1111.... संक्षिप्त नाम एवं प्रारम्भ - संक्षिप्त नाम एवं प्रारम्भ - संक्षिप्त नाम एवं प्रारम्भ - संक्षिप्त नाम एवं प्रारम्भ - (1) यह नियमावली बिहार सूचना इलेक्ट्रॉनिक अभियंता सेवा नियमावली, 2009 कही जा सकेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरत प्रवृत्त होगी।

2222. परिभाषाएंँ -परिभाषाएंँ -परिभाषाएंँ -परिभाषाएंँ -इस नियमावली में, जब तक संदर्भ सेें अन्यथा अपेक्षित न होः-

(क) 'राज्यपाल' से अभिप्रेत है बिहार के राज्यपाल; (ख) 'सरकार' से अभिप्रेत है बिहार सरकार; (ग) 'विभाग' से अभिप्रेत है सूचना एवं जन सम्पर्क विभाग; (घ) 'आयोग' से अभिप्रेत है बिहार लोक सेवा आयोग; (ड.) 'सदस्य या सेवा के सदस्य' से अभिपे्रत है बिहार सूचना इलेक्ट्रॉनिक अभियंता सेवा में नियुक्त व्यक्ति; तथा (च) 'अनुसूची' से अभिप्रेत है इस नियमावली में संलग्न अनुसूची; (छ) 'सेवा' से अभिप्रेत है बिहार सूचना इलेक्ट्रॉनिक अभियंता सेवा।

3333.... सेवा का सेवा का सेवा का सेवा का गठन -गठन -गठन -गठन -बिहार सूचना इलेक्ट्रॉनिक अभियंता सेवा के नाम से राज्य सेवा का गठन किया जायगा । 4444.... सेवा की संरचनाः-सेवा की संरचनाः-सेवा की संरचनाः-सेवा की संरचनाः-यह सेवा सूचना एवं जन-सम्पर्क विभाग के प्रशासी नियंत्रण में होगा।

राज्य सरकार समय-समय पर इसके पद बल का निर्धारण करेगी और स्वीकृत पदों के अतिरिक्त इस सेवा के स्थाई/अस्थाई पदों के सृजन की स्वीकृति दे सकेगी।

5555.... पद स्थिति -पद स्थिति -पद स्थिति -पद स्थिति -इस सेवा के सदस्य राजपत्रित होंगे।

6666.... भर्त्ती का ोत -भर्त्ती का ोत -भर्त्ती का ोत -भर्त्ती का ोत -अन्यथा उपबंधित के सिवाय, इस सेवा में भर्त्ती इस नियमावली के अध्याय-3 के अनुसार सीधी भर्ती द्वारा की जायेगी।

रिक्तियों का निर्धारण एवं आयोग को सूचित करना - विभाग प्रत्येक वर्ष की 1ली अप्रैल की स्थिति के आधार 7777.... रिक्तियों का निर्धारण एवं आयोग को सूचित करना - रिक्तियों का निर्धारण एवं आयोग को सूचित करना - रिक्तियों का निर्धारण एवं आयोग को सूचित करना - पर रिक्तियों की गणना करेगा और इस प्रकार परिगणित रिक्तियों के आधार पर सीधी भर्ती हेतु अधियाचना 30 अप्रील तक आयोग को भेजेगा।

8888.... आरक्षण - आरक्षण - आरक्षण - आरक्षण - नियुक्ति एवं प्रोन्नति में समय-समय पर निर्धारित राज्य सरकार की आरक्षण नीति एवं रोस्टर का अनुपालन आवश्यक होगा।

9999.... आयोग के माध्यम से सीधी भर्त्ती -आयोग के माध्यम से सीधी भर्त्ती -आयोग के माध्यम से सीधी भर्त्ती -आयोग के माध्यम से सीधी भर्त्ती -आयोग विज्ञापन निकाल कर, आवेदन प्राप्त कर प्रतियोगिता परीक्षा अथवा/और अंतर्वीक्षा के आधार पर इस सेवा की मूल कोटि (सहायक इलेक्ट्रोनिक अभियंता) में भर्त्ती के लिए योग्य अभ्यर्थियों का चयन कर सकेगा।16 (cid:18)बहार गजट, 4 माच) 2009 10101010.... पात्रतापात्रतापात्रतापात्रता----इस सेवा की मूल कोटि (बेसिक ग्रेड) में नियुक्ति के लिए अभ्यर्थियों की पात्रता अनुसूची-I के अनुसार होगी।

