सं0-बी1-3-101/2009-16-लोक सभा आम निर्वाचन, 2009 के झारखण्ड राज्य से संबंधित भारत निर्वाचन आयोग की अधिसूचना संख्या-464/2009 दिनांक 13.04.2009 सर्वसाधारण की जानकारी के लिए पुनः प्रकाषित की जाती है।

अपर मुख्य निर्वाचन पदाधिकारी।2 (cid:18)बहार गजट, (असाधारण)] 13 अूील 2009 भारत निर्वाचन आयोग ------ अधिसूचना निर्वाचन सदन, अषोक रोड, नई दिल्ली-110001/दिनांकः 13 अप्रैल ,2009/23 चैत्र, 1931 (षक) सं॰ 464/2009ः- यतः भारत निर्वाचन आयोग ने लोक प्रतिनिधित्व, 1951 (1951 का 43) की धारा-56 के साथ पठित धारा-30 के अधीन जारी 23 मार्च, 2009 की अपनी अधिसूचना सं॰ 464/2009/(1) द्वारा 4-चतरा, 5-कोडरमा, 11-खूंटी (अ.ज.जा.), 12-लोहरदगा (अ.ज.जा.), 13-पलामू (अ.जा.) और 14-हजारीबाग संसदीय निर्वाचन क्षेत्रों के लिए पहले चरण में 16 अप्रैल, 2009 को होने वाले मतदान के लिये 'मतदान का समय' 7 बजे पूर्वाह्‌न से 4 बजे अपराह्‌न तक किया था ; और यतः, भारत निर्वाचन आयोग ने लोक प्रतिनिधित्व, 1951 (1951 का 43) की धारा-56 के साथ पठित धारा-30 के अधीन जारी 28 मार्च, 2009 की अपनी अधिसूचना सं॰ 464/2009 (2ख) द्वारा झाारखंड राज्य में 6-गिरिडीह, 7-धनबाद, 8-रॉंची, 9-जमषेदपुर और 10-सिंहभूम (अ.ज.जा.) संसदीय निर्वाचन क्षेत्रों के लिए दूसरे चरण में 23 अपै्रल, 2009 को होने वाले मतदान में 'मतदान का समय' 7 बजे पूर्वाह्‌न से 4 बजे अपराह्‌न तक नियत किया था ; और यतः, मुख्य निर्वाचन अधिकारी, झारखंड की रिर्पोटाें पर विचार करने के बाद और अन्य सभी महत्वपूर्ण परिस्थितियों को ध्यान में रखते हुए, निर्वाचन आयोग का समाधान हो गया है कि उग्रवादी गतिविधियों और केन्द्रीय अर्ध सैनिक बल की सीमित उपलब्धता के कारण झारखंड राज्य में 4-चतरा, 5-कोडरमा, 11-खूंटी (अ.ज.जा.), 12-लोहरदगा (अ.ज.जा.),13-पलामू (अ.जा.) और 14-हजारीबाग संसदीय निर्वाचन क्षेत्रों में प्रथम चरण में 16 अप्रैल, 2009 को होने वाले मतदान और 6-गिरिडीह, 7-धनबाद, 8-रॉंची, 9-जमषेदपुर और 10-सिंहभूम (अ.ज.जा.) संसदीय निर्वाचन क्षेत्रों में दूसरे चरण में 23 अपै्रल, 2009 को होने वाला मतदान 7 बजे पूर्वाह्‌न से 3 बजे अपराह्‌न तक करवाया जाना उपर्युक्त होगा ।

