) The rule 20(5)(iii) of the said rules shall be substituted by the following:-
"Notwithstanding anything contrary contained in this rule or bye-laws of any cooperative societies, all the delegates to an affiliating society shall directly participate in the Special General Meeting of such affiliating society."
6. Amendment in Rule 21A of the Bihar Co-operative Societies Rules, 1959:-
(a) In rule 21A of the said rules, the words "office bearers thereof and the delegates" shall be substituted by the words "and office bearers."
(b) In the proviso of Rule 21A of the said rules, the word "office bearers and the delegates" shall be substituted by the words "and office bearers".
7. Amendment in Rule 21C of the Bihar Co-operative Societies Rules, 1959:-The sub-
rule (2) of rule 21C of the said rules shall be deleted.
8. Amendment in Rule 21P of the Bihar Co-operative Societies Rule, 1959:-The proviso
to sub-rule (2) of rule 21P of the said rules shall be deleted.
9. Amendment in Rule 21X of the Bihar Co-operative Societies Rule, 1959:-In Rule 21X of the said rules, the words "30 days" shall be substituted by the words "90 days." 10. Addition of a new Rule 21Y in the Bihar Co-operative Societies Rules, 1959:- The following new rule 21Y shall be added after Rule 21X:
(cid:1)बहार गजट (असाधारण), 26 नव'बर 2008 6"21Y Election by the Election Authority - (a) The election to the Managing Committee and office bearers of notified societies shall be held under the superintendence, direction and control of the Election Authority, which shall include the following –
(i) Preparation of voter list, (ii) Appointment of Election Officers, (iii) Notification of place of voting and counting.
(b) Notwithstanding anything contrary in these rules or bye laws of any notified society, the Election Authority (i) shall get the voter list prepared and decide the cut-off date for the preparation of such voter list, which shall not be more than 120 days prior to the date of election.
(ii) shall determine the programme for such elections including venue, date and time for various stages of the election process including counting.
(iii) shall appoint the Election Officer or authorise any other officer not below the rank of Sub-divisional Magistrate for appointment of Election Officers."
11. Insertion of new sub-rule 22(1A) in the Bihar Cooperative Societies Rules, 1959:-The
following sub-rule 22(1A) shall be inserted after sub-rule 22(1):
"(1A) Notwithstanding anything contrary contained in this rule or the bye-laws of any cooperative society, if different types/classes/groups of members are provided in the bye-laws of a cooperative society and office bearers or number of members of managing committee to be elected from such types/classes/groups of members are also earmarked in the bye-laws of that cooperative society, only members belonging to that particular type/class/group shall vote for election of the office bearers and members of the managing committee earmarked for a particular type/class/group of members."