ेग द्वारा अभ्यर्थियों की अनुशंसा----आयोग निर्धारित लिखित प्रतियोगिता परीक्षा (बिहार अभियंत्रण सेवा) 11111111.... आयाआयाआयाआयोग द्वारा अभ्यर्थियों की अनुशंसा ेग द्वारा अभ्यर्थियों की अनुशंसा ेग द्वारा अभ्यर्थियों की अनुशंसा अथवा/और मौखिक परीक्षा में प्राप्त अंको के आधार पर एक मेधा सूची तैयार करेगा। ऐसी तैयार की गई सूची में से आयोग अभ्यर्थियों की उतनी संख्या की अनुशंसा राज्य सरकार को करेगा, जितनी संख्या में रिक्तियाँ अधियाचित की गई हाें। आयोग से प्राप्त अनुशंसा मात्र एक वर्ष के लिए मान्य होगी।

12121212.... चिकित्सा परीक्षाचिकित्सा परीक्षाचिकित्सा परीक्षाचिकित्सा परीक्षा----नियुक्ति के लिए चुने गये प्रत्येक अभ्यर्थी को राज्य सरकार द्वारा गठित चिकित्सा बोर्ड के समक्ष चिकित्सा-परीक्षा के लिए जाना होगा। पदीय कर्त्तव्यों को दक्षतापूर्वक निष्पादित करने की दृष्टि से जो अभ्यर्थी अपनी अपेक्षित शारीरिक योग्यता के संबंध में चिकित्सा बोर्ड को संतुष्ट करने में असफल होगा उसे नियुक्त नहीं किया जायेगा। चिकित्सा बोर्ड स्वयं इसके लिए वस्तुनिष्ठ मापदंड निर्धारित करेगा।

13131313.... वरीयतावरीयतावरीयतावरीयता----इस नियमावली के अधीन सीधी भर्त्ती द्वारा नियुक्त किये गये सदस्यों की आपसी वरीयता आयोग द्वारा अनुशंसित मेधा सूची के आधार पर निर्धारित की जायेगी।

14141414.... प्रशिक्षण्प्रशिक्षण्प्रशिक्षण्प्रशिक्षणााा----इस सेवा के सदस्य को प्रशिक्षण के लिए राज्य में या राज्य से बाहर, विदेश में राज्य सरकार द्वारा निर्धारित अवधि के लिए भेजा जा सकेगा। प्रशिक्षण की समाप्ति पर किए गए मूल्यांकन को विभागीय प्रोन्नति समिति द्वारा ध्यान में रखा जा सकेगा।

(क) किसी मौलिक रिक्ति के विरूद्ध नियुक्त पदाधिकारी का पदग्रहण की तिथि से दो वर्षो की अवधि तक की सेवा गणना परिवीक्षा के रूप में की जायेगी।

(ख) परिवीक्षा अवधि के दौरान या उसकी समाप्ति के समय इस सेवा में भर्ती किये गये पदाधिकारी की नियुक्ति समाप्त की जा सकती है, यदि उक्त पदाधिकारी की परिवीक्षा अवधि का कार्यकलाप संतोषजनक नहीं हो, अथवा अन्य कारण से इस सेवा में स्थाई नियुक्ति के लिए योग्य नहीं हो।

(क) परिवीक्षा पर नव नियुक्त पदाधिकारी को परिवीक्षा अवधि की संतोषजनक समाप्ति तथा सम्पुष्टि के लिए अन्यथा योग्य समझे जाने और बिहार अभियंत्रण सेवा (राजपत्रित पदाधिकारियों) के लिए निर्धारित विभागीय परीक्षा उतीर्ण होने पर सम्पुष्ट किया जा सकेगा।

(ख) नव नियुक्त पदाधिकारी विभागीय परीक्षा में उतीर्ण होने पर प्रथम वार्षिक वेतनवृद्धि के बाद अगली वेतनवृद्धि प्राप्त कर सकेंंगे।

