बिहार-राज्यपाल के आदेश से, प्रभात कुमार गुप्ता, अपर मुख्य निर्वाचन पदाधिकारी।2 (cid:18)बहार गजट, (असाधारण)] 13 मई 2009 भारत निर्वाचन आयोग निर्वाचन सदन, अषोक रोड, नई दिल्ली-110001./तारीखः 27 मार्च, 2009. निदेष संख्या 576/3/ई.वी.एम./2009/एस.डी.आर.—यतः लोक प्रतिनिधित्व अधिनियम 1951 की धारा 61 क में यह उपबंधित है कि मतदान मषीनों द्वारा मत ऐसी रीति से दिए और रिकार्ड किए जाएंगें जैसा कि भारत निर्वाचन आयोग ऐसे निर्वाचन क्षेत्र के लिए प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए निर्दिश्ट करे ; तथा 2. यतः आयोग ने लोक सभा, 2009 के चालू साधारण निर्वाचन में 543 संसदीय निर्वाचन क्षेत्रों में से प्रत्येक की परिस्थितियों पर विचार किया है और संतुश्ट है कि इन 543 संसदीय निर्वाचन क्षेत्रों में मतदान के लिए इलैक्ट्रॅानिक वोटिगं मषीने प्र्याप्त संख्या में उपलब्ध है और मतदान कार्मिक इलैकट्रॉनिक मतदान मषीनों को दक्षता पूर्वक संचालन में भली प्रकार प्रषिक्षित हैं और मतदाता भी इलैकट्रॉनिक मतदान मषीनों की कार्यप्रणाली से पूर्णरुप से परिचित है। 3. अतः, अब, भारत निर्वाचन आयोग एतद्द्वारा लोक सभा, 2009 के चालू साधारण निर्वाचनों में 543 संसदीय निर्वाचन क्षेत्रों में से प्रत्येक को ऐसे निर्वाचना क्षेत्र के रुप में विनिर्दिश्ट करता है, जहां 23 मार्च, 2009, 28 मार्च, 2009, 2 अप्रैल, 2009, 11 अप्रैल, 2009 और 17 अप्रैल, 2009 को अधिसूचित/अधिसूचित किए जाने वाले लोक सभा के चालू साधारण निर्वाचनों में, निर्वाचनों का संचालन नियम 1961 के अधीन निर्धानित रीति से इलैकट्रॉनिक मतदान मषीनों के माध्यम से मत डाले और रिकार्ड किए जाएंगे। जैसा कि इस विशय पर आयोग द्वारा समय-समय पर अनुपूरक आदेष जारी किए जाते हैं।

No. 576/3/EVM/2009/SDR: —WHEREAS, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may be adopted in such constituency or constituencies as the Election Commission may, having regard to the circumstances of each case specify; and
2. WHEREAS, the Commission has considered the circumstances in each of the 543 Parliamentary Constituencies at the current General Election to the House of the People, 2009, and is satisfied that sufficient number of Electronic Voting Machines are available for taking the poll in these 543 Parliamentary Constituencies, the polling personnel are well trained in efficient handling of the Electronic Voting Machines and the electors are also fully conversant with the operation of the Electronic Voting Machines;
3. NOW, THEREFORE, the Election Commission of India hereby specifies each of the 543 Parliamentary Constituencies at the current General Election to the House of the People, 2009, as the constituencies in which the votes at the current general election to the House of the People notified/to be notified on 23rd March 2009, 28th March 2009, 2nd April, 2009, 11th April, 2009 and 17th April, 2009, shall be given and recorded by means of Electronic Voting Machines, in the manner prescribed under the Conduct of Election Rules, 1961, and the supplementary instructions issued by the Commission from time to time on the subject.
