अधिसूचना
निर्वाचन सदन, अषोक रोड, नई दिल्ली-110001 दिनांक 04 मई 2009/14 वैषाख, 1931 (षक)
सं॰ 100/बिहार बि॰स॰/1/2009ः-यतः बिहार राज्य की विधान-सभा में 186-फतुहा (अ.जा.) विधान-सभा निर्वाचन क्षेत्र से निर्वाचित श्री सरयुग पासवान की मृत्यु हो जाने के परिणामस्वरूप दिनांक 30 दिसम्बर 2008 से स्थान रिक्त हो गया है; और
2. यतः इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप-निर्वाचन कराया जाना है;
3. अतः, अब, लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 150 की उपधारा (1) और धाराओं 30 और 56 के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा :-
(अ) बिहार राज्य से उक्त 186-फतुहा (अ.जा.) विधान सभा निर्वाचन क्षेत्र से यह अपेक्षा करता है कि उक्त अधिनियम के और तद्धीन बनाये गये नियमों और किये गये आदेषों के उपबन्धों के अनुसार 5 जून, 2009 (षुक्रवार) से पूर्व राज्य की किसी भी अनुसूचित जाति से संबंध रखने वाले एक व्यक्ति को, राज्य की विधान सभा में हुई उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित करें ;
(आ) उक्त निर्वाचन के संबंध मेंः-
(क) नामनिर्देषन करने की अन्तिम तारीख :
11 मई, 2009 (सोमवार)
(ख) नामनिर्देषन की संवीक्षा की तारीख :
12 मई, 2009 (मंगलवार)
(ग) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख : 14 मई, 2009 (बृहस्पतिवार)
(घ) वह तारीख जिसको, यदि आवष्यक हुआ तो मतदान होगा; 28 मई, 2009 (बृहस्पतिवार)
(ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न करा लिया जाएगा ; 05 जून, 2009 (षुक्रवार)
नियत करता है ; और
(इ) 7ः00 बजे पूर्वाह्न से 5ः00 बजे अपराह्न तक का समय ऐसे समय के रूप में नियत करता है जिसके दौरान, यदि आवष्यक हुआ तो, निर्वाचन के लिए उक्त विनिर्दिश्ट तारीख को मतदान होगा।

NOTIFICATION
Nirvachan Sadan, Ashoka Road, New Delhi-110001/Dated: 4th May 2009/14 Vaisakha,
1931 (Saka) No. 100/BR-LA/1/2009:- WHEREAS, the seat of Sh. Saryug Paswan in the Legislative Assembly of the State of Bihar, elected from 186-Fatuha (S.C.) Assembly Constituency in the State, has become vacant on 30th December 2008 by reason of his death : and
2. WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;
3. NOW, THEREFORE, in pursuance of sub-section (2) of section 150 and sections 30 and 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby –
(A) Calls upon the said 186-Fatuha (S.C.) Assembly Constituency in the State of Bihar, to elect, before the 5th June, 2009 (Friday) and in accordance with the provisions and of the said Act and of the rules and orders made thereunder, a person belonging to any of the scheduled caste of the state for the purpose of filling the said vacancy in the Legislative Assembly of the State ;
(B) Appoints, with respect to the said election :-
(a) the 11th May, 2009 (Monday), as the last date for making nominations; (b) the 12th May, 2009 (Tuesday), as the date for the scrutiny of nominations; (c) the 14th May, 2009 (Thursday), as the last date for the withdrawal of
candidatures;
(d) the 28th May, 2009 (Thursday), as the date on which a poll shall, if necessary, be taken; and
(e) the 5th June, 2009 (Friday), as the date before which the election shall be completed; and
(C) Fixes the hours from 7.00 A.M. to 5.00 P.M. as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.