बिहार सूचना इलेक्ट्रोनिक अभियन्ता सेवा के विभिन्न कोटि के पदों के वेतनमान अथवा तत्समान पुनरीक्षित वेतनमान राज्य सरकार द्वारा समय-समय पर घोषित किए जायेंगे।

18. बेसिक ग्रेड को छोड़कर अन्य सभी ग्रेड के लिए प्रोन्नति विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर विचारणीय होगा।

विभागीय प्रोन्नति समिति निम्ननुसार होगाः- (क) सदस्य, राजस्व पर्षद-

20202020.... अन्य सेवा शर्तअन्य सेवा शर्तअन्य सेवा शर्तअन्य सेवा शर्त----(क) इस सेवा के लिए अन्य सेवा-शर्त्तें यथा अनुशासनिक कार्रवाई, छूट्‌टी, देय सेवा निवृत्ति लाभ इत्यादि, जो इस नियमावली से आच्छादित नही हैं, या जो इस सेवा के लिए अलग से अधिसूचित नहीं है, बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली 2005, बिहार सेवा संहिता, राज्य सरकार द्वारा समय-समय पर निर्गत अन्य सुसंगत नियमावली, आदेश तथा परिपत्रों में नियंत्रित होगी।

21212121.... राज्य सरकार को इस नियमावली में विहित प्रावधानों को यथा अपेक्षित संशोधित करने का अधिकार होगा। प्रशासी विभाग इस नियमावली के प्रावधानों को कार्यरूप देने के लिए नियमावली के प्रावधान के अनुरूप प्रक्रिया विनियमावली द्वारा विहित कर सकेगी।

22222222.... निरसन एवं व्यावृत्ति-निरसन एवं व्यावृत्ति-निरसन एवं व्यावृत्ति-निरसन एवं व्यावृत्ति-

(1) इस नियमावली के प्रवृत होने की तिथि से बिहार सूचना इलेक्ट्रोनिक अभियंता सेवा संबंधी नियुक्ति, प्रोन्नति संबंधी परिपत्र/अनुदेश निरसित समझी जायेगी।

(2) ऐसे निरसन के होते हुए भी पूर्व की नियुक्ति/प्रोन्नति संबंधी परिपत्र/अनुदेश के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली द्वारा या इसके अधीन प्रदत्त शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गयी कोई कार्रवाई समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

(3) इस नियमावली के लागू होने की तिथि के पूर्व से बिहार सूचना इलेक्ट्रानिक अभियंता सेवा के विभिन्न पदों जैसा की नियम 17 में परिभाषित है, पर नियुक्त एवं कार्यरत व्यक्ति स्वतः इस सेवा में शामिल एवं इस नियमावली के अधीन नियुक्त समझे जायेंगे।

No. स्था0(मु0)-1-601/2006/पार्ट-2 स्था0(मु0)-1-601/2006/पार्ट-2-10—The Governor of Bihar hereby makes Rules to regulate स्था0(मु0)-1-601/2006/पार्ट-2 स्था0(मु0)-1-601/2006/पार्ट-2 the recruitment process and service conditions of Bihar Information Electronic Engineering Service using the powers conferred in proviso to the Article 309 of Indian Constitution.

CHAPTER – I

Preliminary

1. Short Title, Extent and Commencement:-

(i) These rules may be called Bihar Information Electronic Engineering Service Rules, 2009. (ii) It shall cover the whole of State of Bihar. (iii) It shall come into force with immediate effect.

2. Definitions.— In these rules unless repugnant to the context

(a) "Governor" means the Governor of Bihar ( b) "Government" means the Government of Bihar. (c) "Department" means/denotes Information and Public Relations Department (d) "Commission" means Bihar Public Service Commission. (e) "Member or members of service" mean the individuals appointed to the Bihar Information Electronic Engineering Service.

(f) "Schedule" means Bihar Information Electronic Engineering Service.

3. Constitution of Service.—The state service shall be constituted with the nomenclature "Bihar Information Electronic Engineering Service".

4. Structure of Service.—This service shall be under the administrative control of Information and Public Relations Department. The State Government shall fix its official strength from time to time and may sanction creation of permanent/temporary posts of this service in addition to the already sanctioned posts.

