एस॰ ओ॰ 1, दिनांक 6 जनवरी 2009—गृह विभाग, बिहार की अधिसूचना संख्या 1495/सी0, दिनांक 08/02/2008 एवं यथा संषोधित अधिसूचना संख्या 1795/सी0, दिनांक 18/02/2008 द्वारा बिहार राज्यपाल ने जॉच आयोग अधिनियम, 1952 (संख्या-60,1952) की धारा-3(i) के अधीन, दिनांक 18/01/2008 एवं 19/01/2008 को कहलगॉव, जिला-भागलपुर में हुई गोली कांड के सही तथ्यों, पृष्ठभूमी, एवं गोली कांड के लिए जिम्मेवार तत्वों की पहचान सहित भविष्य में ऐसी घटनाओं की पुनरावृति न होने के लिए सुझाव देने हेतु, न्यायमूर्ति श्री सदानन्द मुखर्जी (सेवा निवृत) की अध्यक्षता में एकल सदस्यीय न्यायिक जॉच आयोग का गठन किया गया तथा अधिसूचना निर्गत होने की तिथि से तीन माह के अन्दर प्रतिवेदन सौपने का निदेष दिया गया था। आयोग के अनुरोध पर गृह विभाग, बिहार की अधिसूचना संख्या-6887/सी0 दिनांक 25/06/08 द्वारा आयोग का कार्यकाल दिनांक 07/11/08 तक इस शर्त के साथ विस्तारित किया गया कि निर्धारित तिथि तक आयोग द्वारा प्रतिवेदन निष्चित रूप से समर्पित कर दिया जायेगा।
आयोग द्वारा दिनांक 01.10.08 को पुनः अनुरोध किया गया कि जॉच के लिए 70 (सत्त्तर) गवाहों द्वारा साक्ष्य प्रस्तुत करने की कार्रवाई लम्बित है तथा विभिन्न पक्षकारों का प्रतिपरीक्षण करने एवं प्रतिवेदन तैयार करने के निमित अतिरिक्त छः माह का अवधि विस्तार किया जाए।
बिहार राज्यपाल को समाधान हो गया है कि उपर्युक्त जॉच संबंधी कार्य पूर्ण करने के लिए आयोग का कार्यकाल दिनांक 31/03/09 तक विस्तारित करने की आवष्यकता है। 2 (cid:18)बहार गजट, (असाधारण)] 6 जनवर(cid:15) 2009 6 tuojh 2009 एस॰ओ॰ 2, एस॰ ओ॰ 1, दिनांक 6 जनवरी 2009 का अंग्रेजी में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाषित किया जाता है, जो भारत संविधान के अनुच्छेद-348 के खंड-(3) के अधीन अंग्रेजी भाषा में इसका प्राधिकृत पाठ समझा जाएगा।

The 6th January 2009
S.O 1, dated the 6th January 2009—The Governor of Bihar was pleased to constitute one member Commission of Inquiry under Section-3(i) of the Commission of Inquiry Act, 1952 (No. 60 of 1952) to enquire the incident of firing, which took place on 18.01.2008 and 19.01.2008 at Kahalagaon within the district of Bhagalpur, as it was a matter of public importance to know the true facts, background about the said incident and to identify those who were responsible for the trouble leading to firing, including suggestions regarding prevention of recurrence of such incident in future, under the chairmanship of its sole member, Mr Justice Sadanand Mukharjee (retired), Vide Home Department Notification no.- 1495/c dated 08.02.2008, amended as Notification No.- 1795/c Dated 18/02/08, with direction to submit its report within three month from the date of notification. On request of the above said Commission the tenure of the commission was extended upto 07/11/08 with the condition that the commission shall submit its report positively within the stipulated period, vide Home Department Notification No. 6887/c dated 25.06.2008. The commission has again requested on 01/10/08 that the submission of evidences in 70 (seventy) cases of witness are still pending to counter enquire by several respondents and to prepare the report, the tenure of the commission ought to be extended for further six months. The Governor of Bihar is satisfied that for accomplishment of the above mentioned Inquiry, the tenure of the Commission is essential to be extended up to 31.03.2009 Therefore, in exercise of the powers conferred under Section-3(i) of the Commission of Inquiry Act, 1952, the tenure of the commission is here by, extended for the last time upto 31/03/2009, with the condition that the commission shall submit it report positively within this stipulated period.