अतः, अब, साधारण खण्ड अनिधिनियम, 1897 (1897 का 10) की धारा-21 के साथ पठित लोक प्रतिनिधित्व अधिनियम, 1951 की धारा-56 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत निर्वाचन आयोग ने एतद्‌द्वारा पूर्व की अपनी अधिसूचना सं॰ 464/2009 (1) दिनांक 23 मार्च, 2009 और अधिसूचना सं॰ 464/2009 (2ख) दिनांक 28 मार्च, 2009 में आंषिक संषोधन करते हुए निर्णय लिया है कि झारखंड राज्य के लिए 4-चतरा, 5-कोडरमा, 11-खूंटी (अ.ज.जा.), 12-लोहरदगा (अ.ज.जा.), 13-पलामू (अ.जा.) और 14- हजारीबाग संसदीय निर्वाचन क्षेत्रों के लिए पहले चरण में दिनांक 16 अप्रैल, 2009 और 6-गिरिडीह, 7-धनबाद, 8-रॉंची, 9-जमषेदपुर और 10-सिंहभूम (अ.ज.जा.) संसदीय निर्वाचन क्षेत्रों के लिए दूसरे चरण में दिनांक 23 अपै्रल, 2009 को होने वाले मतदान के लिए उस अधिसूचना में निहित स्तम्भ (3) में विनिर्दिश्ट मतदान की अवधि के लिए प्रविश्टियां निम्न प्रकार से प्रतिस्थापित की जाएंगी, अर्थातः-

No. 464/2009—WHEREAS, the Election Commission of India by its notification No. 464/2009 (1), dated 23rd March, 2009 issued under Section 30 read with Section 56 of Representation of the People Act, 1951 (43 of 1951) had fixed "Hours of Poll" from 7:00 AM to 4:00 PM in respect of 4-Chatra, 5-Kodarma, 11-Khunti (ST),12-Lohardaga (ST),13-Palamu (SC) and 14. Hazaribagh Parliamentary Constituencies for the 1st phase of poll on 16th April 2009.

WHEREAS, the Election Commission of India by its notification No. 464/2009(2B) dated 28th March,2009 issued under Section 30 read with Section 56 of Representation of the People Act, 1951 (43 of 1951) had fixed "Hours of Poll" from 7:00 AM to 4:00 PM in respect of 6-Giridih, 7-Dhanbad, 8- Ranchi, 9-Jamshedpur and 10-Singhbhum (ST) Parliamentary Constituencies for the 2nd phase of poll on 23rd April,2009 in the State of Jharkhand.

WHEREAS, after considering the reports of Chief Electoral Officer, Jharkhand and after taking into account all other material circumstances, the Election Commission is satisfied that it is desirable to conduct the poll from 7:00 AM to 3:00 PM in respect 4-Chatra, 5-Kodarma, 11-Khunti (ST), 12-Lohardaga(ST), 13-Palamu (SC) and 14. Hazaribagh Parliamentary Constituencies for the 1st phase of poll on 16th April, 2009 and in respect of 6-Giridih, 7-Dhanbad, 8-Ranchi, 9-Jamshedpur and 10-Singhbhum (ST) Parliamentary Constituencies for the 2nd phase of poll on 23rd April, 2009 in the State of Jharkhand due to limited availability of forces and extremist activity.

NOW, THEREFORE, in exercise of the powers conferred by Section 56 of the Representation of the People Act, 1951 read with Section 21 of the General Clauses Act, 1897 (10 of 1897), the Election Commission of India in partial modification to it's earlier notification Nos. 464/2009(1) dated 23rd March,2009 and 464/2009(2B) dated 28th March,2009 has decided that the hours as specified in column 3 of the schedule contained in the notification during which poll will be taken in respect of 4-Chatra, 5- Kodarma, 11-Khunti (ST),12-Lohardaga (ST),13-Palamu (SC) and 14-Hazaribagh Parliamentary Constituencies for the 1st phase of poll on 16th April 2009 and in respect of 6-Giridih, 7-Dhanbad, 8-Ranchi, 9-Jamshedpur and 10-Singhbhum (ST) Parliamentary Constituencies for the 2nd phase of poll on 23rd April,2009 in the State of Jharkhand shall be substituted as under:-