5. The status of post.—The members of this service shall be gazetted officers.

CHAPTER – 2

Recruitment

6. Source of Recruitment.—Except otherwise provided the recruitment to this service shall be done through direct recruitment under Chapter III of this Rule.

7. Fixation of Vacancies and notifying the Commission.—The Department shall calculate the number of vacancies according to the situation on 1st April of each year and send the requisition for direct recruitment on the basis of thus calculated vacancies to the commission by 30th April of each year.

8. Reservations.—Compliance to the reservation policy prescribed by the state government from time to time and roster shall be necessary in appointment and promotion.

CHAPTER – 3

Direct Recruitment

9. Direct Recruitment through Commission.—The Commission shall select the appropriate candidates for the basic grade (Assistant Electronic Engineer) of this service on the basis of publication of advertisement, acceptance of applications and competitive examination and/or interview.

10. Eligibility.—The eligibility for appointment to the basic grade of this service shall be according to schedule-1.

11. Recommendation of Candidates by Commission.—Commission will prepare a merit list of candidates on the basis of the prescribed written competition examination (Bihar Engineering service) and/or viva-voce and recommend such number of candidates to the State Government which is requisitioned according to the vacancies. Recommendations received from Commission shall be valid for only one year.

12. Medical Examination.—Each candidate chosen for appointment shall have to appear before the medical board constituted by the state government. The candidate who won't be able to satisfy the19 (cid:18)बहार गजट, 4 माच) 2009 board about the required physical capacity needed to fulfill the official duties will not be appointed. The medical board itself will fix objective criteria for this.

CHAPTER – 4

Seniority and Training

13. Seniority.—The mutual seniority of the members appointed through the direct recruitment by the commission will be fixed according to the recommended merit list of the commission.

14. Training.—The members of this service may be sent in the state, outside the state or to foreign countries for period fixed by the state government for training. The assessment done at the conclusion of the training may be kept in view by the Departmental Promotion Committee.

CHAPTER – 5

Probation and Confirmation

15. Probationary Period :-

(a) The service of two years from the date of assuming office will be treated as probationary period for any officer appointed against a original vacancy.

(b) The appointment of an officer recruited for this service may be terminated during the probationary period or at the time of its completion, if the conduct of the officer is not satisfactory during the probationary period or if otherwise found not qualified for permanent appointment to this service.

16. Confirmation :-

(a) The new officer appointed on probation may be confirmed after the satisfactory conclusion of probationary period and otherwise thought fit for confirmation and passing in the departmental examination prescribed for Bihar Engineering Service (gazetted officers).

(b) Newly appointed officer on passing the departmental examination would be entitled for first annual increment and would get subsequent increment henceforth.

CHAPTER – 6

Pay Scale and Increment

17. Pay-Scale :-

(a) Assistant Electronic Engineer, Pay Scale - Rs. 6500 – 10,500 /= (b) Electronic Engineer, Pay Scale – Rs. 10,000 – 15200 /= The state government will announce the pay scale of different grades of Bihar Information Electronic Engineer's service or similar revised pay scales from time to time.

CHAPTER – 7

Promotion

18. Promotion for other all grades except basic grade shall be considered on the recommendation of Departmental Promotion Committee.

CHAPTER – 8

General

19. Contract related to place of work.—The members of this service may be deputed for work to any department under the state government at any place inside or outside Bihar.

20. Other Service Conditions.—(a) The Other service conditions such as disciplinary action, leave, pension benefits etc, which are not covered by this or which are not notified exclusively for this service, will be controlled by the Bihar Government Servant (classification, control and appeal) Rules 2005, Bihar Service Code and other rules, orders and circulars issued from time to time by the State Government.

21. The state government will have the power to make amendments in the provisions mentioned in these rules as and when required. Controlling Department in order to implement the provisions of this rule will be able to make regulations for the rule as mentioned in the provisions of the rule.

22. Cancellation and Revocation :-

(a) From the date this Rule comes into effect, Bihar State Information Electronic Engineering Service related appointments, promotion related circular/instructions will stand cancelled.

(b) Inspite of such cancellation in case of any previous work done or action taken related to appointment / promotion using the powers given by such circulars /instructions, then it will be considered that the rule was already in place on the date on which such work was done or such action was taken.

(c) All those persons who have been appointed or are working at different levels in the Bihar Information Electronic Engineering Services even before this rule came into effect, as defined in rule 17 will automatically be included in this service and will be considered appointed under this rule.

23. The concurrence of Empowered Committee, Finance Department, Law Department and approval of Cabinet has been obtained in Bihar Information Electronic Engineering Service Rules 2009.

SCHEDULE – I Eligibility for recruitment to the basic grade of Bihar Information Electronic Engineering Service – Degree in Electronic Engineering or equivalent / Degree In Electronics and Telecommunication Engineering / Degree in Computer Engineering from any recognized university.

सं॰ के॰/कारा/रा॰प॰-68/04/787—कारा महानिरीक्षक, बिहार, पटना से प्राप्त पत्रांक-26/गो0 दिनांक-01.

12.04 में प्रतिवेदित आरोपों कीे जाँच हेतु विभागीय अधिसूचना संख्या-8981 दिनांक-28.10.05 द्वारा श्री प्रदीप कुमार झा, तत्कालीन अधीक्षक, आदर्ष केन्द्रीय कारा, बेऊर, पटना के विरूद्ध विभागीय कार्यवाही चलायी गयी।

2. संचालन पदाधिकारी ने अपने अधिगम मे श्री झा पर गठित आरोपों मे से एक आरोप को प्रषासनिक भूल के रूप मे प्रमाणित दर्षाते हुए अन्य आरोपों को अप्रमाणित बताया हैै। अनुषासनिक प्राधिकार द्वारा संचालन पदाधिकारी के अधिगम मे अप्रमाणित दर्षाये गए आरोपों पर असहमति का तथ्य दर्षाते हुए श्री झा से द्वितीय कारण पृच्छा प्राप्त की गई। प्राप्त द्वितीय कारण पृच्छा की गहन समीक्षा के उपरान्त इनपर बंदी सांसद केे मुलाकाती की व्यवस्था मे कारा हस्तक के नियमों का उल्लंघन करने, बंदी मुलाकाती पंजी एवं कारा आर्डर बुक के पर्यवेक्षण संबधी उत्तरदायित्व का निर्वहन सही रूप से नहीं करने, उच्चाधिकारियो के आदेष का उल्लंघन करने, कक्षपालो के स्थानान्तरण-पदस्थापन मे अनियमितता बरतने, कारा कर्मियो का वेतन लंबित रखने की स्वेच्छाचारिता करने, स्थानान्तरण के उपरान्त सरकारी आवास खाली किए बिना संबंधित काराकर्मी का अंतिम वेतन प्रमाण पत्र निर्गत करने एवं मृत उच्च कक्षपाल के बकाया भुगतान मे अनावष्यक विलम्ब करने संबंधी आरोप प्रमाणित पाया गया है।

3. अतएव प्रमाणित आरोपों के आलोक में राज्य सरकार द्वारा श्री झा पर निम्नलिखित दण्ड अधिरोपित किया जाता है :-

(i) इन्हे निन्दन की सजा दी जाती है। (ii) इनकी दो वेतन वृद्धि संचयात्मक प्रभाव से रोकी जाती हैं। 4. यह आदेष तात्कालिक प्रभाव से लागू होगा।

——— वाणिज्य-कर विभाग ——— अधिसूचनाएं 25 जुलाई 2008 सं॰ कौन/भी0 129/2007-272—श्री इन्द्र नारायण झा, वाणिज्य-कर पदाधिकारी को अन्वेषण ब्यूरो, तिरहुत प्रमंडल, मुजफ्फरपुर के पदस्थापनकाल में अनाधिकृत रूप से वाहन के चेकिंग करने एवं निर्धारित राजस्व लक्ष्य की प्राप्ति नहीं करने संबंधी कतिपय आरोपों के लिए विभागीय अधिसूचना22 (cid:18)बहार गजट, 4 माच) 2009 संख्या-479 दिनांक 28.12.07 द्वारा तत्कालिक प्रभाव से निलम्बित करते हुए विभागीय संकल्प सं0-103(अनु0) दिनांक 21.02.2008 द्वारा इनके विरूद्ध वाणिज्य-कर संयुक्त आयुक्त(प्र0), केन्द्रीय प्रमंडल, पटना के संचालन में विभागीय कार्यवाही चलायी गयी।

2. संचालन पदाधिकारी के पत्रांक-388 दिनांक 13.06.2008 द्वारा प्राप्त जॉच प्रतिवेदन/मंतव्य एवं उस पर आरोपित पदाधिकारी से प्राप्त प्रतिक्रिया की सम्यक समीक्षोपरान्त सरकार द्वारा निम्नांकित निर्णय लिये गये है।

(क) इन्हें तत्कालिक प्रभाव से निलम्बन से मुक्त किया जाता है। निलम्बन से मुक्त होने के पश्चात्‌ श्री झा अपने पूर्व पदस्थापन कार्यालय अन्वेषण ब्यूरो, तिरहुत प्रमंडल में योगदान देगे।

(ख) इन्हें ''निन्दन'' की सजा संसूचित की जाती है, जिसकी प्रविष्टि इनकी चरित्र पुस्ति के वर्ष 2007-08 में की जायेगी।

——— 11 अगस्त 2008 सं॰ कौन/भी0-903/2004-302/सी0—श्री नवीन कुमार को उनके कोषागार पदाधिकारी, भोजपुर के पदस्थापनकाल में आदेष की अवहेलना करने, अपने से वरीय पदाधिकारी पर निराधार दोषारोपण करने, विपत्रों पर अनावष्यक आपाियॉ लगाने और उन्हें विखंडित कर पारित करने, वरीय पदाधिकारियों के प्रति अषिष्टता प्रदर्षित करने तथा विना सक्षम प्राधिकार की स्वीकृति के मुख्यालय छोड़ने आदि आरोपों के लिए विभागीय अधिसूचना सं0-78 दि0 22.02.2007 द्वारा निलंबित कर विभागीय संकल्प संख्या-118/सी0 दि0 21.03.07 द्वारा विभागीय कार्यवाही संचालित कराई गई। जॉच संचालन पदाधिकारी के प्रतिवेदन तथा उसपर प्राप्त आरोपी पदाधिकारी की प्रतिक्रिया के सम्यक समीक्षोपरान्त सरकार द्वारा श्री कुमार को निम्नांकित दण्ड संसूचित करने का निर्णय लिया गया है। 1. श्री कुमार की 8 (आठ) वार्षिक वेतन वृद्धियाँ आदेष निर्गमन की तिथि से संचयात्मक प्रभाव से रोकी जाती हैं। इसके परिणामस्वरूप उनकी प्रोन्नति वर्ष 2016 तक बाधित रहेगी।

सं॰ कौन/भी0-903/2004-367—श्री नवीन कुमार, वाणिज्य-कर पदाधिकारी (बिहार विा सेवा) को उनके कोषागार पदाधिकारी, भोजपुर (आरा) के पदस्थापनकाल में बरती गई कतिपय अनियमितताओं के लिए विभागीय अधिसूचना सं0-78 दि0 22.02.2007 द्वारा निलंबित कर विभागीय संकल्प संख्या-118/सी0, दि0 21.03.07 द्वारा विभागीय कार्यवाही संचालित कराई गई। जॉच संचालन पदाधिकारी के प्रतिवेदन तथा उसपर प्राप्त आरोपी पदाधिकारी की प्रतिक्रिया के सम्यक समीक्षोपरान्त विभागीय संकल्प संख्या-302/सी0, दि0 11.08.08 द्वारा उनकी 8 (आठ) वार्षिक वेतन वृद्धियाँ आदेष निर्गमन की तिथि से संचयात्मक प्रभाव से रोके जाने एवं वर्ष 2016 तक प्रोन्नति वाधित रखने का आदेष दिया गया है। श्री कुमार के निलंबन मुक्ति एवं निलंबन मुक्ति के उपरान्त योगदान के बिंदु पर सरकार द्वारा निम्नलिखित निर्णय लिये गये है :-

1. श्री कुमार का निलंबन तत्काल प्रभाव से समाप्त किया जाता है। 2. श्री कुमार निलंबन से मुक्त होने के उपरान्त वाणिज्य-कर आयुक्त-सह-प्रधान सचिव, बिहार, पटना के कार्यालय में योगदान देंगे।

बिहार राज्यपाल के आदेश से, षुभकीर्ति मजुमदार, वाणिज्य-कर आयुक्त-सह-प्रधान सचिव।23 (cid:18)बहार गजट, 4 माच) 2009 11 सितम्बर 2008 सं॰ कौन/भी0 908/2005-380—श्री राजेषपति त्रिपाठी, वाणिज्य-कर पदाधिकारी (बिहार विा सेवा) को उनके कोषागार पदाधिकारी, सिवान एवं कोषागार पदाधिकारी, मधुबनी के पदस्थापनकाल से संंबंधित कतिपय आरोपों के लिए विभागीय अधिसूचना संख्या-604 दिनांक 31.07.2006 द्वारा तात्कालिक प्रभाव से निलम्बित करते हुए विभागीय संकल्प सं0-612 दिनांक 03.08.2006 द्वारा विभागीय कार्यवाही संचालित करायी गयी।

2. संचालन पदाधिकारी के पत्रांक-1094 दिनांक 13.11.2006 द्वारा प्राप्त जॉच प्रतिवेदन तथा उस पर आरोपित पदाधिकारी से प्राप्त प्रतिक्रिया की सम्यक समीक्षोपरान्त इन्हें तात्कालिक प्रभाव से निलम्बन से मुक्त करते हुए सरकार द्वारा निम्नांकित दंड दिये जाने का निर्णय लिया गया है :-

(i) इन्हें निन्दन की सजा के साथ-साथ इनकी दो वार्षिक वेतन वृद्धियॉ आदेष निर्गमन की तिथि से संचयात्मक प्रभाव से रोकी जाती है।

(ii) निलम्बन अवधि में इन्हें जीवन निर्वाह भाा के अतिरिक्त कुछ भी देय नहीं होगा। बिहार राज्यपाल के आदेश से, षुभकीर्ति मजुमदार, वाणिज्य-कर आयुक्त-सह-प्रधान सचिव।

———ं 19 फरवरी 2009 सं॰ कौन/भी0-101/99-16—श्री वकील प्रसाद यादव, बिहार वित्त सेवा के वाणिज्य-कर स्तर के पदाधिकारी को उनके सीतामढ़ी अंचल के पदस्थापन के दौरान अन्वेषण ब्यूरो, निगरानी विभाग, बिहार के धावा दल द्वारा दिनांक 06.02.2009 को एक व्यवसायी से रिष्वत के रूप में मोटर पम्प एवं अन्य फिटिंग सामग्री प्राप्त करने के आरोप में गिरफ्तार कर न्यायिक हिरासत में भेजा गया। इस सिलसिले में श्री यादव के विरूद्ध विषेष न्यायाधीष, निगरानी, मुजफ्फरपुर के न्यायालय में भ्रष्टाचार निवारण अधिनियम 1988 की धारा 7/13(2) सह पठित धारा 13(1)(डी) के अंतर्गत प्राथमिकी सं0 011/2009 दिनांक 07.02. 09 भी दर्ज करायी गयी है। श्री यादव के विरूद्ध इस आपराधिक कृत्य/कदाचार के लिए अनुसंधान तथा मुकदमा एवं अनुषासनात्मक कार्रवाई जारी/विचारित है एवं सक्षम प्राधिकार का समाधान हो गया है कि लोकहित में श्री यादव को निलंबित किया जाना अपेक्षित है। अतएव श्री वकील प्रसाद यादव को बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 9(1) के तहत दिनांक 06.02.09 के प्रभाव से अगले आदेष तक के लिए निलंबित किया जाता है।

2. निलंबन अवधि में श्री यादव को बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 10(1) के अन्तर्गत अनुमान्य जीवन निर्वाह भाा देय होगा।

3. निलंबन अवधि में इन्हें जीवन निर्वाह भो का भुगतान उसी स्थापना द्वारा किया जाएगा जहॉ वे हिरासत में लिए जाने के समय पदस्थापित थे।
